NewsTranscript
00:00And welcome to Hannity and breaking tonight, former FBI Director James Comey facing potential perjury charges over allegations that he lied to Congress.
00:09Now, Fox News is told that a grand jury is meeting to consider an indictment.
00:14There are also tonight multiple reports that New York Attorney General Miss Get Trump, that would be Attorney General Tish James,
00:23while she may be in trouble for mortgage fraud, we will have all the details coming up tonight straight ahead.
00:28Also tonight, part-time governor, full-time Tweety Bird, full-time podcaster Gavin Newsom, my friend, just can't get my name out of his mouth, keep it out of his mouth anyway.
00:38I got a friendly message for him coming up in my response.
00:42I know Tweety Bird is watching. Stay tuned for that.
00:45But first tonight, an urgent warning for America.
00:48This is serious. The dehumanizing, demonizing, overblown, hyperbolic, never-ending, obsessive, compulsive, 24-7 deranged condemnation of President Trump,
01:01his administration, ICE, and law enforcement agents, conservatives in general, needs to stop.
01:08Needs to stop now.
01:09Now, look at where we are at this moment as a country.
01:17Apparently it's not there.
01:19All right, two weeks, but we'll show you something in a minute.
01:21Now, two weeks removed from the assassination of Charlie Kirk, America woke up to yet another act of targeted political violence.
01:28A 29-year-old man opened fire at an ICE facility in Dallas this morning in what the Department of Homeland Security is now calling an attack on ICE law enforcement.
01:38The FBI director, Cash Patel, shared images on social media of literally unspent ammunition with the words anti-ICE written on it.
01:48And as of now, this seems very deliberate.
01:50Luckily, no ICE agents were killed or injured in the attack.
01:54Sadly, one ICE detainee was killed.
01:57Two others were seriously wounded.
02:00And remember, this all comes amid a massive spike in threats against ICE agents.
02:06Pay close attention.
02:08You know, I've never seen anything like this in my law enforcement career.
02:11I've never seen threats on law enforcement, specifically ICE, increase the way it is.
02:15You know, we're up over 1,000 percent assaults on officers right now.
02:17And really, just a lot of the talk that's out there, a lot of the rhetoric is just the violence directed towards law enforcement officers just trying to do their job.
02:26And we're just keeping seeing it increase step by step.
02:30This is old, painful.
02:32It is sad.
02:33It is tragic.
02:34It's also preventable.
02:36We are now officially trapped in a sick, twisted, evil assassination culture.
02:41But how do we get here?
02:42Now, first, to be clear, unlike the left, they would openly blame conservatives if some lunatic, you know, were to shoot a conservative.
02:50They tried to say, blame Bernie Sanders.
02:52I said, no, I don't blame Bernie Sanders for what happened on that ball field way back in the day.
02:58On this show, we will be specific.
03:00You can never blame anyone but the person that actually pulls the trigger for any act of political violence or any other type of violence.
03:08Now, but we can no longer deny that the insane, never-ending, dehumanizing rhetoric from the left is so out of control, as President Trump himself wrote on Truth Social earlier today.
03:22Radical left Democrats, they are now constantly demonizing law enforcement, calling for ICE to be demolished, comparing ICE officers to Nazis.
03:30You can add calling them Gestapo and brown shirts, and we'll show you that in a minute, and worse.
03:36Now, Trump, in the same message, called on Democrats to stop this unhinged rhetoric against ICE and law enforcement right away.
03:44And he's right.
03:45It needs to stop.
03:46You know, this is what we hear.
03:48Racist, fascist, Nazi, Hitler, Stalin, Mussolini.
03:52Never stops.
03:53It's every day.
03:55It needs to stop.
03:56This is what it sounds like.
03:57Donald Trump's modern-day Gestapo is scooping folks up off the streets.
04:03As somebody who understands history, when I see ICE, I see slave patrols.
04:08The dangers that we saw in, you know, Nazi Germany are the dangers that we need to react to now.
04:16And these ICE agents running around our communities like masked bank robbers, terrorizing women.
04:26Masked ICE agents.
04:28No badge.
04:31No identification.
04:32Grabbing people off the streets.
04:35Masked secret ICE agents are snatching and arresting immigrants.
04:39Women who are selling fruit on a corner are people who are trying to survive day-to-day as day laborers are car washes.
04:48People are beginning to complain now because car washes aren't open.
