Mark Geragos Rips D.A. Hochman Over Menendez Brothers Case

Attorney Mark Geragos says the new Los Angeles County District Attorney has no clue what he's talking about when it comes to the Menendez brothers ... telling us Nathan Hochman needs to brush up on the facts.

00:11it was really beneath him as a new district attorney.

00:14I would tell you one thing,

00:16has anybody else put together the fact that,

00:19you know, I think I said last time

00:21when I heard him about his response to the habeas

00:25that the 90s were calling,

00:26they want their DA's office back?

00:28And it was interesting that Hockman basically laid out

00:32what would be like a closing argument from the 90s

00:36as if he was prosecuting the case himself back then.

00:42I was watching it and I said, this is great.

00:46Apparently Pam Bozanich,

00:48who was the prosecutor in the first trial,

00:50gave you her closing argument.

00:52There's only one problem.

00:54Not one, but two juries heard everything.

00:58Not one, but two juries heard all of the cross-examination

01:03over weeks of that trial about your litany of lies

01:08that you talked about.

01:09Jurors heard all of that.

01:11All of that was cross-examined though.

01:13I don't know what he's talking about

01:14because both juries rejected,

01:1850% of them rejected the murder.

01:21So what are you relitigating?

01:23Whose rights are you vindicating?

01:24And by the way, he kind of also stepped on,

01:28I think one of the more important things here,

01:31which is there is though,

01:33he mentioned that Milton Anderson is no longer alive.

01:36He passed away last week.

01:38There isn't a single living family member or victim

01:42who endorses Hockman's position today, number one.

01:47Number two, there isn't a single living family member

01:51or victim who was notified of what he was gonna do today,

01:56which is a violation of Marcy's law.

01:58And he has completely misread the resentencing statute.

02:03So for a guy that supposedly did all the hard work,

02:06it's astonishing to me that he wants to litigate a crime

02:10that two juries already rejected his theory on,

02:13that only once they took off the table

02:16imperfect self-defense,

02:18he keeps talking about self-defense.

02:20That wasn't ever given to any jury at any time,

02:24pre or post.

02:25It was imperfect self-defense.

02:27So I ought to at least bone up on the law

02:31instead of memorizing Pambozada just closing.

02:34What do you say to him saying,

02:36well, they're not embracing and owning up to all the lies?

02:39They were cross-examined for weeks, weeks,

02:43and owned up to all the lies.

02:44Read the trial transcripts.

02:46I don't know what he's talking about.

02:48I mean, you know, he keeps saying we have the record,

02:50we have the record.

02:51No, everything he talked about was pre-trial.

02:54I don't even understand what he's talking about.

02:56By the way, resentencing, this isn't a habeas.

02:59Resentencing is focused on what have they done since?

03:04What are they doing now?

03:05The only reason he keeps bringing up Sirhan Sirhan

03:09is he can't find any other basis

03:12upon which to make his kind of crazy decision,

03:16which he didn't even bother to tell the family about.

03:23I haven't even been served with his motion yet.

03:27I mean, it's just wild what is happening with this.

03:31The DA's office is in the 90s.

03:33Maybe they're using the post office from the 90s.

03:35The resentencing hearing,

03:37the only thing that would happen

03:38if the judge resentences them to life in prison

03:42and takes away without the possibility of parole

03:44is that it would go to the parole board

03:46and then the parole board would send it to the governor.

03:48But it's at the parole board already

03:50because of the governor,

03:51so the resentencing is just irrelevant.

03:59I mean, you wanna talk about irrelevance?

04:02is this Hockman setting up a run for governor?

04:06He sure was taking aim at the governor.

04:10I mean, it sure seems as if he was testing out his,

04:14he failed in his last statewide run

04:16when he ran as a Republican for attorney general

04:19and lost in a landslide to Rob Bonta.

04:23Then he changed and became an independent

04:25when he ran for DA.

04:26You have to wonder, is this guy testing out a,

04:29is this a test run for governor?
