A political controversy has erupted over revelations that Election Commissioners Sukhbir Singh Sandhu and Vivek Joshi recorded 14 objections over 10 months during the Special Intensive Revision (SIR) exercise. The concerns included changes to Form Six for new voter registration, access to digital databases and voter deletions in West Bengal and Goa. The Opposition has demanded accountability and accused Chief Election Commissioner Gyanesh Kumar of acting autocratically. The Election Commission, however, said decisions were taken unanimously after internal checks and balances. The BJP defended the poll panel, saying differences during deliberations reflect democratic decision-making. Former CEC OP Rawat and Congress leader Abhishek Manu Singhvi have debated the constitutional and operational framework of the Election Commission.

00:03So far the opposition was in an all-out war against the Election Commission over India's voter rolls.
00:09And now the spotlight is on the poll panel itself.
00:13An Indian Express report has flagged repeated objections from two election commissioners
00:18over the SIR exercise, raising questions over changes to Form 6,
00:24control of electoral data and the way the voter roll revision is being implemented.
00:31Fourteen objections in ten months, a political storm outside
00:35and a denial of any internal rift within the Election Commission.
00:39The Election Commission says it views differing opinions
00:43as a normal part of its internal checks and balances.
00:46But opposition, which has gotten a fresh ammunition and warns CEC out,
00:52says that this is not acceptable.
00:56The BJP has asserted dissent is part of democracy.
01:00So 14 objections, four big flashpoints and a political storm outside the poll panel.
01:06The question now is not just what was objected to,
01:11but why did these objections surface 14 times
01:16and what do they reveal about the SIR process?
01:20Is the Election Commission insulating itself from scrutiny?
01:25Are critical decisions being taken without adequate disclosure?
01:29And if the referee itself is under question,
01:32what does that mean for the credibility of elections?
01:35I will be asking all these questions to the guests who will be joining me shortly.
01:39But first up, here's what happened today.
01:45The Election Commission is meant to be the referee of India's elections.
01:49But after the opposition,
01:51even poll body members are raising red flags over the voter roll process.
01:56An Indian Express report has now flagged objections
01:59raised by two of the three election commissioners,
02:02Sukhbir Singh Sandhu and Vivek Joshi.
02:13The biggest flashpoint is Form 6, which is used by new voters to register.
02:19The two commissioners reportedly objected to changes,
02:22seeking past electoral details,
02:24questioning whether the form could be changed without amending the rules.
02:28The objections also reportedly covered concerns over the centralization of the voter database
02:34and digital access.
02:35With respect to West Bengal,
02:38the Election Commissioner questioned appeals against restored voters,
02:41saying the two commissioners and the Chief Election Officer were not informed.
02:45And in Goa, the issue involved voters who were found eligible locally
02:50but faced a difficulty being included in the electoral roll
02:54because of software-related glitches.
02:59At the heart of it all is Form 6.
03:01The form used to apply for inclusion in the electoral roll.
03:05So what exactly changed?
03:08Parents and grandparents' SIR details now sought.
03:12Parents' old roll details sought.
03:15Parents' constituency details required.
03:18Parents' booth number required.
03:20Option if parents not found in SIR.
03:23Online declaration made mandatory via unapproved IT changes.
03:29And these changes triggered objections from both ECs.
03:33And what was an internal disagreement has now become a full-blown political flashpoint.
03:40CEC Gyanesh Kumar is facing attacks from the opposition.
03:44From Rahul Gandhi to Mamata Banerjee,
03:46Akhilesh Yadav to Arvind K. Chriwal,
03:48leaders have demanded action against the CEC.
04:14This election commission must be arrested.
04:17He has no moral authority to continue.
04:23And BJP must see.
04:25They cannot destruct our constitution.
04:28They cannot destruct demolition non-democracy.
04:53EC has rejected claims of internal rift saying it stands for complete election integrity
04:58and functions strictly under statutory law.