04:51Why would you prey on a car wash unless you're preying on that car wash because you know those are very vulnerable workers?
04:58And another $30 billion to hire and train ICE agents who have functionally become a secret federal police force with expanding domains.
05:08Are coming and kidnapping and disappearing people on the streets of the United States.
05:14We have ICE federal agents pulling up, terrorizing our communities, hopping out of unmarked vans, stealing and, yes, kidnapping people.
05:23An authoritarian government in Washington, D.C. is dispatching masked agents to abduct immigrants from our streets.
05:32That is not justice.
05:34It is cruelty.
05:36And it is criminal.
05:37$175 billion in the bill that was just signed to reinforce the ranks of ICE homeland security for what is increasingly becoming self-evident to anyone with eyes wide open and any level of objectivity.
05:59A private army for Donald Trump.
06:02Private army, we'll respond to Gavin in a minute now.
06:06Secretary Noem, she has to now live in military housing for her safety.
06:10Our border czar, Tom Homan, he has a full-time security detail because of the rhetoric of radical Democrats around the country.
06:18He says he doesn't live with his family because he doesn't want them to face the same threats that he is facing.
06:26He took a public service job.
06:28He is enforcing the law.
06:30Ice agents are enforcing the law.
06:34And now in the case of Tom Homan, it's costing him access to his own family.
06:38It's not a joke.
06:40Shots have been fired.
06:41People have been killed.
06:43It's not the 1930s.
06:45We don't live in Nazi Germany.
06:47This is not fascism.
06:48This is not Stalin.
06:50This is not an authoritarian country with a dictator in charge.
06:53This is the United States of America.
06:56Our country can be and should be and hopefully will be better than this.
07:02Our elected officials should be better.
07:05The legacy media mob is just as bad and they have been complicit and they use the same rhetoric, the same language.
07:13These talking heads on the left, radical Democrats, get a grip on reality.
07:17You know, the daily refrain, as I said, racist, Nazi, fascist, Hitler, Stalin, Mussolini, wash, rinse, repeat.
07:26You know, you do it every day.
07:27It's having an effect cumulatively.
07:30If you look at what's happening here is when deranged people hear this day in and day out, hour in, hour out, every second, every minute, every hour of every day that this garbage in and out and Republicans are horrible people and you can't trust the police, you can't trust ICE, you can't trust conservatives.
07:50They're all Nazis, fascists, Gestapo, brown shirts, people who are not well to begin with, they are hearing every word you are saying.
07:59It is having a dehumanizing impact and effect.
08:03And is it really that far-fetched to ask if people on the edge already at this point actually might start to believe that they're doing good by getting rid of Nazis with acts of violence?
08:17And maybe even believing, oh, I'm helping God's will on earth because they have been indoctrinated to believe the people they target are actual Nazis because they hear it every day.
08:30A refrain that they're hearing from supposedly respected public figures.
08:35Here now with more is Trump, Bordazar, Tom Homan.
08:38I won't give the details.
08:41I did run into you accidentally once at a restaurant.
08:46And when I started to walk, oh, there's my buddy Tom.
08:49I started to walk over and an army stood up.
08:53And I asked you, I said, is it that bad?
08:55And you said it was.
08:56And now you've gone public with how bad it is.
08:59Tell us.
09:00Yeah, it's a death threat level I've never seen before.
09:05It started, you know, right after the RNC.
09:08You know, you were there.
09:09I gave a speech at the RNC.
09:10The death threat started the day after.
09:11And I talked about the terrorist organizations.
09:14I'm going to be wiped off the face of the earth.
09:15Then when President Trump got back in office, I said in March, Sean, back in March, I said, if this hateful rhetoric doesn't stop, there's going to be bloodshed.
09:24Someone's going to die.
09:24I've seen this movie before.
09:25I've been doing this for 41 years.
09:27It's never been this bad.
09:29And, of course, the left said I was crazy.
09:31But there's already been three shootings just in Texas.
09:33There was a shooting at a CBP facility trying to kill a Border Patrol agent.
09:38He picked the wrong facility.
09:39That was a SWAT training facility.
09:40And, you know, they killed him.
09:42Then there was another thing just south of Dallas where they attacked an ICE facility and an officer got shot in the neck.
09:48Now we have this, another assassination, and where, you know, an alien died.
09:53And it's just – and I'm telling you, I'll say it again.
09:55Unless the rhetoric stops, it's not over.
09:59And it's just – it's scary.
