00:52They ain't going to be anywhere.

01:16The call came out that shots had been fired.
01:18I was a new boot.
01:19I was definitely a rookie.
01:21And for a rookie, you're kind of walking into the unknown.
01:24My body camera was already rolling.
01:25There's no other intel, right?
01:28It was smaller.
01:29And I was welcome to.
01:30So there's a gas station, pump gas.
01:32They also, there's a truck south of the gas station.
01:37My adrenaline was definitely rushing.
01:39I was driving that night.
01:41We called him a field training officer.
01:42He was sitting on the passenger side.
01:44And basically, I was like, all right, it's your show.
01:46Let's go.
01:47We turned down the residential street, and we get out of the car.
01:56It was dead silent.
01:58I could hear the car that was revving.
01:59It was pretty eerie.
02:05Turn the car off.
02:06Yeah.
02:10The car was still on.
02:11I could see a black male sitting in the driver's seat, and I could see him convulsing.
02:16And every time the male was convulsing, their engine would rev.
02:20I could see a black male sitting in the driver's seat, and he looked anywhere from 17 to 24,
02:32maybe?
02:33I mean, he was young.
02:34Looks like he's been shot in the head.
02:35Yeah.
02:39I could see that he had a bullet hole to his head.
02:42There was brain fragmentation coming out, blood coming out.
02:44And at that time, I was basically face to face with him and kind of saw his last breath.
02:52And I kind of stepped back from there and just kind of was like, oh, shit.
03:02A field training officer tried to feel for a pulse, and there wasn't one.
03:06This was clearly a murder.
03:12Andy.
03:13Hey, it's Hoover.
03:15I don't know if you're the guy in charge since everybody's out of town, and Brad's on the funeral
03:22leave, but we had a murder.
03:24One third is this one to pass on.
03:26Yeah, we just got the call.
03:27The guy's dead in the car.
03:29He got shot.
03:30We're still actively working it.
03:32Black male in the car and Kentucky plates down on Prissy.
03:34We're seeing Becky.
03:37We're 10, 12, 15 minutes from Kentucky.
03:41It wasn't odd that a Kentucky car was parked here.
03:44We run a plate in our car.
03:45We were able to pull up his driver's license, and on his driver's license, it had his face.
03:52So identified the driver of the vehicle as a 25-year-old Delvin Mitchell.
03:57Delvin was my best friend.
04:06Technically, his name is Delvin.
04:10But he didn't really like it that much, so he would tell us to call him Delvin.
04:14People loved him.
04:15As soon as you walk in the room, you're just going to get that joy.
04:20It's like this wind that comes over you.
04:25Delvin did a lot of music.
04:27He never was really a rapper, but he was doing like the production of it.
04:34He used to hang out at the house with my son, Blake.
04:39My house used to be like a place where all the boys would come to chill out.
04:44So one day, Blake had come and sat down in my room and asked me if he could,
04:47if Delvin could stay with us, because he didn't have nowhere to live.
04:51First, I was kind of hesitant, because I always had people there.
04:55And then I told her, yeah, then yeah, go ahead, we can.
04:57And then from there, me and Delvin, you know, got us a relationship as mom and son,
05:03and he used to call me mom.
05:06He ended up becoming like my actual brother.
05:08He went from a friend to a best friend, close friend to a brother.
05:11That's a whole different relationship dynamic.
05:14Okay.
05:21That night he got killed.
05:25I was asleep.
05:26They woke me up.
05:28Blake called me and told me that Delvin was dead.
05:32I think I just shut down altogether.
05:35I just got numb.
05:38I got a text message and was like,
05:40there's like a Facebook status talking about there was gunshots last night.
05:44Y'all be careful, y'all.
05:45So like, I don't know, my heart's like beating real, real fast.
05:48And I like my whole, I like fell to my knees,
05:52because I had a feeling that like that, that it was him.
05:57And then by the time I got to the crib, they, they told me that it was Delvin.
06:00I don't really remember too much of the conversation, because I was like, I was,
06:07all I seen was red.
06:08Like, like, who would hurt my brother?
06:10Like, I don't know.
06:11I lost it.
06:12For a long period of time, for real, I was, you know what I mean, I was lost.
06:15On scene, it was, you know, kind of that tunnel vision to what we had in the car.
06:30We crime scene off the entire area.
06:32That's when the brigade of detectives, detective sergeants, the crime scene guys,
06:46started to pile in.
