00:32It was diffused to Interpol.
00:34It was given to Philippine authorities.
00:37It did not have a red notice,
00:40so the Philippine authorities or the Philippine National Police
00:46implemented the warrant directly to the accused.
00:50They did not bring it to our court in our country.
00:55Vice President Sar Duterte questioned the process of arresting former President Duterte.
01:01According to the Senate Committee on Foreign Relations,
01:04a diffusion request and not an Interpol red notice
01:09was the basis of the arrest on March 11.
01:12The request of Interpol was the reason for Duterte's arrest.
01:16The request was sent after a prior consultation with the Philippine government
01:22that agreed to the request for arrest of the International Criminal Court
01:26on the Interpol website.
01:28The diffusion was requested by Interpol member states
01:33to arrest, detain, or limit the movement of a convicted or accused.
01:38The red notice was issued by the General Secretariat
01:42to find and arrest a wanted by Interpol.
01:46The Interpol itself told us that it was the first time that the member states
01:52immediately acknowledged that the Interpol Secretariat itself
01:58has nothing to do with it because it is just between states, ICC and Interpol.
02:02The Interpol said that President Duterte was not wanted by Interpol,
02:08he was wanted by ICC.
02:12It was just sent to them.
02:14But according to the Philippine Center on Transnational Crime,
02:17he received a diffusion request.
02:20Whether it is a red notice or wanted person diffusion,
02:24we are obligated to comply.
02:26Moreover, the arrest of Duterte was illegal.
02:29The Rome Statute did not follow the process in Article 59
02:34where the arrested should be brought to the competent judicial authority
02:39or court of the custodial state.
02:41This was patently an illegal arrest.
02:44Where is the warrant of arrest issued by the Philippine court?
02:49None.
02:50Without a valid warrant from a Philippine court,
02:54this was at best a warrantless arrest.
02:57Duterte's other point is that politics is behind the arrest of his father.
03:02But according to the Department of Justice,
03:04the arrest of the former President is legal and under process.
03:08In the Philippine Act on Crimes Against Humanity,
03:11the crime may not be brought to the country
03:14if it is heard in the International Tribunal
03:17and the accused may be subjected by the government.
03:20As we mentioned previously,
03:22and within the provisions,
03:24allows us two options,
03:27either extradition or surrender.
03:30We chose the executive mode which is surrender.

03:37The video has sound effects to make it look like a drama.

03:46The video also shows how the police were harassed
03:51while arresting the accused.
