Sia got a huge W in her divorce from her second husband ... his emergency request for full custody of their son was just shot down by a judge.

00:00So yesterday we told you about this battle between Sia and her estranged husband.

00:04It's a really nasty custody battle with some very nasty allegations being hurled back and forth.

00:11Well, today, Sia has won a battle in this war.

00:15So her husband went into court and said,

00:19even though right now she has primary custody, I only have monitored visitation,

00:24he wanted it changed to the exact opposite, where he had sole custody,

00:28she had monitored visitation, and he said the reason was she had struggled with substance abuse.

00:35What the judge said was, listen, that ship has sailed because when you guys reached an agreement in August,

00:41we knew about her past struggles.

00:43She was very open about it, and she is sober, and she is fine now.

00:48And she has, by the way, volunteered for drug testing, said you can do drug tests anytime you want.

00:54She says he has not agreed to do it on his part, but she has on hers.

00:58And the judge said, look, nothing's changed.

01:00We all knew about this stuff.

01:02Yeah, and I'm not going to change this order on any emergency basis,

01:04because basically the judge said there's no emergency.

01:07Like, the whole point that her husband was trying to make was this has to change because there's some emergency.

01:12Yeah, he'd have to show that there was an imminent danger to these kids,

01:15and he's not able to show, because to the point that you were just making,

01:18all these allegations were out there already.

01:20The real loser in this is the kids of the cross allegations here are brutal of substance abuse,

01:25but also the allegations that she's made about him.

01:27There's child pornography elements in this.

01:30Listen, at the time they reached this agreement in August,

01:33there was an active LAPD investigation on him for child pornography.

01:40That investigation has since been closed.

01:42No charges have been filed.

01:43He's denied it.

01:44Right.

01:44But that's why he had monitored visitation.

01:47The judge did not change the monitored visitation.

01:50Yeah, that's right.

01:50That stays the same still.

01:52So big victory for her to the battle.

01:55The war isn't over.

02:32really just do what's in the best interest of the child.