10:00I'm afraid for the men and women of ICE every night.
10:04Every night I go to bed.
10:05And I pray for the men and women of Border Patrol and ICE that they go home safe to their families.
10:08They're American patriots.
10:09They're enforcing the law.
10:11And it's just – I've never seen anything like this in my entire career, and that's 41 years.
10:16You know, what's so ironic about this is these – what are they actually trying to accomplish here?
10:24For four years, they told us the border's closed.
10:27They lied – flat out lied to us.
10:28For four years, they said it was secure.
10:30Mayorka said it.
10:31Harris said it.
10:32Biden said it.
10:33They all said it.
10:34Democrats said it.
10:35Media were complicit.
10:36They didn't cover the story except probably Fox News and maybe a few others.
10:40I don't know who.
10:41And meanwhile, we have anywhere between, what, 12 and 20 million unvetted illegals among them,
10:49known terrorists – and correct me if I'm wrong when I tell my audience that – known terrorists are in the country.
10:55We know there are murderers.
10:56They wouldn't stand for the family of Lake and Riley at the joint session speech in Congress.
11:00The Democrats wouldn't stand.
11:01They wouldn't stand for Jocelyn Nungary's family, a 12-year-old girl brutally raped and murdered.
11:06You know, but we have murderers, rapists, other violent criminals, cartel members, gang members, and drug dealers.
11:12Am I summing that up pretty well?
11:14Absolutely.
11:15What people need to understand, every morning I look at 22 pages of data for the last 24 hours.
11:21Approximately 70 percent, 7-0, of everybody ICE arresting is a criminal.
11:26Who is the other 30 percent?
11:27Many are non-suspected terrorists or national security threats.
11:31They don't have a criminal history because they're laying low to do the dirty deed.
11:34And many are final orders.
11:35People had due process, been ordered removed by a judge, became a fugitive.
11:39ICE isn't out there separating families.
11:41And, you know, it's – I want people to know, ICE officers are – they're fathers and mothers and sons and daughters.
11:47They don't hang their heart on a hook every day they go to work.
11:49They're enforcing the law.
11:51And they're making the community safer.
11:53I just gave you the real data.
11:54They're making the community safer every day.
11:57And they're under deep threat.
11:58You know, you mentioned, I do have a security detail.
12:00I feel bad because every ICE agent don't have a security detail.
12:03They're actually out doing this job.
12:05I don't – you're right.
12:06I don't live in my family just because of this threat.
12:08But my family understands.
12:09They don't want me to stop doing this.
12:11And I'll tell you something else.
12:12The ICE agents are going to continue doing what they're doing,
12:14making this country safe again because President Trump made that promise to American people.
12:19They're going to keep doing the job.
12:20We're not going to change a thing because we're going to keep doing what the American people voted Donald Trump in office for.
12:25ICE are heroes.
12:26They're patriots.
12:27They're making the streets safe every day.
12:29Every congressman and governor out there, bad mouth and nice, ought to be thanking President Trump for making their communities safer.
12:36They've removed hundreds, hundreds of criminals from the street.
12:40I looked at the numbers, over 200,000 arrests, 70% of that to do the math.
12:44Over 140 known criminals.
12:46And that's not counting the terrorists and that's security threats.
12:49ICE is doing a great job.
12:50You know, ironically, the summer of 2020, a couple of dozen dead Americans, thousands of injured cops.
12:58We had billions in property damage.
13:00But they said it's mostly peaceful.
13:02Summer of love.
13:03And Kamala Harris, they're not going to stop rioting.
13:06They shouldn't stop rioting.
13:07And we're not going to stop supporting them.
13:09Unbelievable times we live in.
13:11Please stay safe.
13:12And, yeah, we pray for your agents as well.
13:14Tom Homan, thank you.
13:15Now, earlier, we did show you some examples of the left demonizing ICE, almost every prominent Democrat in the country.
13:21But last night, another fresh example was added to the list from, well, part-time governor, full-time podcaster, full-time Tweety Bird, our old friend Gavin Newsom.
13:31Take a look.
13:33That's happening in the United States of America.
13:35Mass men jumping out of unmarked cars.
13:37People disappearing.
13:39No due process.
13:40No oversight.
13:42Zero accountability.
13:43Happening in the United States of America today.
13:44People ask, well, is authoritarianism you're being hyperbolic?
13:48Bulls**t, we're being hyperbolic.
