00:44the organising lawyer for the detained Biafra Republic agitation leader had on Wednesday said
00:49in a written and video statement posted on his ex-social media account that, Namdi Karnu is
00:56competent enough to defend himself, especially given the, political elements, in the case which
01:02he understands better than any lawyer. In a press release issued and made available on Friday,
01:08IPOB in the statement signed by Emma Powerful, said it, strongly condemns the new round of fake
01:14news being pushed by certain Nigerian media outlets. The false claim that Mazi Namdi Karnu has,
01:21forfeited his right to defence, in the ongoing trial before Justice James Kolawole Omatosho of the Federal
01:27High Court, Abuja, is a desperate lie meant to mislead the public and cover up an illegal process.
01:34Let the truth be clear, Mazi Namdi Karnu has not forfeited anything. What is happening in court is
01:41not a fair trial but a political show. Up till today, neither Justice Omatosho nor Chief Adigboi Agbaruamalo,
01:48San, the government's lead prosecutor, has been able to point to any valid, existing law that
01:54Mazi Namdi Karnu supposedly broke. Their silence speaks volumes. It is a quiet confession that this
02:01entire case has no legal foundation. The core question remains simple. Can anyone be prosecuted
02:08or convicted without a living law that clearly defines the offence and prescribes a punishment?
02:13The answer is written in section 36, 12, of Nigeria's 1999 constitution. A person shall not
02:22be convicted of a criminal offence unless that offence is defined and the penalty therefore
02:27is prescribed in a written law. This means you cannot charge or convict anyone unless the law
02:33exists in black and white. No judge or lawyer can twist that. The Supreme Court has said the same
02:40thing many times. In Aoko vs. Fagbemi, 1961, AG Federation vs. Abu Bakr, 2007, and NNPC vs. Fawahinmi,
02:511998. Where there is no law, there can be no trial, no conviction, and no justice. But instead of obeying
03:00this clear rule, Justice Omatosho keeps trying to force Mazi Namdi Karnu to open his defence,
03:06as if pretending there's a valid case will make it real. This is wrong, it's a misuse of power and a
03:13clear violation of fair hearing. You cannot force a man to defend himself against a ghost charge.
03:20So we ask again, under which law is Mazi Namdi Karnu being tried? What act of the National Assembly
03:27defines his supposed offence? And by what right does a judge compel a defence where no offence in
03:33law exists? Nigerians deserve honest answers, not propaganda. Everyone should read section 36,
03:4112, and know their rights. It protects all of us from tyranny. Any court that ignores the
03:47constitution becomes part of the problem, not the solution. IPOB fully supports Mazi Namdi Karnu's
03:55stand in refusing to legitimise this illegality by entering a defence. The truth is unshakable.
04:01No valid law supports this case, none whatsoever. Now, Justice Omatosho says he will give judgment
04:09without even allowing final addresses from both sides. That's laughable and unheard of in criminal
04:15law. If that is truly his position, then maybe he needs to go back to law school and learn what due
04:22process means.
