00:20A U.S. federal judge has delivered a major blow to the Trump administration's deportation
00:26policies, ruling that the government cannot use immigration powers to silence protected
00:32speech.
00:33In a ruling from San Jose, California, Judge Noel Wise said the Trump administration's
00:39efforts to deport non-citizens over political expression violated key constitutional protections.
00:47The case was brought by the Stanford University Student Newspaper, which argued that international
00:52students had become afraid to speak publicly about Israel's war in Gaza because of the
00:59threat of deportation.
01:01Judge Wise emphasized that freedom of speech and freedom of the press are foundational to
01:06American democracy.
01:08She found serious First Amendment and Fifth Amendment problems with portions of the federal
01:13provisions being used to justify deportations.
01:17The judge also pointed to actions by U.S. immigration authorities in March 2025 against people whose
01:24speech supported Palestinians or criticized Israel's actions in Gaza.
01:30Wise warned that the danger could extend far beyond the current political debate.
01:35She said targets could eventually include anyone in the United States who exercises free speech
01:41simply by expressing opinions the government does not like.
01:45The ruling builds on an earlier decision by a federal judge in Boston, who also found that
01:51the Trump administration violated constitutional protections when it targeted non-citizens for
01:57deportation because of pro-Palestinian speech and criticism of Israel.
02:02The Justice Department has not publicly commented on the latest ruling.
02:06Meanwhile, the Foundation for Individual Rights and Expression, which brought the lawsuit, welcomes
02:12the decision.
02:13Attorney Conor Fitzpatrick said the ruling reaffirmed a fundamental principle.