13:49If you're a black and brown community, it's here in this country.
13:54Oh, maybe that's why California is a sanctuary state and has so many sanctuary cities and so many benefits for illegals.
14:02Newsom, today, in the wake of the attack on the ICE facility in Dallas, he told FoxNews.com that he condemns political violence and attacks on law enforcement.
14:10This is the same Gavin Newsom who, on Saturday, signed a bill into law banning ICE agents from wearing masks in California.
14:20Oh, maybe those guys would be identified.
14:22Maybe that's a version, I don't know, maybe, of doxing.
14:26And by the way, that would be blatantly unconstitutional, Gavin.
14:31No state government has that kind of power over ICE agents.
14:34Read it.
14:34It's called the Supremacy Clause.
14:36Federal agents are not in your control.
14:40And by the way, the jurisdictions with the federal government, glad I can help educate you.
14:46Also worth noting, according to Politico, the California Highway Patrol, according to this bill signed on Saturday, they're exempt from this mask ban.
14:55And guess who guards the governor at all times?
14:59Apparently, it's California Highway Patrol.
15:01Now, don't forget, ahead of the signing of that bill, Newsom's press office put a post on X saying that DHS Secretary Kristi Noem was about to have a bad day.
15:12What did that mean?
15:13Well, we asked Secretary Noem on Monday about that post.
15:17Here's what she said.
15:18Well, it was cryptic.
15:20And it was really menacing.
15:22I would say, Sean, it immediately panicked my family and friends within, I would say, a couple of minutes of that being posted.
15:29When you get a post like that by a governor, immediately, you know, my staff and family think, what is going on?
15:36What does he mean?
15:36And we're trying to figure it out.
15:38So, you know, this is a day and age where we've always known that words matter.
15:42But there's been real consequences that we have realized that have happened to incredible people like Charlie that we'll have to live with forever.
15:52Apparently, Gavin Newsom doesn't like our very honest critique of him.
15:56He's going after me while talking to the very low-rated, not very funny, Stephen Colbert.
16:01Take a look.
16:02I never imagined it would break through like it has and get under the skin of the president of the United States and some of my friends.
16:10Some of your friends?
16:12Who are these friends?
16:12Some of my friends.
16:13Who are these friends?
16:14Some of, well, and some of my friends on, you know, Pravda, Fox.
16:20It was Hannity, all these guys, outraged, offended, disgusted because we put a mirror up to Trump and the absurdity of what's going on in this country.
16:30No, it's just, it's not real.
16:32It's not authentic.
16:32You're not Trump.
16:33So tonight, here is my message to the part-time governor, full-time Tweety Burke, full-time podcaster who pretends to run the state of California.
16:40Gavin, we were old friends.
16:43Maybe it's time to stop tweeting, stop podcasting, start governing your state.
16:48Now, you can attack me all you want, and I will gladly respond.
16:51Gavin, California's in serious trouble.
16:54People are leaving your state in droves because of failed government policies.
17:00You have the highest income tax in the country, highest sales tax, highest gas tax.
17:04Massive deficits, in spite of all the taxes, rampant, out of control, homelessness.
17:09You've had, well, how is it possible California in Los Angeles had empty fire hydrants and an empty reservoir, according to reports,
17:17in Los Angeles during what are predictable wildfire seasons and predictable Santa Ana winds.
17:24And why haven't the people, the owners of those homes, why aren't they getting the permits so they can start rebuilding?
17:30They want to rebuild their lives, Gavin.
17:31Why don't you worry about them?
17:33I'm not that important.
17:34Plus, out of control crime across your state, you know what, your state sanctuary policies,
17:40all it's doing is aiding and abetting and rewarding those that did not respect our nation's laws and borders and sovereignty
17:49by providing taxpayer-funded benefits.
17:52No wonder you can't balance your budget out there.
17:54Even with the sky-high taxes, and you don't even keep stats on crimes committed by illegals in your state of California.
18:02Why is that?
18:04You know, your time as governor is running short.
18:07You know, you got a little over a year left in office.
18:10Maybe focus on actually bringing the people of California and the country together,
18:14make the world a better place.
18:16And then if you want to run for president, good luck.
18:18You can run on your record.
18:19Good luck with that, too.
18:20And on your tweets.
18:22Anyway, free advice that you won't listen to.
18:24Here with more.
18:25California Republican gubernatorial candidate Steve Hilton.
