00:00it's incredibly rare for murder defendants to take the stand it's a risk very few take at stake
00:17their freedom or even their lives my name is sasha scar this is sasha scar an aspiring rapper
00:24charged with the murder of her producer and lover martel deruen she's chosen to take the stand
00:30determined to tell her side of the story that deruen attacked her in a fit of jealous rage he
00:36was hitting me choking me up to the point where i couldn't breathe will she be able to convince the
00:42jury that she acted in a moment of desperation why did you grab the weapon were you in fear for
00:48your life at that point yes i was or will the prosecution prove that scar is a liar guilty of
00:54murdering her music mentor martel's aggression is not supported by the evidence hers is take a
01:02court-side seat with the officer on the scene the lead investigator the cousin of the defendant
01:08the reporter who covered the trial the state had offered 20 years plea deal but she rejected it
01:15and the legal analysts following the case it wasn't until sasha testified that she gave a
01:21different light as to who martel was i'm dan abrams and this is taking the stand raise your right
01:29do you solemnly swear i'm being honest with everything i say to you do solemnly swear the whole truth and
01:34nothing but the i would like to testify the testimony you are about to give the whole truth and nothing but
01:39the truth so how you got
01:41a murder at an upscale apartment complex caught many by surprise in january 2021
01:5134 year old martel de rowan was found shot to death and the search was on for his killer
01:57i think the headline that kind of stuck out to most people is martel's connection with the music industry
02:04and him being related to beyonce cousins through his mother's side that really captured people's
02:12attention wanting to know more about who he was and why he was killed 21 year old sasha scar is charged
02:20with the first degree murder of 34 year old martel de ruin in his san antonio apartment on january 22nd 2021
02:28on that day investigators respond to a mysterious 9-1-1 call
02:34san antonio 9-1-1 this is brooke do you need police fire or ems i need police now
02:41my name is joya duran i'm trying to get in my apartment but i'm not able to get in and i think
02:50my husband is injured there's a hole in his door and i don't know what's going on
02:56but the caller gives the police the wrong address and they close the call four days later
03:03de ruin's family requests a wellness check and police find his body at the home in a pool of blood
03:10she shot him through the middle of the door knowing he's right behind him and the bullet striking his
03:19head next to the people that is a definition of murder in texas but the defense claims that was
03:28not her intent there's always another side to the story everything's not as cut and dry just because
03:35what somebody sees when they respond to a crime scene is exactly what it is after turning down a plea
03:43for 20 years which would have had her out of prison at the age of 43 sasha's scar has chosen to take the
03:50stand so sasha must have been feeling quite strongly that there was a chance that she would succeed
03:57she has to convince the jury that at least there's reasonable doubt if not she now faces the possibility
04:06of life in prison
04:07san antonio police this is christy how can i help you i have a question out there in san antonio
04:15and our family members have been trying to call him since our strategy and we haven't made any response
04:22back and we wanted to know if you guys could do a wellness check
04:25martel's stepmom was able to get the police to go over to martel's house and conduct a wellness check
04:34on january 26th of 2021 i was on top of the rotation i was up to catch the next murder case
04:43i was notified that officers had responded to an apartment complex on lock and terror parkway
04:48as soon as i arrived at the scene there was a bullet hole on the door so that kind of alarmed us
04:55when they go to the apartment they're knocking on the door there's no response
04:59at that point maintenance are drilling the lock out
05:03and as soon as i opened the door i observed an individual on on the floor that appeared to be
05:12unresponsive
05:13he was on his back head was laying toward the right
05:19uh you could see that he did have a gunshot wound to his head approximately this location
05:25um there was a lot of blood he had been pronounced deceased by ems and
05:32so there was no question in my mind that he was a victim of homicide
05:35the crime scene seemed to indicate that there might have been a physical fight
05:43between two individuals maybe three individuals
05:46observe a overturned chair also observed broken glassware or dishes
05:52from the main bedroom uh that definitely caught my attention the bed is unmade it was broken toward
06:01the front toward the headboard we also found on the bed an acrylic fingernail which uh this kind of
06:08supported our thoughts that maybe there was some kind of domestic dispute happening inside the
06:12apartment because it appeared to you that the victim had been shot did you take steps to look for any
06:18firearms we did locate a box in the closet on the shelf for a firearm yeah did you find weapons no
06:29we noticed that near the closet there was a box containing a magazine with ammunition in it for
06:35nine millimeter handgun it was smith and wesson this led me to believe that someone took that gun or it may
06:43have been the gun used in the homicide speaking to martell's family uh we were able to get a good idea
06:55about his character he had served in the military one of the proudest days of my life seeing him um you
07:03know graduating you know become the man that he you know was becoming in the air force
07:10he had one love and that was joya jenkins who he met in high school
07:16what do y'all see him when he was in the military not at the beginning he went to basic it was long
07:22distance but once that was over with we reconnected and then we got married in 2007.
