08:44So there was an incident in February of 2024 where our neighbor's dog got out of their house

09:14So on April 20th, 2024, we were at our campsite, as Mr. Baker said.
09:20It was a cold day, like he said, rainy.
09:23We've been going to this campground for four years, have taken our dog with us every weekend
09:30to the campground.
09:31Typically, we keep her in our camper.
09:34So we were setting up the tent.
09:36And the dog was locked in the camper?

09:39So Mr. Baker came over from his campsite, which is approximately 20 yards away, with Sarah,
09:45the dog.
09:46He was helping Clint set up the tent, at which point I said to Clint that Rona needed to go

09:55So I walked to our camper, put Rona's harness and leash on her, and then handed him the leash.
10:01And I stayed in the camper to get food around.

10:05I took the leash at that point.

10:41Came out, barked at our dog, at which point Rona went directly, and Rona is very protective

11:08Your Honor, this dog has bit another camper, a grown man, who came up unexpectedly prior.
11:16And then the dog incident, she had explained that the dog got up the kid's playground near
11:22the thing and jumped over the fence and attacked the dog two months earlier.
11:26Let me ask you this question, Mr. Baker.
11:29I have always had little dogs.
11:32And certainly, I believe that your brother and Ms. Roberts understand.
11:37And certainly, from the fact that they put this dog down, they understood that the dog
11:42had propensities that they didn't want to deal with anymore.
11:45Does that be a fair statement?
11:47Sure.
11:47However, you knew clearly what those were.
11:51And so they are at least partially responsible for these vet bills, despite the fact that they
11:58did, in fact, put a leash on their dog.
12:00It was, even though a stretch, it was negligence of not holding onto the leash tight enough so
12:07that it wouldn't get off the leash.
12:09But their intention was, knowing that the two dogs had had a problem, they did leash the dog to take
12:16the dog out, right?

12:48Mr. Baker, if the dog was being held by either you or your girlfriend or on a leash, the incident
12:58would not have happened.
13:00Even if she was on a leash, we could not stop that dog from attacking this dog.

13:07So I'm telling you that while I find the actions of the defendant correct but negligent because
13:18the leash slipped out of their hand, I don't find you and your girlfriend without fault.

13:57Danielle Roberts, of owing for vet bills after their pit bull attacked Molly's chihuahua.
14:04Now, you just went on with a litany, Mr. Baker, of things that you knew about this dog, including
14:10the fact that they had had a dust-up before.
14:13And this is a big dog.
14:16So either you keep your dog locked up if you're going over to your brother's camper.
14:21I asked before I went over there if Rona was locked up in the room, not just in the camper.

14:58You were an ineffective parent by allowing your dog to be in a situation where your dog
15:04was off-leash and able to be attacked by theirs, even though it was due to their negligence.
15:10So I actually believe that whatever the vet bills are that you've incurred so far are
15:17going to be evenly divided between you and your brother, because that's reasonable.
15:22You were negligent, and your girlfriend was negligent with a little dog, and she's your
15:28responsibility.
15:28She can't take care of herself.
15:30She can't say, please leave me in my own camper.

19:11You know, it's heartbreaking, honestly, because we put our dog down because of this, and we miss her every day.
19:18I feel that they had a known, legal, vicious dog that they escaped.
19:25She is trained to stay without a leash.
19:28I'm happy that, you know, the fairness in it was seen, that it wasn't just our responsibility.

19:34Their dog just is not good with certain people and every animal.
19:38Hopefully we can mend things after this.
19:40I just hope that we can move on past this, and our families can get along and go from there.
19:47I think the doctrine of contributory negligence really was a perfect example out there today.
19:52And it really was surprising to me that they didn't seem to understand your logic as far as that was
19:58concerned, about you were negligent.

20:02He was presenting the history in such a way that was meant to be harmful to the defendants, but in
20:08reality, it was really harmful to himself because he was the one that knew of all the same history and
20:14didn't protect his smaller dog.
20:16So, you know, the defendants did everything.
20:18I think it was evident by the fact that they ended up putting their dog down after this incident.
20:22They really tried to do everything they could to keep their dog under their control.
20:26They had the dog on a leash.
20:29So I think no one is above the rules.
20:33I also felt so sad for these two brothers.
20:36It seems that they're not kids, and they've enjoyed a lifetime of friendship as evidenced by the fact that they
20:46share this campsite for six months a year, and they're there every weekend.
20:50And it's clear to me that this sort of came between them, primarily because the plaintiff was pig-headed.
