00:00Her dog bit you.
00:01He did clamp down on the left buttock.
00:04Was your dog up to date with shots?
00:06No. I got laid off from my job.
00:09Oh, it's not my fault. I lost a job. It's not my fault.
00:12The dog ate my homework.
00:15Do you understand how stupid that sounds?
00:17This is Judy Justice.
00:37Joseph Otanez is suing his neighbor, Samantha Lira, for damages resulting from a dog bite.
00:45Court, come to order. All rise.
00:48Have a seat, everyone.
00:50Judge, case 4057, Antonez v. Lira.
00:54You're welcome.
00:55Mr. Antonez, how old are you, sir?
00:5739.
00:58What do you do for a living?
00:59I'm a cinematographer and editor.
01:00Are you independently hired or do you work for a company?
01:04I'm freelance.
01:04You've been doing that for a long time?
01:06I chose a good time to go in. I went in January of 2020.
01:10Is this your wife?
01:11Yes.
01:12What's her name?
01:13Sarah.
01:13Do you own or you rent a house?
01:15We own.
01:16How long have you owned a house?
01:1712 years.
01:18How long have you been married?
01:20Four years.
01:22But together for 12?
01:24No.
01:25Eight.
01:25Eight years total.
01:27You have kids together?
01:28Three dogs.
01:29What kind?
01:29Two scruffy mixes and a German Shepherd, all rescues.
01:33Ever been incarcerated, sir?
01:35No.
01:35Ever been arrested?
01:36No.
01:37I ask you those questions because of some issues that the defendant raises in response to your case.
01:42Okay.
01:43Because this case is a dog bite case.
01:45It is your claim that you were walking in the street and her dog bit you.
01:49Bit you in the derriere.
01:51Bit you in the behind.
01:52And you want to be compensated for your medical bills and a little for pain and suffering.
01:57That's correct.
01:57For her negligence.
01:58She says you were drunk and stumbled onto her property and it was your fault.
02:03And aside from that, she doesn't think anything happened.
02:06You probably fell because you were drunk.
02:08You have a driver's license.
02:09I do.
02:09I assume.
02:09Ever get arrested for DUI?
02:11No, I also don't drink.
02:12I never have.
02:13I'm just asking you some straightforward, objective questions so that I'm perfectly comfortable with what I see.
02:22And I am.
02:23Okay.
02:24So on what date did this happen?
02:26March 21st at about 4.30 p.m.
02:29Light out.
02:30And what were you doing?
02:31I was on a daily walk through my neighborhood.
02:33It's something I do every day, pretty much.
02:35And how long have you been in your house?
02:3732 years.
02:38And how old is the dog that you have?
02:40He's a five-year-old Dalmatian.
02:41How long have you had him?
02:43Five years.
02:43Have you ever walked past her house before?
02:45Yes.
02:46Often?
02:46Every day.
02:48Okay.
02:48And have you seen this dog before?
02:49I can't say that I have, but I may have.
02:52Okay.
02:53So tell me what happened.
02:54So March 21st, my daily walk, I was on the sidewalk.
02:59And as I crossed the front of her house, I saw her dog, Dexter.
03:02He saw me.
03:03He started barking.
03:04How did you know the dog's name?
03:06I only know that now after the animal control report.
03:08Your dog's name is Dexter.
03:10Dexter Lyra.
03:11Okay.
03:11Go ahead.
03:12So the dog saw me.
03:13He started barking and then he lunged.
03:15But I saw he was on a leash, so I thought, that's okay.
03:17It's a dog's job.
03:18So I kept walking.
03:20And then before I knew it, he was on the sidewalk behind me.
03:22And then he lunged and I kind of tried to move out of the way.
03:26But then he did clamp down on the left buttock.
03:29When he released me, I got far enough away around her driveway where the dog couldn't get to me anymore.
03:35He was still pulling at the leash.
03:37At that point, I took out my phone because I was going to take a picture, mark where I was,
03:41take a note, something.
03:42And then that's when Miss Lyra came out of her house and I said, your dog just bit me.
03:46And she said, my dog doesn't bite.
03:47And I said, well, he did.
03:49He just bit me.
03:49And then I reached behind me and I felt a hole in my pants.
03:52And I said, there's a hole in my pants.
