00:04 On Friday, the Supreme Court sentenced Prabhu Nath Singh, a leader of Rashtriya Janata Dal
00:09 and a former member of Parliament to life imprisonment for his involvement in a double
00:14 murder case from 1995.
00:16 This decision came shortly after the court reserved his earlier acquittal attributing
00:21 to the failure of the state machinery and the trial court to ensure a fair trial.
00:26 Prabhu Nath Singh has been a member of 12th, 13th and 14th Lok Sabha.
00:30 He represented the Masra Assembly Constituency from 1985 to 1995 and the Maharaj Ganj Lok
00:36 Sabha Constituency of Bihar from 1998 to 2009.
00:40 In 2013, Prabhu Nath Singh won the by-poll and remained a member of Parliament until
00:46 2014.
00:47 A bench of justice namely Sanjay Kishen Kaul, A.S.
00:50 Oka and Vikram Nath also ordered Prabhu Nath Singh and the Bihar government to provide
00:55 financial compensation.
00:56 Prabhu Nath Singh, who is already serving a life sentence in another murder case, participated
01:01 in the proceedings via virtual means from Hazaribagh Jail in Jharkhand.
01:06 In 2017, a trial court found Prabhu Nath Singh guilty for his involvement in the 1995 murder
01:11 of legislator Ashok Singh, who had defeated him in the 1995 Bihar Assembly poll.
01:17 Notably, Prabhu Nath Singh has issued threats to eliminate Ashok Singh within 90 days of
01:22 the election results.
01:23 During the sentencing phase, senior advocates Abhishek Manu Singh and R. Basant, representing
01:28 Prabhu Nath Singh, implored that the client should not receive the death sentence.
01:33 They argued that this case did not meet the criteria for the rarest of rare offences.
01:39 They also pointed out that the Supreme Court had already overturned his acquittals in two
01:43 lower courts and a review petition has been filed on August 18.
01:47 In its August 18 judgment, the Supreme Court expressed deep concerns over the failures
01:52 of the key participants in the criminal trial, including the investigating officer, the public
01:58 prosecutor and the judiciary.
02:00 The court lamented the collective failure to fulfil their respective duties and responsibilities.
02:05 On the same day, the Supreme Court ruled that there was sufficient evidence to establish
02:10 that Prabhu Nath Singh has murdered Rajendra Rai and Daroga Rai near a pooling booth in
02:16 Chapra in March 1995.
02:18 The motive for the killings was their failure to vote according to Singh's instructions.
02:23 Due to the allegations of witness intimidation and influence, the case was transferred from
02:28 Chapra to Patna High Court.
02:29 In December 2008, a Patna court acquitted Singh citing a lack of evidence.
02:34 This acquittal was upheld by the Patna High Court in 2012.
02:37 However, Rajendra Rai's brother challenged the acquittal in the Supreme Court.
02:42 In its August 18 judgment, the Supreme Court emphasized that the investigation has been
02:46 compromised, highlighting Prabhu Nath's abuse of power as a prominent sitting MP of the
02:51 ruling party.
02:52 The court criticized the prosecution, the trial court and the Patna High Court for overlooking
02:57 crucial evidence including the dying declaration of Rajendra Rai and the eyewitness account
03:02 of his mother.
03:03 It condemned the deplorable functioning of the public prosecutor, police administration
03:08 and the preceding officer of the trial court.
03:10 However, the court upheld the acquittal of six other co-accused individuals due to insufficient
03:16 evidence.
