Justin Timberlake has remained tight-lipped in the aftermath of his DWI arrest ... but his lawyer says he's ready to fight tooth and nail for his client, which is interesting.

00:00It looks like Justin Timberlake is gearing up for a fight.

00:04If you believe, his lawyer, and his lawyer is a guy

00:08who is well known in the Hamptons.

00:11His name is Ed Burke Jr.

00:14And he is a really good lawyer.

00:16And I've talked to people in the Hamptons.

00:19Represents a lot of people.

00:20And he is gearing up for a fight.

00:22Yeah, that's what it sounds like.

00:24I mean, after the DUI arrest, DWI arrest,

00:28we kind of figured that this is just something,

00:30it's a first offense for Justin.

00:32He will settle it and we'll just move on.

00:35It's not gonna be a big deal.

00:36His lawyer is making it seem like

00:38there's something that we don't know here.

00:40At least, maybe something that may come out

00:42on the body cam based on this statement.

00:45This is what Ed Burke told us.

00:46He said,

00:59Here's the problem with this.

01:00The full discovery from the DA's office.

01:02Yeah, the discovery from the DA's office

01:03involves obviously the body cam, the blood.

01:07Well, they don't really have a breathalyzer.

01:10And therein lies the problem.

01:11I mean, look, this case is never going to go to trial.

01:16The fact that Justin refused the breathalyzer

01:20is almost end of story.

01:23Because it ends up being essentially his story against.

01:27The police who did a field sobriety test

01:29and everything else.

01:30And in terms of, you know,

01:31did they have probable cause to stop him?

01:33If they have body cam video showing him

01:35blowing a stop sign and then swerving, that's enough.

01:40What I'm getting at is this.

01:41It is a first offense.

01:43These things almost always settle.

01:46And with a plea bargain.

01:48And, you know, it could be that he ends up

01:51pleading to reckless driving and he might,

01:54and I'm sure he's gonna get a license suspension

01:56because of the failure to take the breathalyzer test.

01:59But my guess is this will plead out as a reckless.

02:03And the question is, is it wet reckless

02:05or just ordinary reckless?

02:07Please explain that.

02:09A wet reckless is involving alcohol.

02:13And what a lawyer will try and do

02:16is eliminate the wet part and just make it reckless driving.

02:19And I think that's where the battle is gonna lie.

02:22But this is never gonna go to trial.

02:24So Harvey, if you're right,

02:25which by the way, I agree with you.

02:26I think he is gonna plead out.

02:27It's not gonna go to trial.

02:29If that's in fact the case,

02:30why do you think his attorney is telegraphing

02:34that he's gonna put up a fight?

02:35Because this to me on its face

02:37seems like Justin is gonna fight this.

02:40He thinks he was wrongly arrested.

02:41That's kind of what I'm gleaning from this.

02:43And if that's the case,

02:44why would you even be pushing back on that?

02:47Because this seems quite strong, right?

02:49But that's what you, as the attorney,

02:50a good defense attorney says that

02:53he does not wanna look like

02:54he's gonna roll over on this thing.

02:56That helps you in negotiating

02:57whatever the terms of the plea deal are gonna end up being.

03:01Because look.

03:02You have to have a strong position.

03:03Now again, the body cam is really critical.

03:06Back in the day when you didn't have a body cam,

03:08it would be the cop's word against the person arrested.

03:13But here, look, it's gonna speak for itself.

03:15The refusal of the breathalyzer is objective

03:18because you have to submit if you're driving a car

03:22and they stop you and ask if there's probable cause.

03:25I don't see how you get around the probable cause

03:27if you blew the stop sign and it was swerving.

03:29So to me, this is whether it's gonna be a wet reckless

03:33or whether it's gonna be straight reckless.

03:36One other thing here that Justin's wife, Jessica Biel,

03:41is not far from him.

03:42Actually, it's a couple hours.

03:44That's if you have no traffic.

03:46She's in New York City working on a show for Amazon Prime.

03:49And she was unfazed by what's going on out on Long Island.

03:55Unfazed based on the photograph.

03:57Well, the fact that she's at work,

03:59was still shooting the show.

04:01Charles, she's fazed.

04:02You think she's fazed?

04:03You know she's fazed.

04:05This is her coming out after they had kids.

04:09She kind of put her career on hold.

04:11She's going back in.

04:12And now all of a sudden, this headline is kind of.

04:14It is really bad timing for her.

04:16Plus, bad for the family.

04:17Right, bad for the family, bad timing for her.

04:20You're right, that she's getting back out there.

04:21And as it happens, then Justin has this arrest.

04:25But I think she's unfazed in that.

04:28Do you think she got up in the morning and was like,

04:31maybe I'm not gonna go to work today?

04:32No, of course she was gonna.

04:33I'm not saying that.

04:34But you know that this.

04:37It was on her mind, clearly.

04:39Clearly.

04:40So bad timing for her.

04:41You know what it's good timing for?

04:43For the American Hotel right now,

04:45which I'm sure is getting a ton of publicity,

04:46ton of people coming by.

04:48Speaking of the American Hotel,

04:50we actually spoke with the owner of that place,

04:51and he tells us that Justin is welcome back anytime,

04:55open arms, and that he kind of gave a little more clarity

04:58in terms of what he says he and his staff did that night,

05:01in terms of, because there's all these rumors and reports

05:03that Justin was like drinking a ton at the hotel

05:06and grabbing other people's drink, et cetera.

05:08Ted Conklin, the owner of the American Hotel,

05:10says they did not over-serve him.

05:12He's saying that clearly.

05:13We didn't over-serve him.

05:14Our staff acted properly.

05:15But at the same breath, he's saying.

05:16That doesn't really respond to the allegation

05:19about how much Justin was drinking.

05:21He's just saying we didn't over-serve him.

05:23Over-serve is a relative term,

05:25because you can get drunk in a bar

05:28as long as you're not the one driving,

05:30and it's not over-serving.

05:31So it's kind of a murky thing,

05:34that if you have a .16, which means you're wasted,

05:39if somebody else is driving,

05:41that's technically not over-serving.

05:44And let's be honest, I mean,

05:46Ted Conklin, I'm sure, is a lovely guy,

05:49but he's running a business in a town

05:51that is a hotspot for celebrities in the summertime, right?

05:55So he's never gonna have anything bad to say

05:57about a celebrity unless they very clearly

06:01do something bad in the hotels.

06:02By the way, just real quickly,

06:03Britney Spears, who has had her issues

06:06with Justin Timberlake, and you know all the history,

06:09we're not gonna get into it,

06:10she posted what looks like something cryptic.

06:14I kind of viewed this differently.

06:16So she posts a drink.

06:18A cocktail that she's having in Vegas.

06:21She was very excited about being in Vegas again,

06:23and she said, it's the little things, you know?

06:26So some people say this is shade on.

06:28With the flower emoji.

06:29So I think she's referring to,

06:30she's excited about her drink

06:32and the fact that it was served with a flower in it.

06:34The problem I have with this

06:35is not whether it's shade on Justin.

06:37She shouldn't be drinking.

06:38She has a substance abuse problem,

06:40and drinking for her is really, really bad.

06:43So I know we kind of harp on this,

06:45but a lot of people are really concerned about that.

06:48So anyway.

07:15and getting a call that her husband is in jail
