00:02:12So let's dig in. Clavicular. Charged. This is as of September 2026. A couple of things first. The usual caveats.

00:02:22Me, no lawyer. Me, no legal expert. Me, took philosophy of law in university. Me, not expert.

00:02:29Do not. This is not legal advice. Nothing I say has any legal content or validity.

00:02:36These are all just nonsense opinions with a tiny little bit of philosophy knowledge about law.

00:02:40So all of this I'm talking about, of course, are allegations. Innocent until proven guilty. Nothing has been proven in

00:02:46court.

00:02:47There is a Massachusetts criminal case and a Florida civil case.

00:02:53So here's the case snapshot. Defendant Brandon, sorry, Brayden Peters, also known as Clavicular, born December 17th, 2005.

00:03:04Yes, I've never felt younger. He's 19 on the charge date, 20 now.

00:03:11So he was born the same year I started doing Freedom Aid, back when it was Freedom Aid Radio, when

00:03:17I thought everything was just going to be wired like Radio Shack.

00:03:21Named civil plaintiff, Alexandra Vasilevna Mendoza, now 18 years old.

00:03:32Criminal court is Orleans District Court, Cape Cod.

00:03:35Charge is filed September the 8th, 2026, after probable cause September 4th.

00:03:39Arraignment is October the 14th, 2026.

00:03:43He is summoned. Clavicular is summoned. He's not been arrested.

00:03:46The counts are rape, drugging a person for sexual intercourse, procuring alcohol for someone under 21.

00:03:52Because Lord knows, none of us have ever done anything like that, ever.

00:03:57The max on rape is up to 20 years in prison.

00:04:03Now, the Massachusetts age of consent is 16, still four years higher than some places in Mexico.

00:04:12So, 16, this is an intoxication incapacity case, not statutory rape of a child under 16.

00:04:18So, just be aware of that.

00:04:21The civil suit in Miami-Dade filed April the 28th, 2026, later amended.

00:04:26Is it the same accuser for the civil case and the criminal charges, or the criminal case?

00:04:33Well, the court did not name her.

00:04:35Massachusetts redacted the complaint, and in the criminal complaint,

00:04:37the public docket does not say this is the Florida plaintiff.

00:04:41A fact-pattern match.

00:04:43The two have said that there's the same date, same Chatham House, same live stream and vodka story,

00:04:48same next morning claim.

00:04:49Her civil lawyer, Andrew Moss, confirmed to the New York Post that Mendoza is the alleged victim

00:04:55in the Massachusetts criminal case.

00:04:56That is the accuser's representation, not a court finding.

00:04:59CNN used an unnamed source with knowledge of the charges.

00:05:03Miami News, which obtained the police narrative, said they could not independently confirm from

00:05:08the redacted criminal file that it is the same woman, and flagged the 16 versus 17 age

00:05:14discrepancy between the two filings.

00:05:16So, Clavicular has treated her as the same person in public.

00:05:21He posted her letter, text, bottle girl DM, and clips under the rape charge news.

00:05:27So, what has been happening?

00:05:30And we'll get into the philosophy of it as we go along.

00:05:33So, around May 2025, there was a contact through Instagram from Clavicular.

00:05:38He pays her for a looks, maxing videos, and invites her to stream.

00:05:43Civil complaint says she was 16 when they met.

00:05:46May 23rd, 2025.

00:05:49So, the criminal file about the Cape Cod night says the complainant was 17.

00:05:54She Ubered to the family house, Clavicular's mother and grandmother were home, and they

00:05:59did a Twitch stream from his bedroom.

00:06:01There was vodka.

00:06:02Well, okay.

00:06:04I mean, was there, was there not?

00:06:05So, I suppose you can't drink on a camera in some places.

00:06:10And so, I think he was pouring from what looked like a vodka bottle, but he said it's just

00:06:15water.

00:06:15I don't know if that's a way of bypassing the restrictions.

00:06:18I don't know for sure.

00:06:19So, a kiss on stream.

00:06:22They kiss on stream.

00:06:23After she says she's drunk, sex that night, she falls asleep.

00:06:27She says she awoke to sex the next morning, and then was Ubered home.

00:06:31And then there was a gap of about six months.

00:06:34So, the woman told the police she did not see him again for about six months.

00:06:37In and around November 2025 in Miami, they reconnect.

00:06:41There's a live stream where Clavicula injects her with Aqualix, which sounds like underwater

00:06:49sex, but no, Aqualix.

00:06:52Aqualix is a European fat-dissolving injectable.

00:06:54It is supposed to be injected into a pocket of fat, so the cells break up, after which the

00:06:58body clears them.

