00:19Justice Leong Wai Hong noted that the trial judge in the Session Court had made findings of fact after hearing
00:25all witnesses
00:26and that there was no reason for an appellate court to interfere.
00:30The appellants Kanga Amno Chief Fatul Bari Matjaya, Sheikh Fazli Sheikh Ruzi and Wan Azizul Wan Yusuf have filed a
00:38further appeal to the Court of Appeal.
00:40Leong described the case as a sad instance of greed prevailing over the spiritual needs of KRS Travel Sinjun Berhad's
00:47clients
00:48and noted that the three had admitted using the money for personal purposes and making false representations to KRS.
00:55He also said they had applied to have Rehla struck off the register under Section 550 of the Companies Act

01:03to prevent KRS from pursuing legal action.
01:06The Session Court entered judgement of RM492,480 in favour of KRS after finding that the trio had committed fraud.
