00:00Let's go.
00:30This is Sandra Aguinaldo.
00:46Hi, Jeremy C. Lotok. Do swear.
01:07si Pangulong Bongbong Marcos, First Lady Lisa Araneta Marcos, at dating House Speaker Martin Romualdez.
01:14To me, as the chief investigator at that time, the utterances made by the Vice President was serious
01:25and the threat was real and actual.
01:29Is this contained in your investigation report?
01:32Yes, sir.
01:33What made you say that?
01:35Na yung pagbabanta ng vice-presidente ay both seryoso at totoo?
01:42Number one, the delivery or manner in which the utterances were spoken.
01:50That's one.
01:51Number two, the literal meaning of the statement.
01:58Number three, the nature of the instruction.
02:03And number four, the relationship between the parties.
02:06The Vice President was furious on filming that.
02:10Nakita ho namin dun sa video nung niran ho namin, Your Honor.
02:13If I'm not mistaken, I think more or less palung beses po siya galit na galit at nagmumura at minumura
02:22yung presidente,
02:24si first lady, and then the former Speaker of the House.
02:34Why is this a factor in classifying her threats as serious and real?
02:46Yes, Your Honor, it's very much a factor because we want to establish the intent of the Vice President
02:54and that intent is crucial in our investigation.
02:59We want to determine whether those utterances made by the Vice President were just a product of a temporary feat
03:10of anger.
03:11Was it just spur of the moment or were they really serious?
03:20Was it serious, real?
03:22Yeah, Your Honor.
03:23In those utterances, the Vice President said,
03:26Wag kang tumigil hanggat hindi mo sila mapapatay.
03:32It shows persistence on the part of the Vice President that she was determined to carry out those utterances.
03:46Your Honor, pwede hong mag-take advantage yung ibang grupo dyan, ibang individual.
03:55God forbid may mangyari sa Vice Presidente for one reason or the other.
04:00Mati-trigger ho ngayon yung instruction.
04:03And then, papatayin ngayon yung God forbid again, ang Presidente, Lisa Marcos, ang former Speaker.
04:10And, in fact, even yung triggering na phase na yun, pwede mag-take advantage doon yung ibang grupo,
04:26Medyo magiging disorder, magiging chaotic, magiging anarchy yung society.
04:31Sa kanilang pag-iimbestiga, nakahanap pa raw sila ng iba pang video bago pa man ang November online press conference.
04:39Nakita raw nila ang isang press conference noong October 18 ng parehong taon sa Facebook page ng Office of the
04:46Vice President.
04:47Gusto ko, ang galing ng ulo niya ba?
04:57I realized, toxic na yung relationship.
05:02Imagine myself, cutting his hand.
05:10Magiging ilang bahagi mula sa November 23 press conference, ipinakita sa Senado kanina.
05:19Ninyong lahat, Martin Romualdez, Lisa Marcos, Bongbong Marcos.
05:26Ano yung significance ng three comparisons nito sa investigasyon?
05:30Based on these patterns and consistencies in the utterances made by the Vice President,
05:38it appears that these statements have tendency to steer up the people against the government,
05:50have tendency to disturb the peace of the community.
06:00na freedom of expression lamang ang kanya naging pananalita.
06:04Three reasons, Your Honor.
06:06When the second highest official of the land openly and publicly uttered
06:12that she had already contracted a person to kill
06:15the highest official of the land,
06:17the First Lady and the former speaker,
06:21and that she instructed the person to be relentless in killing them,
06:25we failed to see any amount of freedom of speech in that utterance, Your Honor.
06:30That's number one.
06:31Number two, we talk to ourselves.
06:37If we allow the argument that it is within the bounds of freedom of speech,
06:43if we allow that to become the norms of our society,
06:48then who would prevent anybody from doing the same to anyone?
07:00Based on your affidavit of investigation,
07:04did the Vice President commit a crime?
07:12Based on your investigation, Attorney Lotok,
07:18was there enough basis to file a criminal complaint, as you did,
07:24for the crimes you charged the Vice President with prima facie evidence only,
07:29not as to whether or not she indeed committed it or not,
07:32because only a Court of Justice can determine that?
07:36Yes, Your Honor. Based on our findings,
07:38we believe that the Vice President committed the crime of grave threats and inciting positions.
07:43Only in so far satisfying the requirement of prima facie evidence sufficient to file a case.
07:50Prima facie evidence with reasonable certainty of conviction.
08:03What findings, if any, convince the NBI the motive of the respondent to kill the President and two other people?
08:18Meron po bang kayong nakitang motibo?
08:22Yes, Your Honor. As I've said before,
08:25when we take into consideration all the facts and circumstances surrounding that issue,
08:45Sinasabi ng Vice Presidente is
08:52politically motivated yung pag-attack sa kanya
08:56and then at the same time, pinagtutulungan siya ng buong gobyerno.
09:36Now, Your Honor, I think, I believe that's a typo yung date.
09:39Council, we shall await that the document speak for itself.
09:42Yes, Your Honor, please.
09:51First Lady at dating House Speaker?
10:18does that automatically mean that the threat is no longer credible or actionable?
10:24The threat was absolute.
10:45Grave threats can be committed with or without condition.
10:48Si Sen.
11:06You're not denying that the vice president spoke to a hitman.
11:09No, we are denying that, Your Honor.
12:07We didn't revise the affidavit of investigation. We just produced the affidavits.
12:13Hindi ho namin binago, Your Honor, yung affidavit namin.
12:16Nag-require ho ang Department of Justice.
There's something wrong with the case.
12:38Siguro po, next time, make sure na yung kaso yung sasampa ninyo is airtight.
12:57The SAMSES Department of Justice, correct? It's a very basic question.
13:00Again, I don't know, Your Honor.
13:02No, based on this document, the only question is, it says Department of Justice, correct?
13:09As I've said, Your Honor, hindi ako ang nag-file. May inutusan ako.
13:15Do you see it in the screen? Do you see it in the hard copy?
13:18Counsel asked and answered, move on. That's the response of the witness.
13:22So, will you agree that, considering that this was supposed to be received by the DOJ,
13:27it is only the DOJ that has the authority to change the date?
13:32Again, you ask the DOJ, sir.
Judge Mig Zubiri
13:41para hilinging ipagpabukas na lamang ang cross-exam.
13:45We've been here for 6 hours, 2 to 8.
13:47May we request, maybe counsel for the defense or the body that we just adjourned tonight and continue tomorrow.
Lotok.
14:10Ako, si Mark Salazar, ang inyong saksi.