05:02It says internal notes are part of the commission's checks and balances,
05:06while differing views are a normal part of deliberation.
05:09ECI says all commissioners can make suggestions to the CEC.
05:14The poll body also says it took unanimous decisions over the past year.
05:20The BJP too has backed the EC saying differences during deliberations are a sign of democracy
05:26and has pointed out that the opposition won seats, it had claimed, were compromised by the poll body.
05:34All the opposition parties have fallen into the trap.
05:37The trap where they said that the election commissioner and this government was a dictatorial government.
05:44Rather, I would say that this is pure democracy.
05:47Election commission of India, nor any constitutional body in India,
05:52is under a dictatorial rule.
05:55They are functioning in a democratic manner.
05:59And of course, they are upholding the democracy of this country.
06:04As War of Words continues, one question remains.
06:08Are the 14 objections routine deliberations or signs of deeper differences within the poll body?

06:19And joining me on the show tonight, Dr. Syed Zafar Islam,
06:22National Spokesperson of the BJP and former Member of Parliament, O.P. Rawat,
06:26former Chief Election Commissioner, is also joining us.
06:29Mr. Rawat, let me begin with you.
06:31You have been part of the election commission.
06:34In fact, did I say, you sat in that chair.
06:36Is dissent normal or is 14 on record objections a warning sign?
06:45Maria, this is perfectly normal for election commission's functioning
06:50because election commission, no individual commissioner has any power or authority.
06:57They have power only through election commission, the body.
07:01And the body has to function according to a law.
07:04Law says all decisions of the election commission shall be taken either unanimously or by a majority vote.
07:12So, it will be presumed that all the decisions taken so far have been taken either unanimously or by majority
07:22vote.
07:23The objections notwithstanding because both election commissioners must be conversant with the law,
07:30must be conversant with the procedure.
07:32So, if any decision is recorded against their will, they knew that they have majority.
07:39They could have overruled and they could have decided other way.
07:43They were not supposed to go to cabinet secretary or to register their complaint somewhere.
07:49If at all they felt something seriously wrong is happening,
07:53the only course of action for them is to go to President of India
07:57because they function as an autonomous body, constitutional body, which works under President of India.
08:04Okay.
08:05Since you have made that important point that this is routine,
08:08that's where I will bring in Dr. Syed Zafar Islam.
08:12Dr. Zafar Islam, this has become a political hot potato
08:16with the entire opposition saying that the chief election commissioner must resign
08:21but also highlighting other aspects.
08:26That if two commissioners say that they are being bypassed,
08:31the opposition is asking a question, who is actually running the commission?
08:36Well, Maria, Mr. O.P. Rawat has very nicely explained everything.
08:42What is the authority they draw from the body?
08:46What constitutional rights they enjoy?
08:49And what is the decision-making process?
08:53And it is election commission, commissioner, they are all among equals.
08:59So it is either consensus or they can obstruct through majority.
09:05I think it's very nicely been explained by Mr. Rawat.
09:08So all the decision which has been taken,
09:11and that is the press release of the election commission also says,
09:14that deliberation is part of the decision-making process.
09:20So they must have been deliberated.
09:21All issues must have been, they must have a different opinion.
09:24I mean, there is no problem if somebody has a very different take compared to the other people.
09:29But as long as there is a meeting of minds and consensus there,
09:35it's a decision taken by everybody, and they have all been signatory to all the decision.
09:39Had that not been the case, perhaps they had the majority, two out of three,
09:46perhaps they could have blocked all the decision which has been taken by the election commission.
09:49But that is not the case.
09:51So all these arbitrary, they will, I mean, all the opposition will tomorrow,
09:55or whenever the election commissioner will speak about it,
10:00they will stand exposed because the commissioner must have taken dissent unanimously.
10:06and all these things are irrelevant when the dissent have been made and it is unimplemented.
10:14Because today, if they say that I have not been given the chance to,
10:20or my dissent has not been recorded or not been acknowledged,
10:25it's something which is factually incorrect.