00:07:00So, the civil claims are that he was unlicensed, there was no valid consent, there's implied

00:07:04meth in the mix, and a perforated cheat, and this is a different night from the indictment.

00:07:10So, why did he inject her a Luxmax in content?

00:07:12It was supposed to melt cheek fat, leading to a shaped jaw, chisel, and so on, right?

00:07:17Chisel the face on kick.

00:07:19She claims he stated or implied that the mix contained methamphetamines, but there is no

00:07:23toxicology reports.

00:07:24To substantiate this, you'll notice that this came quite a long time, hundreds of days after

00:07:28the incidents, sometimes, or a couple of hundred, so there's no toxicology reports.

00:07:35December 2025, per post he made in September 2026, text he attributes to her in screenshots

00:07:42with the contact he stored as Lexi, not independently authenticated.

00:07:45Monday, December 29th, 5.38pm.

00:07:48Her, hey Clav, how are you?

00:07:50Him, good.

00:07:51She hearts the reply.

00:07:54Seems like some affection.

00:07:56That later that night, Monday, December 29th, 9.48pm.

00:08:00Her, I want you, NGL.

00:08:02That means not going to lie, I think.

00:08:04I want you, NGL.

00:08:05She said, I'm tired of being like independent.

00:08:07I mean, I like it, but I just need a man to relax with.

00:08:11We could keep everything private too, like no social media.

00:08:14Clavicular says, I've been pretty busy.

00:08:16Her, yeah, I get that.

00:08:18When you get more settled, let me know.

00:08:21And Wednesday, January the 7th, she says, can you help me set up Kik?

00:08:26I think that's a streaming platform.

00:08:28Now, again, unverified.

00:08:30So later, a handwritten letter TikToks and DMs the Clavicular posted that he attributes to her.

00:08:35A handwritten letter.

00:08:36I wish you had art supplies so I could make this good.

00:08:38Also, don't mind my dyslexic writing, but just know, Brayden, you have my loyalty 100%.

00:08:50This is after she claims he raped her.

00:08:55Also reported, she thanks him for helping provide income and a place to stay.

00:08:59Offers him a back massage, cooking, or a spa day.

00:09:02Says she admires him as a man.

00:09:04Some write-ups say it is signed, Alexandra.

00:09:07And then there's a TikTok of her saying they're not dating.

00:09:10They did a stream where he injected Aqualix.

00:09:12It was really fun.

00:09:13He was super nice.

00:09:14And he sent me an Uber home right after.

00:09:18And then she posted the following.

00:09:20Oh, sorry.

00:09:21He posted the following.

00:09:23L-A-L-M-A-O, laughing my ass off, was literally trying to work at Bacara as a bottle

00:09:28girl.

00:09:28How about don't finance guys you can't afford?

00:09:31Happens to all successful young men.

00:09:32People try to come for your money.

00:09:34Greed is evil.

00:09:35And Clavicula included a clip of her with a car and a TikTok DM screenshot from her to somebody else.

00:09:43And so I'm curious how much you make and how the job is.

00:09:51The civil suit is filed.

00:09:52Original counts.

00:09:53Battery.

00:09:53Fraud.

00:09:54Intentional infliction of emotional distress.

00:09:56Or I-I-E-D.

00:09:58Which, of course, sounds fairly close to I-E-D.

00:10:02Unauthorized likeness.

00:10:02No sexual battery count at that filing.

00:10:05The unauthorized likeness is about 15k worth of sponsorships she was supposed to have had.

00:10:11We'll get into that.

00:10:12June 4th, 2026.

00:10:14Complainant and a lawyer walk into Chatham PD.

00:10:16Three hundred and seventy-seven days after the May 23rd, 2025.

00:10:24Alleged.

00:10:25Accused.

00:10:27A rape.

00:10:30And June 2026.

00:10:33Sexual battery added to civil suit.

00:10:35July 2026.

00:10:36Clavicula side moves to dismiss fraud.

00:10:39The I-I-E-D.

00:10:40And unauthorized likeness.

00:10:41They leave the injection battery count and ask to sever the sexual battery count to have that tried separately.

00:10:47Severing a charge, if granted, means the judge has the discretion to conduct separate trials.

00:10:52They cite tax letters claiming that those items show that she knew about the injections.

00:10:56He refuses to settle.

00:10:58August 2026.

00:10:59Police tried to call Clavicula.

00:11:02There's no answer.

00:11:02The mailbox is full.

00:11:04Uber records later confirm a right tied to his number.

00:11:07September 4th to 8th, 2026.

00:11:09Probable cause found by a clerk magistrate.

