The Supreme Court has made critical observations while hearing petitions concerning the Special Intensive Revision (SIR) in Delhi. The court noted that it has not yet adjudicated on the legality of the 'logical discrepancy' category, which previously led to the deletion of 27 lakh voter names in Bengal as an interim measure. Addressing the ongoing process in Delhi, the bench questioned why individuals excluded from draft rolls are being directed to submit Form 6 instead of Form 8 for address changes. The court observed that time to submit claims and objections must be extended before the rolls are finalised, highlighting ongoing legal concerns surrounding the voter revision exercises across different states.

00:05okay let's turn to the breaking news that's coming in at the moment the supreme court today
00:09has given scathing observations on sir while hearing the delhi sir please the supreme court
00:16now is saying that the logical discrepancy category under which lakhs of voters in bengal
00:22were deleted is only an interim measure the supreme court says we haven't adjudicated on
00:28legality of logical discrepancy remember as many as 27 lakh voters were off the rolls in bengal
00:36because allegedly according to the election commission there were logical discrepancies
00:41surnames mismatch and other such issues those have been challenged in the delhi sir and now the
00:47supreme court is saying it's an interim measure we haven't decided on the legality of logical
00:53discrepancies anisha mathur who tracks the court joins us prima facie anisha that seems a rather
00:59illogical thing for the court to say to say it's an interim measure of right to vote after having
01:05allowed the election commission to engage in mass deletions now the supreme court while sir is on is
01:11saying no no logical discrepancies we haven't pronounced on the legality what is what else
01:16are the observations of the court on this or what has court specifically said on it well see rajdeep
01:23the supreme court has made one thing very clear that whatever is happening in the sir whether it is
01:29bengal delhi or any other state is something that is still looking into even in bengal as you pointed
01:35out lakhs of people were deleted but remember the supreme court as an interim measure also introduced the
01:41the appellate tribunals that are still working and those 27 lakh persons who lost the lost out on
01:50their names being in the roles for this particular election their application their appeals are still
01:55being heard and we of course it's being heard very very slowly and that is a matter that is also
02:00before
02:00the supreme court and various petitions that people have lost the right to vote in this election but when
02:05it comes to delhi let's look at what has happened today three very serious observations one of course
02:11what you pointed out that the court has said that logical discrepancy is something the legality of
02:15which we are still going to look into because the bihar verdict that came last year has not said that
02:21logical discrepancy or the process itself has been given a stamp the bihar verdict is only saying that the
02:27election commission had the power to conduct an essay second big observation and big uh issue by it is by
02:34the
02:34court is that why are people being asked to fill form six if their names are being put off the
02:42draft
02:42rolls because remember in delhi it's only the draft rolls right now and even those are open till the
02:4730th people have the time to file their claims and objections till the 30th of october which is why this
02:53matter was taken on an urgent basis because the petitioners had said well if you don't hear it now then
02:58people will lose out when the rolls are sealed on the 30th the court has said very clearly that the
03:04time should be extended thirdly this entire debate we've seen over the last few months over form six
03:10versus form eight court has made it very clear that if somebody has shifted their residence or was not
03:15found at their residence when when the enumeration form was sent those people should be given the right
03:21to file form six form eight which is change of address and not form six which is a new voter
03:28and
03:29the court has made that distinction also very clear that people states where and particularly in delhi
03:34because the voter rolls have not been finalized yet they have not been frozen yet then form six has no
03:40business if the final list had come and somebody's name had been deleted then the legal situation would
03:45be different right but you know questions today being raised yeah but this is delhi sir the question
03:51is of course that there are srs that have gone through the same process in karnataka so it almost
03:56seems listening to the court's observations that the left hand doesn't know what the right hand is doing
04:00karnataka has got a final role their form six has been used logical discrepancies have been used in other
04:06states the supreme court needs to give us clarity you can't say something is an interim measure which has
04:12already resulted in lakhs of people losing their right to vote so justice bakchi justice surya khan will
04:19have lots of questions to answer anisha mathur joining me on the show tonight thank you very much
