00:00The Bureau also voted on the 8th of June to suspend you as the prosecutor of the International Criminal Court
00:08till the whole ICC 125 state membership convened to vote on a secret ballot on the issue on the 24th
00:18of July here in New York.
00:20The ICC Bureau must win by at least a two-third majority of the 125 member states.
00:29If they fail in doing so, then the whole motion to find you guilty of sexual misconduct is rejected by
00:37the ASP, the Assembly of State Party, and that's that.
00:41If they win and the ASP finds you guilty by two-third majority, which is 83 member states, then they
00:50will start another motion to vote on firing you,
00:53and that can be decided by a simple majority, i.e. the support motion to the motion of firing must
01:01be 63 member states or more.
01:04So I hear here, now at the United Nations, the ICC Bureau want to vote to go straight on the
01:12motion of firing you with simple majority
01:16by passing the determination of your guilt or innocence of misconduct by two-third majority.
01:24Will the Bureau succeed in doing so, especially this is the one time in history that such a vote is
01:34conducted?
01:35Can they do it?
01:37Well, the Bureau has a composition that I think the WIOG, the Western European and other group, Eastern European group,
01:44and the allies are disproportionately represented.
01:46Going back to your first point, it's really critical to understand that in the 20 years of the International Criminal
01:54Court,
01:54until my matter, experts have written that not one decision of the Bureau was decided by a vote.
02:05It was all by consensus until Kareem Khan's matter was before the Bureau.
02:12The biggest group of countries is the Africa group.
02:17There are 33 countries from the Africa group.
02:20And no country from the whole of this vast continent of Africa supported the finding of misconduct.
02:28They were really of the view that you have judges, you should stick with the judges.
02:34This is what people have said after the vote.
02:38In terms of the procedure, I'm in the dark.
02:41I mean, it's amazing that I'm in the dark.
02:45I find out things from the media, from speculation.
02:48They have not told me what the procedure is.
02:51I can't, of course, go to New York, but I don't know if I can address the Assembly of State
02:56Parties.
02:56The procedure says I should be able to.
02:58But they haven't given any guidance to my lawyers.
03:02They haven't told me anything other than there will be a special session of the Assembly of State Parties convened
03:10in New York on the 24th of July.
