00:00Federal Judge Orders Kilmar Abrego Garcia to Be Released from ICE Custody
00:04Just in time for Christmas, a federal judge has ordered the immediate release of Kilmar
00:08Abrego Garcia. Yes, that Kilmar, the man allegedly tied to MS-13 and now facing human
00:14smuggling charges. The Department of Homeland Security is now stuck scrambling to appeal
00:18what it's calling naked judicial activism. The ruling came down Thursday from U.S. District
00:23Judge Paula Zinnis, an Obama appointee naturally, who decided that Abrego Garcia's re-detention
00:28by ICE lacked lawful authority. But now, after bouncing back to the U.S. to face charges,
00:34he's been granted his golden ticket out of detention. Again. Never mind that ICE was
00:39trying to send him to Liberia after at least five other countries reportedly refused to take him.
00:44DHS Assistant Secretary Tricia McLaughlin didn't mince words, calling the decision legally baseless
00:49and vowing to fight it tooth and nail. Under President Donald Trump, the administration
00:54has made it crystal clear that the days of catch and release are over. But here comes Judge Zinnis
01:00with a last-minute legal curveball, tossing a wrench into what should have been a straightforward
01:04detention of a man allegedly involved in transporting migrants illegally into the country.
01:09He's pleaded not guilty and says he's not affiliated with MS-13. According to the federal
01:14indictment, he conspired to unlawfully transport migrants from Guatemala, El Salvador, Honduras,
01:19Ecuador, and other nations. Just keep appealing, and eventually, someone will decide that due process
01:24now includes a get-out-of-jail-free card. As a career prosecutor and elected district attorney,
01:31I am deeply disturbed by Obama-appointed activist Judge Zinnis' order to release MS-13 gang member
01:37Kilmar Abrego Garcia. The trial is scheduled to begin in January unless, of course, Abrego Garcia manages
01:44to get those charges tossed too. So here we are in 2025, with the southern border still a political
01:50battleground, sanctuary policies still being protected like sacred texts, and now, judges
01:55unilaterally deciding who gets to walk free.