07:27what led to the separation led you to go to separate ways i wanted to settle have kids have some pets
07:34maybe live a quiet life and he wanted to pursue his music so we separated
07:43martell because of his talents is signed under one of the labels under sony when he was 30 years old
07:51he beat sasha scar who was 17 years old at the time
07:55the words i would use to describe sasha is she's friendly happy joyous
08:04sasha was an excellent student she was always on the honor roll she was the student that the teachers
08:10would trust when they would leave the classroom and we all thought that she would go into something
08:16in the arts for sure i've been making music and performing music for mostly my entire life
08:31how did you come to be martell he had messaged me on instagram and requested if i could be in one of
08:39his music videos he started to work with her and trying to help her flourish in her own music career
08:48he was like people are going to be coming over and blah blah you know it might be ladies or whatever
08:54just wanted to let you know that and i said okay it's fine like we're separated at some point
09:01mid years of martell's relationship moves on from business to become more intimate
09:09after two years we became close we would start hanging out a lot it's a fair to say around june
09:16or july of 2020 was the first time you all had any kind of sexual relationship
09:24i would say more towards the beginning of the year
09:26joya she talked to her a few times but i don't know she fully trusted her she seemed like she was
09:33either very shy or just hiding something on january 26 2021 joya gets a phone call from martell's
09:44family saying we haven't heard from him can you swing by his apartment see what's going on she explains
09:50to me that even though her and martell were still married they had been separated for a couple of years
09:55the police officer that i was talking to in the room was like you know it looks like it's gonna
10:00be a murder investigation of course i'm the considered the spouse so you know suspect we did have our
10:11suspicions about joya we knew that the previous friday someone had called from that apartment complex
10:20and identified themselves as joya del ruin your husband's hurt yes do you hear him no he's not
10:29responding and i called him and there's a hole in his door and i don't know what's going on honestly
10:40that officers responded but weren't able to find anything because the apartment number given was for
10:44an apartment building that was not finished being constructed joya is taken downtown to answer
10:50questions and it was quickly realized when they pulled up the 911 call and they played it for joya
10:57there's a hole in the door she's like that's not me that's sasha
11:02are you outside the apartment or where are you i'm outside the door and i cannot get in i listened to
11:16the 911 call that was received on the night of january 22nd i wanted to hear that call just to satisfy
11:25myself that it was not joya del ruin who actually called it's just locked he's not answering and you
11:32don't have a key no ma'am i don't do you live there yes i do she gave a lot of inaccurate
11:42information as far as the apartment number she couldn't spell martell the ruins last name properly
11:50a lot of things just didn't make sense and she did not sound like joya the ruin when they played
11:55the 911 call and they asked joya is that you in that call you could tell that she had a lot of
12:02anger towards sasha you could feel it in the courtroom you could feel that tension
12:07my name is joya your aunt spell her first name joya g-a-o-i-a
12:14your head is hurt yes do you hear this no he's not responding i called him and he's not responding
12:24and there's a hole in the door and i don't know what's going on honestly
12:29miss joya did you make that call no after listening to that recording can you describe to us
12:38what misinformation the defendant provided to 911 well number one she pronounced my name wrong my last name
12:45is not duran it's duruin she spelled it wrong it wasn't the correct information at all you know
12:54after i had spoken to joya we continued our canvas we wanted to see if we could find any other witnesses
12:59that may have heard or seen anything
13:03they come across a neighbor who tells them hey i heard what could be a verbal argument or a physical
13:10argument to the point where i decided to record because i didn't know what was going on
13:20she said it was a regular thing but this night it was sounded more violent
13:24things being broken a woman saying get off me this female whoever she was was getting physically
13:36assaulted the most valuable part about that was that it gave us a time
13:47the neighbor who lived directly across from martel at one point she started
13:51tearing some banging on the door i don't recall her saying anything i just recall her banging
13:56repeatedly can you describe this woman you saw yes she was wearing a long green dress sundress
14:04essentially all the way down to her feet she was barefoot she looked a little disoriented a little