06:52When I arrived on scene, and kind of processed that scene myself,
06:58just looking at things, seeing where, you know, there's a round laying there on the street.
07:07There's one in the floorboard, the, the victim Delvin's been shot in the head.
07:12You're kind of wondering that was, is this a setup? We, we don't know.
07:16There, there's all different kinds of scenarios as a detective that you run through your head
07:21to try to get it figured out as soon as you possibly can.
07:28The driver's side window also had what was consistent to be a projectile round through that.
07:34The door was open, so it could lead to a couple different things,
07:37but it looked like who shot him was in the vehicle or in close proximity to the vehicle
07:42when the shots were fired.
07:45The violence behind it was intentional.
07:47And you could tell that just from the amount of rounds that were sent through the car.
07:51It wasn't just to scare him, it was to kill him.
07:53There's two shell casings that we've seen.
07:57One in the car and one right outside the passenger side.
08:01This side?
08:02Yeah.
08:05Look through to the other side.
08:08There's a shell casing.
08:08Because the out, out looks that way.
08:10Yeah.
08:11Do a, your boys start a crime scene log.
08:15Okay.
08:17We don't have all the pieces to the puzzle yet.
08:19It was one of those eye-opening experiences of, hey, you know, we've got somebody,
08:23we know that shot, but where's the shooter?
08:26As you're standing there, you're just, you're, you'll, you see this.
08:30You're, you're asking yourself why.
08:32And, you know, it's, it's just a mystery.
08:34You can't go southbound on the sweetest, right?
08:51Here in my ear, the dispatch had notified us that a car was fleeing the area and other units
08:58were trying to get behind it.
08:59Um, and as it was fleeing, they could see that the car had false plates on it, possibly involved
09:05with the scene.
09:06So, um, hearing that in my ear, I'm thinking, hopefully we can get this car stopped, figure
09:11out who's in the car, maybe they're involved with what happened here.
09:17Officers are, are initiating their, their lights and sirens, trying to get this guy to stop.
09:22Won't stop.
09:23So now in the back of everybody's mind, they're thinking, maybe he's our suspect.
09:28You know, he's definitely not going to stop.
09:33It's just a straight adrenaline dump.
09:36And it's, it's just a rush.
09:38Like we have to get this car stopped at all costs.
09:42And knowing that there's a possible gunman in this car, the level of threat just goes through the roof.
09:53There was a vehicle pursuit.
10:01We were trying to get the vehicle stopped and it wasn't stopping.
10:04So we thought possibly could be involved because it's in the area.
10:08It's fleeing the area.
10:09It could be a piece of the puzzle.
10:11This sergeant or lieutenant at the time
10:14radios and said other counties and state police are starting to pick up on this pursuit.
10:18So now they're pursuing the guy.
10:20But they ended up stopping him and placed him in handcuffs.
10:27Where's he from?
10:29We got an Indiana ID card.
10:33I don't know if that's going to happen.
10:36Yeah, Jack, what's his phone number?
10:37Uh, baby.
10:39I want to keep calling the phone.
10:41We're going to want to take this guy back to Vanderburg.
10:43So.
10:44We're thinking this might be our guy.
10:49He had the false plates on his vehicle and they look suspicious.
10:55I was planning, I mean, we got felony charges in our county.
11:01So there's no extradition there that we should be able to bring him back to Vanderburg.
11:07And you guys can try to top swing.
11:10Just the him leaving the area, but that is awful coincidental.
11:15And talk with Peter and the prosecutor, I mean, if they just want us to impound this
11:19and talk back to Tri-State to Evansville, we'll get a search warrant for it.
11:24Okay, thanks.
11:24I identified the guy as a subject named Simone.
11:29And Simone was placed in one of our patrol vehicles.
11:33And that patrol officer brought him to headquarters for an interview.
11:41Hey, what's going on, man?
11:44I'm Detective Lowe.
11:47This is my Sergeant Detective Hunt.
11:52I need to ask you some questions, okay?
11:56So I'm going to read you Miranda.
11:58Probably heard that before, right?
11:59I still have to read it to you, all right?
12:03You can tell a lot by when interviewing subjects, by their disposition.
12:09How they act, how they talk.
12:11Are they looking you in the eye?
12:13Are they looking away?
12:15Simone had some of those, but you're thinking, well, this guy was right there.
