Elon Musk's Bid To Dismiss OpenAI's Harassment Lawsuit Denied By Court

Elon Musk will face OpenAI’s counterclaims alleging a years-long harassment campaign after a federal judge rejected his motion to dismiss, according to Reuters. U.S. District Judge Yvonne Gonzalez Rogers ruled Tuesday that Musk’s press statements, social media posts, legal actions, and “sham bid” for OpenAI’s assets provide grounds for the case to proceed. Musk originally sued OpenAI and CEO Sam Altman over the company’s for-profit shift, while OpenAI countersued in April, accusing him of fraudulent business practices. A jury trial is set for spring 2026. Musk has recently accused Apple of antitrust violations, alleging it blocked xAI’s Grok app from topping App Store rankings in favor of ChatGPT. Altman called Musk’s actions “remarkable” and accused him of using X to promote his ventures while undermining rivals. Musk’s $97.4 billion bid for OpenAI failed earlier this year.