14:11frazzled i went on the elevator and when you were on the elevator was there anything that caught your
14:18attention yes i heard a loud bang and because of the where i live i figured it was um the six flags fireworks
14:30i believe it was about 8 55 when you hear that bang and we believe that might have been the gunshot
14:37i think the biggest key evidence for police was a neighbor who lived down the hall told them hey
14:45i looked through my ring doorbell and i noticed something suspicious the night that martel was
14:50murdered on the ring video i saw a person walking in the hallway carrying a handgun and a phone
15:00what we got from joy is that she was able to identify the person in the ring camera video she says that's sasha
15:09at the scene she was able to provide me that name and showed me a photograph from a social media account
15:19we were able to obtain an arrest warrant within eight hours of officers first responding over there
15:26while investigators are convinced darun was a victim of homicide the question still being asked by so many
15:32tonight is why the search is on for sasha scar on an instagram page you can see people telling her to
15:40turn herself in san antonio police told me that they do believe wherever she is that she is armed and
15:47possibly dangerous she tried to go on the run tried to hide but somewhere along that way the pressure got
15:55to her how did you find out that there was a look for your arrest not only did i have people tell me i
16:02saw it on the internet did you turn yourself in yes late breaking news as we come on air tonight san
16:10antonio police have arrested the suspect accused of shooting and killing a man at a lock and tear
16:15apartment complex when sasha scar ultimately surrenders she is arrested and formally charged for the
16:21murder of martel de ruin i was just taken back because you know you're like wait what so just
16:29going and looking and making sure that was actually her picture i was definitely surprised and then
16:36heartbroken from the time we got the warrant to the time she turned herself in was approximately 11
16:42days when i met with sasha at the jail she was obviously exhausted she looked like she had been on the
16:49run she declined to give a statement and requested an attorney so we were never able to get her side of
16:55the story about what happened sasha scar sat in her cell for more than two years before her trial started
17:08as the trial began we started to see martel's family and friends enter the courtroom
17:15you could obviously see that they wanted justice they were finally going to get the answers so many
17:22people want to know what happened why what was your intent when i've been fired
17:33as i was leaving i was backing up i backed up into the kitchen
17:36i just kept telling them don't touch me stay away from me
17:52it is a new week and a new murder trial will begin tomorrow sasha scar is accused of the murder of an
17:57aspiring san antonio rapper two years ago sasha scar was 21 years old when she fired that shot into the
18:06door of martel's apartment ultimately shooting him in the head now she's on trial she's 23 years old
18:14if she's found guilty the minimum is five years up to life after turning down a plea deal for 20 years
18:23in a case where she could be facing life in prison scar must feel fairly confident that the jury will
18:30believe her story the trial was happening on youtube i believe or instagram
18:42and i just watched it the first day and i didn't see any one from my family there so i decided to go to
18:51the trial my earliest memory of sasha is playing outside always being very cheerful and happy
19:04going into that courtroom i didn't see that smile that i'm used to seeing
19:11she didn't look the same sasha that we saw years prior
19:15i was glad to be a familiar face in the room the martel de ruin story is not a whodunit there's no
19:26doubt that it was sasha scar who pulled the trigger but did scar intend to kill martel and if not then
19:35how and why did this happen sasha scar did intentionally and knowingly cause the death of an individual
19:42namely martel duran by shooting the complainant with a deadly weapon namely a firearm but the
19:48defense is saying that she's a victim of domestic violence she knew that he kept a gun there she
19:54doesn't want to use the gun and shoot him in his apartment she did that to have him stop coming
20:00after her in the bedroom after he had just attacked her joya was the first to take the stand for the
20:07state you could tell there was a lot of built up animosity and i think joya was waiting for this day
20:14to face sasha in court what was the nature of your meeting the defendant martel met her on a video shoot
20:22and then he said oh she's interested in music you know i want to help her out and then she came to the
20:27studio she was often time a visitor in the home with him and joya to work in the studio with him
20:37did you ever observe any ugliness from her i gave her a ride home one time she told me that martel
20:46said that she could borrow some money so i let her borrow about 40 bucks not much but then i went home
