Justin Baldoni made an offhanded remark as the cast of "It Ends With Us" was getting ready to shoot a scene ... he says, "Sorry, I missed the sexual harassment training" -- but it was a joke about the wardrobe for the scene.

00:00On the surface, Justin Baldoni said something pretty shocking during a rehearsal for the show
00:07for which he is now being sued.
00:09The movie, it ends with us.
00:11He said, sorry, I missed the sexual harassment course.
00:15That sounds really bad when you remember that this whole thing started with Blake Lively
00:21accusing him of sexual harassment on the set while they made this movie.
00:26So, what's shocking is this video, which we're about to play for you, was submitted in the case by Justin Baldoni himself.
00:34And when you dig down, there is a reason Justin submitted it.
00:38Right.
00:39And I think it's an important reason.
00:40So, what you're about to see is they're getting ready to shoot a scene in a bar.
00:46This is behind-the-scenes footage.
00:48You're going to hear a lot of voices, but you will hear Justin there.
00:52Blake is standing off to the right.
00:54And Jenny Slade is there.
00:57It's important to talk wardrobe.
00:58As you watch this, realize they're all in PJs.
01:02Right.
01:02This scene was the scene in the movie.
01:04If you haven't seen it, they're in the bar.
01:07Everyone is wearing pajamas, I guess, to get free drinks.
01:11I'm told I haven't seen the movie.
01:13But anyway, that's the context.
01:15But listen to what he says, and then we'll break down why this actually could help him in this case.

01:36Ma'am, do you have a toothpick?
01:37Yeah, right here.
01:48Ready, everyone.
01:49High energy.
01:51Have fun.
01:53It's not the first thing.
01:54It's funny you're at a bar.
01:55Have fun, right?
01:56So, with this, it's, he was joking.
02:05I mean, he says sexy because it wasn't sexy and it was kind of a joke.
02:09Making a joke like we're all standing around in onesies, oversized onesies.
02:13And then he tells the joke, which I've heard a million times.
02:17Oh, I miss the sexual harassment training.
02:19And so, what he's, what it really shows, not only was it a joke, but Blake seemed cool with it.
02:25Yeah, I mean, she's saying.
02:27At the end of the whole exchange.
02:28It's all good at the end of the exchange where it obviously lingered with him.
02:31And he said, I just want to make clear that I'm apologizing.
02:33She says it's all good.
02:35It's also used in his documents as, look at this context.
02:38We're in a crowded bar scene.
02:39Was I openly sexually harassing my co-star in a crowded bar scene?
02:44Some of her allegations, though, come up outside of this context.
02:46I think this will ultimately be helpful for him.
02:48But some of them are, you know, talking about her breastfeeding more privately, going into her dressing room.
02:54Those are her allegations.
02:56And he has an answer to that.
02:57He says she invited me into that trailer when she was doing that.
03:00So he has different answers for different things.
03:01But the bigger thing is there is a scene that Blake improvised.
03:08The kissing scene.
03:09The kissing scene.
03:10There's a scene at a hospital where part of his argument in getting this case thrown out is that Blake wasn't just an employee on this set.
03:17She controlled it.
03:18She doctored the script.
03:19She improvised on her own.
03:21And there's a scene where she's kissing him and it wasn't in the script.
03:25And so if you think about it, if the shoe were on the other foot and he had done that, this would be exhibit A in her lawsuit.
03:32Well, his point is at the time when that hospital scene was shot, that was after she had made the allegations on set.
03:39There was a big meeting between the entire crew where they talked about new boundaries and they said there would be no more improvising.
03:48And he's making the point that even after that meeting, in a scene that she wrote, she's improvising a kiss.
03:54And not just improvising, improvising a kiss.
03:56That's right.
03:56His larger point is it's rich for you to say, I was improvising in a sexually harassing way when you were the only one improvising on set to kiss me.
04:03So this case is headed for trial next year.
04:07And I got to say that, you know, everybody's talking nuclear option now with politics.
04:14The nuclear option in this case is if Blake actually takes it to trial, Justin is going to call Taylor Swift to the stand.
04:22I have no doubt about it.
04:24And when Taylor Swift testified.
04:25Because remember, she was in the, she ended up being at Blake and Ryan Reynolds' home when Justin had come over to talk about the script.
04:35And according to Taylor, she was set up by Blake to show up then because Taylor had no idea, Blake, that Justin was going to be there.
04:44And she feels totally betrayed by Blake.
04:47Look, if that comes out on the stand, that Blake Lively betrayed Taylor Swift, there is no jury, I believe.
04:56It does not cut well with a jury.
04:57Yeah.
04:58Good luck.
04:59I mean, she's the most popular person on earth, potentially.
05:01So what does she do?
05:02Telling the jury.
05:02So what does she do?
05:03Does she try to settle it?
05:05How do you settle it at this point?
05:07Well, you're saying she has to settle it because that nuclear option is out there.
05:10But she's been winning a lot of these battles along the way.
05:13His whole offensive suit against her is out the window.
05:15This is just Blake's lawsuit.
05:18And so she's won a lot of the legal battles.
05:20But you're right, there's what's looming is this Taylor problem she has in front of a jury.
05:24What ultimately matters is, does she win or lose the war?
05:28Does she win anything if a jury says sorry?
05:32It's a great point.

05:35And really, where is the welcome to hell moment from all of this?
05:38We've seen so much footage from this movie.
05:40So many things have come out.
05:41And yet there's no moment where these two actors ever seem uncomfortable.
05:44This seems like a really friendly moment.
05:46It looks like she's laughing at the joke.
05:48We see that kiss scene going on in the movie.
05:50And it seems fine.
05:51But somehow this is justifying a $161 million lawsuit on a movie that made a ton of money.
05:56If they stayed in, they would have made a fortune working together on the sequel.
05:58But that's never going to happen.
06:00And yeah, this lawsuit just looks like a giant joke right now.
06:02I think it's a disaster for everybody.
06:04Yes.
06:05I don't know how anybody backs out of this now.