03:53And she said, let me see.
03:54So I turned around and showed her.
03:56And then I asked her name and her address.
03:58I neglected to get her phone number because I was, frankly, out of sorts.
04:03And I left.
04:04Once I got far enough away, I reached into my pants just to see how bad it was.
04:08And my hand came back with blood.
04:10So then at that point, I went straight home.
04:12I showed my wife the wound.
04:13I asked her how bad it was.
04:14She took a picture.
04:15I do have those pictures here, too.
04:17I'd like to see that photograph.
04:18I would, too.
04:19I don't care what you would like.
04:22This isn't a dance party.
04:23I've never seen a picture.
04:25Of course, if something's in evidence, we'll show it to you.
04:29The first two pictures are the damage to the clothing.
04:32And then the last picture is the scar that I still have.
04:36I don't understand, but this is a picture.
04:37So on the left, that's my underwear with blood.
04:41Oh, your underwear has?
04:42Yeah.
04:42The skeletons on it.
04:43I couldn't figure out what it was.
04:45Okay.
04:46I'm going to show this to you now, Miss Lyra.
05:03Okay.
05:03And I understand from your papers that you sought some medical attention.
05:07May I see your practice for that, please?
05:09This is the hospital visit, and it does state reason for visit is dog bite.
05:17So you were given an antibiotic?
05:20Yes.
05:20Okay.
05:21Was your dog up to date with shots?
05:23No.
05:24Why not?
05:24I got laid off from my job in June.
05:27What does that have to do with your dog?
05:28He got it done in March for the rabies, but all the other vaccinations are up to date.
05:32So he wasn't vaccinated at the time of this incident?
05:36I wouldn't say that.
05:37When I got the dog, he got all his shots.
05:39He got his rabies.
05:40The rabies is good for three years.
05:42So in June, I got laid off from my job.
05:44I was out of work for eight or nine months.
05:47In November or December, he was due for his rabies.
05:50So like two months, three months, he didn't have the shot, which is true.
05:53And I didn't have a job, so I wasn't able to go into my house.
05:56You had a job and not.
05:57You ate.
05:57You bought makeup at Sephora or Ulta.
06:00You drove a car.
06:02At that time, I did it.
06:03Just a second.
06:03You drove a car.
06:04You paid your rent.
06:06I don't pay rent.
06:07You own a house?
06:08No, I don't pay anything.
06:09So who do you live with?
06:10I live with my dad.
06:11You live with your father?
06:13Mm-hmm.
06:13Okay.
06:14Well, then you ask your father to take money out and take your dog to the vet
06:18and make sure that if your dog is up to date, on its shot.
06:22As soon as I started working again, I took him to get it.
06:25That's a shoulda, woulda, coulda, madam.
06:26I know, but...
06:27That means that you're placing somebody else at risk.
06:30If your dog bit somebody else and that somebody else says,
06:35well, am I going to take a chance because she lost her job?
06:39Let me figure this out, genius.
06:41She lost her job so she couldn't get her dog rabies shots.
06:46And now her dog, Nipmi, broke the skin.
06:50And because she didn't have a job and prioritized her other funds,
06:56I have to be on antibiotics for a week so that I don't worry that I'm going to get rabies.
07:03Do you understand how stupid that sounds?
07:07You're 32.
07:08What generation does that make her?
07:09Me?
07:10Millennial?
07:11Millennial.
07:11A millennial?
07:12Millennial.
07:12A millennial.
07:14As soon as I got my job.
07:16Millennials, they're not the greatest generation.
07:18Is that right?
07:19No, I don't think so.
07:20And later today...
07:21In May of 2023, he was arrested and...
07:26I don't think that's relevant to the case, Your Honor.
07:28Shh, shh.
07:28Well, it is.
07:29It's her defense, actually.
07:40Joseph Otanez claims his neighbor, Samantha Lira, is responsible for his injuries after her Dalmatian bit him.
07:49You understand, to a normal citizen, just a normal citizen, not, oh, it's not my fault, I lost a job,
07:59it's not my fault, the dog ate my homework, you're in my personal space, get out of my personal space.
08:05I lost my job, I couldn't take care of my dog.
08:08Oh, that's too bad that you had to be inconvenienced by taking antibiotics for a week.
