00:00Silicon Valley is a place where people's dreams can turn into reality and when you succeed in
00:15Silicon Valley it's awesome you make it big you're making a lot of money but it can also
00:21be a place where those dreams can turn into nightmares sergeant Sandra Brown Palo Alto
00:27police department Silicon Valley has advanced so much since I was a little girl it has become the
00:33epicenter of technology throughout the entire world it's amazing I spent my career investigating
00:40major crimes in Silicon Valley like Janine Harms Janine was working in Silicon Valley and she
00:49was doing really well there she was a woman who was handling millions of dollars of contracts you
00:55just had this sense that she was taking the world on and then everything changed she's never not
01:04shown up for work and that's when I was like oh god something is really wrong it was big news all over
01:12Silicon Valley police have received dozens of tips from the public but nothing that looks like a case
01:18breaker you know how can this get any worse I knew Janine since we were infants our parents were friends
01:44so that's how we were drawn together and as we got older we chose each other as good friends if you
01:54were to meet her on the surface you would like her because first of all she was beautiful and she had a
02:00really good sense of humor cake and Neapolitan ice cream is all I have to say a lot of the humor was
02:07very self-effacing so she came off very human as well as being beautiful people were naturally drawn to
02:14her she had two older brothers Craig was the oldest Wayne was second oldest then Janine was third can you
02:26say hi to the camera hi camera they were pretty close family and their family had a very sort of
02:33sarcastic humor they were all really funny people I see myself a little bit in Janine Harms we both grew
02:47up in the Bay Area Janine Harms went to San Jose State and I went to San Jose State we're roughly the
02:55same age but she graduated with a degree in liberal arts and I graduated with a degree in criminal justice
03:02Janine was hired straight out of college for Amdal Corporation which was a major company in Silicon
03:11Valley for its time she had a job as a purchasing agent and she was doing really well there had been
03:19promoted like five times I think really loved what she was doing and loved her co-workers and was very
03:26happy with her job there Amdal was a great reputable company here in Silicon Valley they made mainframe
03:34computers and the founder had worked at IBM before and came up with a way to use its technology to build
03:42his own company I think it was a really good company for her to work for Amdal built and sold mainframe
03:48computers and they were one of IBM's main competitors in that market for many years during Janine Harms time
03:55in Silicon Valley I mean she was a woman who was handling millions of dollars in contracts and back
04:00during those days there were not a lot of women in Silicon Valley she was a hard worker she committed
04:07herself to her job she put in long hours staying late and going in early that's the woman she was she loved
04:15what she did and she loved working for that corporation and when we talk about the tech bros guess what Janine
04:21Harms was a tech bro Amdal which was making these mainframe computers couldn't keep up with IBM's
04:29technology so they started having a really hard time they started laying off people you know Silicon
04:37Valley companies go through layoffs and Janine had gone through a couple to where she was worried about
04:42her job but she always survived them her boss at Amdal I know that he thought a lot of her and
04:48probably helped her save her jobs during these layoff times for Janine even though things at work
04:55were getting a little bit more difficult in her personal life she just met a man named Randy Harms I
05:01didn't know a lot about Randy before she decided to marry him which was weird I was a little shocked by the
05:10the whole thing when I found out she was getting married but you know I was supportive they seemed
05:16to get along it's too bad it didn't last I wanted her to be happy she was moving up in her career at
05:24Amdal and I don't think he was in a similar position in his career I think they just grew apart and he
05:32wasn't the person that she wanted to grow with in April 2001 the apartment next to my mom's apartment
05:45was vacant so I asked Janine if she wanted to move in and she did she was having a really good time
05:52living on her own she was living the life right then she was really really having a good time she made
06:00good money but she did like to spend money too she loved to go out and shop she bought her dream car
