00:00Thusha Sharma's case has taken a dramatic turn after her husband, lawyer Samarth Singh,
00:03appeared at the Jabalpur district court, saying he wanted to surrender,
00:06only to be arrested before the process could be completed.
00:09Here's what exactly happened.
00:21For nearly 10 days after Thusha died in Bhopal, Samarth Singh had been absconding.
00:25Police had already announced a Rs 30,000 reward for information leading to his arrest
00:29and a lower court had also rejected his anticipatory bail plea.
00:32On 22nd May, Samarth withdrew his anticipatory bail plea from the Madhya Pradesh High Court.
00:36His lawyers told the media that he now wanted to surrender before the court and seek regular bail instead.
00:48Now legally, surrender means the accused voluntarily appears before a court or police and summits to custody.
00:54Usually after surrendering, the accused can apply for regular bail immediately.
00:57That's different from anticipatory bail, which is protection from arrest before police custody happens.
01:02But Thusha's family and their lawyer, Anurag Srivastav,
01:04alleged this surrender attempt was strategically planned to avoid direct police action.
01:11They claimed Samarth was sitting inside the district judge's courtroom with the door shut,
01:15despite being an absconding accused.
01:17Srivastav even alleged that when pressure mounted to open the room,
01:20Samarth allegedly shifted to the Bar Association chamber.
01:23The family says this points to influence being used because Samarth's mother, Girbala Singh, is a retired judge.
01:28Meanwhile, Samarth's legal team maintains that he was following due legal process.
01:32His lawyer said he had already decided to surrender after withdrawing his anticipatory bail plea.
01:36However, before the surrender proceedings could conclude,
01:39Bhopal police took him into custody from the Jabalpur court premises itself and brought him back to Bhopal overnight.
01:44The case is also intensified after the High Court allowed a second postmortem,
01:48while the Bar Council of India suspended Samarth Singh's license from legal practice,
01:51and court has sent him to a seven-day police remand.