18:27I don't know what to make of it.
18:30I mean, in all honesty, I did at one point have a good relationship with Gavin, then it gets hostile.
18:37And we actually had a really good exchange over Charlie Kirk.
18:40I can disclose that part.
18:43And then this happens, you know, on Saturday.
18:45What is going on out there?
18:48Well, I just don't know, Sean.
18:50He's turned into this ridiculous fool, this puffed-up buffoon of a governor now
18:55with these pathetic juvenile posts on X, trolling the president,
19:01his increasingly bizarre hand gestures all the time.
19:04Meanwhile, as you say, nothing is being done to solve the problems that they created.
19:09I could add to your list of everything going wrong in California.
19:12Right now in California, we have the highest unemployment rate in America.
19:16We have the highest poverty rate in America.
19:20The highest costs for everything that matters.
19:22Because electricity, gas, housing, rent, everything is a disaster.
19:26We've got the worst business climate.
19:28All because of their far-left ideological crusades, including on climate that's making everything so expensive.
19:34What's he doing about any of that?
19:36Absolutely nothing.
19:38And in many ways, you could say it's probably just as well that he's not doing his job as governor.
19:43Because when he is doing his job, he just makes everything worse.
19:47Look, we need a change in California.
19:49That's why I'm running for governor on all those issues.
19:52We've got to focus on making life better for working-class Californians, for small businesses.
19:56I used to be a small business owner.
19:58They're being crushed by these policies.
20:00And when you talk about crime and the border and the sanctuary state policies,
20:04we need a governor that is going to enforce the law and work with the president and the administration
20:10to enforce the law as well and turn things around.
20:13We can't let California continue to slide into decay and decline like this.
20:18Is there a number how many billions of dollars are spent on services?
20:24And that would be Medi-Cal, I believe you call it your state medical care and schools and law enforcement, et cetera.
20:33Any numbers, any estimates about how much the state is spending on illegal immigrants based on the sanctuary state policy that they have?
20:42Yeah.
20:43I mean, you can certainly identify the number on health care because that was a new program.
20:47But Gavin Newsom bragged about adding.
20:50And then also he lied about it.
20:52He said that he was restricting it in response to the outcry.
20:55But in this year's budget, the spending has gone up from just over $9 billion to over $12 billion just on the health care part.
21:02And you look at the way I'm across the state the whole time.
21:05Schools are being completely overwhelmed.
21:08Students are there who don't speak English, disrupting education for everyone else.
21:12Our housing crisis, you've got so many people here overcrowding.
21:16They won't build homes because of their new, their ridiculous environmental regulations.
21:20And they won't admit the problem because their ideology gets in the way.
21:24We need practical common sense policies in California, just as President Trump has shown the effectiveness of that at the national level.
21:32And here in California, we can have that, too.
21:35We just need to vote for change next year.
21:38You know, the interesting part to me is I actually think he was on the right track talking to people like Bannon and Charlie Kirk.
21:45Exactly.
21:45Having a conversation about disagreements and, you know, when he spoke to me.
21:51That Gavin seems to be gone.
21:53And it's like invasion of the body snatchers.
21:55I guess he wants to be president.
21:56He was not gaining traction among the radical base in his party.
22:01So now he's going to be the most anti-Trump, the most vitriolic.
22:05Maybe it helps him politically get the nomination.
22:10I don't think that's going to resonate.
22:11I don't think America wants to beat California at the end of the day.
22:14Last word.
22:15But it's also hurting the country, Sean, because as well as all this trolling, there's really dangerous rhetoric coming out of Gavin Newsom.
22:23Just days ago, he put out a video saying we need to, quote, punch our opponents in the mouth.
22:30That is reckless and irresponsible.
22:31He's got to stop pandering and do his job.
22:35We'll see what happens.
22:37We're going to follow your campaign, your race out there, just like the race in New Jersey, the race in Virginia.
22:43Hard races to win for Republicans.
22:45But you know what?
22:46Maybe there's a tipping point here where they've had enough of the rhetoric, enough of the insane policies.
22:50Exactly.
22:51Steve Hilton.
22:51Thank you, sir.
22:52Up next, huge breaking news tonight.
22:55The Department of Justice is now seeking to indict former FBI Director James Comey for lying to Congress.
23:01We'll have a live report.
23:02We'll get the latest and reaction from Greg Jarrett.
23:05Nicole Parker will join us.
23:07Oh, Jimmy Kimmel's back.