20:53i said hey did you say that she could borrow money he was like i never said that
20:58it kind of threw me off as she was just wasn't being truthful about things
21:02after the prosecution plants doubt about sasha scar's honesty they introduced damning texts martel
21:10sent her shortly before he was killed can you read the first text message which appears to have been
21:16sent by martel come get your stuff you attacked me and defended myself all because i asked you to leave
21:24the defense is saying that sasha is a victim as opposed to the prosecution who says no
21:30she's actually the one who was the aggressor and in her anger she went back and actually took out
21:37martel with just one bullet were you able to find out the size of the projectile that was taken out of
21:46martel yes i was determined it was a nine millimeter with ammunition that was found in the
21:52little storage container at the crime scene sasha scar had no choice but to take the stand if there was
22:02any chance of her being found not guilty of the murder charge the prosecution's evidence was overwhelming
22:12that ring video where it shows sasha walking with a gun in her hand
22:25at the approximate time when it's believed that martel was killed ending of the text messages or the 911 call
22:33i think my husband is injured sasha is the one and only witness for the defense the defense knows that
22:45sasha scar has to tell her story directly to the jurors and she offers a very specific explanation of what
22:52happened and why how many years before january 2021 did you know martel i would say we met in 2017 2016.
23:02how old did you get back then 17. did you ever stay the night at martel's uh place yes how many times
23:11approximately when we first met i stayed the night once for music purposes
23:16after about two years i would stay the night pretty consistently the defense played upon that she was
23:25kind of this helpless young girl who really trusted martel and that he took advantage of that
23:35i never really offered to become more than friends but we became we had sexual relations
23:43six months before this incident happened she came across as a very you know soft-spoken victimized woman
23:55it was a game changer when sasha testified she gave a different light as to who martel was
24:10i was in the hospital and i was in the hospital when sasha took the stand we just looked at each other and i
24:16think she knew i was there to support her let's start talking about plenty of january 22nd where were you
24:25that day at my mom's house and smart so picked me up we ended up going to san antonio to his apartment
24:35that was pretty much the beginning of how this kind of all ended for martel
24:46well we were planning for some shows we have the next day she cooks him dinner they're talking they're
24:54drinking after sasha gets a facetime call from another man things take a turn
25:02it's a photographer a male photographer
25:09trying to set something up with her in the future
25:13that facetime call ends and she goes to lay down this seemed to be where everything intensified
25:19i was getting ready to go to sleep i was scrolling on my phone and martel came into the room and turned
25:29the lights on he just asked me to leave his apartment he was upset because he felt like i was on the phone with
25:41another man did this verbal argument escalate into anything more physical yes it did
25:55he came to the other side of the bed where i was at he tried grabbing my stuff and i snatched my stuff
26:01from him did you tell the jury what we're looking at there that is most likely one of my fingernails that had broken off
26:10how did the fingernail get broken off
26:14from me trying to probably pull him off of me for what felt like a long time he was hitting me
26:22choking me and so up to the point where i couldn't breathe and then the bed just broke all of a sudden
26:31it's okay
26:34do you have any visible injuries in this photo
26:38a bruised eye and a few scratches on my neck when and how did you sustain those injuries the night of
26:46the incident thank you while i was on the bed
26:50once the bed had broken he ended up falling off the bed and that's when i crawled across the bed
26:56did you grab the weapon yes i did
27:05why did you grab the weapon i grabbed it to tell him after i grabbed it i told him don't touch me
27:14okay it was still hitting me and i was unable to breathe so i was panicking at that point
27:26i started backing up out of the bedroom he started following me i started grabbing dishes out of the
27:33cabinets and throwing it in between us
27:40why exactly were you breaking uh dishes or throwing dishes at that point um to keep space between us
27:49were you in fear for martell i was at the time yes
27:53sasha does go into a little bit of detail about the relationship having some other
28:00issues in the past did he hit you yes what else did he do he pulled his gun out on me she says
28:10that the night that everything happened it was just an abrupt escalation of any previous
28:16altercations they had in the past after the dishes had got broken i had to go over the kitchen counter