06:10which was a Ford Mustang black and she immediately ran out and got racing stripes for it and she loved
06:17driving it there's absolutely a work hard play hard mentality in Silicon Valley she really was
06:27disciplined at work was always on time and I think for her to blow off steam after work it's all part of
06:36just getting through life in Silicon Valley there's a lot of stress she was very motivated to find
06:44somebody after her and Randy divorced and so that drove her to go out more she used to go out a lot on
06:53the weekends to a couple bars in Los Gatos and meet people that way things were looking pretty good
07:00for Janine Harms she had survived the layoffs she'd survived a divorce from her husband and then
07:08everything changed July 27 2001 I saw Janine at her house she was getting ready to go on this date she
07:25came out and said goodbye and that was the last time I ever saw her she had reluctantly made a date with
07:35this guy who was being real persistent with her they had made a date a couple of weeks earlier and she
07:42blew him off he just kept being persistent so she reluctantly agreed okay I'll just meet you for a drink
07:50she had asked me if I could go and I had already had a date and was going to the movies I wasn't really
08:00sure what was going to happen I just left when we went to the movies and that was it I was very
08:10curious to hear the next day like what ended up happening did you meet him I think I left a message
08:17on her home phone and her cell phone was going straight through to voicemail which I thought was odd
08:22odd so I called her at work Monday morning and she didn't answer and I thought that was odd too
08:32because she used to pick up her work phone so I called Chiggy and said have you seen Janine since
08:40some Friday night and she said no I mean her car is here but I haven't talked to her and her windows
08:48are closed at that point I decided to call back to her work and ask for one of her co-workers she
08:56said you know we're really worried about Janine she didn't have a day off planned and this is not like
09:02her she's never not shown up for work and that's when I was like oh god something is really wrong
09:08Chiggy ended up being the one to call the police when the officer got there I had a spare key when
09:19you open up the door you're looking right into the living room and what I saw was the couch with no
09:27cushions on it and there was no rug I knew right then something terribly was wrong why would the rug and
09:36couch cover and the cushions be missing when I looked in her bedroom I could still see the
09:42indentation where she had sat on the bed to put her shoes on so I knew the bed hadn't even been
09:47touched in addition to the Persian rug and the cushions from the couch being missing her car keys and her
09:55wallet were missing the odd thing about that was Janine's car was still parked in her driveway so if she
10:03went somewhere she didn't drive her car by the time I got there Chiggy and the police officer were already
10:11there but at the time the police officer didn't seem all that concerned because it was clean there was no
10:18signs of a struggle there were no broken dishes or knocked over tables it was a very odd scene there
10:27was nothing was roughed up in the house but the items that were missing were extremely suspicious in
10:36other words these aren't things that people would steal they wouldn't just come into a house and take two
10:42cushions Chiggy and I both knew there's something really wrong this is not like Janine at all so I
10:49think it took a lot of us explaining to the police no this is not normal where's her purse and her keys I
10:57was just a wreck all I could think of was the guy that Janine met that night something happened
11:04something bad happened when Los Gatos police arrived at the scene they're looking for the missing person
11:15simple as that is the missing person in the house well they don't find the missing person she's not
11:20there so obviously what they're going to do is check for signs of force entry they did that there were
11:26none the place was clean didn't have any signs of struggle there were no signs of blood the house was
11:36swept for fingerprints and her house appeared to have been wiped down because they didn't find
11:43fingerprints they didn't even find Janine's fingerprints so that's another clue that
11:49something's gone wrong Janine played the guitar she had a guitar over in the corner they picked it up
11:56they dusted it there were not even any prints of Janine's on the guitar there was just complete lack