10:26because if there is a dissent of two people,
10:29they cannot make a dissent, the dissent cannot be taken.
10:31So it is absolutely baseless to make this kind of allegation.
10:35Let me bring in O.P. Rawat as well.
10:36O.P. Rawat, you know, throughout the entire special intensive revision exercise
10:40when it was undertaken, I had spoken to you on multiple occasions,
10:44you had flapped some concerns,
10:46and then you had spoken about the entire, you know,
10:50perhaps that was the need of the hour as well.
10:52And these objections, sir, is coming at a time when SIR exercise
10:57is being questioned repeatedly by the opposition.
11:01Here are two of the three commissioners saying that steps were taken without their knowledge.
11:08Is that really possible?
11:10Was that possible in your tenure?
11:15This must never be possible if you are in the commission
11:19and if you know your authority.
11:22You are sitting there, you are functioning as a commission,
11:26all decisions are taken in the commission,
11:28no individual is authorized to take any decision relating to election,
11:32SIR, electoral roll revision, or anything.
11:35Only a few administrative powers are with CEC
11:37regarding transfer, etc., of their election commission employees.
11:42There are sanctions of leave.
11:43Only those administrative powers, financial powers.
11:46Not anything regarding elections, or electoral processes, electoral systems.
11:52All those decisions have to be taken by the commission in a meeting by unanimous vote or majority vote.
12:01So, there is no question of that they are not knowing.
12:04And if any such thing has come to their notice,
12:07they must immediately go to President of India and complain
12:11that this is what is happening in the election commission,
12:14that even the law governing the working of election commission is being subverted.
12:20There are two election commissioners here, Sukbir Singh Sandhu and Vivek Joshi,
12:25who have raised 14 objections in 10 months.
12:29Unusual? Or do you think this is how it works?
12:32It never works this way, because if there is any difference of opinion,
12:37election commission meeting is meant only to iron out those differences,
12:41bring about a consensus, or if a consensus is not possible,
12:45defer that matter, if it can be deferred for some time,
12:48no urgency is there, or if urgency is there,
12:52then take a vote and decide it.
12:55So, that has been the process.
12:57There is no scope for the process.
12:59Losing complaints.
13:01And here it is really laughable
13:04that two election commissioners
13:06having same opinion,
13:09having majority on their side,
13:11why should they go and complain?
13:12They should take decisions in the meeting
13:15according to their will.
13:17So, they should exercise their powers
13:20rather than complaining to the cabinet secretary.
13:24So, it is completely...
13:24Correct.
13:25In fact, going to cabinet secretary is bad,
13:28because it gives a signal
13:29that you are still under the government.
13:31You are not.
13:32You are under only president of India, nobody else.
13:35But it also gives an impression,
13:37as the opposition is reading,
13:39that this is a clear example of CEC's misuse of power.
13:44Perhaps he is trying to control the entire power
13:46and the functioning of the entire election commission.
13:49And not really believing in collegiality,
13:52which has been the principle of any,
13:54the functioning of any election commission.
13:56Now, that is where I am saying
13:59that knowing the law is your duty
14:01because you are a constitutional authority.
14:03So, when you know the law
14:05and you know that two is a majority out of three,
14:09how can you give a handle like this to any CEC
14:12having dictatorial attitude?
14:15How?
14:15If you give it that kind of handle to him,
14:19then he is enjoying.
14:21Why should you complain then?
14:23Because you can take a meeting,
14:25decide and record
14:27and those decisions become final.
14:29Overruling everything else.
14:31Dr. Zafar Islam,
14:32here is a very unique perspective
14:33which is coming in from a former CEC.
14:35So, I want to understand from you
14:37because this is playing out in the,
14:39you know, political domain.
14:42You know, in fact,
14:43politicians are of the opinion.
14:45Arvind K.D.
