00:01Your dog was out of your control,
00:03entered her home, severely injuring her dog into her house.
00:12There was blood all over the place.
00:15It was a mess.
00:17This is Judy Justice.
00:30Karen Burrow-Threlkeld is suing her neighbor, Mark Soifer,
00:40for vet bills and property damage
00:43after his pit bull attacked her chihuahua.
00:46Court coming to order, all rise.
00:50Have a seat, everyone.
00:53Hello, Judge.
00:54Case number 1106, Burrow-Threlkeld versus Soifer.
00:58You're welcome.
00:59Mr. Elkeld, how long have you lived
01:01across the street from each other?
01:02We don't live across the street from one another.
01:05You live on the same side?
01:07Yes.
01:08How long have you been living in your home?
01:1031 years.
01:11And Mr. Soifer, how long have you been living in your house?
01:14I closed on it May 7th of this year.
01:16Mr. Elkeld, are you immediately adjacent to the defendant,
01:21or are you separated by a house?
01:24We're separated by six homes.
01:26Do you happen to have a photograph?
01:28Yes, I actually do.
01:31The house?
01:32I'd like to take a look at it.
01:34I have them according to the order.
01:43Oh, so there's a good deal of distance between the two houses.
01:45Yes, ma'am.
01:46Yes, ma'am.
01:47Mine is the very last one.
01:49This is your house?
01:50Yes, ma'am.
01:51Mr. Soifer, this is what her complaint is, and this is what she's asking for.
01:56Ms. Elkeld says that a dog that belongs to you got out of your house, which is six houses
02:05away from hers, and somehow got into her house through a doggy door.
02:10What kind of dog do you have?
02:12A pit bull mix.
02:13How much does it weigh?
02:1435, 40 pounds.
02:16And what kind of dogs do you have?
02:17I have a Chihuahua and two miniature Schnauzers.
02:21So relatively small dogs?
02:23Yes, ma'am.
02:24And this is your daughter.
02:25She was involved in that incident that day.
02:28Somehow, your dog got loose from your control for whatever reason, got in to the defendant's
02:37house, inside her house, and inside her house, your dog attacked one of her dogs, causing
02:45serious injury to that dog and making a mess in the house in the process because there was
02:53blood all over the place, and it was a mess.
02:56In order to try to get your dog back while this was going on, your daughter, from your
03:03house, because you had just come in, according to you, from unloading paintings that you had
03:09just bought for the house, your door was open.
03:12That's how the dog got out.
03:14You say the dog was chasing her dogs that were out in the street.
03:17I don't care.
03:18Her dogs didn't come into your house.
03:20From your house, your daughter ran after your dog and tried to get into the house by crawling
03:28through the doggy door.
03:30So far correct?
03:31Yes, ma'am.
03:32You can stand up.
03:35She crawled in through the doggy door, couldn't get all the way through, but was able to reach
03:42up and open the door from the latch, which allowed the door to open.
03:47Is that what happened?
03:49Yes, ma'am.
03:50And when you got inside Ms. Threlkeld's house, what did you see?
03:55I didn't actually go inside the house.
03:58Where did you see your dog?
04:00As soon as I opened the door, she ran out towards the other dog.
04:03Her other dog was in the yard.
04:05Yes.
04:06Did you see the dog that had been injured inside the house?
04:09Yes.
04:10What kind of dog was it?
04:12I'm pretty sure Chihuahua.
04:14Did you see blood?
04:15Yes, ma'am.
04:16How did your dog get out of Ms. Threlkeld's house?
04:21Through the door.
04:22After you opened it?
04:23Yes, ma'am.
04:24So you opened the door, did you go back out through the doggy door?
04:29Yes.
04:30And then you walked into the house?
04:32No, I did not go inside the house.
04:34The dog, when you opened the door, ran out?
04:38Yes, ma'am.
04:39And you saw in the house the Chihuahua with blood?
04:43Yes, ma'am.
04:44And then, according to you, you saw your dog go after the other dog?
04:50Yes, ma'am.
04:51What kind of dog was the other dog?
04:53I have no idea.
04:55Was it a small dog or a big dog?
04:58Small dog.
04:59So, that was probably one of the miniature Schnauzers?
05:03Yes, ma'am.
05:04Did you see what your dog did to the miniature Schnauzer?
05:08No, ma'am.
05:09Where was your father?
05:11He was at the gate, but he was not able to get inside the yard.
05:15He was at the gate?
05:16Mm-hmm.
05:17How did you get inside?
05:19I went through the gate, because it was wide open.
05:21Okay.
05:21So, you went in through the gate, and did you see why your father couldn't get into
05:26the gate?
05:27Karen wouldn't let him in the backyard with my sister.
05:30Oh, so he was with your sister?
05:32Yes, ma'am.
05:33So, he came running after your dog to her house, and she wouldn't let him in the yard?