23:09So, straight ahead.
23:11And breaking today, Fox News has confirmed that the Department of Justice is now seeking to indict former FBI Director James Comey for lying to Congress in September of 2020.
23:29Our very own Kevin Cork is here with the very latest.
23:32Kevin.
23:32Sean, if you're like many Americans and you've been waiting for justice, you know, for less talk and more perp walk, well, that time may finally be at hand.
23:41President Trump's handpicked U.S. attorney in Virginia, Lindsey Halligan, is reportedly planning to ask a grand jury in the coming days to indict former FBI Director James Comey for allegedly lying to Congress.
23:53Now, the probe into Comey centers on whether he lied, as you pointed out, during his September 30th, 2020 testimony about his handling of the investigation into Russian interference in the 2016 presidential election.
24:08And this is key.
24:09Under federal law, prosecutors have exactly five years to bring a charge.
24:13The five-year mark in this instance occurs next Tuesday.
24:17Still, critics note that a months-long investigation into Comey by a since-removed DOJ prosecutor failed to establish probable cause of a crime.
24:27But the president, as you know, has been critical of Comey for years over his handling of that investigation.
24:31And you may remember he fired him back in 2017.
24:35And this is actually interesting as well, Sean.
24:37We have news tonight that Comey may not be alone in facing an indictment soon.
24:41There are reports tonight that New York AG Letitia James could also be indicted in the coming weeks, something we will keep a very close eye on.
24:51But for now, back to you.
24:53All right, Kevin Cork, thank you.
24:54Great coverage this weekend as well.
24:57Now it's about time the DOJ does take action against Comey.
25:00House Oversight Committee Chairman James Comer has come on this program many times,
25:05pushing for Comey to be held accountable for his 2020 testimony.
25:09For example, take a look.
25:11We've got to hold people accountable for wrongdoing.
25:14Brennan and Comey perjured themselves to Congress.
25:19They should be held accountable.
25:21The committees where they testified and lied to Congress, which you said is a felony,
25:26they need to have criminal referrals to the Pam Bondi Department of Justice,
25:33and we need to see some accountability.
25:35All right, here with Reaction are Fox News legal analyst Greg Jarrett,
25:39along with Fox News contributor, former FBI special agent, Nicole Parker.
25:43So this is how I see this going down today.
25:45He likely got a target letter, Nicole.
25:48You can explain to people what that is.
25:50That was likely leaked to MSDNC.
25:52He knows that it would be about false statements because we know the people that the House Oversight Committee have interviewed.
26:00The grand jury meets tomorrow.
26:03It would either be tomorrow or Tuesday if, in fact, an indictment came in all likelihood, maybe Friday.
26:09And that the statute of limitations, as Kevin said, are up.
26:13So you're very familiar with this process.
26:16Let's get into it.
26:19Right.
26:19So first of all, I'm also very familiar with James Comey because I worked under him when he was the FBI director.
26:24And I can tell you that in talking to current and former FBI special agents,
26:29this is something that those at the FBI want to see more than anybody, frankly,
26:33unless you were one of what they call Comey's homies,
26:36which there were individuals at the FBI, Sean, that actually adored Comey.
26:40They had mugs and they said literally Comey's homies on him and T-shirts and all these things.
26:45Look, that's ridiculous.
26:46Everybody else at the FBI knows that James Comey is the one that really brought down the entire FBI,
26:51which it has never recovered from.
26:53You know, when someone receives a target letter, they're basically being put on notice.
26:57You're being looked at.
26:58They haven't actually been charged.
27:00And so what I think should happen, in my opinion, is that if James Comey lied under oath,
27:06Title 18 United States Code Section 1621 is perjury lying to Congress under oath.
27:12That is a federal violation.
27:13Or Title 18 U.S. Code 1001, making a false statement made to a federal officer or to a body,
27:20which could include Congress, making a material and made knowingly a false statement,
27:25he could also be charged with that.
27:27And so I think that we all have heard over and over, no one is above the law.
27:32And you know what, James Comey?
27:33You're not above the law either.
27:34The statute of limitation is expiring.
27:36And let's see what DOJ does with this.
27:39All right.
27:39I want to get your thoughts on this, Greg Jarrett, from a legal standpoint.
27:43And of course, you did two number one bestselling books on this.
27:46But I would add to that, would FISA abuse be a part of it?