14:46while you heard a soundbite,
14:47he says that all the elections
14:49which have been held under the CEC,
14:53Mr. Gyanesh Kumar,
14:55should be declared null and void
14:57and that no election should be held now under CEC
15:01because there are states that are going to polls.
15:03Rahul Gandhi says that this is Deshdro as well.
15:07I think Mr. Opi Rawat,
15:10his statement,
15:12I mean, I was with him on another channel as well,
15:14has bulldozed all those kind of statements
15:16which is coming from the opposition parties.
15:19Having said that,
15:20let me tell you very candidly
15:21that all the two election commissioners
15:25we are talking about,
15:28why did they,
15:28as he rightly pointed out,
15:30why did they write to cabinet secretary
15:32when the constitutional authority for them
15:35and the superior body
15:37is the president of India?
15:39If there's anything
15:40which they had to complain,
15:42they should have gone to president of India
15:44instead of writing something
15:46and politicizing now.
15:47I mean,
15:48if they are part of the decision-making process,
15:50either you object then
15:52when you draw the constitutional authority
15:55from the constitution and the body,
15:57then you should exercise those powers
15:58at that time
15:59instead of making that statement
16:01or revealing those information now.
16:03When you have the authority,
16:05exercise it.
16:06When you know that something wrong is happening,
16:08then you must stop it.
16:09But this is something
16:11which is more political
16:13if at all.
16:15I don't know authenticity of the report
16:17of what has appeared in the next press.
16:21But if they are feeding this thing
16:24to political parties,
16:26opposition parties,
16:27it will not work
16:27because they definitely will get exposed
16:30because they had the power,
16:32they didn't exercise the power.
16:33Or if at all,
16:34they feel that they had dissent
16:37and that has not been acknowledged
16:39by the Chief Election Commission.
16:41So all the political parties
16:42which are making noise today,
16:44tomorrow they will have to shut their mouth
16:46because they are on the wrong footing.
16:48They are making a statement
16:50which is factually incorrect.
16:52And I'm sure that at some stage
16:54the Election Commission will come out.
16:55I think I'll give the last closing remark
16:58to O.P. Rawat, sir.
17:00Mr. O.P. Rawat,
17:00what will you be telling
17:01all the political parties
17:02which are saying that
17:04they stand vindicated today
17:06after this report?
17:09Political comment
17:11may be based on many facts
17:12because there have been
17:17plunders in the SIR process
17:19starting from Bihar.
17:21When pointed out,
17:22Election Commission made amends
17:25tried to improve
17:26and corrected
17:28and then went through
17:30the whole process.
17:31Honorable Supreme Court
17:32also intervened at times.
17:34They also gave directions.
17:36So based on that also,
17:38political opinion may be based.
17:40It may not be based
17:42only on these two election commissioners
17:44coming up with their 14 complaints
17:46and all.
17:47So there are other issues
17:48like West Bengal.
17:50That is an eye-opener.
17:52That you deleted their names
17:54and an appeal
17:55and 93% are found eligible voters.
17:58This is a blot on the democracy.
18:01How could you preside over a process
18:03where eligible voters
18:07to the extent of 93%
18:08got deleted from the electoral rolls?
18:12Those are the things
18:13which really
18:15give you disturbing signs.
18:17Okay.

18:18Mr. Rawat,
18:19always a pleasure speaking to you, sir
18:20because you had some
18:22very interesting observations
18:24to make today.

18:37He is a fifth term
18:38sitting member of parliament,
18:40eminent jurist,
18:41former chair of
18:41Parliamentary Standing Committee
18:43on Law,
18:44Home Affairs and Commerce
18:45and member of the
18:46Congress Working Committee.
18:47Dr. Singhvi,
18:48you have cited
18:50the 1995
18:51Supreme Court ruling
18:52that the CEC
18:53is only first among equals.
18:55But if
18:56the other two
18:57election commissioners
18:58that is
18:59Sukbir Singh Sandhu
19:01and Vivek Joshi
19:02disagreed,
19:03why didn't
19:04either commissioner
19:05file formal
19:06dissent
19:07or resign
19:08rather than
19:08leaving it
19:09to a newspaper
19:10report to surface?
