00:36time did you call this i've been waiting for you for over an hour i know i'm sorry jack there
00:40was
00:40a big hold up just outside leeds what are you doing in leeds at this time of the morning
00:44he's been out clubbing with trish it's a bit mad look i'm not really interested in your nightlife
00:48can you just sort my sheep out actually i can't right now why not because i've left all the stuff
00:55back at the surgery oh for heaven's sake can't you give me some idea what's wrong with her look
00:59i'll just i'll just nip back i'll get me gear why didn't you do that in the first place i'm
01:04sorry
01:04i know i'm i was just worried about being late i'm really sorry will you stop apologizing and go and
01:10get your equipment i can't stand around here all day waiting for you to get over your hangover
01:14oh no jack i'm not i'm not over just a bit short asleep i'm sorry i can't stay in court
01:22today we're
01:22just run off our feet at the practice it it wouldn't be fair on paddy don't worry about it
01:28well look on the bright side could all be over by the end of today that's what i'm afraid of
01:34oh come on kim you know as well as i do the jury aren't gonna find you guilty
01:39chris practically demolished the case against you single-handed after his little outburst yesterday
01:45i hope you're right i know i am
01:55paddy where on earth have you been that phone's not stopped ringing yeah i know yeah well i've just
01:59had a right earful from jack's sugden i thought he was gonna have a heart attack i know i've just
02:03seen him you can't have you don't have any of your stuff for you yeah i know that lynn and
02:06that's
02:07why i've come back to fetch it and i'm gonna go back to jackson a minute and it's all under
02:10control
02:12well this ain't gonna do the reputation and the practice much good is it lynn where's zoe
02:18running kim into car right um do you mind not saying anything about this please all right
02:30mrs marchant do you recall the evidence given by miss dixon earlier in the trial she said that
02:36she obtained orcino from your husband at midday on september the 15th yes what were you doing at
02:42that time exercising the horses so why didn't you notice that orcino was missing i think steve's
02:48already said he switched the horses he put a white daub on toby's forehead to make him look like orcino
02:53but surely you still would have noticed that a horse was missing i don't exercise them all at once
02:58so if he timed the switch right then no and in the evening you checked all the horses yourself
03:05didn't you i did so why didn't you notice that toby had been moved if orcino had been stolen at
03:11lunchtime there would have been one empty stall whatever swapping about had been done toby's one
03:16of the stable horses and not nearly as valuable or as important as the stud horses so checking them
03:22at night isn't an exact science you look down a line of stalls you can't necessarily see every one
03:28really that's a bit slapdash isn't it i didn't look closer because i had no reason to think that
03:34anything was wrong or because you knew toby wasn't there no
03:40do you think a minute goes by when i don't wish i hadn't looked down that line of stalls and
03:44seen that
03:45toby had gone if i if i had done that then steve's whole plan would have been blown apart and
03:53cathy would never
03:56are you all right mrs marchant yes yes i'm fine
04:05i did not steal orcino but that doesn't mean i don't feel responsible for what happened to
04:13cathy glover i'm sure we're all deeply touched by that heartwarming display of social conscience
04:20mrs marchant your honor really the prosecution is attempting to ridicule my client please confine
04:27yourself to your cross-examination miss sharp your honor so as far as you were concerned orcino was
04:34safely in his stall except that it wasn't orcino it was toby and that's right i would like you to
04:41take a look at these photographs mrs marchant exhibits d and e your honor
04:50can you identify the horses in these pictures mrs marchant
04:54yes this is orcino and this is toby oh so no problem telling them apart no of course not
05:00for a start i know both these photographs they're from our brochure if i look at them closely like
05:06this well the difference is obvious but on a busy day going about my routine well it's a different
05:10matter really are you seriously asking us to believe that you couldn't tell a 300 000 pound
05:17thoroughbred from a nag toby's not a nag he's a hunter part thoroughbred both horses are over 15
05:25hands and they're both brown it was disguised he was in the right stable at the right time
05:31i wasn't looking for an imposter my mind was on other things how long have you been working with
05:37horses mrs marchant we've had stables at home farm for about 10 years but you were working with
05:42horses before that since i was a girl so 20 years more yes and you can't tell two horses apart
05:49that's not a very good advertisement for your equestrian expertise look we don't even know if the
05:54horses were swapped we've only got dixon's word for it and she's a self-confessed crook please answer
05:59the question mrs marchant if the horses were swapped i didn't spot it i don't know why i wish
06:05i did there's nothing else to say all right let's talk about what happened that night look at this
06:13please exhibit f your honor can you identify that document it's my phone bill your mobile phone yes
06:23look at the highlighted call halfway down the page 9 50 pm on september the 15th 1998 do you recognize