12:03of evidence in the house but certainly there was evidence that Janine had not left on her own to go
12:12somewhere the police were pretty sure that this was foul play Janine was in the middle of a divorce with
12:20her husband Randy now typically if we have a homicide we would look at the husband is it possible that Randy
12:31harms discovered that his wife was going out with other men could that be a motive of course it can be
12:36so they did delve into Randy harms they found out that Randy harms was out of state the night that Janine went missing
12:48Janine's friends knew that she had a date with someone that Janine was not really excited to see but they didn't know the
12:57name of the fellow she was meant to meet so her work was called we didn't know the guy's name she
13:07was with and we were certain that that guy must be the one that has her I called her co-worker and
13:14said did Janine tell you the name of the guy she was meeting and Marcia goes hold on I'm gonna check the
13:20calendar and on Janine's calendar at work she had written Alex and a phone number on Friday night and
13:28so Marcia gave that to me and I gave that to the police and they found the person associated with
13:34that phone number I remember that the police having a funny look like yeah it's Alex Wilson he's the son of
13:47the former mayor of Santa Clara and we're like oh wow that's interesting it was almost like okay you
13:57gotta tread lightly I guess if his father was the mayor of Santa Clara Santa Clara sits just northwest of
14:06Los Gatos and it's full of tech bros Alex Wilson came from an old Santa Clara family everyone knew the
14:17Wilson name in Santa Clara and the fact that his father's a former mayor it raised a lot of intrigue
14:25even red flags could there be power and influence that could influence the case police went to interview
14:35Alex Wilson once they had his name and he was very reluctant to talk to them but ultimately he gives the
14:46police or readers digest about what happened Alex says he showed up about a half hour late for the date
14:55with Janine and Janine was already there talking with another group of people so he approaches and he
15:03too also joins their group and he notices that Janine is giving a lot of attention to a short stocky guy
15:10slightly balding and he's annoyed by this because she's supposed to be going out with him so after
15:17sitting with this group of folks at some point Alex Wilson claims she invites both of them to her home for a
15:24nightcap but he decided that he didn't want to go so Alex ultimately said he never went to Janine's home
15:34immediately we think we really have to look at this guy Alex Wilson is a person that Janine was meeting
15:42that night Janine didn't want to meet him she'd blown him off once she wanted a buffer when she was going
15:49to meet him the second time I heard he was pretty rude with the police he was annoyed with Janine and he
15:57actually used the term she's a psycho bitch now that's interesting right Alex had not been cooperative
16:06and there's two ways of looking at that he's not cooperative because he didn't have anything to do
16:12with it or he's not cooperative because he did the police didn't know whether or not he was a good
16:18suspect so they continued their investigation they impounded Alex Wilson's car they brought a canine
16:28dog to his car and a canine dog looking for the scent of Janine Harms hit on that car
16:36not only did the canines pick up something on the back seat of the car
16:44there was a shovel and a set of maps located in the trunk of that car that pointed to Alex Wilson's
16:54family's property located on Mount Hamilton in East San Jose what are the odds that you're going to find
17:01a shovel what are the odds that you're going to find a map and what are the odds that the canine's
17:06going to hit on the missing victim's odor in the back seat of Alex Wilson's car
17:10all that leads to me thinking this this guy is my number one suspect
17:16they still haven't found Janine's body where's her body could it be somewhere on Alex Wilson's property
17:25in the days after Janine's disappearance investigators are looking at Alex
17:40Wilson as number one suspect who happens to be the son of a Silicon Valley well-known family
17:47this is a case with foul play a missing woman you think the worst has she been buried
17:58police got a search warrant and did a thorough search of that property owned by the Wilson family
18:08they send out cadaver dogs canines who go out and start searching this property
18:13they didn't get a hit they searched the property they have nothing
18:19so they can't go forward with Alex Wilson
18:23there were really two reasonable explanations for the canine dog hitting