05:38Yes, ma'am.
05:39Was the Schnauzer injured?
05:41Yes, but I didn't realize he...
05:43Did the Schnauzer go to the vet, or just the Chihuahua?
05:46No.
05:47Just the Chihuahua.
05:48And it's the Chihuahua's vet bills, and whatever damage was done inside your house that you
05:55want Mr. Seifer to pay for.
05:57And the doggy door, when they went...
06:00And if the doggy door was damaged, that would have been as a result of this young lady trying
06:05to go through the doggy door?
06:07Mm-hmm.
06:08And my pain and suffering.
06:09The only one that's pained and suffering right now is me.
06:12No.
06:15Your dog was out of your control for three times the width of this courtroom into her house.
06:22What do you think could possibly be a defense for that?
06:26And later today...
06:28I asked you that question because I bought my husband a trike for a big birthday.
06:34He thought I was actually trying to kill him.
06:37Karen Burrow-Threekilt claims her neighbor, Mark Seifer, owes her vet bills and property damage after his pitbull attacked
06:43her Chihuahua.
06:44Mark is countersuing for negligence.
06:47Karen Burrow-Threlkeld claims her neighbor, Mark Seufer, owes for vet bills and property damage.
06:56After his pit bull attacked her chihuahua, Mark is countersuing for negligence.
07:02Mr. Seufer, you have no defense. Do you understand?
07:05You have no defense to the fact that your dog was out of your control, entered her home, injured her dog,
07:14your daughter, in an attempt to get back the dog, damaged her doggy door by trespassing in her house.
07:22Your suggestion that it's her fault because her dogs were free without a leash,
07:29if her dogs had caused any damage to your home if they were out without a leash,
07:35I would say, well, I'm going to hear that.
07:36But even if they were outside without a leash, that's not a defense for your dog.
07:42Your dog, much bigger, much more potentially aggressive, to be out of your control
07:48and to run six houses down into her house.
07:53Do you understand that?
07:54I would say that it's not six, but three houses.
07:57Who cares?
07:59How many houses separate yours from hers?
08:02Three.
08:02Three.
08:03So the dog ran three houses away.
08:06Yes.
08:07And your daughter ran three houses away.
08:09This is not next door.
08:11This isn't a common driveway.
08:12Was out of your control for three times the width of this courtroom.
08:18At least.
08:19Probably six.
08:21Out of your control.
08:22Into her house.
08:24What do you think could possibly be a defense for that?
08:28Well, I think it's also relevant that police issued citations, not to me, but to my neighbor.
08:35Then they were stupid!
08:36The animal control officer who showed up...
08:38Don't tell me what an animal control officer told you.
08:41I'm telling you, you bought your home, sir?
08:44Yes.
08:44So you have homeowner's insurance?
08:46Yes.
08:46In what state do you live?
08:48Missouri.
08:48Missouri?
08:49Yes.
08:49Did your insurance carrier ask you if you had a pit bull?
08:52No.
08:53Really?
08:54What insurance carrier do you have?
08:56Originally it was USAA, then became Safeco.
08:58I don't know which carrier on this date was my insurer.
09:02No, I'm just asking you, sir.
09:04Yes.
09:05Where in Missouri?
09:06Vineeto Park.
09:07What's the county?
09:08St. Louis County.
09:09St. Louis County, Missouri.
09:11Do you have anything interesting from St. Louis County, Missouri?
09:14I'll let you know.
09:15Okay.
09:16She's going to get back to me.
09:17So what you're telling me is, in Missouri, insurance carriers on homeowners insurance,
09:23don't ask you, if you have a dog, what kind?
09:27That's what you're telling me.
09:27Well, I've now had two different insurance carriers for that property, and neither asked
09:33me that question.
09:34And I don't recall them asking for the home that I sold prior to moving into that one,
09:41which was also in the same county.
09:43I have a couple of homeowners insurance policies in several states.
09:47Every single one asked me if I had a dog and if I did what kind.
09:51Maybe they don't in Missouri.
09:53That's a possibility.
09:54You have heard of that, have you not?
09:56Yes.
09:57Sure.
09:57Because some insurance carriers say, we're not going to cover you if you have this kind
10:01of a dog.
10:02That's on our dangerous dog list, right?
10:04Yes.
10:05There's a municipal stigma typically.
10:08It's not a municipal stigma.
10:10It's that some insurance carriers will not insure you if you have a particular kind of
10:15dog.
10:15Or they charge you an excessive premium if you have that kind of a dog.
10:20You have heard of that, sir.
10:21Yes.
10:21Did you ever hear of a chihuahua being on that list?
10:24No.
10:25How about a miniature schnauzer?
10:27No.
10:28But you have heard of a pit bull being on that list.
10:30Yes.
10:30So you know what that means?
10:31That means if you have a pit bull or...
