00:05In the criminal justice system, the people are represented by two separate yet equally important groups.
00:11The police who investigate crime, and the district attorneys who prosecute the offenders.
00:16These are their stories.
00:2324. Tough walk.
00:27Son of a bitch!
00:30You're killing me.
00:31What are you doing hitting a 16 against a 5? It's suicide.
00:34I'd do it my way.
00:37Hey.
00:38Take it easy, okay?
00:41Your marker took out with this last shoe.
00:44It didn't go through.
00:45That's impossible, bro.
00:48I need you two to come with me.
00:53Leave the chips.
01:04Your guy's late.
01:07He's coming.
01:09I promise.
01:11You see, when you hand over a credit card to pay for cards, it's a promise too, right?
01:18So your word doesn't mean a whole lot around here right now, you understand?
01:27What do you two do in here anyway?
01:29You're out there for months at a time.
01:31You have 48 hours in the city.
01:32You wind up in here playing cards you suck at and can't afford.
01:37I don't know.
01:43Oh, good.
01:45Daddy's here.
01:53Let's get this done.
01:55Four gray.
01:56Make it six.
02:00It's a little motto I learned in business school.
02:04Where there's four, that is six.
02:11Then we have two choices.
02:15Educate me, please.
02:16I give you the four grand that they owe you.
02:20Or you're going to ask me for six again.
02:22And when you do, make sure you got those guys by your side.
02:42Okay, officer.
02:44What do we got?
02:45It happened up there.
02:47No way he survived that.
02:49You sure he didn't fall?
02:51Or jump?
02:52That's a different department.
02:54No, he was pushed.
02:56That lady called 911.
02:58At 1035, she was walking down here.
03:01Heard arguing between two men.
03:03Next thing she knew, this guy went over the side screaming.
03:06Grabbing at the air.
03:08Practice head opening.
03:10Hey.
03:11Hey, what are you doing here, Lou?
03:13Victim's name is Wally Kane.
03:15He's a vice admiral in the U.S. Navy.
03:18Commander of a strike group visiting for fleet week.
03:20Everybody's watching this one.
03:22Including the D.A.
03:27Dead.
03:32Each person is playing in the U.S. Navy.
03:34And the reality.
03:35TheIG.
03:52Just on the team is making the U.S. Navy.
04:16Why was Wally Kane in New York for Fleet Week?
04:20A celebration of America's maritime power.
04:24That's who New York City managed to fail, this time our very best.
04:28Why look right to the top, to the weak, soft, on-crime DA.
04:32This city is over...
04:34No worse enemy than a former friend.
04:36They can't even protect...
04:37Well, I already contributed to your campaign, so...
04:40Thanks for stopping by.
04:42The death of Vice Admiral Kane's already gotten political, it's only been 12 hours.
04:45Political how?
04:47Well, it turns out that the soft, on-crime DA is to blame for all this.
04:51Okay, so you need answers.
04:52As soon as possible.
04:53We're on it.
04:54Nick, door's open in five minutes.
04:57Just stay on message to the extent possible and just, uh, be charming.
05:01That's what I do.
05:02Gotta go.
05:03Keep me updated, okay?
05:04Good luck.
05:07...assembled mastery over the scene.
05:10Wally Kane carried out airstrikes in Bosnia.
05:15Flew sorties in Kosovo.
05:19Coordinated strikes against the Taliban.
05:22We've become generous with the word hero.
05:26But out there, character reveals itself in ways land rats can't understand.
05:35Where there was risk, he faced it.
05:39Consequence, he absorbed it.
05:44Recognition of praise, we pass that on to you.
05:47We honor him by obeying his wishes.
05:53Take care of your shipmates.
05:56We have the watch.
05:58Fire, sir!
06:02Wally Kane and I were friends for 30 years.
06:08Sounds like you meant a lot to this crew.
06:10Yeah, we understand he spent most of his time on this ship.