00:11:11Then complained by the police.

00:11:14September 21st to 22nd, 2026.

00:12:18So, October 14th, 2026.

00:12:20The judge will read the charges.

00:12:21He will enter a plea.

00:12:23Counsel, bail.

00:12:24Next days will be determined.

00:12:25The district court cannot try the case.

00:12:27Rape and drugging are felonies, of course, that must be tried in Superior Court.

00:12:30But, typically, cases of this sort take two paths to a Superior Court.

00:12:35A grand jury indictment, which may then proceed to a Superior Court indictment.

00:12:39District court probable cause or bind over hearing.

00:12:41A judge hears witnesses to determine probable cause.

00:12:44If he finds probable cause, the case is then sent to a Superior Court.

00:12:48There are cases, of course, in its very early stages.

00:12:50A lot can still happen, including the charges being dropped.

00:12:53So, what is factual and what is theorized?

00:12:57What is in evidence and what is not?

00:12:59So, documented or well-reported?

00:13:02Yes.

00:13:02The live stream clips exist.

00:13:04Police reviewed them.

00:13:05She is on camera talking, flush, saying she's drunk, then kissing him.

00:13:09I've seen a video where she's fondling him and calling him hot.

00:13:12He's topless in the video, and so on.

00:13:15The full live stream video on demand does not appear to be available.

00:13:19Clips circulating may or may not be the woman in question.

00:13:23She told police the clavicular told her to say she was 18 and that the vodka was water.

00:13:34I do not know how he said, she said, with no objective evidence or third-party witnesses

00:13:39or recordings or anything like that.

00:13:41I have no idea how that gets to the 95 plus percent you require or is required

00:13:46for proof beyond a reasonable doubt.

00:13:49I do not know.

00:13:51I do not know.

00:13:52But this is why, you know, we as a society or people as a society need to prevent this

00:13:58kind of stuff from coming into existence in the first place because who knows?

00:14:03You can't tell.

00:14:04It's he says and she says.

00:14:07So, the alcohol amount is her estimate only.

00:14:10She said two, three shots, not really shots, more like cups, no pour count, no bottle, no

00:14:17blood, alcohol level.

00:14:20She described being awake for the stream, the kiss, the couch makeup, and sex in more than

00:14:25one position.

00:14:33Now, I'm no expert, I'm no expert, but, and I'm certainly no lawyer, but it would seem

00:14:39to me that sex in more than one position, hey, let's do it this way, hey, let's do it

00:14:43that way, hey, let's put on the fur gloves and hang from the spinny top, let's get on the

00:14:48roundabout, let's take open the swing set.

00:14:51I mean, sex in more than one position, does that not seem consensual?

00:14:55It would seem to me something in that direction again, just an opinion.

00:14:59So, then she woke up to sex the next morning.

00:15:02She told police she did not give verbal consent that night and also did not tell him to stop

00:15:07during that encounter.

00:15:09Again.

00:15:10Oh, actually, that hurt a little, but that's fair.

00:15:12That's fair.

00:15:13We should be punished for letting society go this insane.

00:15:16So, she appears to be on stream, from what I've seen, appears to be on stream, saying

00:15:20he's hot and touching him and so on.

00:15:22She's above the age of consent, he's 19, and she is, I think, 17, and so on.

00:15:29Let me just double-check that.

00:15:37Sorry, why don't I look at this right?

00:15:38Defendant, 19.

00:15:39Yeah, he was 19 then.

00:15:41I think she was 17, so, yeah, I mean, yeah, the complainant was 17, sorry, 17.

00:15:48Just don't want us to double-check that.

00:15:49I don't want to get that wrong.

00:15:50So, it's above the age of consent.

00:15:51They're two years apart, and women mature a little faster than men in the teenage years,

00:15:55so they may actually be roughly about the same in terms of maturity.

00:16:05So, she says she did not give verbal consent but not tell him to stop.

00:16:14If they're having sex in different positions and she's not telling him to stop, what does that mean?

00:16:29There was no sexual assault forensics exam.

00:16:32She said so to police.

00:16:33No reported blood alcohol test, no toxicology or DNA from that night, and, of course, 377-day delay makes those

00:16:41impossible.

00:16:44And, of course, she voluntarily reengaged months later for another stream.

00:16:50What is not established, that a second drug was given on May 23rd, the, quote, drug in count is charged.

00:16:55Public reporting does not prove it is anything beyond the alcohol incident or theory.

00:17:01Exact age consistency.

00:17:03Civil is 16 when they met at some events.

00:17:06Criminal is 17 on May 23rd.

00:17:09On stream, she allegedly said 18.