10:34Sorry.
10:34Excuse me.
10:35There's a city ordinance actually for that exact town that says section 205-215, keeping
10:42or possessing a pit bull dog, no person within the city raised, maintain, possess within his
10:47or her custody or control of a dog of the pit bull breed.
10:51Did you know that?
10:53No.
10:53She's going to read it to you again.
10:55No person within the city raised, maintain, or possess within his or her custody or control
11:01a dog of the pit bull breed.
11:03And it says just that one dog?
11:05Or is it more than that one dog?
11:06It says pit bull breed is defined to mean any dog descending from the following bloodlines
11:10and it lists a list of dogs.
11:12Now do you understand, sir?
11:14Yes.
11:15Okay.
11:16So that means, and you seem like an intelligent man and your daughter is actually very truthful
11:20for which I...
11:21Your name is Naomi?
11:23Yes, ma'am.
11:23Naomi.
11:24Naomi is a truthful young lady.
11:26But what that means as an owner of the pit bull, A, what you're doing is against law, according
11:31to your city ordinance.
11:33But more than that, if you have a dog that you know has been identified as potentially dangerous,
11:38you can't let a door open and let that dog get out.
11:41And there is certainly zero defense for your dog getting out and going into her house and
11:49severely injuring her dog.
11:51There's no excuse for that.
11:53And now that you know and that you're on notice that what you're doing is against the law,
11:58so that means that the police that responded to your house and the animal control officer
12:04who responded to your house, they didn't know what the ordinance said.
12:08You're not making that up, are you, Sarah?
12:10No.
12:10No.
12:11Do you understand, Sarah?
12:12Yes.
12:12But giving her a citation to me means zero.
12:17How much were your vet bills?
12:18$1,369.49.
12:23And what was the damage to the interior of the house?
12:26The interior of the house is just my maintenance and cleaning it up.
12:31No.
12:32No.
12:32And what did it cost to fix the doggy door?
12:36$715.43.
12:39$715.57.
12:43That's $2,074.
12:45Did you ask the defendant for payment?
12:49Yes.
12:49Did you ask him in person or by phone or did you send him a letter or a text, a note?
12:55I actually put a copy of the bill in his mailbox and then on July the 3rd, I tried to talk to Mark
13:06and he told me at that time that the police and animal control told him not to speak to me
13:13and if I come back to his house for him to call them and I will be arrested.
13:19So I left it alone and filed my suit.
13:23Smart.
13:23Do you understand?
13:25Where I'm coming from?
13:26Yes.
13:26So they suggested that...
13:28Don't tell me what they suggested to you.
13:29I'm telling you, I just took the facts directly as they were relayed from your daughter, sir.
13:34I don't know what you told the police and I don't know what you told animal control.
13:41Did you return it?
13:42I returned, if not more of it.
13:45Oh, show me.
13:45I just deposited into the account.
13:49Were there any deposits made into the account by the defendant?
13:52No, ma'am.
13:52No, ma'am.
13:55Karen Burrow-Threlkeld claims her neighbor, Mark Seufer, owes for vet bills and property
14:11damage.
14:11After his pit bull attacked her chihuahua, Mark is countersuing for negligence.
14:17Now, you have more than ludicrous counterclaim for harassment and for her negligence in letting
14:24her dogs be outside unsupervised.
14:28Judging for the plaintiff in the amount of $2,074.
14:31Good girl, got it.
14:34Good thing to be honest, always.
14:36We're done.
14:37I would think twice about keeping that dog, sir.
14:39It's against the law.
14:41Court is adjourned.
14:44Well, it did become kind of a traumatic experience.
14:46When Mark stated that I received a citation, I didn't.
14:50We worked out amicably by avoiding each other at the very least.
14:54Actually, I just wanted Mark to know I forgive him.
14:57They saw the violence up close.
14:58I didn't.
14:59And that we're going to be neighbors.
15:01Do you know what was most disturbing to me about that case, and actually you earned your
15:05money on that case, is that if what he says is accurate, that both the police came and
15:12animal control, and the ordinance that you read was clear, to have done nothing in that
15:18scenario is actually outrageous.
15:20Case number 1066, Goddard v. Tekachenko.
15:24All parties, please step forward.
15:27Michael Goddard is suing fellow biker, Elrad Tekachenko, for money and property taken from
15:34their biker club.
15:35Mr. Goddard.
15:36Yes, ma'am.
15:37You ride motorcycles.
15:39Yes, ma'am.
15:39Two wheels or three?
15:41Two.
15:41I ask you that question because I bought my husband a trike for a big birthday.
15:47He thought I was actually trying to kill him.
15:50So did all of our friends, the thing that I was trying to kill him.
16:00He's allowed to ride it within the development.
16:03He's not allowed to take it outside in two-lane traffic.
