A Colorado mayor is fighting a 108-acre data center beside homes, Memphis deadlocks 6-6 on a moratorium, a judge keeps the NAACP case against Musk's gas turbines alive, and an Oregon city declares an emergency over a statewide pause. Here's what happened across U.S. data centers:

🏘️ COMMUNITY β€” Aurora Mayor Fights Vantage's 108-Acre Data Center Near Homes. Mayor Mike Coffman rejected a pause on new rules as the council fell short on a moratorium re-vote. Vantage's Trident: two stories, 1.5M sq ft on 108 acres at E-470 and E. 48th Ave. Council voted 6-5 to revisit a moratorium but missed the two-thirds needed. Draft rules would ban data centers within 750 feet of homes.

🏘️ COMMUNITY β€” Memphis Council Deadlocks 6-6 on 18-Month Data Center Moratorium. After a five-and-a-half-hour debate, councilors settled for a 135-day pause on new applications. JB Smiley Jr.'s 18-month moratorium tied 6-6, with one member absent. 135-day pause on new applications matches a 90-day review ordered by Mayor Paul Young. Oct. 6 meeting ended in protests and fights outside the chamber.

βš–οΈ LEGAL β€” Judge Keeps NAACP Case Against Musk's Gas Turbines Alive. Mississippi regulators also seek about $6.1M from a SpaceXAI unit over construction without stormwater permits. Judge Debra Brown refused to dismiss the NAACP's Clean Air Act suit over Southaven turbines. MDEQ seeks up to $25,000 a day; exposure about $6.1M across three sites. SpaceXAI plans a single agreed order with the state.

πŸ›οΈ POLICY β€” Oregon City Declares Emergency Over Governor's Data Center Pause. Umatilla says Gov. Tina Kotek's freeze threatens more than $5 billion in private investment. Kotek told regulators to stop issuing data center pollution permits until July 2027. Umatilla warns of about $6M in direct losses and 1,000+ construction jobs at risk. Council seeks immediate reconsideration; emergency reviewed in 90 days.