27:51Because he signed, correct me if I'm wrong, three of the four FISA warrants,
27:54ruined Carter Page's life, backdoor into Trump, his campaign, transition team, and presidency.
28:02And they knew, if my memory serves me well, correct me again if I'm wrong,
28:06in December, when they said bye-bye to Christopher Steele,
28:11that in fact that dossier was BS.
28:14And did he legally have an obligation to go back to the court?
28:18Tell us what you think about that part of the legal aspect as well.
28:22Well, it should have been brought a long time ago.
28:25And unless you weave it into an ongoing conspiracy,
28:27the statute of limitations on the FISA lies by Comey and others has expired.
28:35You know, Hillary invented the Russia hoax, Sean,
28:38but it was Comey that drove the narrative to falsely incriminate Trump,
28:43knowing full well it was all a lie.
28:45And frankly, there were so many acts of corruption and deceptions and misfeasance.
28:50You need an elaborate flow chart to keep track of it all.
28:53But, you know, these reports indicate that this particular case focuses on whether Comey
28:59leaked highly classified information to a non-FBI friend who passed it on to the media.
29:05And when questioned by Congress, Comey allegedly lied about it repeatedly.
29:11And indeed, on more than one other occasion,
29:14he denied that he had ever been an anonymous source.
29:18But the evidence belies that claim.
29:21In fact, his own deputy director, Andrew McCabe, implicated Comey as complicit in leaks of
29:26sensitive information.
29:28Other top officials at the FBI confirmed Comey was a prodigious leaker,
29:33often to improve his image and smear Trump.
29:37Whether a grand jury will indict, we'll have to wait and see.
29:40There's certainly been disagreement in the U.S. attorney's office.
29:43Reportedly, some prosecutors don't think they can prove a case beyond a reasonable doubt at trial.
29:48It's a very high standard.
29:50But, you know, even if perjury or obstruction is not brought against Comey,
29:55he's not in the clear.
29:56The FBI director said he discovered burn bags, other hidden documents,
30:00squirreled away in the building during Comey's tenure involving the Russia hoax.
30:05I mean, that could also be fresh evidence of wrongdoing in a conspiracy case.
30:11We just don't know at this point.
30:13The grand conspiracy aspect investigation confirmed by Kash Patel, that to me is where people need to look
30:20because that would then, that pushes away the statute of limitations.
30:26All right.
30:26I appreciate both of you.
30:27Nicole, thank you.
30:28Greg, thank you.
30:28And up next, tonight on Hannity.
30:30Part of the problem is I really did not fully embrace the reality of how people felt.
30:38Kamala Harris' book tour is in full swing as one report reveals Democrats today are seething over her tell-all.
30:47And we'll explain that.
30:48Oh, and Jimmy Kimmel, back on the air last night after a brief suspension.
30:52Joe Concha weighs in with the latest.
30:54Straight ahead.
30:57All right.
30:57Last night, Jimmy Kimmel made his dramatic return to late night after nearly one week off the air.
31:02Kimmel did not apologize for his comments that led to a suspension.
31:06Predictably, he just went after Donald Trump and blamed him.
31:11It's not his blame.
31:12David Portnoy, Barstool said it best in an ex-post earlier today.
31:16I think he nailed it.
31:17If Kimmel came on and apologized like this the day after his remarks, he probably wouldn't have been suspended.
31:23But by all accounts, he wanted to double down, again, for the billion time.
31:29This isn't a free speech issue.
31:31He works for Mickey Mouse on network TV.
31:34Nobody said he was going to jail.
31:37He was dealing with the consequences of making off-color jokes about the murder of a guy who meant a ton to a ton of people
31:45and blamed it on the very people who loved him the most before the body was even cold.
31:52So, yeah, there was outrage that Mickey had to deal with.
31:55Then the pendulum swung the other way.
31:58They put him back on the air.
31:59Either way, it was never a free speech issue.
32:02And for the record, ABC said it was their decision.
32:06Now, also, it's interesting that, you know, there have been many, many well-funded efforts.
32:13I've dealt with this for decades by left-wingers trying to get me, and not just me, many other conservative voices fired and boycotted.
32:24I don't remember any liberal ever standing up for any of us.
32:27Here was a reaction.
32:28Fox News contributor, Joe Concha.
32:29There was no uproar, conservatist.
32:32Fire Jimmy Kimmel.
32:33Because everybody knows you have something called freedom.
32:36You don't like the show?