28:26and that's when i just ran outside the door did you have any looking with you still yes i did
28:32did you have any shoes on when you left no i didn't
28:35here we have a female who's leaving the apartment with no shoes she's leaving her belongings it could be
28:47that she's scared
28:53some drawers may have been a bit sympathetic thinking about those things she's just like i
28:59needed my stuff my money my debit card all of that was inside his apartment i had my phone in my hand
29:06i have to go to the other hand and i was waiting on the door with him
29:12you couldn't see anything through it all right do you have any idea martell is standing behind that door
29:19at some point was the shot fired all right how i want you to demonstrate to the jury how exactly
29:27was the gun discharged as i was knocking on the door i just threw the gun up and just
29:39after the gun goes off what happened next that's when i ended up calling the police san
29:46antonio 911 i need police now do you mean to hurt yourself not at all tell the story what was your intent
29:55that's the maximum of the fibers
30:10i guess my intent was just to get his attention
30:17for her to start crying that's a good moment for the defense because she's being humanized on the stand
30:25the prosecution has a challenge ahead because intent can be difficult to prove and remember
30:31sasha scar turned down a 20-year plea deal so one can assume she strongly believes in her innocence or
30:39at the least that a jury will have reasonable doubt thank you ma'am terrible passes with us
30:52she claims she feared for her life in an unexpected move today a defendant in a murder trial took the
30:59stand sasha scar has admitted to shooting martel de ruin after she claims he attacked her during an
31:06argument she says it was never intentional now the state will challenge her version of events by
31:11focusing on key evidence from the crime scene i just kept telling them to don't touch me stay away from
31:20me and i was storing the dishes on the floor
31:26immediately after that i went over the counter and i ran out the door did that last part again
31:37i just lifted myself up and crawled over the counter let me show you state's exhibit number 26
31:50we have no room at the end of the counter it seems physically impossible for you to leap over it
32:00from this angle you would agree with that person it might seem like it the basic argument of the
32:05prosecution is if someone was really trying to get over the counter there's no way that those dish
32:11placements would have been perfectly situated the prosecution as they continue with their cross
32:17examination they were really trying to get her to break on the stand the photographs that we saw of
32:26your injuries specifically why did you take those photos because i realized there was a warrant for my
32:34wrists a lawyer told me that if i have any injuries i should take a picture but you did not take any steps
32:41to report the choking the moment you had an opportunity once you left the apartment correct no i didn't but
32:48is your testimony that you're so scared to death while you're in the apartments you leave with a gun
32:57and you come back to the same place where you're afraid right is that your testimony yes sir so instead of
33:04calling 919 and saying hey i've just been assaulted i've just been choked you didn't do that correct
33:13i'm not sorry i didn't you had a gun in your hand and you could found a safe place to remain and call
33:18police correct yes sir it doesn't make a lot of sense for somebody who's claimed to be so afraid for
33:25they're alive in an apartment to go back to the apartment and start knocking on the door can you
33:30understand why that doesn't make sense to me yes i understand you lied to a 911 operator correct i lied
33:39about my identity yes and you lied about his condition correct you a bullet went in there but you
33:46didn't tell them 911 operator i knew the bullet had entered the apartment so how the prosecutor used
33:57that 911 call was she's lying on this 911 call she's lying then and you know she's lying so she can also
34:05be lying now you didn't tell the operator that you shot through the door no i didn't can you see from my
34:12standpoint it doesn't necessarily see that you're terribly concerned for his safety
34:22well i didn't necessarily lie about what happened i just didn't say everything that's fair that's a
34:30fair point you did not say everything i submit to you i submit i submit this you're not saying fully
34:36everything what happened on that night you're saying proportions of it
34:39and in your testimony that as you're raising the gun and why are you raising the gun
34:54i guess because at the time i just went mad i just wouldn't say
35:01for what reason are you raising the gun to i wouldn't necessarily say to shoot it because
35:13then why there would be no other answer but
35:17the other answer is that you're angry and decided to shoot at him that would be another reason why we
35:22are you raising the gun that's i didn't decide to shoot at him though
35:31no further questions your honor