08:14Do you understand how ridiculous that sounds to me?
08:16In that order, but I was laid off in June, he was due November, I took him in March, as
08:22soon as I started working again.
08:24But my dog had never bit anyone before.
08:26He's the lovely first person.
08:27Do you understand what I'm saying to you?
08:30Do you understand that?
08:31Yeah, but...
08:32How old are you?
08:33I want to know.
08:33I'm 32.
08:34You're 32.
08:34What generation does that make her?
08:37Millennial, millennial.
08:38A millennial?
08:39Millennial.
08:39A millennial.
08:41As soon as I got my job.
08:42Millennials, they're not the greatest generation, is that right?
08:46No, I don't think so.
08:47I don't think anyone can classify that.
08:48Sort of passed them by.
08:49Okay, all right, I got it.
08:52Is that your video or your video?
08:54That's me in my home.
08:56Oh, well, then it's your video.
08:58So that's my wonderful Dexter.
09:04And that's the sidewalk.
09:10What are you showing me?
09:11That's a nice dog.
09:12But that's the tether in my yard that I've been using for five years.
09:15I don't care whether it's a tether in your yard.
09:17He told me what happened.
09:18Did you see what happened with your dog?
09:20Yeah, I mean...
09:23Did you see what happened in the interaction between the plaintiff and your dog?
09:31Really?
09:32So you just said to me, you observed the interaction that he just described with your dog.
09:41Yes.
09:41So you were outside?
09:43I was there.
09:44I didn't say I was on the lawn, but I was there when it happened.
09:47That's not what you said in your answer.
09:50That's exactly...
09:51That's no.
09:51It's not what you said in your answer.
09:53Well, can I explain my side?
09:54You can.
09:55Please.
09:56You can.
09:57Go ahead.
09:58Okay.
09:58I'm reading your answer.
09:59Go ahead.
09:59So it was a wonderful March.
10:01I had just got a job, actually.
10:03And I got home from work.
10:05My baby boy came downstairs.
10:07I opened my front door.
10:08I tethered him in.
10:09I've been using this tether for five years.
10:11Tethered him in where?
10:12So my front yard, I have grass.
10:14I saw the front yard.
10:16Yeah, my back...
10:16So where is the tether?
10:18It's on my porch.
10:19The tether is on your porch, and you actually saw the dog tethered.
10:22I did.
10:23To something.
10:24Mm-hmm.
10:24Go ahead.
10:25Okay.
10:26I have concrete in my backyard, so I've been using my front yard.
10:28No, no, no.
10:29Look, I just want you to tell me what you did.
10:32You came home from work.
10:33You opened the door.
10:35Okay.
10:35You tethered the door to something that you have holding, a leash or a tether, holding
10:41onto the dog, and then what happened?
10:43My front door is open.
10:44I have my front door here, and my window is here.
10:47I'm sitting there taking off my shoes.
10:49I hear him barking.
10:51I look up.
10:52I see him stumbling on my yard.
10:54My dog can't reach the sidewalk.
10:55I didn't hear what you said.
10:57I see him stumbling in my yard on my dog walk.
10:59He was, like, stumbling around the sidewalk, so he's on my grass.
11:03My dog barked at him.
11:04He kind of fell, and then I asked him.
11:07I said, are you okay?
11:08He says, I don't know.
11:09I need to go home and check.
11:11And I was like, okay.
11:13And then he left.
11:14Do you have any other bills to show me?
11:16I do.
11:17Here are the two bills from medical insurance.
11:25Did you pay this $1,418?
11:29Yes, I did.
11:30And I have receipt of that as well.
11:31Can I see that, please?
11:34There are two there, one for $14 and change, one for $15.
11:38Well, that's because it seems you went for this visit, and then you had to go to an emergency room?
11:45I did have to go to the emergency room.
11:47Originally, I went to urgent care, but they turned me away because they don't deal with rabies.
11:51So I had to go to the emergency room.
11:53Did you present these bills to the defendant?
11:57I did.
11:57Did I have a record of our text messages?
11:59May I see them, please?
12:00Yes.
12:08Oh, well, on July 12th, he says if, because he keeps asking you to reimburse him for the expenses,
12:16and you don't answer him for a while.