16:09Every once in a while, the family catches him coming around the garage when he thinks
16:14nobody's looking to go to the bank.
16:17I find those things a little frightening.
16:20How long have you been riding a motorcycle, Mr. Goddard?
16:23Approximately 48 years.
16:25Pronounce your last name for me.
16:27Tekachenko.
16:28Tekachenko.
16:29Tekachenko.
16:30That's true, Mr. T.
16:31That would make it easier.
16:31That's how I was called in school, Your Honor.
16:33Mr. T.
16:35You have a little group.
16:36Yes, ma'am.
16:37How many people are in this little biking group?
16:40Currently, there are five.
16:42And Mr. T. was a recent inductee in the group.
16:46He was made the treasurer of the group.
16:48Your complaint alleges that as the treasurer of this group, he misappropriated some funds
16:54from the treasury.
16:56Yes, ma'am.
16:56How much?
16:57$120.77.
17:00And you're suing him for $661.
17:04That has to do with some patches that he has.
17:07Yes, ma'am.
17:08Allegedly.
17:09Club patches.
17:10Yes, ma'am.
17:10How did he come into custody of these club patches?
17:14As part of the treasurer's function, he's also responsible for the unassigned patches,
17:21which he would either give to people that were going to be inducted in.
17:27Well, there are only five people there now.
17:28How many patches did he have?
17:30Three main patches and other little ones that go with it.
17:34There's three sets.
17:36Each set contains six patches.
17:38Do you have those patches?
17:40I do, Your Honor.
17:40Great.
17:41Would you give them to me?
17:42I want to see what he's looking at.
17:44And was he voted out?
17:46He was voted in the club, and then you voted him out of the club.
17:49Yes, ma'am.
17:50Okay.
17:51We'll take them all.
17:52Just all.
17:53We'll take them all.
17:54Perfect.
17:54Patches.
17:55Perfect.
17:55Yep.
17:57And you're not the club treasurer anymore.
18:00Is that right?
18:00From what I understand, no.
18:02Okay.
18:02So give them the patches back.
18:03Now Mr. Goddard has the patches.
18:05So now we're talking about $120.77.
18:09You had a credit card that belonged to the company?
18:12That belonged to the club?
18:13To the club.
18:14Yes, I did.
18:15According to your answer, at least, you didn't have your own credit card once you ran into
18:20an emergency and you used the card for some personal expenses.
18:23I did.
18:24What personal expenses did you use them for?
18:26It was like some purchases at local stores.
18:30I honestly just ran out of cash that day.
18:33So I used it.
18:34Okay.
18:35He says you used it to the extent of $120.77.
18:38It's, I thought it was somewhere around $100, $120.
18:44Did you return it?
18:45I returned, if not more of it, because...
18:49Well, show me.
18:50I did, I just deposited into the account.
18:53Were there any deposits made into the account by the defendant?
18:57No, ma'am.
18:58Then you can show me, Mr. T, proof, if you have it, that you deposited money.
19:03I paid it all back, yeah.
19:05That's why this entire episode was kind of...
19:07I just, you acknowledged that you used their card for about the same amount as the plaintiff
19:13says that was withdrawn, which was $120.77, which he has proof of, I'm certain.
19:20Kevin, would you get that and show that to Sarah, please?
19:23She can just verify the amount.
19:25Okay.
19:26That I assume add up to $120.77.
19:31It looks about right, but I could do the math for you.
19:33There's a lot of little charges, like 15 or some odd charges.
19:38You've added it up, sir?
19:39Yes, ma'am.
19:40$120.77?
19:42Yes, ma'am.
19:44Yeah, $121.77.
19:46Okay.
19:46And there's no proof of repayment.
19:48So you have your patches?
19:50Yes, ma'am.
19:51$120.77, and what else do you...
19:53He has materials.
19:54Yes, ledges, account books.
19:57Okay.
19:57Are all those there?
19:59It's all here, ma'am.
20:04All set?
20:05Yes, ma'am.
20:05Now you have him back.
20:06Yes, ma'am.
20:07Okay.
20:08Is our work here done?
20:09Yes.
20:10Very good.
20:10Judgment for the plaintiff, $120.77.
20:12Everything else has been returned.
20:14Thank you very much.
20:15Court is adjourned.
20:16It was something that I did use.
20:19I'm pleased with the decision.
20:20I'm glad that the judge could see the truth.
20:23That I did repay.
20:23If he engages in any other club, he'll do the right thing.
20:28Obviously, I don't have proof of it, so it goes against me.
20:32You cannot get any respect from other clubs and the general community if you show any dishonesty.
20:40I don't expect to be part of that club in any way, shape, or form.
20:44Just in case anybody thinks that I am not a truth teller, that was for Poppy's 80th birthday, I believe.
20:52And I also can confirm that us grandkids also believed you were trying to kill him by getting him a trike for his 80th birthday.
