The Supreme Court of India has made significant observations regarding Rahul Gandhi and the INDIA bloc's protest march held on October 12. The bench questioned the conduct and the commotion caused when protesters barged towards the court premises, noting that crowds entered the complex despite the Chief Justice of India having declined a meeting beforehand. An FIR was registered by the Delhi Police at the Tilak Marg police station in connection with the incident, and the court indicated that the actions surrounding the protest will need explanation. Simultaneously, the court addressed multiple petitions, deciding to segregate the electoral roll Special Intensive Revision matters from the pleas concerning the protests. With the Solicitor General identifying specific related items, the bench issued notice on the electoral roll petitions, confirming they will be taken up first, while deferring immediate hearings on the protest challenges.

00:00This is a big observation that is coming in on Rahul Gandhi's march as well.
00:04October 10th, 11th, 12th, specifically remember were three days where you witnessed different kind of agitations
00:09even though they were permitted to head to the Rajghat.
00:12But before and after there were scuffles and confrontations that were seen.
00:16It was a show of strength by the Congress Party and the opposition leaders.
00:19But of course October 12th was the big day when the big news had come in.
00:23Now I bring in Shreya Chatterjee here.
00:26Shreya, tell me more about what the Supreme Court has said and also primarily about
00:29the October 12th agitation. Over to you.
00:36Well you know this is the same day, Pooja, that we saw that protest march
00:40that was called under the banner of India block that was led.
00:44And subsequently we also saw Rahul Gandhi reach the doors of the Supreme Court.
00:48This is, apart from the fact that there was a petition also filed by him by the Registrar General's office,
00:53he also reached the Supreme Court.
00:55Now possibly this is what the court is mentioning.
00:59Because clearly there was an FIR also that was registered by the Delhi Police about the kind of commotion
01:05and the situation that was created due to that.
01:08I mean FIR was registered in the Tilakmark Police Station.
01:11Possibly that is one of the things that the Supreme Court is now seeking a response from.
01:15Because he's been pulled up for his actions is what our reporter Shambhavi, who's inside the court, is communicating to
01:22us side by side.
01:23We're also seeing the hearing that is being done against the affidavit that was filed by Rahul Gandhi as well.
01:29And that proceeding is also simultaneously taking place right now, Pooja.
01:34Stay on with me Shreya, because constant updates that are coming in from the court about what's unfolding.
01:41The Supreme Court has given out an observation about Rahul Gandhi on his conduct on 12th of October.
01:47It's the big observation with regard to that march.
01:49Visuals on your screen.
01:50And the Supreme Court appears to have questioned the entry of the crowd also into the court premises.
01:57He'll have to explain further about the 12th October action.
02:00The Chief Justice of India, remember, declined the meeting.
02:02And yet Rahul Gandhi and other leaders had marched for the petition.
02:06Eventually a delegation was allowed to go.
02:08But it had its own share of kind of detentions and curbs that were put in place.
02:13Shreya, go ahead, explain further about what the court has said.
02:20Well, you know, Pooja, interesting developments are coming in now.
02:23The CJ has actually asked the petitions.
02:26There are multiple petitions filed in court.
02:27Some regarding the entire SIR process.
02:30There's also petitions filed in the court about the ongoing protests that are going on.
02:34What they have said is that they have to separate the SIR electoral roll petitions from the concerning protests.
02:39Because they have clarified that the court will not be hearing the protest matters first.
02:43Because they have challenged the, they have actually discussed the challenges.
02:47Because there was section 163 that was prevalent.
02:50And also, because of that reasons, protest matters will not come up.
02:55We are thinking that these SIR hearings, particularly around the form 6 claims, etc.
03:01Those were the things that will be taken up.
03:04The Solicitor General has identified these items.
03:06That item number 24, 25 and 45 are SIR related.
03:10And the court has issued a notice against these petitions.
03:15And they have asked the pending issues to be tagged along.
03:18So, clearly, it is regarding the SIR hearing that the court will be taking the matters up.
03:24But so far as the protest is concerned, unlikely that we will see any kind of further hearing immediately.
03:30So, that is what the development is right now taking place.
03:34But SIR hearing will continue because that is also a parallel hearing that's been going on for quite some time
03:40now.
03:41There are additional petitions that have also been filed in that matter.
03:44So, those will be the matters that the court will first be taking up for hearing.
03:49So, even though, of course, the focus is on detention and curbs,
03:53later the Election Commission-related plea will be heard by the top court.
03:56But do you think this is primarily about how there is always a right to protest
04:00and a democratic peaceful protest, but it's the behavior of pushing towards the court
04:05despite an email reply that came from the CJI.
04:08That has been questioned.
04:09That he'll have to explain that how did this whole march happen
04:12when there was a clear communication that went in.
04:18Well, you know, the concern largely is that the Supreme Court
04:21is a constitutional institution of the country.
04:24If we see that people are coming in for protesting inside the court,
04:28that somewhere down the line tackles and actually entangles the entire judicial conduct as well.
04:34So, probably that is the reason this kind of an observation has come in
04:37that he's been pulled up, Rahul Gandhi has been pulled up
04:40for the kind of manner in which protesters along with him barged in.
04:44There was a commotion inside the complex of the Supreme Court.
04:47Yes, the Delhi Police is parallelly looking into the entire incident,
04:51but this is the court taking observation.
04:53So, how that will be perceived is something we'll have to look in.
04:56But right now, there has been a notice that has been issued
04:59so far as the SIR matters are concerned.
05:02And we'll have to see those responses that is coming in from the government.
05:05Clearly, the parties will also be made to the Election Commission of India.
05:08So, we'll go back to the next week.