12:19And this guy fled the scene from there.
12:21All right, do you know why you're in here right now?
12:28Run me down what happened tonight.
12:31I don't even know, man.
12:32All I know is the police jumped behind me.
12:35And I just was just thinking about getting to my mama, man.
12:41Because, you know what I'm saying, I'm on probation and stuff.
12:44And they're like, the PO, you know what I'm saying, he said I got a warrant or whatever.
12:52So, I don't know, man, I'm stupid.
13:00Simone basically told me that he had warrants.
13:04He was scared.
13:07He didn't want to go to jail.
13:08You think, well, maybe they did flee because they have warrants.
13:12Maybe, maybe they have something else going on.
13:17Well, can you at least run me down?
13:20I'm trying to figure out something that happened tonight.
13:23And I'm trying to take you out of the equation.
13:26But I need you to tell me, like I asked you a while ago,
13:29the last couple hours before cops got behind you and you took off, what all did you do?
13:35The liquor locker right there on cover, but I ain't been nowhere else.
13:41I ain't even do nothing wrong, man.
13:43I thought I had a warrant.
13:46After we talked to him, we got a signed search warrant for his vehicle.
13:53We couldn't find anything that would tie him to it.
13:58So, we released him from that crime.
14:00It is a, a little frustrating because you're thinking, well, this guy was right there
14:10and doesn't have anything to do with this, with this murder.
14:15Now you're back to square one.
14:16You got to take a broad picture and just, you don't want to get hooked on one thing.
14:20And this is, this is the way this happened.
14:22You know, that's a good thing of a, of a good investigation as you look, you know, broadly and see
14:27who all could be involved in this and what all possibly happened here.
14:30The suspect that's still out there didn't like this guy.
14:33I mean, who, who killed Delvin?
14:37Still don't know.
14:38Don't have any, anybody else to look at right now.
14:41So, when you're going through these investigations, you want to know the victim's life.
14:54You want to build the victim, his own profile.
14:59The more information you gather, you're starting to build
15:03some sort of a lead to try to help solve this case.
15:07One thing we're going to do is look at his background.
15:12There's a couple of different ways we can do it on Facebook and interviewing witnesses
15:16and talking to people.
15:17So, as we're investigating this, this murder, we start looking at Delvin's history.
15:25We don't have much to go off of.
15:27He has a report taken under his name for something criminal, which wasn't like something huge.
15:34There wasn't anything of interest that we would need or think that we would need to,
15:41to follow up with.
15:46A short time later, another detective in the office had, had answered a phone call.
15:51And it was a male subject, and it was named Justin Brewer,
15:54saying he'd like to talk to detect, Detective Lowe.
15:58Pretty much almost every homicide, we do always kind of get some type of tip or,
16:02hey, you might want to know this information. That's kind of typical of every case you have.
16:06My name is Justin Brewer. She said I could talk to you.
16:10Yes.
16:11Hi, how are you doing today, sir?
16:13Not doing too bad. Just in here trying to figure out
16:17an investigation I've got going on, trying to figure out what happened.
16:21Yes, sir. That's the reason why I called. I wanted to present myself to you properly
16:26and help as much as possible. But I didn't want to talk to you, sir.
16:31Okay.
16:33First, I wanted to tell you that, you know, Delvin, that's who you're talking about, right?
16:40Because that's the only one that I'm, you know. First of all, he wasn't a bad guy.
16:45You know, he wasn't an angel. We'll get it wrong. But, you know, he wasn't a bad guy, sir.
16:50He said that Delvin was a good guy. He's a great guy. He's known Delvin and his,
16:57and Delvin's family pretty much his entire life.
16:59I don't want to tell you what I think, because I've heard so many different stories.
17:04I've heard so many different allegations coming from so many different situations.
17:08Uh, okay, uh, okay, for example, okay, he was having sex
17:14with a guy's wife that lived across the street from me and my wife.
17:18He also mentioned a, uh, a subject named Sean. And, uh, he, he has, uh, either a wife or a
17:27girlfriend that was named Chastity. And supposedly Delvin was messing around with this Chastity lady.
17:37And maybe we should turn our direction towards that. Maybe, maybe Sean's mad at Delvin
17:44and decided that he's had enough and he's going to take care of it.
17:48Okay. All right. Well, you have my number, Justin.