12:19And finally, he says to you, if you tell me your insurance provider and policy,
12:24they can reimburse me, and it won't have to be out of your pocket.
12:29It's like going after someone's car insurance after the accident.
12:32They take care of it.
12:33And you respond to him.
12:35Remember this?
12:36Absolutely.
12:36Oh, I see.
12:37My dad is the homeowner, so I'd rather take the responsibility and leave him out of it.
12:43I'd be happy to reimburse you.
12:45Well, so what happened?
12:47If you look at the text, he sent me a screenshot this big that says,
12:50medical claim, $1400.
12:51There's no detail.
12:52I asked him, can you send me an itemized bill?
12:54Just a second.
12:55Just a second.
12:56I'm glad you feel that way.
12:58If you can send me Zelle payment for $2,000, we'll call it done,
13:02which covers most of the bills and maybe some of your aggravation.
13:06And you say, can you please send me an itemized bill and your email address?
13:10I also need an address for the release, because you want to be released from liability.
13:16And then he responds to you.
13:17Hands off your hips.
13:19Okay, he says, here's the thing, and I haven't read this, so I'm reading it at the same time
13:24as I'm reading it out loud.
13:25I already sent you a copy of my original bill on April 2nd.
13:29We're now talking about July, which you chose to ignore for three months until I got a lawyer.
13:35This is not a business expense reimbursement.
13:38It's an out-of-court settlement.
13:40$2,000 is for medical bills.
13:43The clothes that were damaged and the stress I suffered, the whole situation caused me.
13:48It's beyond fair.
13:50You can send the release via text, but I expect it to be paid before signing.
13:55Did you discuss this matter with your father?
13:57That's a yes or a no.
14:00Yes.
14:00That's a yes?
14:01What does that mean?
14:02Does that mean, yes, I did?
14:03Well, he came to my home the next day and harassed me.
14:05No, I'm asking you whether you discussed it with your father.
14:07That's either a yes or a no.
14:09Well, did your father have homeowner's insurance?
14:11Yes.
14:12Did you tell him, could we put this through homeowner's insurance?
14:15No, because I have $1,400 and I can pay him the money.
14:18So why didn't you pay him?
14:19Because he sent me a, if you look at the text message, that's the only bill I've ever received.
14:23It's this, it's a screenshot this big.
14:25There's no detail.
14:27There's nothing on there.
14:28I asked him, can you show me an itemized bill and a receipt that you paid it?
14:31I'm not just going to zell someone $2,000 without seeing, like, I never saw a picture of the bike.
14:36Just one second.
14:37Just one second.
14:38Hold on a second.
14:39Between April, when he sent this to you, April 2nd, and you have papers in front of you, between April
14:462nd and July, can you show me where you said to him, that's not a good enough itemized statement for
14:55me?
14:58What's the address on your driver's license?
15:01His address, where he lives now.
15:04Where do you get your mail?
15:05Look at me.
15:06Where do you get your mail?
15:09At his house.
15:10You know where I'm going with this, right?
15:12Yes, ma'am.
15:22Joseph Ohtonez claims his neighbor, Samantha Lira, is responsible for his injuries after her Dalmatian bit him.
15:31Okay.
15:32Show me where you said to him, that's not a good enough itemized statement for me.
15:38Something that suggests that you didn't just ignore him April, May, and June, three months.
15:45Just listen, don't speak.
15:49Unless you're going to tell me I didn't answer him for three months.
15:52I did ignore him.
15:53Gotcha.
15:55Okay, I actually believe that he's entitled to something for being bitten by your dog.
16:00Judgment for the plaintiff in the amount of $5,000.
16:03I hope you have a good job.
16:05We're done.
16:05This court is adjourned.
16:11I'm honestly just so happy that this is over with, because this man has been stressing me out for months.
16:17I'm ecstatic.
16:17I'm so glad that this is finally behind me after a better part of a year, something like nine months.
16:22The fact that this is done, he'll get his little check, and then I can move on and be happy.
16:27I'm more shocked that she said I was drunk, because I don't drink.
16:31I never have.
16:34You know, I'm not sure how I feel about those dog tethers, especially in a front yard where you have
16:39sidewalks that your neighbors or anyone walking through the neighborhood.
16:43Because I've seen a dog before on a front porch, and you don't know if it's tethered or not.