06:31the number steve's mobile why did you call him i didn't no as far as i knew he was in
06:38the bedroom
06:38making business calls i was enjoying a quiet evening in with zoe tate when the reverend thomas
06:45came round to ask about the fun run that's right he had a question for mr marchant yes i shouted
06:53it
06:53through the door i didn't want to disturb steve i knew he'd be angry if i went in so who
07:00did call
07:00mr marchant on your mobile actually i've thought about this really yes you see steve's number is
07:07preset into the keypad james was still up he was playing downstairs so he could quite easily have
07:13picked it up and press the button it's happened before how old is james a two oh he's a bright
07:20chap i like to think so so bright he was able to tell your husband all about the fun run
07:25i beg your
07:26pardon well by his own admission mr marchant wasn't in the bedroom when you called to him about the fun
07:31run and yet according to the reverend thomas your husband was able to answer his query
07:36unprompted when he finally returned to the house now how do you think he managed that
07:41i don't know pardon i said i don't know perhaps he heard us talking when he came down the stairs
07:48maybe the vicar did ask him the question again i don't know how ashley can be so sure he didn't
07:53are you saying that the reverend was lying no but i can't remember not definitely
07:59it was a trivial conversation i have a different explanation i suggest that when the reverend came
08:09round you panicked you shouted the question through the door to play for time fully aware that at that
08:14very moment your husband was miles away no now you had to pretend that he was there because this was
08:20your alibi you'd sent him out to fake the horse theft at a time when zoe tate would be an
08:25alibi for
08:26both of you that's not true you realized your mistake and on the pretext of taking out the
08:31rubbish you quickly phoned mr marchant to make sure that he knew what to say when he got back
08:36this is a fantasy then how did he know mrs marchant how did he know really your honor the prosecution
08:45is browbeating my client mrs marchant has already answered the question do you wish to add to your
08:52previous answer no your honor you don't have a plausible alternative explanation because there
09:04isn't one it was a brilliant plan i've told you i don't know anything about it except it all went
09:11wrong when your husband ran kathy glover down in cold blood you couldn't trust him anymore could you
09:18he was a liability you'd used him to do all your dirty work and now he'd outgrown his usefulness
09:24you set him up didn't you mrs marchant no or perhaps you just got too greedy you wanted all
09:30the money for yourself no that's not true none of this is true
09:45thank you mrs marchant i have no further questions your honor
09:52kathy love are you all right no why don't you sit down love i'll get you a nice betty don't
09:57what's going on well she's upset and who could blame her poor love raking over all this stuff
10:04kathy do you want me to take your help no please everybody stop telling me what to do all right
10:08i'm
10:08just trying to help that's all i've been an idiot what are you talking about i've made a terrible
10:13terrible mistake i think you should take her on no no i know exactly what i have to do kathy
10:22wait
10:31i'm sorry dad i let you down
10:38she's gonna get away with it again
10:44the worst thing and the sickest thing is
10:51all lies she tells
10:55it's like she's laughing at you
11:01why won't she let you rest
11:06why can't she just leave you alone
11:12dad why can't she just leave you alone
11:27what's going on
11:32did you find her i don't know where she's gone betty well she must be somewhere did you have a
11:36word with
11:36one of the objects i have received a request from mr martin's defense counsel
11:43that he should be allowed to re-examine mrs glover
11:47i have noted the objections from mr derbyshire
11:50but in the interests of justice and a fair trial for all parties
11:54i have decided that this new testimony must be heard
11:58please bring mrs glover to the stand
12:20mrs glover
12:22you understand that you are still under oath
12:24yes i do good so please tell the court what it is you want to say
12:30yesterday when i said that i had seen steve
12:34mr marchant behind the wheel before he hit me
12:39well i don't know if that's true or not
12:42surely either it is or it isn't
12:45a few hours after i came out the coma
12:48it must have been the middle of the night
12:50i was still pretty dazed
12:54i had a visit from kim marchant
12:59on her own
12:59yes
13:01she was very upset
13:04she told me that it was steve
13:06who had run me over
13:09she said that he told her
13:11he'd done it deliberately
13:12and that i'd seen him
13:14called out his name
13:15but you don't actually remember this yourself
13:20when i think back
13:22i can see steve behind the wheel
13:25driving straight at me
13:27i can see him clearly
13:28the expression on his face
13:33but i know that before kim's visit
13:35that memory wasn't there
13:37she planted it
13:40not necessarily
13:42i don't know
13:44it's all such a blur
13:45i don't know what i remember
13:49but i suppose
13:50if i'm really honest
13:52it could have been anyone driving that car
13:58yes
14:16so mrs glover
14:17when you gave your original testimony
14:19you were lying
14:21no
14:21when kim told me what had happened
14:24or her version of what had happened
14:25i just assumed it was true
14:27it was like it became my own memory
14:30i was confused
14:32you were confused
14:34i don't mean it like that