17:55When Mr. Brewer talked about, um, Sean being involved, so that's something you have to take
18:00in consideration. Sometimes you have retaliation killings. We were very concerned of the situation.
18:06When the gentleman that's having an affair with your significant other does end up murdered,
18:10you're always suspicious when anything like that happens. Maybe that could be one potential motive
18:14for Mr. Mitchell's demise. We need to interview him to help us find out where is this going to lead us.
18:20Mr. Brewer did contact the police department, um, uh, on a recorded phone call. Uh, he brought up the,
18:34the information that Mr. Mitchell was, uh, having a relationship with Chastity, uh, and that her
18:39husband, Sean, was not happy about that. Sean's the one that I raised also. Everybody thought
18:45Sean done it. Everybody thought Sean done it. And everybody was calling me, talking about Sean,
18:50we're going to kill Sean. Me knowing Sean, growing up with Sean, like, I knew that he,
18:54you know, he wouldn't do nothing like that, you know, but, you know, no, put nothing past nobody,
18:59though. We don't know. We just know that he's a person of interest. Obviously, you're going to look at
19:04Sean's criminal history, and he did have a little criminal history with disorderly conduct and lying to
19:09law enforcement. Sean said, Mom, I didn't do it. So I believe Sean. So I went with Sean to the
19:21interrogation place. I want to read you, Miranda, just because your name is being brought up as a
19:29suspect. Yes, sir. I understand that. I had talked to Sean about, uh, the murder and that he's a possible
19:37suspect that his ex-wife, Chassidy, had been seeing Delvin. Well, you guys were divorced, though,
19:46right? Yes, sir. Yes. It was none of my business. Yeah. You know what I mean? But then, I guess.
19:50But still. Yes, sir. Because you and Delvin were friends. Well, as far as I knew, we was. And then,
19:56I didn't get all the traumatic and sad information until after that. He didn't even really like you.
20:02And obviously, you know, by the actions of what was going on, that I wasn't anything to him. Right.
20:07You know what I mean? But I didn't know all these hurtful things until after that.
20:10That night, he got killed. I had to tell Sean that Delvin was with Chassidy. He didn't know.
20:19So he got mad and sad all at the same time. He said he was a little upset about that, but,
20:25you know, it wasn't something that he would go and take revenge out on somebody for.
20:31Why do you think your name was brought up about this, though?
20:33I think my name was brought up because everybody needs a fallback and a scapegoat,
20:39and that's who I am. Not that I'm blaming them on anyone, but I even immediately, when I heard it,
20:44it was like, oh my goodness, what should I do? What do I need to do? Is there someone I need to speak with?
20:50Like, because, I mean, look, you know what I mean? Like, how it looks. You know what I'm saying? Like,
20:54your buddy's messing with your wife, blah, blah, blah, whatever. Yeah, it looked real bad.
20:58You know what I'm saying? Yeah, I mean, it did furlough.
21:01Yeah, it really did. Yes, sir. And, you know, I mean, we've all watched, you've seen enough,
21:06you know, shows to know that. Sean said he went to sleep that night, that that incident occurred,
21:15and he didn't know anything about it until the next morning when he woke up.
21:19You have a past conviction of lying to the police, you know, what, you know,
21:22why are we going to believe? You're going to have to show us, you know, why,
21:26why you're not involved in this.
21:27Would you mind us looking at your phone?
21:30I don't. Okay.
21:32Whatever you need to do.
21:33Can I take it? I'm going to take it in there and look at it. Is that all right?
21:37Yeah, that doesn't matter.
21:39He said, I have an app that tracks my sleeping pattern, and it'll show you on my phone that
21:44at that particular time and day that I was sleeping. So we looked at his phone,
21:52looked at that app. He was just being very honest and truthful,
21:57which in our minds kind of eliminated him from this murder. Investigating something like this
22:05is hard sometimes because it's a little overwhelming, but we keep working our case.
22:14Delvin was my biggest fan, my biggest supporter.
22:18Delvin was always pushing me to do great. I remember like preparing for the funeral.
22:26His birth mother did not want to show up. She did not.
22:30His sisters welcomed me in, you know, because they know that I took care of him.
22:35Then everybody got together and wanted a picture taken of all the guys together.
22:40That whole time, like, I changed to a whole different person. Like, I don't even remember
22:48who I was at that moment. And we were still trying to find a killer for Delvin.