00:17:11He says that's her.

00:17:13Police say he coached that line, right?

00:17:15Maybe on Twitch or wherever they were streaming, you have got to be 18 or something like that.

00:17:20So, she says she's 18, and then she also says to the police, oh, no, no, he told me to

00:17:26say that.

00:17:27Again, who knows?

00:17:29Who knows?

00:17:33So, what is not established is that the later affectionate texts, the loyalty letter, the bottle girl ask, are fake,

00:17:40or that they legally cancel a rape claim.

00:17:43Right?

00:17:44There was this fairly ghastly meme from some months back, which was the pouty, vengeful woman from the movie Obsession.

00:17:53And it was like, how your girlfriend looks at you when you ask her to block the guy she claims

00:18:01raped her, you know, five years ago or something like that, right?

00:18:10So, allegations, civil allegations in Florida.

00:18:15So, later Miami injection, this is the Aqualix, the alleged meth comment.

00:18:19This is around November 2025 on the stream.

00:18:22Civil charges, battery fraud, intentional infliction of emotional distress.

00:18:26Claims he was unlicensed, that Aqualix is not FDA approved for that use.

00:18:31There was no valid consent.

00:18:32She looked impaired after the first poke.

00:18:35Her cheek looked perforated, and he knew she was still a minor.

00:18:39Now, again, the minor is not with regards to sex.

00:18:42If it is, oh, no, sorry, that's different in Florida.

00:18:46My mistake, sorry.

00:18:48So, what's his response?

00:18:49The motion to dismiss claims other than battery, as detailed earlier, text or letters show she knew what the injections

00:18:54were, and he refused to pay.

00:18:56He posted her later comments that the stream was really fun, and he was super nice.

00:19:02So, in early 2026, this young woman apparently signed with an online trading platform as a social media promoter at

00:19:08$15,000 a month.

00:19:10Must be nice.

00:19:11She claims that he ran a campaign to discredit her using his following, and that she lost the deal and

00:19:16other sponsorships.

00:19:18So, that's another issue.

00:19:21Unauthorized likeness.

00:19:22This is a civil charge.

00:19:23Unauthorized use of name and likeness.

00:19:26He used her name slash face on the Kik injection livestream and monetized replays without permission.

00:19:31Complained neither he nor Kik had consent to stream that session.

00:19:34The VOD stayed up.

00:19:35He kept profiting.

00:19:37His response?

00:19:38Greed, shakedown, bottle girl DM, don't finance cars you can't afford, and so on, right?

00:19:43Again, I'm no lawyer.

00:19:44I don't mean to repeat myself, but it bears repeating.

00:19:47I don't quite understand how you livestream with someone and then say, oh, my God, it's livestreamed.

00:20:00I don't know.

00:20:02Neither he nor Kik had consent to stream that session because it was a livestream.

00:20:07So, I'm not quite sure.

00:20:09Maybe it'll become sort of clear.

00:20:10But, you know, if there are people chatting and comments flowing in and you're livestreaming and you're saying hi to

00:20:17people and you're having live interaction with the audience, I'm not quite sure how you end up saying, oh, my

00:20:22God, you livestreamed that?

00:20:23Again, what do I know, right?

00:20:26Cape Cod sexual battery charge.

00:20:28The Cape Cod sex was already in the April 28th fax.

00:20:31Alcohol, no consent that night.

00:20:32The morning claim is that she woke up to him having sex with her and she didn't say anything, let

00:20:40it happen.

00:20:40But she's saying that that's a form of sexual assault as far as I understand it.

00:20:45So, the charge itself was added by amendment in June 2026.

00:20:49His response, no separate public comment on this charge.

00:20:51In September, after criminal charges, his spokesperson cited the late ad to the case as part of the shakedown story.

00:20:58And who knows, right?

00:21:00I mean, not in this particular situation, I'm sure, but we can imagine a situation where a woman says, you

00:21:06know, pay me X, Y, or Z amount of money or I'm going to add, I'm going to throw you

00:21:10a rape charge.

00:21:15So, the criminal allegations in Massachusetts.

00:21:18These are the facts tied to the Orleans District Court complaint.

00:21:21Rape, drugging a person for sexual intercourse, procuring alcohol for someone under 21.

00:21:25He invited a 17-year-old to stream and paid her for looks-maxing videos.

00:21:32So, his response, of course, is general denial of criminal wrongdoing, points that laid a friendly contact and money motive.

00:21:37No detailed public account of why he brought her there.

00:21:42Apparently, well, he knew she was 17 and told her to lie and say 18, according to her police narrative.