16:48And in that split second, when it starts running at you, and you're not sure if anything's going to catch
16:53it before it gets to you, that's frightening to someone walking by, no matter what kind of dog it is.
16:59It could, you know, a little dog, a big dog.
17:00A Dalmatian is obviously quite a big dog.
17:02You know, you're right.
17:04It's all about being a good citizen.
17:06And considerate of other people.
17:08Yeah, and so in my next career, which I'm actually sitting and thinking about right now, I'm contemplating doing what
17:15your generation wouldn't remember, but my generation certainly does, an Andy Rooney minute.
17:21Andy Rooney used to be on a program called 60 Minutes before he passed away, and at the end of
17:26every 60 Minutes, he would have a minute or two, and he would be complaining about something in society.
17:32And since Andy Rooney, nobody is around to complain about those things that people should do to be good citizens.
17:39I could go on forever.
17:41And I'm sure you will.
17:42And I might.
17:44Case 4015, Coleman v. Parks.
17:47All parties, please come forward.
17:49John Coleman is suing his ex-girlfriend, Tishana Parks, for an unpaid school loan.
17:57Mr. Coleman, you and Ms. Parks had a relationship for a period of time.
18:02You have a child together.
18:03Yes, ma'am.
18:03And while you were living together, the defendant, according to your complaint, wanted to go to school to become a
18:12dental assistant.
18:13That is correct.
18:14It was an eight-month program, and the cost of the program was $7,500.
18:20That's correct.
18:20She couldn't afford to take out a loan, evidently cost of credit, so you co-signed the loan for her.
18:28That's right.
18:28So far, is that correct?
18:30Yes, Your Honor.
18:31Subsequently, you broke up.
18:33Correct.
18:34The defendant is not paying the loan, and you, in order to protect your credit, either have started to pay
18:41the loan or want it paid off.
18:42So which one is it?
18:44Have you started to pay off the loan?
18:45I have started to make payments towards the loan.
18:47How much did you pay on the loan that you can prove to me today?
18:50I don't know the exact amounts.
18:52I've been making payments of between $90 and $122.
18:55Well, you have that proof today.
18:57I do.
18:57Yes, Your Honor.
18:58Okay.
18:58When did you start paying off the loan?
19:01December 2023.
19:03December of 2023.
19:05That is correct.
19:06Okay.
19:06Now, let's get some dates.
19:07When were you and the defendant living together?
19:10We had been living together since about December of 2017, all the way up until, oh my goodness, September of
19:182023.
19:19And when was this loan taken out?
19:21The end of January in 2023.
19:24When did you start school?
19:25In January.
19:27Of 2023?
19:28Yes.
19:29And you were still living together?
19:30Yes.
19:30Now, Ms. Parks, do you recall where you were when the loan was taken out?
19:35Was it taken out at a bank or was it taken out over mail?
19:39We did it online with my computer at home.
19:42Okay.
19:43Did you start school in January?
19:45I did, yes.
19:46And what happened?
19:47I was doing well.
19:49And then in May of 2023, he was arrested and...
19:54I don't think that's relevant to the case, Your Honor.
19:56Well, it is.
19:57It's her defense, actually.
19:58It doesn't take away from her responsibility of paying the loan.
20:01Just a second.
20:02It's her defense.
20:03Sure.
20:03He was arrested in May of 2023 and had to spend a few months in jail.
20:09And...
20:09How long?
20:10Until July of 2023.
20:13And because of that, the program that I was in, it was Monday through Friday, 9 to 5, and it
20:19was an hour away.
20:20So I was dependent on him to take our daughter to daycare and to pick her up.
20:25And when he went to jail, I didn't have that help.
20:29I didn't have anyone to watch her or to take her.
20:32You were not working.
20:33I was not working.
20:34So Mr. Coleman was working.
20:37Yes.
20:38He was paying our bills.
20:39And he was paying the bills.
20:40Since 2017?
20:42Or had you been working?
20:43I had been working before we had our daughter.
20:46Okay.
20:46Now, you went into a county jail, I assume, for a short period of time.
20:50Sure.
20:51That's the first time since 2017 you had been incarcerated?
20:54Correct.
20:55Everybody makes mistakes, you know, partying a little too much, being a dumb kid.