22:53So it's just a lot going on at this moment, you know what I'm saying? Like, I can't grieve at all
22:56right now. Like right now, it's just like, my soul's gone. You know, I don't even want to live no more
23:03myself. You know what I mean? So it really hurt, for real. And I'm still suffering.
23:07I'm still suffering. His life was taken. He didn't deserve that.
23:14There's a lot of people out here that deserve it, but he didn't.
23:27A short time later, phone rings. And again, it's Justin Brewer. Same guy from the earlier
23:33communication. He was having sex with a guy's wife that lived across the street from me and my wife.
23:41I did find that kind of odd that another call came in. So I answered the phone. He tries to tell me
23:47several different stories about what could possibly happen to Delvin, which, in my mind,
23:54thought was kind of far-fetched. I said, did you ever meet up with Delvin? He said he was supposed
24:00to meet Delvin on the night that he was murdered. And at that particular time, I don't know that
24:08information. He didn't want to give a whole lot of information before. So you're kind of wondering
24:13why now.
24:14That night, I called him. And he was supposed to meet up with me. My wife is a cab driver.
24:20I called my wife to bring me. And he never showed up. And I didn't charge him, you know,
24:25to my heart about that because it was something so small and petty. You know, honestly, I just felt
24:29like, well, maybe he thought it wasn't worth his time.
24:32So I asked him where they're going to meet at. It's a little apartment complex,
24:36block and a half away from where Delvin got shot and killed, where he could get a bag of weed for
24:43his wife. His wife's name was Amber Brewer. She worked for a cab company, driving a cab. And he said,
24:53no, no, I met in that area and I waited all night long. He never showed. There was other detectives in
25:00the room with me. We kind of all just looked at each other in awe.
25:07We just could admit of being there that night, close to the area where Delvin was murdered.
25:13In my opinion, you're being nosy because you know something happened and you're wanting to know
25:18what we know. And I'm not giving that to you. You heard the stuff on Facebook, like the police
25:25chase and the shooting and all that. You tried to call him or text him or what'd you do?
25:28No, sir. No, sir. After I left, I tried to call him again and he didn't answer.
25:34After we completed our conversation, like I said, did this guy really just call in here
25:40and give this story of
25:46his events that in his mind took place? It didn't make any sense. None of his stories made any sense.
25:54I believe then Justin called back one or two more times, just trying to kind of feel the detect
25:59about, hey, what do you have on me? And then trying to throw shade on maybe other, just to send an
26:05investigation to another area other than himself. He kind of admitted that he was supposed to meet
26:11Delvin's very close to where the incident occurred the night that he was murdered. So we had enough
26:18probable cause to get a warrant for his phone number to get call detail records, text messages,
26:26and found out that on the night of the incident, Justin had called a female,
26:33her name's Scarlett. There were several, uh, phone calls and texts back and forth. So we all were
26:40thinking, is she the side chick that got involved? When you commit a crime such as murder, you know,
26:46the wheels are turning. I'm sure he's looking out the window. Did anybody see us? You know, he called
26:50on somebody that he's had faith in and maybe that was Scarlett. We got to talk to that person, find out
26:56how she was involved. We did some further follow-ups and found additional cell phone data. Cell phone
27:11data does not lie. The phone data showed that Scarlett was in recent contact with Justin at night
27:19of the murder. There were several phone calls and texts back and forth that was suspicious.
27:26We found out that Scarlett was living with her mother. So we went to the mother's house to try
27:34to interview her there, but she wasn't home. So we interviewed the mother at her house.
27:42Okay, Terry, go ahead and have a seat. Terry, you remember me. I'm Detective Wheeler.
27:47Yes. And this is Detective Hands.
27:50She's a very nice lady, and I believe she had some concerns about her daughter's safety.
27:54since she was involved with Justin Brewer.
27:56She said, Mama, Justin was going to know if he can come to the house and stay for about
28:04three to four days. And I said, well, for what? He's got a home. Because when he came that night,
28:11I was so freaked out. I knew she wasn't right. And I stayed in there to myself. I didn't want to be around him.
28:19Nothing. She said Justin ended up getting dropped off at Scarlett's mother's house the night of the murder.
28:28And Justin had come in kind of in a frantic type mood, very wired, very amped up.
28:34Yeah. It's your daughter. I understand. I know, I know.
28:46This is unsettling. But what I want to make sure is you're not doing something to your kid now.
28:52No. If you know something, it's important.