14:37kim told me she was afraid of steve
14:39that he was violent
14:41she said she was scared he might hurt her
14:43so when i told the police that i'd seen him
14:45i thought i was doing the right thing
14:47really
14:49yesterday when mr keating was feeling
14:51a little less enthusiastic about your testimony
14:53he went to great pains to remind the court
14:56that since the incident
14:57you've been seeing a psychologist
14:59on a regular basis
15:01and why exactly did you start this treatment
15:04it's nothing unusual
15:06anyone with an injury
15:08no mood swings
15:08panic attacks
15:09short-term memory loss
15:11nothing like that
15:11yes but
15:12so either you are psychologically unfit
15:15to give evidence
15:15or you're a perjurer
15:17which is it to be
15:18objection your honor
15:19these are just personal insults
15:21mr derbyshire
15:23no
15:23no it's
15:24it's all right
15:27i admit
15:28it's not been
15:29easy recovering from this head injury
15:32but i swear to you
15:34i clearly remember kim's visit
15:36oh yes
15:37yes
15:37but i'm not sure about the accident
15:39the doctor told me
15:41things would come back slowly
15:43bit by bit
15:44so
15:44maybe kim just helped things along
15:47helped trigger a real memory
15:50but maybe she planted it
15:51maybe she was just telling me what to say
15:56the thing is
15:58i don't trust her anymore
16:01i think she used me
16:05game over kim
16:09right lynn
16:10got some calls and i'm off to court
16:13you're right paddy
16:15you look terrible
16:15yeah yeah i'm fine
16:17i think i might be coming down with flu or something
16:19well go to bed if you're ill
16:21lynn can reschedule your appointments
16:24no it's nothing
16:25and how was jack
16:27pardon
16:28jack's had on this morning
16:29right
16:30yes
16:31jack was fine
16:33the sheep
16:34not so good
16:36i'll see you later
16:43you can't go on like this
16:45you what
16:45letting things slide
16:48and i thought kelly windsor was annoying
16:50no i'm serious paddy
16:51it's not fair asking me to cover up for your mistakes
16:53look
16:54no more lectures
16:55i was on the scene
16:56yeah well you're only a receptionist
16:58and only a temporary one at that
17:02i must ask you to remember
17:03that stephen marchant has pleaded guilty
17:06to all charges relating to the theft of orsino
17:10it is only left for you to decide
17:12whether he did
17:13or did not attempt to murder
17:15kathy glover
17:16as for kim marchant
17:19you must ask yourselves
17:21whether or not you believe that she was a victim of her husband's machinations
17:25could he have planned and executed such a complex operation
17:30living under the same roof
17:32without her knowledge and complicity
17:36if you believe that he could
17:38then you must acquit kim marchant
17:41if you don't
17:42then you must convict
17:46hi
17:47i didn't expect you back so early
17:49well there was only the summing up left
17:50and i've got a pile of work to catch up on
17:52well kim may walk free
17:54but i've worked out the final piece of the jigsaw
17:56what are you talking about
17:57i'm going to make sure she doesn't make a penny out of her nasty little crime
18:01even if she can sweet talk a jury with her poor little wronged woman act
18:05oh i don't think it'll come to that
18:07why
18:08kathy testified again
18:09she practically blew kim's case out of the water
18:13kim knew about the theft
18:14apparently she came to the hospital
18:16and told kathy what to say about identifying steve
18:19i hope she's got something fun planned for tonight
18:21because this could be her last night of freedom for a long time
18:27chris what's so funny
18:30you'll see
18:31you will now retire to consider your verdict
18:34however due to the lateness of the hour
18:37deliberations will not begin until tomorrow morning
18:40so i'm afraid you'll have to spend the night in a hotel
18:44thank you
18:45all stand
18:53you finished game
18:55even you can't snake your way out of this one
19:14kim i think we should have a serious chat before you go off
19:18not now
19:24oh i'm sorry i'm late
19:25leave me alone
19:26what's happened
19:28make sure she doesn't do anything stupid
19:32kim wait
19:34if you will burn the candle at both ends
19:36it'll do you no good at all
19:38right please mr turner
19:41any news of the trial
19:43jury's out
19:44what is kathy coming over
19:45nah she went straight home after court apparently pretty upset
19:48there'll be a verdict tomorrow
19:50who knows
19:51i'll be arguing out all day i should imagine you know
19:53locked in a smoke fill room slacking 12 angry men
19:56yes wonderful phil
19:58yeah that was henry fonda
20:00yeah i've seen that
20:01jack lemon's in it as well
20:03i don't think so
20:03yes he is
20:04jack lemon's one of the jurors
20:06that's right isn't it rachel

20:10who
20:10he was in the tv series the odd couple
20:12but jack lemon was in the film version of the odd couple
20:15that's why you're getting confused

20:32i went round to kathy's
20:33but she's not answering the door
20:35what happened in court today kim
20:37i don't want to talk about it
20:38well your barrister said something worrying
20:40i i guess there must have been some sort of setback
20:51sorry they're gonna put me away
20:52no
20:54what's gonna happen to james
20:58i'm sure it's not as bad as you think

22:30i felt humiliated
22:31come on
22:33you can't be serious
22:35hey
22:37moody
22:38no
22:51hey
23:14ah
23:15so it is you kim
23:17not that i can think of anyone else in the village who might have buried 190 000 pounds in my
23:21father's grave
23:24so
23:26you've either got off scot-free