20:58Are you on parole?
21:00No.
21:00Is that case over?
21:01Yes.
21:02When you went to jail for that two-month period, where did you go?
21:07I was still living at the house.
21:09Who was paying the rent?
21:11I was from jail.
21:12Is that correct?
21:13Yes.
21:14When you got out of jail, did you go back to that same apartment?
21:18Yes, absolutely.
21:19She wasn't there?
21:20She was.
21:21That was July of 2023.
21:22I think we didn't separate and she didn't move out until September of 2023.
21:26So she was still there.
21:27Oh, so she was still there?
21:28Correct.
21:29So what happened?
21:30I wasn't able to finish school.
21:32Why?
21:32I didn't have assistance with my daughter.
21:36I didn't have anyone who could take her to daycare or pick her up.
21:39And the times that I was in school, and because my school was an hour away, it wasn't possible
21:44for me to do either.
21:46You were living in this same apartment since 2017?
21:50Correct.
21:50A house, actually, yes.
21:51So there were no friends?
21:53There was no anyone?
21:55I mean, it was a long time.
21:57It's six years.
21:58I didn't have anyone who could take her Monday through Friday consistently.
22:02When he co-signed this loan for you, was it your arrangement that when you went back
22:07to work, you would pay off the loan?
22:09Yes.
22:09Okay.
22:10Well, then it would seem to me it's your responsibility to pay off the loan.
22:14Are you working?
22:15I'm working part-time right now.
22:17And what else are you doing?
22:18Watching our daughter.
22:20He works full-time.
22:21What does that have to do with you?
22:22Are you together?
22:24No, but I am the one who is responsible for our daughter.
22:28She is.
22:29She's an incredible mom.
22:30I have to give her...
22:32Don't speak.
22:32Yes, ma'am.
22:33Don't speak.
22:34Do you have a car?
22:35I do, yes.
22:36The car is in your name?
22:39Yes.
22:39When did you purchase it?
22:41I want to say November of 2019.
22:43It's all paid off?
22:44No, actually, I make those payments.
22:46I make the payments on the car as well.
22:48Mm-hmm.
22:48What's the address on your driver's license?
22:51His address, where he lives now.
22:53Where do you get your mail?
22:55Look at me.
22:56Where do you get your mail?
22:59At his house.
23:00You know where I'm going with this, right?
23:02Yes, ma'am.
23:02Do you know I'm not buying all this?
23:04This is what I'm going to do, folks, because I'm not buying this case.
23:07Do you understand?
23:08Yes, Your Honor.
23:08I'm dismissing it without prejudice.
23:10You go back to your local small...
23:12I don't understand.
23:12You go back...
23:13You go back to your local small claim score,
23:15because I don't think that you don't live together.
23:18That's what I don't...
23:19She moved out.
23:20She left.
23:21Just a second.
23:21She moved out.
23:22She was gone for an entire year.
23:23I was at a scene.
23:24You can try to talk over me all you like.
23:27Your Honor, she moved to Hawaii.
23:28She was gone.
23:29I'm not buying it that you don't currently live together.
23:33That has nothing to do with the loan, Your Honor.
23:35Oh, yes, it does, sir.
23:36How so?
23:37The case is dismissed because you lied in your papers.
23:41I did not lie on anything.
23:42This court is adjourned.
23:51What they wrote in the papers was,
23:54she left to go to Hawaii.
23:55She came back so he could be part of the child's life
23:57to Colorado, but they're not together,
24:00and now he's paying off the loan.
24:02The truth of the matter is,
24:03they've been living as a family,
24:05as a family since 2017.
24:09With the brief stint when she went back to Hawaii
24:11while he was incarcerated.
24:13She didn't even say she did.
24:15She may have gone back there for a couple of weeks.
24:17In her papers, she did.
24:17She said in her paper she went back,
24:19but he said she was there until July.
24:21He went in in May.
24:23I mean, the fact that he's still paying
24:24her car note for the car,
24:26the fact that he's still saying,
24:27oh, she's a fabulous mother,
24:29all those things would tend to lead me to believe.
24:31And she has a driver's license.
24:33With his address on it.
24:35She still gets her mail at his address,
24:38convinced somebody else that this is a lawsuit,
24:41not me.