35:37the state is inferring a lot of things but there's not evidence of what they're trying to present as
35:43murder and in fact sasha stood in the light which most of our defendants don't most defendants don't take
35:50the stand the defense during closing said that she actually had every opportunity to shoot him
35:57before she had the gun while he was she was in the apartment she doesn't turn around and shoot him and
36:04kill him she runs out she runs down the hall he locks her out of the house remember no shoes no purse
36:13no credit cards nothing she called 911 to get her stuff she gave the name of joya because joya is his wife
36:23and would realistically have access to the house when she's coming back she's not in fear for her life
36:31anymore she wanted her stuff so she's mad we're not saying that she accidentally discharged the gun
36:40we're not saying she slapped it like this she actually was banging the door with the butt of the gun
36:49martel is silent back there doesn't say a word he was quiet because he is afraid that the police are
36:57there because he had just beat her
37:04this was a tragedy this was not an intentional killing this is somebody who could not see through
37:09the door that fired off a single shot in anger and frustration at the exact worst time
37:17the defense was pretty adamant that sasha was remorseful for what she had done
37:24and didn't mean for this to happen and was really hoping that they would pull the jury
37:30to have some mercy on her
37:39once he started hitting me he was choking me um to the point where i couldn't breathe
37:46after declining a plea deal for 20 years in prison sasha scar decided to take her chances with a jury
37:53she confessed to shooting martel darwin but not intentionally saying the gun went off as she
38:00banged on the door did her bold choice to take the stand and emotional testimony convince jurors
38:10few of martel's family members sitting in the courtroom they were kind of with their heads down holding
38:16hands anxiously waiting to hopefully hear the verdict that they wanted ladies and gentlemen it is my
38:24understanding that you've reached a verdict and to the poor person of the jury is that verdict unanimous
38:31if you could please hand the verdict to the deputy
38:33we the jury find the defendant sasha scarred guilty of the offense of murder as charged in the indictment
38:53i just was honed in her at this point and i just think she was in shock and disbelief
39:00this jury felt so strongly in a prosecution's case that they came back with a verdict of guilty in less
39:09than three hours
39:14it just goes to show you how much they discredited the testimony of sasha scarred
39:21it broke my heart just to see that and um i'm so sorry if 23 year old sasha scarred had taken the plea deal
39:39she would have been released from prison by the time she was 43 and eligible for parole when she was just 33.
39:47the jury now one week after refusing the state's offer the jury will hand down her final sentence
39:57this jury has the ability to sentence her to five years up until life in prison
40:05if miss scar and please rise we the jury having found that the defendant is guilty of the offensive
40:11murder now return this verdict as to her punishment we assess her punishment at confinement for a term of 55 years
40:25it was hard to swallow because of the length of time that's a hefty sentence i think for for anyone to hear
40:32i was very surprised that she just stood there and that she didn't collapse
40:43well in the state of texas you're eligible parole after serving half of your sentence but if she did
40:49serve those full 55 years she'd be well into her 70s she still killed an innocent man
40:55regardless if they had fought before she was in no danger at that time so i could see why the jury would
41:07feel justified in giving her that 55 years
41:12i feel like sasha's motivation with killing martel was just simply her temper she didn't know how to
41:19control herself the victim's family those that are affected get some final closure by expressing
41:30themselves in the presence of sasha i haven't slept in a very long time as a mother to lose a son and to
41:43lose him that way it's just it's unimaginable and i wouldn't wish that on anybody nobody
41:49ever
41:55sasha the pain and agony that you brought upon my family is unbearable you deserve every single
42:02consequence that you caused from your own actions your time is up and the time has come for you to pay
42:08for what you've done so fix your sheets if you happy because you've made your bed and now it's time to lay
42:15so i felt for the family that has the loss you know a life is taken and then i felt like this side a
42:27life was taken as well for sasha because she only got to live for 20-something years
42:32knowing the family i i know they were pleased uh with the outcome i know they appreciated the job
42:42that was done by everyone and they definitely felt justice justice was served in this case
42:49defendants are never forced to take the stand but that decision is likely the biggest one
42:55they'll ever make for taking the stand i'm dan abrams