00:00A Colorado mayor is going head-to-head with one of the world's biggest data center developers over.
00:06A campus planned beside family homes, across the country, communities, courts, and governors are now deciding how far the data
00:16center boom can go.
00:19In Aurora, Colorado, a fight over a proposed data center called Trident has split the city council and pitted the
00:27mayor.
00:27Against the developer, Vantage wants to build a two-story, 1.5 million square foot campus on 108 acres near
00:37homes in Green Valley Ranch, including a 55-plus community.
00:43Last week, Vantage offered to scout other sites if the city paused its new rules.
00:48Mayor Mike Kaufman answered with a resounding no.
00:52On Monday, the council voted 6-5 in favor of revisiting an indefinite moratorium, but that fell short of the
01:01two-thirds needed.
01:02Kaufman says he will bring it back.
01:05Meanwhile, the council advanced zoning rules that would ban data centers within 750 feet of homes.
01:14That same tension is playing out in Memphis, Tennessee.
01:19City councilors debated for five and a half hours before deadlocking 6-6 on Councilor J.B.
01:26Smiley Jr.'s proposed 18-month data center moratorium.
01:30With one member absent, the tie meant the ban failed.
01:34Some councilors argued a moratorium would hurt economic development and push tax revenue elsewhere.
01:41Instead, the council approved a 135-day pause on new data center applications.
01:48Timed to a 90-day review of digital infrastructure that Mayor Paul Young ordered at the start of October.
01:56The vote came after a heated October 6 meeting that ended in protests and fights outside the chamber.
02:04Elon Musk's SpaceX AI operates several data centers in the Memphis area.
02:10And the legal pressure on one of the biggest names in AI is mounting.
02:15In Mississippi, the Department of Environmental Quality is seeking civil penalties of up to $25,000 a day from a
02:25SpaceX AI subsidiary.
02:27With preliminary exposure of about $6.1 million across three data center sites.
02:33Near Memphis, the notice alleges construction began before the required stormwater permit.
02:40Separately, a federal judge, Deborah Brown, refused to dismiss the NAACP's Clean Air Act lawsuit over a gas-fired power
02:50plant in South Haven, Mississippi.
02:53The group says it was billed and operated without required permits and wants penalties and an injunction halting the turbines.
03:02The judge rejected the federal government's bid to end the case, writing that federal enforcement does not mean complete control
03:10over such litigation.
03:13State leaders are taking notice, but the consequences are real.
03:18In Oregon, the city of Umatilla declared a local state of emergency after Governor Tina Kotek directed state regulators to
03:27stop issuing pollution permits for data centers until July 2027 and paused sales of state land for such projects.
03:36The city's resolution warns that more than $5 billion in private investment could be delayed, possibly permanently, along with at
03:46least 1,000 construction jobs and about $6 million in direct losses.
03:52A police station and water upgrades funded by data center revenue are also at risk.
03:58City manager Dave Stockdale says no current services depend on the money.
04:03The council is asking the governor for immediate reconsideration.
04:09The scale of what is being built is hard to overstate.
04:13Meta says the first phase of its Prometheus supercluster in New Albany, Ohio, is complete, linking hundreds of thousands of
04:22NVIDIA Blackwell GPUs across several interconnected buildings.
04:26With a target of about 1 million, each building's network connects up to 20,736 GPUs.
04:36Racks draw about 135 kilowatts today.
04:40And next-generation Vera Rubin racks will exceed 170.
04:44Synchronized AI training can swing power demand by 30 to 40 percent, which Meta manages with power capping, rack-level
04:54batteries, and coordination with utilities.
04:58Closed-loop liquid cooling serves the newest buildings.
05:02Meta is already applying the lessons to Hyperion, its next giant site in Richland Parish, Louisiana.
05:10The pressure on the grid is only half the story, because water tells the other half.
05:16In Gilbert, Arizona, the town council postponed action on proposed data center rules that would ban open-loop evaporative cooling,
05:27limit facilities to light and general industrial zones, require a 650-foot setback from homes,
05:34and bar the town from supplying drinking water for cooling at principal data centers.
05:40Vice Mayor Chuck Bongiovanni and Mayor Scott Anderson wanted more time to address small and micro
05:47data centers.
05:49Councilman Kenny Buckland cast the only vote against the delay,
05:53citing an Arizona State University study that found large data centers raise nearby air
05:59temperatures by two and a half degrees.
06:02staff returns with revised rules on December 15.
06:07Yet despite that regulatory wave, construction is pressing forward.
06:13In Alton, Illinois, about 18 miles north of St. Louis,
06:18a developer called TerraWatt has proposed a gigawatt-scale campus,
06:23the Riverbend Technology Center, on 381 acres at the former Alton Steel Mill.
06:29The plan calls for up to 1 gigawatt built in 200-megawatt blocks.
06:35Powered from the grid, with Ameren, Illinois studying the site and TerraWatt promising to pay for local upgrades.
06:43The sale would close in 2027, subject to rezoning and approvals.
06:49If approved, demolition begins in 2027.
06:53The first block is built from late 2027 into 2029.
06:58And the campus could be fully operational by 2031.
07:04TerraWatt says it has not signed a lease for any capacity.
07:09And the financial commitment behind all of that construction is staggering.
07:14AI cloud provider Nebius secured a $3.5 billion senior secured financing facility from Citi.
07:22With a one-year maturity, pricing starts at the secured overnight financing rate plus 2.75% and can rise
07:32to three and a half.
07:33The money supports its global capacity build-out, including data center development and GPU purchases.
07:41It follows $5.75 billion in senior notes sold in August chief operating.
07:48Officer Ophir Nave said sequencing financing is how the company optimizes its long-term cost of
07:54capital and noted that asset-backed financing could draw on more than $40 billion of
08:01investment-grade customer contracts.
08:05Recent leases include a 50-megawatt deal in the United States.