06:13Uh-huh.
06:14He, uh, he loved the job.
06:17The mission.
06:18Right.
06:19Were you with him last night?
06:21No, when we're here for Fleet Week, I'm slammed.
06:23Part of the routine is we open up the fleet to the public.
06:27Show off what we do so I was stuck here on the ship.
06:30Did Vice Admiral Kane seem like he was under any strain?
06:33Lately, anything seem off?
06:35No, if anything, he's on a high.
06:38You may have read that I've been nominated to be an ex-secretary of defense,
06:41which meant that Wally was in line to take my job.
06:45Getting his fourth star.
06:47We got access to Vice Admiral Kane's credit cards,
06:50and it looks like he took out a $4,000 cash advance last night downtown on Orchard Street.
06:55Any idea why he might have been in that part of town?
06:58No, sorry.
06:59Excuse me, sir.
07:00Yeah.
07:04Admiral, Seaman Harris and Seaman Nichols request permission to speak with the officers.
07:07Uh, detectives.
07:10Carry on.
07:15We have something we need to confess.
07:18Wally Kane paid their tab?
07:20Yeah, apparently these two dopey sailors got way in over their head playing blackjack.
07:24Kane shows up with four grand to bail him out.
07:26That's a hell of a boss.
07:27You'd do the same thing for me, right?
07:29No, I definitely would not.
07:31We're putting together a timeline here.
07:32Looks like Kane left the card room around 9.30 p.m., assuming he was going back to the ship.
07:37And the elevated walkway would have been a good way to go.
07:39Not until it wasn't.
07:40Hey, check this out.
07:42Just got footage of the incident from this little bodega across the street.
07:45Of the actual crime?
07:47Mm-hmm.
07:47I mean, the quality's not great, but if you step through it, it tells a story.
07:52There's Kane.
07:55Here comes another guy.
07:56Can't quite make out his features.
08:00We argue.
08:01It gets nasty quick.
08:04And then...
08:06Man, what a way to go.
08:08Yeah, we lose the perp after that.
08:10The warrant landed.
08:12We just got access to Kane's text messages.
08:14And?
08:14You owe me alternative bad for all 9.40 p.m. last night.
08:199.40 p.m.?
08:21Kane was dead an hour later?
08:23Who sent that?
08:24I don't know yet.
08:25The contact name on the phone is just FM.
08:27Okay.
08:28Let's figure it out and find him.
08:32Alternative bad for all.
08:33I'm no genius, Mr. Mazio, but it feels like the alternative in this case was murder.
08:39No.
08:40It was...
08:41I was...
08:43Wally and I have known each other forever.
08:45It was a little dispute.
08:46Dispute about what?
08:47Business.
08:49Wally Kane was in the Navy.
08:50We were talking about investing in a new venture.
08:53I own and lease ports all over the country, so his skill set was useful to me.
08:58Well, when was the last time you saw Vice Admiral Kane?
09:02I don't know.
09:03A few months.
09:07Frank.
09:09We tracked his Fitbit.
09:11We know you were with him last night.
09:13At Bob O'Malley's bar, 8.30 p.m.
09:16It's really not a good look.
09:18It's not what you think.
09:20No?
09:20Because it seems pretty simple to me.
09:23Wally owed you money.
09:24You tried to resolve it at the bar.
09:25It didn't work out.
09:26So you hunted him down on the elevated walkway, and then you pushed him overboard.
09:30No.
09:31No?
09:32That's not...
09:33We met up to talk about business, and then I went home.
09:36I swear.
09:37And I can prove it, too.
09:40Hey, Luke.
09:41Need you out here a minute.
09:43Now?
09:44A Dick's here.
09:46Who is here?
09:47Assistant Director in Charge.
09:48The FBI.
10:00He needs to release Frank Mazio.
10:02Why is that?
10:03I can't get into the details at the moment.
10:05Well, we're investigating him for the murder of a Vice Admiral in the United States.
