00:00Costco Sues the Trump Administration Hoping to Get Tariff Refund
00:04Costco has filed a lawsuit against the Trump administration seeking refunds for tariffs it
00:09has already paid, while also asking the court to block future collections until the Supreme
00:14Court rules on a major case involving Presidential Tariff Authority. The suit, filed in the U.S.
00:20Court of International Trade, comes ahead of a December 15 deadline that could make those
00:24tariff charges permanent. The case centers on tariffs imposed by President Donald Trump under
00:30the International Emergency Economic Powers Act, i.e. EPA, including reciprocal tariffs on trading
00:36partners and fentanyl tariffs on imports from Canada, China, and Mexico. Costco argues that it
00:42has paid significant sums under these policies, but has not been given clarity on how much could
00:47be refunded if the Supreme Court sides with businesses challenging the tariffs. Costco's
00:52filing states that U.S. Customs and Border Protection refused its request to delay the
00:57liquidation process, the final step that legally locks in tariff charges on imports. Once liquidation
01:04occurs, importers may have no meaningful path to seek refunds, even if the tariffs are later
01:09deemed unlawful. Although importers typically have six months to protest, not every liquidation
01:15can be challenged, leaving many companies exposed. Dozens of businesses have filed similar lawsuits,
01:21fearing that if they do not act before December 15th, they may lose access to refunds, even if the
01:27Supreme Court invalidates Trump's tariff powers. The concern intensified after the Federal Circuit
01:33ruled 7-4 in August that IEEPA does not authorize presidents to impose tariffs unilaterally,
01:40reaffirming that Congress holds constitutional authority over taxation and trade. The Trump
01:46administration appealed, and the Supreme Court heard arguments on November 5th.
01:49Some justices appeared skeptical of the administration's position, but no ruling has
01:54been issued. The White House maintains that the tariffs are lawful and economically necessary.
02:01For Costco and other importers, the coming weeks will determine whether they can recover
02:05potentially millions in tariff payments.
