00:01In a David and Goliath battle, a small lesbian rights group is taking on the Australian Human Rights Commission.
00:08It's seeking an exemption to the Sex Discrimination Act so it can legally exclude trans women from its public events.
00:15The group subscribes to the philosophy of lesbian feminism and wants to exclude all biological men, even those who identify
00:23as women.
00:24In court, the group's lawyer said they have the right to associate in a way that furthers their own unique
00:30needs
00:31and the application should be granted on the same basis that women-only gyms can exclude men.
00:38Outside court, the group's spokesperson Nicole Mowbray said they still support trans women having their own events.
00:45We're not out to harm anyone. We are merely putting up a boundary and saying please respect our boundaries.
00:52And there are plenty of trans-only events. This is what's crazy.
00:57There are loads of trans-only events. We respect their need for their space.
01:02We would just like to be afforded the same respect to have our space. That's all it is.
01:07The group has had this application rejected twice before and it has crowdfunded to pursue this appeal.
01:13The Human Rights Commission says the appeal should be dismissed.
01:16It says it's not justified to discriminate against trans women and it could cause real harm to their wellbeing.
01:22The hearing will run for two days.
