00:00Does any restitution be stayed pending appeal?
00:02I don't know that I have that authority.
00:03Did not cross my mind that you would not have that authority, so...
00:06As for today, the court's duty is to make a decision.
00:10A weighty, long-lasting decision.
00:13Corey Richens was convicted, unanimously and beyond a reasonable doubt,
00:18of attempting to murder Eric Richens, her husband and the father of their three children.
00:24And then, having failed in her first effort of spending the next 17 days,
00:30not changing course, but doubling down, preparing to try again,
00:34and ultimately completing the act through the administration of poison.
00:39And for what? Money.
00:40All for pecuniary gain.
00:42A person convicted of committing that sequence of acts in that way and for that reason,
00:48and who causes the absolute tragedy that has befallen Eric Richens' sons and family.
00:55A person convicted of those things is simply too dangerous to ever be free.
01:01Accordingly, Ms. Richens, based on your conviction on count one,
01:05first-degree felony aggravated murder,
01:07the court hereby sentences you to life without parole.
01:11When this woman was sentenced to life without parole,
01:13and her lawyer asked to delay restitution,
01:15the judge denied the request and ordered the payment to move forward.
01:19We're here for a restitution hearing.
01:21Ms. Lewis, the state filed a motion for restitution hearing.
01:24Ms. Richens has not filed any written response to it.
01:27Does she stipulate to the amounts in the motion, or is she requesting a hearing?
01:31We're not requesting a hearing.
01:33We would ask, the only thing we're asking,
01:34is that any restitution be stayed pending appeal.
01:37Other than that, we'll just submit.
01:38I don't know that I have that authority.
01:40I'm happy to be educated about that, but
01:42I think the statute requires me to make a determination,
01:46and then because Ms. Richens is in prison,
01:49to send that amount to the Office of State Debt Collection.
01:52It did not cross my mind that you would not have that authority,
01:55so I didn't, I mean, I can look into that if we want to address that later,
01:59and I can submit something if I find something on that, but...
02:02Any objection to the amount?
02:03No.
02:03It requests $1,017,018.49 to auto owner's insurance,
02:10and $352,562.61 to TrueStage.
02:16The state's motion for restitution is granted as unopposed.
02:22Ms. Richens' request for a stay on that determination
02:26is respectfully denied without prejudice,
02:29because the court's view of the underlying statute
02:32is that I am required to make this determination,
02:34and because Ms. Richens is incarcerated,
02:37I am required to send that amount
02:39to the Office of State Debt Collection.
02:42Ms. Lewis, if you find authority to the contrary,
02:44I'm happy to consider it.
02:45It looks like a motion's going to need to be filed.
02:48It says it can be stayed,
02:49but it might have to be filed in the appellate matter,
02:52so I'll figure that out.
02:53Okay, very good.
02:53Thank you for your patience.
02:54I wish you all the very best.
