00:11...new bill that could give thieves a get-out-of-jail-free card.
00:15Now, it would create expanded diversion programs for offenses they consider crimes of necessity.
00:20But what exactly is a crime of necessity?
00:23The amendments make it clear that this policy only applies to low-level theft crimes,
00:28no felonies, and codifies case law.
00:31And while we have diversion programs for drugs and mental health,
00:34we do not have the same for crimes of necessity led by poverty.
00:39Joining us now, a man who's fighting back against this new bill,
00:42California State Assemblyman Carl DeMaio.
00:45Carl DeMaio, thank you for being here.
00:47What is a crime of necessity?
00:51Well, basically, the Democrats say that if you're poor,
00:55that forces you to go out and rob a store.
00:58Now, let me be very clear.
00:59No one is robbing stores for food, bread, eggs, milk, or butter.
01:05They're stealing Nikes and Playstations.
01:07Let's be very clear about what crimes and what criminals
01:11they're trying to protect with these diversion programs.
01:14More offensively, when this bill was brought up,
01:17the author of the bill and the Democrats said,
01:19Donald Trump is responsible for the crime wave
01:23because of H.R.1, the big, beautiful bill.
01:26People will be going hungry, which is not true.
01:29The big, beautiful bill is all about cracking down on fraud
01:32and protecting taxpayer money.
01:33People who need help will continue to get help.
01:36But they said Donald Trump's going to cause a crime wave,
01:38and so we need to make sure when people do commit crimes
01:42because of necessity, because they're poor,
01:45that they not be put in jail.
01:47Voters in California overwhelmingly rejected
01:49this coddle the criminal nonsense last year in Prop 36,
01:54and they said we want to punish criminals
01:56because we cannot have a crime wave impacting