10:09He didn't do it.
10:10I assure you.
10:11Okay.
10:12Well then, forget it.
10:13I can explain more later, but right now, I need you...
10:16What's his alibi?
10:16I mean, do you have any proof for us that he's not involved?
10:19Like I said, we can talk about all this down the road, but right now, we need to pull him
10:24out.
10:25I'm not releasing him.
10:26Then that would be a bad career move.
10:28Are you seriously threatening me?
10:30All right, Jess, come on.
10:32We just need to know that Mr. Mazio is not going to be leaving town anytime soon.
10:37He's not.
10:43Fine, he's all yours.
10:53Time to go.
11:07What the hell is going on?
11:18Frank Mazio's alibi holds up.
11:20He was home at the time of the murder.
11:21But he admits talking business with Wally Kane and then sent him a nasty text afterward.
11:25Apparently, he's so important that the FBI can just rip him out of the middle of an interrogation.
11:30Well, just because Mazio didn't commit the murder doesn't mean he's not involved somehow.
11:33Let's track his movements from the time he left the bar at 830 until the 911 call.
11:41Mr. Campisi, is that your vehicle, sir?
11:45That's my vehicle.
11:46So, you know Frank Mazio.
11:49I do.
11:50How?
11:51We work together.
11:53You own and lease ports too?
11:55No.
11:56Work for the FBI.
12:00So, Mazio's working undercover?
12:02No, he's an informant.
12:04And you're his handler.
12:06That's why I was over at Bub O'Malley's that night.
12:09Was Wally Kane involved in this?
12:12Look, we're on the same team. I get it.
12:16But, this needs to stay off the record.
12:18Got it.
12:20Wally Kane was our target.
12:24Can you be more specific?
12:27Look, we don't need chapter and verse here.
12:29We just want to know if your operation has anything to do with our murder.
12:32I don't know.
12:34Sorry.
12:34What kind of case is it?
12:36Bribery.
12:38Mazio controls a big chunk of the waterfront around here.
12:41And he was paying people off so they would dock their boats in his ports.
12:45And Wally Kane was one of those people?
12:48So, he's taking bribes to dock navy vessels with this Mazio guy, huh?
12:52Yes.
12:54Anyone else involved?
12:58What is your business with the Admiral?
13:00Well, we need to discuss that with him.
13:01Flag officer, on deck!
13:06How's your work?
13:08Detectives and Mr. Lieutenant Brady.
13:11Have you made an arrest?
13:13No, but we think we might be close.
13:15Could we have a word with you in private?
13:17Anything you need to say to me, you can say in front of them.
13:19We don't keep secrets on this ship.
13:22Okay.
13:24We think you were taking bribes.
13:26We think you met with Wally Kane to talk about Frank Mazio because you knew the feds were...
13:31Get the hell out of here.
13:32Sorry, that's not how this works.
13:34Get the hell out of here.
13:35Now.
13:36What is this?
13:37This is a United States Navy vessel.
13:39A protected federal enclave under maritime and territorial jurisdiction law.
13:44No one comes aboard without my express permission.
14:00Where's my evidence?
14:02Where's my evidence?
14:13Haven Avenue.
14:14Haven Avenue, a quarter mile from the murder scene, six minutes after the 911 call.
14:18And it looks like Garvey.
14:20Yeah, and that's that scarf from the walkway video.
14:23I couldn't get a hit on facial wreck, but he stops and talks to this guy who's in uniform,
14:28a sailor, and we can see his face clear as day, and every member of the military is in facial
14:34wreck.
14:35Great.
14:35Track him down.
14:38You bet.
14:39That's me.
14:41You're positive you were talking to Admiral Garvey.
14:43Are you kidding?
14:44To guys like us, Admiral Garvey is a celebrity.
14:48I'd never even talked to him before.
14:50I wasn't going to miss my chance.
14:52How did he see him when we talked to him?
