00:10 got some rights that I'll read over to you in relation to section 131 of the Criminal
00:17 Justice Scotland Act 2016. I have to remind you of certain information, please listen
00:22 carefully. You have been arrested on suspicion of murder, attempt to defeat the ends of justice,
00:28 rape, common law times 9, rape section 1, Sexual Offences Scotland Act 2009 times 2,
00:35 attempted rape, common law, abduction times 3, indecent and/or sexual assault, common law times
00:45 12, sexual assault section 3, Sexual Offences Scotland Act 2009 times 3 and assault times 6.
00:55 This is in relation to charges 18, 37 and 38. Mr. Bateman has also been provided with a list of
01:04 those charges, okay? And this is in relation to Emma Caldwell. Tell me your involvement relating
01:10 to the rape and murder of Emma Caldwell. Ian, moving on, and this is the last three charges
01:18 that will come to you. It's charges 18, 37 and 38 and these three charges relate to Emma Caldwell.

01:34 Can you confirm where and when you first met? Who introduced you? Can you confirm what age Emma was
01:44 when you first met? What age were you? Can you provide me with details of all sexual contact
01:53 that you had with Emma Caldwell? And again, that's to include locations that you've been at,
01:59 sex acts carried out, prices and if you wore a condom on each occasion.

02:11 can you explain what circumstances led you to believe on each occasion that consent was given?
02:16 Ian, charge 37 on the 5th of April 2005 at Inglefield Street, Butterbiggins Road, North
02:27 Glasgow, M74 Road within an area of woodland known as Lingfield Woods near to Howgate Road,
02:33 Roberton, South Lanarkshire and elsewhere in Scotland. The exact location is being made
02:38 plain and known to the prosecutor. You, Ian Gorton-Packer, having met Emma Caldwell, now
02:44 deceased and persuading her to enter motor vehicle registration number Sierra November 05,
02:50 Echo Kilo Golf, that's SN05EKG, did drive her to an area of woodland known as Lingfield Woods
02:58 near to Howgate Road, Roberton, South Lanarkshire and did thereafter assault Emma Caldwell,
03:04 force her to remove her clothing and underwear, restrain her, seize her wrists,
03:09 seize her neck, place a cable around her neck and tight and sane, restrict her breathing and
03:17 strangle her and by means to the prosecutor of unknown otherwise inflict violence on her
03:23 and all this you did with intent to rape her and you did murder her. Do you understand that charge?

03:50 You, Ian Gorton-Packer, having committed the crimes liable in charge 37, hereof, which is the
03:57 previous charge and in the knowledge that said crime and the death of Emma Caldwell, if discovered
04:03 would be investigated by the police, did dispose of the naked body of Emma Caldwell and thereafter
04:09 did dispose of the mobile phone, clothing and personal belongings of Emma Caldwell by means
04:15 unknown. Clean the interior of said motor vehicle registration number Sierra Neve, Sierra November
04:21 05 Echo Kilo Golf SN05EKG to remove evidence of Emma Caldwell's presence within same and all this
04:31 you did to conceal the crime liable in charge 37. Hereof, to prevent the cause of Emma Caldwell's
04:38 death being ascertained, to impede or stop or hinder the police from conducting a full and
04:44 proper investigating investigation into said crime and her death, to conceal and destroy evidence
04:51 in connection therewith and to avoid detection, arrest and prosecution in respect thereof and
04:58 with the intent to defeat the ends of justice and you did thus attempt to defeat the ends of justice.
