American Eagle Outfitters has filed a lawsuit against Amazon, accusing the e-commerce giant of using its Aerie trademarks to promote counterfeit products. The lawsuit alleges that Amazon’s unauthorized use of the Aerie and Offline by Aerie branding in search results deceives consumers into purchasing inferior knock-off merchandise. The lawsuit notes that American Eagle intentionally declined to sell Aerie products on Amazon to maintain its brand identity. Amazon has faced similar legal issues, with Birkenstock and Daimler AG previously suing the company over counterfeit items sold by third-party sellers on its platform.
