00:00I don't know why, when people go to places, how hard it is to follow instructions.
00:04When this politician assaulted a poll worker after refusing to remove his campaign hat,
00:08the judge rejected his self-defense argument and held him accountable for breaking election laws.
00:12The court is calling 2025 CR003507, State v. Jesse Lutzenberger.
00:20All right, what were your issues that day?
00:21I was in line for 45 minutes before I actually got to vote.
00:25They asked me to remove my hat then, after I was standing here for 45 minutes.
00:28So I removed it and put it in my lower back.
00:31When I went out the other side, this person that had already harassed me in two other previous times
00:36that I went to go vote in a different location was again there.
00:39I walked away from him twice when he was verbally harassing me and getting physical with me.
00:44Let me tell you what it says in here.
00:46It says, he observed an older adult male inside the polling premises and you had displayed campaign material,
00:54which was your hat.
00:55He observed the violation.
00:56He contacted the male and advised him that he would need to refrain from wearing the hat while on the
01:02premises.
01:03The complainant explained that the male complied with his instructions while he was voting,
01:07but then put the hat back on as he was making his way to exit the premises.
01:12Due to still being well within the premises,
01:15he approached you again and advised you to remove the hat while he was on the premises.
01:20The male, that's you, explained that he was on his way out and refused to comply.
01:24He began to follow you and told you again to remove your hat.
01:28And as you were about to exit, you struck him on the chest and facial area several times with your
01:34fist,
01:34causing him pain and discomfort.
01:36I don't know why, when people go to places, how hard it is to follow instructions.
01:40How old are you?
01:41All right, you're 64 and you're up here fighting.
01:44And I don't even call it fighting because it doesn't say that he ever even hit you back.
01:48And they're not even paid enough money for somebody to be hitting on them.
01:51It appears to me you do have anger issues.
01:54I don't have anger.
01:54I was walking out.
01:55He was quite a waste.
01:56Did he not tell you to remove your campaign gear and that you were not allowed in the area?
02:01It was after the fact when I had a refund.
02:03I was in the library section.
02:05Let me just tell you, within that hundred line, you are not allowed to wear campaign gear.
02:10Now, if you're saying what's being said is untrue, then you need to set this for a jury trial.
02:14And there's a reason why this says waiver consent to stipulation of testimony and stipulations.
02:20You know what that means?
02:21That means that everything is in this document.
02:22You're stipulating that it is true and correct.
02:25I, Jesse Lutzenberger, do hereby judicially confess and admit that I intentionally and knowingly
02:31in Bexar County, Texas, caused injury to the complainant by striking the complainant
02:35with the hand of the defendant and by pushing the complainant with the hand of the defendant.
02:39You stipulated to that and said it's true.
02:41Do you think about him punching at me first?
02:43Now, if you're saying he punched you first, then maybe you want a jury trial and you want
02:46to say it's self-defense.
02:47It's on video.
02:48The only reason why I'm accepting that is because I don't have the money to continue.
02:51All right.
02:51Does he want a jury trial?
02:52I'm not accepting it.
02:54There's going to be a $500 fine.
02:56Two years deferred.