28:56The only time that he talked to me, he come downstairs, Scarlett was gone. And he just kept walking back and forth,
29:04you know, doing this. I really want to tell you what's going on, Mom. I think you should know,
29:11but I really don't want to tell you. You know, more or less, he was admitting to me, but he didn't come out and say it.
29:24According to Scarlett's mother, he said something bad had happened that night.
29:28We were starting to get more and more information. She did admit that Justin was at the house.
29:36She's a potential not eyewitness to the murder, but maybe a circumstantial witness to a murder.
29:44Do you ever get 100 percent of the information? The only person that really knows that is the person
29:49you're interviewing. Did he expand on that? What he wanted you to know?
29:52No. Not at all. He did not come out and say he murdered that boy. No, he did not.
30:01And I put my name on the Bible to that. He did not say that. But in so many words,
30:08I knew that something wasn't right and he done something.
30:14I mean, you could tell she was scared of him. She would sit there and talk to us and smoke,
30:18which I'm not a smoking fan, but it was worth it.
30:22What did Scarlett tell you that he told her? Scarlett told me that he killed me.
30:30When was this? This was... Before he left?
30:34Yeah, before he left. Justin didn't tell you personally that he did?
30:38No, he did not. I never heard that come out this time. In a roundabout way, though,
30:43he said it, you know, in a roundabout way.
30:51Afterwards, we did some interviews with Scarlett. She was not willing to give up any information.
30:58We tried to speak with Justin, but he refused to talk to law enforcement when confronted.
31:03Justin didn't want to speak with us. So we put our attention more towards Amber, Justin's wife.
31:13In the interview, phone calls before with Justin Brewer, he did inform detectives that he had
31:21been picked up that night in Amber's cab to meet Mr. Mitchell. And Mr. Mitchell had never shown up.
31:27We then go to view cabby. They did confirm that, yes, Amber was working that night.
31:36And her cab, it had GPS tracker in it, which is always good for us.
31:43And it shows exactly where the cab was going.
31:45It could be that break moment where like, oh, this is it.
31:53There is almost always information on those devices that will help us along in our case.
31:59So you're hoping that happens.
32:03I went into the office and they had come back from the taxi cab place with the GPS information.
32:08And it showed Amber's cab going down to the southeast side and stopping a block or so from the murder.
32:19So it was kind of nice to look at the data and go, okay, so it puts them at the scene of the crime
32:22at the time of the murder.
32:27And then immediately after, it shows her stopping on top of Diamond Avenue over Pigeon Creek.
32:31That was the first thing we all thought, holy , she just threw that gun out in the creek.
32:41The dive team showed up at the bridge.
32:44And they did their process as far as searching for the gun.
32:50Are we going to find something there?
32:54My thoughts are there's no way.
32:56There's a young man from the local news.
32:58And my first question to that reporter is, hey, when is this going to be on TV?
33:01And he said it'll be on an 11 o'clock news.
33:04Evansville is not a huge community.
33:07But you look up and there's news media trucks lined across this bridge.
33:12They were all over the story.
33:17We then got the thumbs up that there was a discovery and the diver did a great job.
33:22He found it in pitch dark water and he pulled that thing up and I'll never forget it.
33:26And the next thing you know, you're looking at a slide from the Smith & Wesson.
33:32So this is more icing on the cake.
33:37We had enough probable cause to get arrest warrants for Justin and Amber.
33:44But we could not locate them here in the city of Evansville.
33:57It might have taken us a week or two, but then we got a, I was on a date night with my wife
34:03and got a confirmation from the FBI that Amber and Justin were in custody in Shumlee, Georgia,
34:09just outside Atlanta.
34:11She was stopped while texting and driving.
34:14So at that point, things were going good.
34:19With them in custody, you'd love to sit down face to face with them, look them eye to eye,
34:25and get a full confession.
34:29Justin Brewer refused to speak to investigators,
34:32but Amber decided to speak with law enforcement.
34:35Myself and Detective Lowe walked in there thinking, OK, what are we going to hear?
34:57Are we going to hear some story that does not jive with any of the evidence we have?
35:01I'm going to take you back to Rome, January 25th of 2019.
35:06Or is she going to tell us the truth?
35:20We're being recorded, you understand that, right?
35:26Amber Brewer did decide to speak with law enforcement.
35:28I only intend not to tell a lie at home.