18:29either it was a scent that Alex Wilson had on him from Janine Harms
18:35or it was more sinister than that she had been in the car
18:40but we can't prove he's involved
18:43he's one of the last people to see her
18:48he had a bad attitude toward police
18:52he had a shovel in his car but that isn't really enough to say that he was involved with her disappearance
19:00so they start looking at other possibilities in this case
19:05Janine had been missing for several days
19:11it was big news all over Silicon Valley
19:14it was on the news it was on the front page of the paper
19:17still no sign of Janine Harms
19:20her disappearance made national television last weekend
19:23and police have received dozens of tips from the public
19:26but nothing investigators admit that looks like a case breaker
19:30the Janine Harms case was a huge story
19:34but the DA's office and the Los Gatos Police Department
19:39used the media to hopefully get clues and hints from the public
19:45because when a person goes missing
19:48you need information
19:51once Janine disappeared
19:54there was a huge effort to find her
19:57her friends started websites
20:00we had an anonymous tip form posted on her website
20:07in case anybody had information
20:08they could submit anonymously
20:10that was pretty impressive during that time
20:13considering internet technology was relatively new
20:16her company Amdahl
20:18they contributed money as well
20:20in the search effort
20:22at this point Alex Wilson knows
20:28wow I'm a suspect
20:29he's not talking to police anymore
20:32but police obviously now have Janine's car
20:37the technician dusting Janine's car
20:41lifts a single print
20:43after lifting that print
20:46they put it into the system
20:48when they run the print
20:50they actually get a hit
20:52everyone expects it to be Alex Wilson
20:55but they're way off
20:57it comes back
21:00to 37 year old
21:01Maurice Nazmi
21:03Maurice was a Berkeley educated architect
21:07who had a job with a local firm
21:11with startups popping up left and right
21:16being an architect
21:17was a good job to have in Silicon Valley
21:20during the tech boom
21:21and just like the tech bros
21:26Maurice was very active
21:28in the local nightlife scene
21:30the reason the police were able to link
21:33the fingerprint
21:34to Maurice Nazmi
21:36was because of a drunk driving arrest
21:39Maurice Nazmi is a match
21:44for the description provided by Alex Wilson
21:47of the short stocky almost balding man
21:49so now the police have his contact information
21:55and they proceed to his home
21:56when they first made contact with him
22:00he is very cooperative
22:02he starts talking to them
22:05and he's going along with the program
22:06he admitted
22:09that he had been with Janine Harms
22:13and admitted
22:14that he had drinks with her
22:17Maurice's version of what happened
22:21on that Friday night
22:22he said he was hanging out
22:25with some colleagues
22:26Janine was sitting at the bar
22:29one of his colleagues invited her to join their group
22:33but at some point another man
22:37Alex Wilson approached Janine
22:38and he joined the group
22:40and then Janine invites both of them
22:43to her home for a nightcap
22:45he said Alex Wilson was going to come with us
22:49but then he decided not to
22:51we picked up a six pack of beer
22:54then we went to her place
22:58they go in
23:02she starts playing her guitar
23:06and they just kind of hang out for a while
23:10he's saying that
23:11they came back to her house
23:13they drank a couple of beers
23:15then she fell asleep on the couch
23:18and he left
23:21but the weird thing was
23:24Maurice claims
23:25that when he was leaving her house
23:27he saw somebody else
23:28kind of walking up towards her house
23:31the way he described that person
23:34it sounded like he was describing Alex Wilson
23:37there are pieces of Maurice Nazmay's story
23:43that's not adding up for investigators
23:45and specifically there's one piece
23:48that's really not adding up
23:49Maurice said that Janine played the guitar
23:54so why doesn't Janine's guitar
23:58have her fingerprints on the guitar?
24:01and I also find it strange
24:03that he said they brought the beer
24:04they drank the beer
24:06but they didn't find any beer bottles
24:08you drank beer
24:09you had a six pack of beer
24:10you guys were drinking
24:11what happened to the beer
24:12and the empty bottles?
24:14so Maurice tells them
24:15well
24:15I took the beer
24:17and I also took the empty bottles
24:18I just didn't want to be rude
24:21or I just took them with me
24:22let me tell you something
24:24that's suspicious
24:25okay?
24:26who takes two empty beer cans
24:27with them?
