One of the showcase stars of Jackass, who won’t be seen in the newest sequel set for release on Sept. 3, is raising a big legal challenge over his ouster from the franchise.

00:00Jackass star Brandon Bam Margera is suing over his ouster from the franchise.
00:04According to a complaint filed by Margera on Monday in Los Angeles Superior Court,
00:09Jeff Tremaine, Johnny Knoxville, and Spike Jonze quote,
00:11accosted him and coerced him into a wellness agreement during his stay in a rehab facility two years ago.
00:17The agreement allowed for his immediate termination in the event he didn't blow into a breathalyzer three times a day,
00:22submit to urinalysis twice a week, have his hair follicles tested on a regular basis,
00:26and take pills every morning while on a FaceTime call with a doctor hired by Paramount Pictures.
00:31The suit calls the agreement quote, psychological torture and legally unenforceable,
00:35plus even references Britney Spears' conservatorship.
00:38In his suit against Paramount, MTV Networks, Tremaine, Knoxville, Jones, and other associated entities,
00:43Margera says producers violated his civil rights.
00:46He also says he suffers from physical and mental disabilities,
00:49as he's been diagnosed with bipolar disorder and attention deficit disorder,
00:52and that his termination amounts to illegal discrimination.
00:55According to the star, represented by attorney Eric George,
00:58he was ousted after one of the numerous drug tests Margera was forced to submit to
01:02demonstrated that he was taking prescription Adderall.
01:04Defendants knew full well that Margera had to take Adderall to treat his attention deficit disorder.
01:09He had been on this medication for several years.
01:11But all of this notwithstanding, and without even giving Margera an opportunity to explain,
01:16Paramount fired him.
01:17The suit claims the producer's actions against Margera were a violation of the UNRWA Civil Rights Act,
01:21California's Fair Employment and Housing Act,
01:24an unlawful retaliation, and a wrongful discharge in violation of public policy.
01:28Additionally, Margera is suing defendants for breaching his deal to star in Jackass,
01:32plus fraudulently inducing him into the agreement.
01:35The suit also includes a claim that the forthcoming Jackass 4 constitutes an infringement of his intellectual property,
01:41and that he deserves a piece of the profits.
01:43Through his suit, Margera also takes credit for creating Jackass,
01:46saying it would have been, quote, impossible without him.
01:48The star is shooting for an injunction on the release of Jackass 4 and demanding monetary damages.