35:34So if it's safe to say on 125th of 2019, that in January 25th of 2019,
35:39you were working at UCAVI?
35:41Mm-hmm.
35:41At some time or another, did you have a conversation with Justin,
35:46and did you go pick him up at the hotel you were staying?
35:49Yes.
35:50OK.
35:52I went and picked him up so I could get him back to eat.
35:54OK.
35:55Amber basically told us that the night of the murder,
36:01Justin was wanting to get a little bag of weed.
36:05Who, um, who set up the deal to get the bag of weed?
36:08He did.
36:09OK.
36:10And we're talking about, and who did he set it up with?
36:12Um, that young man right there, his name was on that paper, Devin.
36:18Devin Mitchell.
36:18Mm-hmm.
36:19OK.
36:20She said she picked Justin up.
36:23They drove to the southeast side of Evansville to meet Delvin that night.
36:29We just entered into the parking lot.
36:32OK.
36:33And what happens there?
36:34We get in, um, the car that he was driving.
36:37Devin's car?
36:38Mm-hmm.
36:39OK.
36:39And what happens in there?
36:40Um, he takes off out the parking lot, and I can't.
36:44I'm not going to tell you which direction we went in,
36:46because at the point we get in the car, I'll leave it up to them to figure out whatever
36:51they're doing, because, you know, I'm just, I'm with my husband.
36:53I understand.
36:54She gets in the back passenger seat of Delvin's car, and Justin gets in the front seat.
37:05They drive around a little while.
37:07So, I'm in the back seat, minding my own business.
37:10Susie pulls over, my husband pulls out a gun.
37:13And I'm not used to those type of things, so I'm not trying to yell.
37:18So, I just, I got out the car and took off running.
37:21OK.
37:22And, um, that's, that's when I heard, um, the gun go off.
37:27Um, I just...
37:28You couldn't remember how many times you heard it go off?
37:30No.
37:32Justin's got a gun pointing at Delvin.
37:36And she says she jumps out of the car and takes off running.
37:40And she gets a short distance and hears some gunshots.
37:46People give false confessions.
37:47We did not find anything deceitful in her interview with us.
37:52Everything was consistent with our investigation.
37:56OK.
37:56At some point, do you stop your cab at the Pigeon Creek Bridge there?
38:00Yes.
38:00OK.
38:00And do you get out?
38:01Yes.
38:02And what do you do there?
38:03Well, my, my vehicle was smoking.
38:05I didn't make a maintenance report about it.
38:07And, um, I don't, I don't know if it was smoking.
38:12But, um, I threw the slide that he told me I had to get rid of.
38:16So after she tells us this story, you're pretty confident you've had the right guy.
38:24You've been hearing his name.
38:25He's made calls to you.
38:28It all matches up.
38:29Mr. Mitchell was a very young man, and to be killed over a bag of marijuana, it is tragic.
38:41He's not going to get his life back, and the family doesn't have him back.
38:46I don't know if it's a lack of respect for a human person, or it's just
38:50the disdain for not getting something you think you deserve.
38:53I don't know what causes this.
38:54Amber testifies against her husband.
39:02She was charged with obstruction.
39:07She was released on time served.
39:13Justin was ultimately charged with murder.
39:17They found him guilty.
39:20He was sentenced.
39:21And the judge recommended 85 years in prison.
39:24Scarlett was ultimately convicted of obstruction of justice for lying to law enforcement.
39:33And she was sentenced to two years and 182 days.
39:40We've done phone calls before where people have actually called in and talked to law enforcement,
39:44knowing they're the suspect.
39:47They want to know what the word on the street is.
39:49But curiosity kills the cat sometimes, and that's what happened in this case.
39:54In my mind, in my heart, I hope the family knows that we did everything we could,
40:00and that we did get justice for Delvin.
40:02Delvin, he was a star.
40:12I mean, he was just great.
40:15He didn't really get a chance to even live life.
40:26I'm still having trouble with it.
40:28I said at home all the time, I really don't deal with anybody.
40:34I don't deal with anybody.
40:35I hope Justin really thinks about what he's done and how bad he impacted a lot of people.
40:48Delvin was the joy of a lot of our lives.
40:56And now we don't have that joy no more.
41:00You stole that joy from us.
41:01He took my bestest friend.
41:10So I'm hurt still to this day.
41:16It was the life of the party.
41:21There ain't no more parties no more.
