The IPCC Act on the Freedom of the Practice of Police Conduct
00:06
began in force on July 1, 2023.
00:11
This means that I will not issue a five-year date.
00:14
I will issue a one-year date.
00:18
The number of complaints we have received is 348.
00:23
As you are aware, under the same Act, Section 25,
00:29
the IPCC is allowed to classify complaints.
00:34
If it is a bribery, under Section 25A,
00:40
the IPCC will issue a complaint to the SPRM.
00:43
There are also cases where the IPCC continues to issue complaints
00:47
to the relevant authorities, under Section 25B.
00:52
Under Section 25D, it is the Police.
00:56
Under Section 25E, it is the No Further Action.
01:01
Under Section 25C, it is the jurisdiction of the IPCC.
01:07
There are seven cases.
01:09
In these seven cases, the nature of the cases is
01:14
the members of the PDRM make a complaint against them,
01:18
or the complainant makes a complaint because there is no action
01:22
on the initial complaint.
01:24
There are also complaints from these seven cases
01:26
that are related to the issue of integrity.
01:28
This means that the selection of the recruiter
01:32
is said to have elements that compromise on integrity.
01:38
Then there are also cases related to sexual harassment.
01:40
There are seven cases.
01:41
The one you are asking about is whether the results of this IPPC
01:44
are still in the investigation process.
01:49
I have two related questions.
01:54
First, from the seven cases,
01:58
or the seven complaints that were taken action on,
02:05
that is a relatively small number
02:08
compared to the large number, which is 348 complaints.
02:12
If I am not mistaken, that is the answer from the Minister.
02:16
So, given the situation,
02:18
does the IPCC have an effective objective
02:25
in handling complaints against the police,
02:30
especially complaints from subordinates
02:35
against superiors?
02:39
Secondly, Mr. Minister,
02:41
the IPCC has been referred to or described
02:52
by Amnesty International
02:56
as a somewhat regressive law.
03:02
It does not have sufficient power
03:09
compared to EAIC and IPC-MC,
03:15
which may have been tabled in the past.
03:24
But no.
03:25
So, given the situation,
03:27
does the government intend to strengthen or intensify this IPCC
03:35
in handling complaints against the police?
03:44
Thank you, Mr. Speaker.
03:45
Thank you, Mr. Speaker.
03:47
Thank you, Mr. Speaker.
03:52
The principle that we hold, Mr. Speaker,
03:54
in a law is dynamic, not static.
04:01
I mean, the IPCC has only been in force for a year.
04:08
I think the approach that is more appropriate
04:11
is to give room, to give trust to the IPCC
04:16
to perform with permission.
04:18
And at some point, I have the opinion
04:22
that any responsible government
04:25
cannot retain an act or a law.
04:30
But for now,
04:32
we believe that the existence of the law is sufficient.
04:36
And I would like to point out
04:39
why the number is so small, 7 compared to 3, 4, 8.
04:44
Because the IPCC's act itself
04:47
allows for compensation to be made
04:50
to other authorities
04:52
who also have the power to investigate and enforce the law.
04:57
That is why the largest number in 348,
05:01
when divided,
05:02
is included in the criminal complaint.
05:06
This one is related to violence, sexual harassment,
05:10
burglary, infringement of documents,
05:12
rape, or issues of integrity.
05:15
This one, of course,
05:17
in the police act itself,
05:19
there is a clear power field.
05:21
So for now,
05:23
the position taken by the IPCC
05:26
is that the existence of the law
05:30
is something we can maintain
05:33
by taking the approach that
05:35
on the day of judgment,
05:37
where there is a need for us to review this act,
05:41
we will investigate at that time.
05:44
Thank you.
05:51
Thank you.