00:21:48He knew she was 17, coached the on-stream age line.

00:21:51He posted a clip, he says, shows her saying 18, criminal file says 17 that night, consent in Massachusetts is

00:21:5916.

00:22:00Vodka presented as water.

00:22:02She says, Clifficula told her to call it water to dodge a Twitch ban.

00:22:05She felt peer pressured.

00:22:07Quantity is sloppy in her own words.

00:22:09Do three shots, not really shots, more like cups.

00:22:13On-stream, wait, I'm so drunk.

00:22:15Then a kiss, face is flushed.

00:22:17He, shirtless in at least one clip, family is in the house.

00:22:20This is the factual core of the under-21 alcohol count.

00:22:23He was also under-21.

00:22:26His response, no poor by poor account, brought a denial.

00:22:29Sex that night without consent because she was too drunk.

00:22:32After the stream, a couch make-out session, then bed, multiple positions, no verbal consent in her telling.

00:22:38She also told police she did not tell him to stop during that encounter.

00:22:41Now, in Massachusetts law, as far as I understand it, drunk sex is not automatically rape.

00:22:46The state has to prove incapacity and that he knew or should have known.

00:22:52Yeah, good luck with that.

00:22:54Over a year after it, his response, he denies.

00:22:58Spokesperson also denies.

00:23:00So, she was drunk.

00:23:04He'd been drinking.

00:23:06How is it automatically, since they're both above the age of consent,

00:23:10and they have sex while they've both been drinking,

00:23:14how is it automatically that she is the one who is the victim?

00:23:19Why is he not the victim?

00:23:21Because he's drunk.

00:23:22Maybe he was more drunk than she was.

00:23:24Maybe she took advantage of him.

00:23:25Right?

00:23:25It's called forced to penetrate,

00:23:27where men can get erections even if they are being assaulted.

00:23:32All right.

00:23:32So, next morning, she says she woke up to sex already happening.

00:23:36Quote in the police narrative,

00:23:38I was getting effed when I woke up.

00:23:41Shock didn't stop him because it was already underway.

00:33:56From what I've seen, again, I'm not sure if it's exactly the same clip and all of that, but it

00:34:02it seems that she was quite enthusiastic to be there, I don't know what's going on with Clavicula's family that

00:36:53system, if I was involved in that kind of situation, as reviewing, I would say, on what grounds can we

00:37:03get to prove beyond a reasonable doubt?

00:37:06That would be my question, upon reviewing this.

00:37:11On what grounds, on what grounds can we get to prove beyond a reasonable doubt?

00:37:17She appeared to be into him.

00:37:20Well, they're saying that she was intoxicated, but there's no blood alcohol level.

00:37:33I mean, she could have been pretending to be drunk for coolness sake, right?

00:37:38But there's no specific mention of how drunk she was.

00:37:46And there's no blood alcohol count.

00:37:48There's no exact count of how many drinks she had.

00:37:51And she stayed the night, and even if she was intoxicated the night before, it seems unlikely that she was

00:37:57intoxicated in the morning when they had sex, and she didn't indicate, or she didn't say no, she didn't seem

00:38:03to indicate that there was anything negative happening, and so on.

00:38:06And so, how is it possible?

00:38:08And look, there may be twists and turns.

00:38:10In this case, what do I know?

00:38:11I'm just talking sort of general legal theory in a free society, in a rational society.

00:38:16How do you get to prove beyond a reasonable doubt when it's his word against her?

00:38:26You can't even get to the preponderance of evidence.

00:38:35I generally find it hard to give accusers a lot of credibility if they stay in positive and affectionate contact

00:38:44with the people they claim assaulted them in these hideous kinds of ways.

00:38:49I just, this is my personal opinion, right, it's not illegal, blah, blah, blah, I find it very hard to

00:38:56give that a lot of credibility.

00:39:02It's not absolute certain proof that something unthwarted didn't happen, but if this was a horrific assault that happened, what,

00:39:20Why you would stay in positive, if not affectionate, if not lusty contact with the man afterwards.

00:42:49But if it does, if you're going to have sex with a woman and dangle wealth and fame and status

00:42:57and all of that, and she sleeps with you because she wants to be your girlfriend,

00:43:04she wants to sleep her way into something permanent, then that's really tough, and it's tough for women.

00:43:14I'm telling you, it is tough for women because in the past, women kind of held the line as a

00:45:17So, of course, the goal or the hope for rich guys,

01:08:16And so, I have a decent friend group.

01:09:10And I went to work as a gold panel prospector, and I spent some time in Thunder Bay.

01:09:18We'd bring them back and process them in a warehouse in Thunder Bay.