24:29talk about a red flag
24:30the things that he said
24:33it just didn't add up to me
24:34like she fell asleep on the couch
24:36that's just not Janine
24:37she just doesn't do that
24:39it just seemed weird to me
24:41the whole story seemed weird
24:42and completely out of character for her
24:44I remember thinking to myself
24:48that Maurice
24:49this just sounds like
24:50the guy that did it
24:51Maurice Nazmay now is a suspect
25:02in the Janine Harms disappearance
25:04he claims
25:06when he was at her home
25:07that she fell asleep
25:09and that's how he left her
25:11the investigators find this
25:14to be very suspicious
25:15police get a search warrant
25:19for his car
25:20and the car is
25:22impounded
25:23and searched for evidence
25:26Nazmay says he has not
25:29cleaned the car
25:29but it looks pretty darn clean
25:31they sweep the car for DNA
25:34they sweep it for fingerprints
25:37during the search
25:40they locate 27 unknown fibers
25:44in the back of Maurice Nazmay's jeep
25:46they know
25:49that the Persian rug is missing
25:52fibers lifted
25:54from the green jeep
25:56may well match the Persian rug
25:58but they don't actually have
25:59the Persian rug
26:00so everything is held in evidence
26:03Maurice Nazmay ultimately hires
26:06a very well respected attorney
26:09in the valley
26:10and after that
26:12he invokes his right
26:14not to talk to us
26:15and he refuses to take a polygraph
26:20at that point
26:25it just became
26:26just very frustrating
26:28like okay
26:29these answers
26:30that we wanted to get so quickly
26:32it's just taking forever
26:34it was frustrating
26:36just sitting and waiting
26:37and you know
26:38time is ticking
26:39whatever the police
26:41were working on
26:42they weren't always
26:43forthcoming with us
26:45so we weren't really
26:45up to speed
26:46on what was going on
26:47in the investigation
26:48this started out
26:50a difficult case
26:51and it continued that way
26:53for a while
26:54because
26:55it was the lack of clues
26:57that had investigators
27:00and prosecutors
27:00scratching our head
27:02it was basically
27:03a cold case
27:04for a couple of years
27:05Janine's family
27:07was just heartbroken
27:08by this situation
27:09I had many many phone calls
27:12with her mother
27:13promising her
27:14that we're not going to
27:15give up on this case
27:16we have to do something
27:18we can't just sit back
27:20and wait
27:20and wait
27:21and wait
27:21gosh it was tough
27:23on the whole family
27:24especially Wayne
27:26Wayne loved Janine
27:30but
27:31Wayne I think
27:33had some moments
27:34where he was a little
27:35too antagonistic
27:36with her
27:37and I think
27:39his
27:40past relationship
27:42with Janine
27:42kind of
27:43ate away
27:45at him
27:46I know myself
27:49I was
27:50trying to stay hopeful
27:52that
27:52Janine was going to come back
27:54because
27:57without her body
27:58it can let your mind
27:59wander into thinking
28:01things that
28:02maybe there is
28:04a different explanation
28:05for it
28:06even though I know
28:07there's probably not
28:08you can think of
28:10all sorts of weird things
28:11when you don't have
28:11a real answer
28:12or proof
28:13of what happened
28:14as we're all
28:20scratching our heads
28:21on how to
28:22make this case
28:23a stronger one
28:24we decided
28:25why don't we get
28:27the picture of the rug
28:28and run it
28:29in the newspaper
28:29we didn't even know
28:30at that point
28:31if we had a photograph
28:32of the rug
28:33it was something
28:34Chigi came across
28:35and was like
28:36oh this is
28:36you know
28:37I have a picture
28:38of the rug
28:38my mom had a camera
28:43when she died
28:44and on the camera
28:45was a roll of film
28:46and so I had it developed
28:48and it just so happened
28:49that on that roll of film
28:52the last picture
28:53on the roll
28:53was a picture
28:54of the rug
28:55with my son
28:56standing on it
28:56if they could find
29:00the rug
29:01that would carry
29:03this case forward
29:04but the rug's been
29:05missing for two years
29:06this is a total
29:08long shot
29:09but the police
29:10decided to put
29:11a picture of the rug
29:13that was missing
29:13in the newspaper
29:15it was crazy
29:17it was a long shot
29:18but we took it
29:19and that's when
29:21we hit the jackpot
29:22unbelievably
29:25the police
29:26get a phone call
29:27from a woman
29:27who says
29:28about two years ago
29:30I found a rug
29:30similar to that
29:31and I took it
29:33and brought it home
29:34it was found
29:36near a large dumpster
29:38a couple of miles
29:40from Janine's house