32:38Hit the button.
32:40That's what most people, he'll get a spike, and then it'll slowly dissipate because it'll go back to being, you know, a Trump-hater full-time.
32:48Oh, of course.
32:50And Jimmy Kimmel actually agrees with David Portnoy, believe it or not on this, Sean,
32:53where at least, well, the 2018 version of Kimmel agrees with him.
32:58Here's what Kimmel said in 2018 after Roseanne Barr got fired by ABC.
33:03Quote, you could say what you want, but networks don't have to pay you to say it.
33:07That's what he said before he cheered on her firing.
33:10So that is an absolute hypocrite that you're seeing on your screen.
33:13And last night, as you say, Kimmel just couldn't apologize the right way.
33:17Instead, he took the weasel way out by saying, well, if anyone was offended by what I said, I mean, give me a break.
33:23And then he lied over and over again, again.
33:26Kimmel claimed that Trump is the reason why Stephen Colbert is going off the air.
33:31No, it's because he's losing $40 million a year for his network over at CBS while making $20 million a year himself.
33:38I mean, have these people even run a lemonade stand?
33:41How hard is this to get from a business perspective?
33:43And then Kimmel made himself the victim, saying Trump did the same thing to him,
33:46which is really odd because how, again, was Jimmy back on the air last night if Trump has the power to control the media?
33:53So that's a rhetorical question, Sean.
33:55And speaking of free speech, again, the hypocrisy is so pure you could snort it completely.
34:01Elizabeth Warren said this in 2021.
34:03Quote, Trump is a danger to democracy and must be kept off the air.
34:07And then she applauded Facebook and Twitter for banning Trump at the time.
34:12Here's Elizabeth Warren just yesterday.
34:14When someone uses their government position to threaten speech they don't like,
34:18that undermines the First Amendment and our entire democracy.
34:22I could give you dozens of examples from Biden to AOC to Kamala saying the same thing
34:27and embracing censorship by weaponizing it when it's against their opponents.
34:31But now that one of theirs is now suddenly the victim, more of a victim, I guess, than Charlie Kirk who was executed,
34:37then suddenly they do a 180 when it comes to now suddenly embracing free speech.
34:42It's an absolute joke.
34:43Well, we've been playing this montage, Jen Psaki and Tim Walls.
34:47Let me play it now so our audience can see it.
34:51And, you know, now the ones that are lecturing everybody on free speech.
34:54Let's play it.
34:54You shouldn't be banned from one platform and not others for providing misinformation out there.
35:03I think we need to push back on this.
35:04There's no guarantee to free speech on misinformation or hate speech, and especially around our democracy.
35:10There are Americans who are engaged in this kind of propaganda.
35:16And whether they should be civilly or even in some cases criminally charged is something that would be a better deterrence.
35:26Look, if people go to only one source and the source they go to is sick and, you know, has an agenda
35:33and they're putting out disinformation, our First Amendment stands as a major block
35:39to the ability to be able to just, you know, hammer it out of existence.
35:43This is a matter of corporate responsibility.
35:46Twitter should be held accountable and shut down that site.
35:48It is a matter of safety and corporate accountability.
35:51The First Amendment is not absolute.
35:54It does not protect any single thing anyone says.
35:58And there are limits, and that's important.
36:00I believe that when it comes to broadcast television like Fox News,
36:05these are subject to federal law, federal regulation in terms of what...
36:11Oh, we'll give you the last word, Joe.
36:15Pain is temporary, film is forever.
36:18Wouldn't it be nice to have a media that would play those clips back to those people
36:22when they get interviewed on the CNNs and MSNBCs of the world?
36:25Boy, that would be nice.
36:26The great Tim Russert used to do it.
36:29You just did it now.
36:30But fortunately or unfortunately, they're too much of a coward to actually go in front of real journalists
36:34to play back their own words to them and say, what's changed, AOC?
36:38What's changed, Hillary?
36:39What's changed, Goofy Tim Walls?
36:41It's just not going to happen.
36:42Good point.
36:43We appreciate you.
36:45Joe Concha.
36:46Up next tonight on Hannity.
36:48We've got to stop demonizing each other.
36:50Now, I think most of that right now in our country's history is coming, you know, from the right.
36:57All right.
36:58Hillary makes that comment, stop demonizing each other.
37:01The moments later, put all of the blame on Republicans.
37:05LJ, Lawrence Jones is next.
37:07Stay with us.
