00:05And that's why today we're not going to go into the substance, right?
00:10Everybody wants to know, you know, what happened here, how did they get up, etc.
00:18But at the end of the day, the only appropriate place to deal with this is in the court.
00:23That's why we're going to deal with this in the court and the proper channels of the court.
00:27Another thing I want to point out, though, is that, I don't know if any of you guys saw it
00:32on NBC News this morning,
00:35but they made a statement that even the building's own people, Empire State Building's own people,
00:42said that there was no risk of danger to any of the tenants, to any of the guests on the
00:48observation deck,
00:50or anyone in the building.
00:52So I want to bring that to your attention.
00:54I have seen nothing about any burglary tools whatsoever.
00:58Right now, we're at the initial stages of the case, right?
01:01In any criminal case, we're entitled to what's called discovery.
01:05What that is, is all the evidence that the state has in the case, right?
01:09So the next step is for the government to provide all that evidence for us to do our job,
01:15just like we do it on every single other case.
01:17You know, just because this is a media case doesn't change the process.
01:20But we all saw the evidence. They were up there. They weren't supposed to be there.
01:24What's the defense?
01:27So we're not going to be making any statement of defense yet because we haven't had a chance to review
01:33all the discovery yet.
01:34We need to observe, we need to review all the discovery, go through it with the fine comb,
01:40and then we can assess that.
01:42But there's really no way I can properly, you know, advise you on that at this stage.
01:48But another issue is, you know, based on my reading of this complaint, the DA's office overcharged here, right?
01:56So they had to have known they were going to be seen by the whole, not just the city, but
02:00the whole world.
02:00Absolutely, and they're trying to send a message.
02:03But at the end of the day, you know, thank God that my firm and I were hired.
02:07You know, there's no bail set on this case, and we're going to do what we need to do, just
02:12like on any other case.
02:14What was the motivation for them to do this?
02:16I'm not going to be making any of the statements as far as their motivation.
02:19I'm here as their lawyer, and I'm just going to be doing my job.
02:22You said they had a message, right? What was the message they wanted to send?
02:25Well, listen, as far as what I've seen, and I'm sure you've all seen, it was a message of love,
02:32all right?
02:32And, you know, that's a nice thing.
02:35Now, but on the other hand, you know, the law is the law, right?
02:38So we're going to deal with this case.
02:41But I will say, you know, it's nice to have somebody wearing black masks doing a message of peace instead
02:47of a message of destruction and war.
02:50And, you know, no one was hurt here.
02:53The winds were very low speed on the day.
02:58It was like five to six miles per hour, all right?
03:03There's, we're not talking 20, there are other cases we're talking 20, 30 mile per hour winds, all right?
03:07We're not dealing with that here.
03:08We're talking about five mile per hour winds.
03:11You know, that's not, that's very, very insubstantial.
03:13So no harm, no foul?
03:14I'm not, listen, that, my, like I said, I'm not here to make any statement with respect to that.
03:21I'm here to do my job as a defense attorney, and I hope you all have a wonderful day.
03:25Are they going to get married soon before they return to court?
03:29It looks like, you know, she didn't say no and everything went well, so that's, I'm very happy for that.
03:36I mean, come on, what a, what a way to propose.
03:38It's something like you could only dream of, so you got to, you know, give them some credit for that.
03:43So are you asking for all charges to be dropped?
03:47I didn't make any statement that we're asking for all charges to be dropped at this time.
03:52You know, it's step by step.
03:53Today was the arraignment.
03:54We just got the charges.
03:56We haven't received a shred of discovery.
03:59Once we receive the discovery, then we'll assess it, and we'll have a better, a better lay of the land,
04:04and what we're dealing with in our next steps moving forward.
04:06Any damage to the law enforcement that was out there?
04:10You know, nothing but respect to the law enforcement who would do their job and do it well.
04:17On the other hand, when they don't do it well, then they have to be called out, and, you know,
04:23they have to be called out when they do the job wrong.
04:26But, you know, I'm not going to make any statements with respect to how they did their job with respect
04:31to this,
04:31because I haven't reviewed the bodyboard camera, I haven't reviewed the surveillance tapes.
04:36So it would really be premature for me to make a statement with respect to that at this time.