29:41Janine's landlord
29:45and one of her best friends
29:47had given her that rug
29:49and she told us
29:50that there was
29:51a distinct mark
29:52on that rug
29:53a few of the tassels
29:55were singed
29:56police immediately
29:57went out
29:58to look at the rug
29:59and sure enough
29:59it had
30:00little singed tassels
30:02they confiscate the rug
30:06take it in for evidence
30:07when the wool fibers
30:11removed from the back
30:13of the green jeep
30:14are compared to fibers
30:17coming from the Persian rug
30:19they match
30:22police on December 16th

30:27arrested Maurice Nesme
30:30for the murder
30:31of Janine Harms
30:32it's a weird feeling
30:36when you find that out
30:37because
30:37I was happy
30:39that they arrested him
30:40I was really happy
30:41but it still
30:43doesn't bring her back
30:44you know
30:44but yeah
30:45it was a good feeling
30:47knowing he was finally
30:47in custody
30:48I remember
30:50thinking
30:51and hoping
30:52that maybe
30:53now that he's under arrest
30:55he would confess
30:56to what he did
30:57with Janine
30:58and we would be able
30:59to find her
31:00and bring her home
31:01this case is layered
31:11with tragedies
31:12and I think it
31:13centers on
31:14the amount of time
31:14that the family
31:15has had to wait
31:16for an answer
31:16evidence was presented
31:21that showed
31:22that these fibers
31:23from the Persian rug
31:26were found
31:26in the back
31:27of his jeep
31:29and Maurice Nesme
31:32was arrested
31:33because of that evidence
31:34the case all
31:37came tumbling apart
31:39when the criminalist
31:41who worked
31:42in the Santa Clara County
31:43criminal lab
31:45was determined
31:46that he did not
31:46have proper certification
31:48to come to that conclusion
31:50they now have to
31:53resubmit that fiber evidence
31:55to another technician
31:56it's going to take
31:57about a year
31:58as they send it out
32:00other cases are coming in
32:01and the fibers
32:03have to go through
32:04probably 10 different
32:05processes
32:06so unfortunately
32:07it does take
32:08a lot of time
32:09at this point
32:11Maurice Nesme
32:12has been held
32:13in custody
32:13for two years
32:15awaiting trial
32:16in 2007
32:20Maurice Nesme
32:22says
32:23I have a right
32:24to a speedy trial
32:25and I'm going to invoke
32:27that right now
32:29and at that point
32:31the judge
32:32dismissed the case
32:34because the people
32:34were not prepared
32:35to try the case
32:37so after he was
32:40in jail
32:40for two and a half years
32:41they had to release him
32:42we were just
32:44you know
32:45understandably
32:46devastated
32:48and frustrated
32:50like
32:50oh my gosh
32:51you know
32:52how can this
32:52get any worse
32:53there's a lot
32:56of evidence
32:57that he murdered
32:59Janine Harms
33:00but he's out
33:01people are not
33:02comfortable with that
33:03some people are worried
33:05that something else
33:05is going to happen

33:32we were told
33:36that they fully planned
33:38to re-arrest him
33:39after they have
33:40a new fiber technician
33:42analyze the evidence
33:43and they were going to
33:45hire the best in the
33:46country
33:46and they felt
33:47this was going to
33:47take about a year
33:48and then it didn't
33:50take a year
33:51we'd constantly
33:52be calling the DA
33:53and they'd constantly
33:54tell us
33:55oh it'll be another
33:56six months
33:56it'll be another

33:59and it just went
33:59on and on
34:00the wait
34:03was so long
34:03and I believe
34:05that Wayne
34:07poor Wayne
34:10after she went
34:12missing
34:12I think he really
34:14had demons
34:15from that point on
34:17he felt like
34:18he should have been
34:19more of a protector
34:20for her
34:21and I think it just
34:24ate away at him
34:25on January 15

34:34is sitting in a
34:35popular restaurant
34:35watching a hockey game
34:37at the bar
34:37when Maurice Nesbitt
34:40walks into the
34:41restaurant with a
34:42date
34:42they settled
34:45next to him
34:45and they struck
34:47up a conversation
34:48and somewhere
34:49during that
34:49conversation
34:50Wayne realized
34:51who he was
34:52they got into
34:53a little bit
34:54of a confrontation
34:55Wayne probably
34:57confronted him
34:58and said
34:58hey I know
34:59who you are
35:00and then Wayne
35:02left
35:02went home
35:05and came back
35:08by this time
35:12Maurice has moved
35:12to a coffee shop
35:14Wayne walks in
35:16and there's
35:18pandemonium
35:19in the coffee shop
35:20Wayne tells
35:43the date
35:44to get out
35:45of the way
35:45and with one shot
35:48he murders
35:49Maurice Nesbitt
35:50oh my god
35:53he shot somebody

35:58the employees
