Of all things, a phallic laser pointer is at the center of the Jamie Foxx birthday dinner dispute, and turns out his beef was with folks from the 'Jackass' franchise's production company ... TMZ has learned.

00:00So we told you about this crazy incident a couple days ago with Jamie Foxx where he actually

00:07ended up in the hospital getting stitches after a birthday celebration at a fancy Beverly

00:13Hills restaurant.

00:14We now know, we believe, what happened during this confrontation that led to somebody throwing

00:22a glass at Jamie.

00:24What we couldn't figure out was what set anybody off to the point that a glass would

00:29be thrown, that Jamie would be this upset, and we now know it all has to do with a laser

00:34pointer.

00:35A particular kind of laser pointer that I didn't even know existed.

00:40So look, I mean, we're going to be as delicate here as we can, but it's a penis laser pointer.

00:47A phallus.

00:48It projects the image of a phallus.

00:51Well there I said it.

00:52There.

00:53So we should set the scene here.

00:56So Jamie is having his birthday dinner with family and a few friends.

01:01And Mr. Chow.

01:03Which, by the way, we should say there are two levels.

01:05We should say Mr. Chow is the last restaurant where you would expect a brawl.

01:10This is a traditional kind of between the lines restaurant.

01:16Not a club, not a party place.

01:21So he's having his dinner downstairs.

01:23There is a party upstairs.

01:27It's a holiday party for the production company behind the Jackass franchise.

01:34We're told that Johnny Knoxville wasn't there.

01:37Steve-O wasn't there.

01:39But Johnny, Jeff, and Spike are the owners of this, but they were not there.

01:42This was crew members who were having their holiday party.

01:47In the spirit of Jackass.

01:48And in the spirit of Jackass, someone up there had a laser pointer and decided to shine

01:53it down on Jamie's dinner party.

01:55And the table.

01:56On the table, perhaps on people's bodies.

02:01Don't know.

02:02But that image.

02:03That image ends up on Jamie's.

02:07The image, the phallic image, was shown down on Jamie's table and Jamie saw it and that's

02:17what upset him.

02:18And Jamie was upset because his daughters were there?

02:20Daughters are sitting at the table and he just felt like it was inappropriate.

02:23So at that point, Jamie and some friends go upstairs to have a word with the party and

02:32they don't know who these people are, but Jamie said this was out of line, why are you

02:36guys doing this?

02:37We're in the middle of a party.

02:39And that's when things got heated and someone throws a glass.

02:42Which is, by the way, there's something, there is something, I'm sorry.

02:47There is something missing here because what would cause the jackass people to throw the

02:54glass if Jamie's just saying, hey, knock it off.

02:57It seems like something happened.

02:59You know what I mean?

03:00Maybe there was more.

03:03The tone with which Jamie and his friends came up.

03:06This is the whole shtick of the jackass crew, right?

03:08I know these guys are affiliates.

03:09It's not the main crew that we all grew to love in the 90s.

03:17They were shining the light in his face in order to get a ride, to rile him up.

03:33Maybe they meant to miss, but whatever it is, it's not out of character for them to

03:38throw a glass at him even if it wasn't deserved.

03:41We should say we don't know specifically who threw the glass or, like you said, exactly

03:48what was said right before that to precipitate it, but police were called.

03:54We should say the glass broke when it hit Jamie and it cut his lip?

04:00Cut somewhere on his mouth.

04:02He ended up going to the hospital for stitches, so it ruined the night for sure.

04:08They are investigating.

04:10There are videos, we're told, either from Mr. Chow, from the restaurant itself, or patrons

04:19who were there, but we're told there are videos.

04:22You would think there would be videos, too, because if Jamie's going upstairs, you would

04:27think somebody in the restaurant is saying, oh, I'm going to get a cut.

04:32Maybe that's what it is.

04:33So the jackass lawyer, Brian Friedman, issued a really interesting statement here.

04:41He said, although the crew has the greatest respect for Jamie, the version of events that

04:45has been presented is totally inaccurate and deeply unfair to those attending their holiday

04:51celebration that night.

04:53So what we do know is we have spoken with two patrons who were there who gave us the

04:59story and the police.

05:01And law enforcement.

05:02Actually, three different patrons who were there.

05:06And law enforcement.

05:07And so I guess the question, we don't know who specifically threw that glass.

05:12And so that may be what Brian Friedman is addressing.

05:18He does say totally inaccurate, which I don't understand.

05:22Maybe it was the plus one of somebody who was on the crew?

05:25It could be.

05:26And therefore not a crew member?

05:29As for the laser, you know, he's saying totally inaccurate.

05:33But we got three people in the restaurant saying we saw the laser and the whole thing.

05:38I don't think that Brian is specifically is refuting the laser.