19:14We live in troubled times.
19:17It is no answer
19:19for an autocratic CEC
19:21or a runaway EC
19:23which has been hijacked
19:24by one man
19:25to say
19:26that because
19:27there is written objection,
19:29because the objection
19:30says illegal,
19:30unauthorized,
19:31because I have not
19:32bothered to reply
19:33to the objection,
19:34but unless they resign
19:36or they take
19:37some other drastic action,
19:39I will ignore them.
19:40Point one.
19:42Point two.
19:44Perhaps
19:45the chief election
19:46commissioner has read
19:47or possibly
19:48in all probability
19:48not read
19:49the Supreme Court judgment.
19:50Mr. Session
19:51raised exactly
19:52the same argument
19:53which de facto
19:54the current CEC
19:55is implementing.
19:56The argument
19:57was that the CEC
19:58has primacy
20:00over and above
20:01the ECs.
20:02The Supreme Court,
20:03and I quoted it
20:04in my press conference,
20:06demolished that
20:06categorically,
20:07they are set
20:08first among equals.
20:09Altogether,
20:10he must develop
20:11a convivial
20:13confidence in all of them
20:14and there is
20:15absolute majority
20:16rule there.
20:17Thirdly,
20:18to my arithmetic,
20:20two out of three
20:21is a majority.
20:23Two out of three
20:24have given in writing.
20:26There is no reply
20:27to those letters,
20:28but here is
20:29the internal
20:30bulldozer
20:30of the commission.
20:32We have talked
20:33about external
20:33governmental bulldozers
20:35which have bulldozed
20:36several of our
20:37constitutional
20:38and statutory bodies,
20:39but here is
20:40an internal
20:41bulldozer
20:41which has hijacked
20:43and bulldozed
20:43its own EC
20:44from its own
20:46colleagues
20:48and that
20:49cannot be the answer
20:51unless we are
20:52told that
20:53this was the reply
20:54given
20:54and after the reply
20:56was given,
20:57everybody agreed
20:58in a third order.
20:59None of that
21:00has happened.
21:01So, this is nothing
21:02but, as I said,
21:03what about it?
21:04Two election
21:05commissioners here,
21:06Mr. Sandhu
21:06and Vivek Joshi,
21:07recorded 14
21:08written objections
21:09over 10 months.
21:10Yet, the ECI
21:11insists
21:12that every
21:13decision
21:13was unanimous.
21:14The Congress
21:15party is calling
21:16this cover-up.
21:17Isn't it equally
21:18possible
21:19that this is
21:19normal
21:20internal
21:22deliberation
21:22which is now
21:23being weaponized?
21:27Somebody had
21:27the courage
21:28to put in
21:28public domain
21:29that letter
21:30X was written
21:31on August 13
21:32by Sandhu
21:33and Jushi.
21:33Letter Y
21:34was written
21:34in May 2026
21:35by the same
21:36two persons.
21:37They elicited
21:37these replies
21:38and after
21:39these replies
21:39they recorded
21:40the satisfaction
21:41in this manner
21:42and the replies
21:43would have to
21:43show four
21:44things,
21:45Maria.
21:45It's important.
21:46The first
21:46reply to the
21:48first letter
21:48would show,
21:49look,
21:49there is no
21:50restriction of
21:51access to
21:51EROs.
21:53the allegation
21:54that the IT
21:54department of
21:55the EC
21:55does not
21:56allow its
21:56own EROs
21:57unrestricted
21:58access is
21:59wrong for
21:59the following

22:01Not the
22:01if they
22:02dictate or
22:03the dictat

22:42government,
22:43answer is
22:43no.
22:44Whether the
22:44EC can modify
22:45itself,
22:46answer is
22:46no.
22:46But did
22:47the EC
22:48ask all
22:49these people
22:50that yes,
22:51all you
22:5213 crores
22:52whom we
22:53have
22:53disenfranchised
22:54in the
22:54country,
22:55any of
22:55your children
22:56who now
22:56apply will
22:57be faced
22:57with this
22:58preliminary
22:58threshold
22:59objection
22:59that 13
23:00crores of
23:00us have
23:01parents who
23:02have been
23:02disenfranchised
23:02therefore we
23:03can't apply.
23:04Now if I
23:04get a letter
23:05like that in
23:05response by
23:06the CEC,
23:07maybe I'll
23:08begin answering
23:08your question.
23:09But these
23:10generalities,
23:12these banal
23:13blanket denials,
23:15this speaking
23:15like a
23:16sovereign from
23:16the mountaintop,
23:18this exhibiting
23:20illusions of
23:21grandeur do
23:22not befit a
23:23constitutional
23:24functionary.
23:25Sir, the
23:25election commission
23:26in its press
23:27release says
23:28that differing
23:28views are
23:30normal
23:30deliberations,
23:31that every
23:32officer is
23:33also fully
23:34authorized to
23:35give suggestions.
23:36But if
23:37suggestions can
23:38simply be
23:39overruled and
23:39then called
23:40unanimous after
23:41the fact,
23:41what does
23:42dissent inside
23:43the ECI
23:44actually mean
23:44in practice?
23:47Dissent
23:48inside the
23:48EC means
23:49that you
23:50suffer the
23:50fate of
23:51Lavasa.
23:52Dissent
23:53inside the
23:54EC means
23:54that you
23:55are road
23:55rolled.
23:56Dissent
23:57inside the
23:58EC means
23:58that your
23:59dissent is
23:59not replied
24:00to.
24:01Dissent

24:26definition or
24:27sets of
24:27definitions,
24:29which are
24:29worse than
24:30Alice in
24:30Wonderland,
24:31which say
24:31I will
24:32define words
24:32as I
24:33think I
24:33want to
24:34define them.
24:35Okay,
24:35Dr.
24:35Singh,
24:35my last
24:36question.
24:36Since you
24:36have appeared
24:37in multiple
24:38SIR cases,
24:39the Election
24:39Commission has
24:41called this
24:42one part of
24:43the picture
24:43and has
24:44pointed to
24:45the much
24:45larger body
24:46of approvals.
24:47But transparency
24:48isn't a
24:49number game,
24:50Mr.
24:50Singhvi.
24:51If even
24:52one commissioner's
24:54objection was
24:54overridden
24:55without proper
24:56explanation,
24:57doesn't that
24:57undermine the
24:58credibility of
24:59everything else
25:00the commission
25:01claims was
25:01unanimous?
25:04You are
25:05broadly right,
25:06the commission
25:07or rather
25:08don't call
25:08it the
25:08commission.
25:09The commission
25:09is a
25:10collegiate
25:10body
25:10decided in
25:11specific terms
25:12by the
25:12Supreme Court
25:1330 years
25:13ago in
25:141995.
25:15Whenever you
25:15say commission,
25:16please amend
25:16your word to
25:17say CEC.
25:18Today in
25:19India,
25:19one man is
25:20speaking because
25:21he's an
25:21internal bulldozer
25:22who's backed
25:23by an external
25:23bulldozer in the
25:24government.
25:24government, so
25:26the CEC today
25:27believes that
25:2914 objections
25:32in 10 months
25:34do not deserve
25:35a reply, do
25:37not deserve the
25:37disclosure of
25:38a reply, if
25:39any, and
25:40unless you
25:40disclose it
25:41means there
25:41is no reply.
25:43And because
25:44by a variety
25:45of hooks and
25:46by crooks and
25:47more by crook
25:48and less by
25:48hook, you
25:49ultimately ride
25:50roughshod over
25:51the descents,
25:52the new
25:53definition of
25:53that is
25:54unanimity.