14:56A little shaken up, to be honest.
14:59Wasn't interested in a long conversation, that's for sure.
15:12State trip business.
15:14Don't bother.
15:15Pursuant to MRE 315, NCIS has determined that probable cause exists for these authorities to
15:21conduct the search of this vessel.
15:24This is a legal order. All hands will cooperate and will not interfere.
15:36Shoot me.
15:53You want to tell me just what the hell it is you're trying to accomplish?
15:57I can read, but this is goddamn outrageous.
16:00The law?
16:01Yeah, it's wild stuff.
16:04Who?
16:10So?
16:11So?
16:14This is you.
16:16Wearing that scarf and pushing your friend to his death.
16:19Can you turn around, Admiral?
16:22Press your hands behind your back to this, sir.
16:26You're under arrest for the murder of Vice Admiral Wally Kane.
16:35Take off my handcuffs, so I can return their salute.
16:38Enough theatrics, let's go.
16:41I will be back on this deck.
16:45And you are gonna regret this.
16:53Okay, we'll talk soon.
16:55Are you really doing this?
17:00How's it going, Jack?
17:02Can't believe you're out and about seeing how dangerous this city is and all.
17:06Admiral Garvey is a legend.
17:08A war hero, and you're gonna put him on trial for murder?
17:12The evidence against him is significant.
17:14Doesn't look like that to me, or the people I work with.
17:17He's set to be the next Secretary of Defense, for God's sake.
17:21Irrelevant.
17:23To charge Garvey with murder is a slap in the face to a lot of very important people, Nick.
17:29Not if he actually did it.
17:36The people's case is strong, Your Honor.
17:38We have video of the admiral at the crime scene, and we believe the defendant presents
17:42a significant flight risk.
17:44He is an admiral in the U.S. Navy, and if released, he will retake the helm of his naval
17:48fleet
17:48and set sail for the Middle East.
17:50Mr. Banks?
17:52We plead not guilty and look forward to clearing Admiral Garvey's reputation.
17:57As for bail, this man has served our nation for three decades.
18:03We request reasonable bail.
18:05This is a murder case.
18:07Defendant is hereby remanded.
18:08Your Honor, this is a political witch hunt.
18:11You can't penalize the defendant for the DA's office.
18:13Watch it, Mr. Banks.
18:15Next case.
18:20We're challenging your video evidence.
18:29Just selling the video that people claim places my client at the crime scene was obtained from a bodega.
18:37It employed extremely dated technology.
18:40This is an analog DVR-based system, first generation of black box recorders.
18:45Back then, storage was at a premium.
18:49They saved space by using compression.
18:51And the storage is nearly full, which it always is at this little shop.
18:55The frames per second rate drops to 10 per minute.
18:59This is not reliable evidence.
19:02What say you?
19:03Your Honor, the law does not require perfect technology.
19:06It requires reliable authentication and relevance, and we have both.
19:10Now, yes, the system is older, but it doesn't mean that these images are unreliable.
19:14I'm worried that the jury might give undue weight to what appears to be visual confirmation.
19:19But it is visual confirmation.
19:21Clearly, with demonstrable deficiencies.
19:23The video is out.
19:25Your Honor, this is-
19:26And that's the end of the conversation, Mr. Price.
19:32Can we win without the video?
19:35Yes, the evidence is strong.
19:37Motive?
19:38Admiral Garvey was trying to cover his own ass.
19:40What does that mean?
19:42Wally Kane knew that Mazzeo was coming for him, that he was wearing a wire.
19:47So he called Garvey, told him what was going on.
19:49They met up, presumably, to talk about the bind they were in.
19:52And Garvey got upset and pushed Kane to his death.
19:56Something like that, yeah.
19:57Do the phone records and cell data support all that?
19:59Yes.
20:00Okay, good.
20:02So we're still on solid ground.
20:05We are, yeah.
20:08But this whole video thing, it was a pretty routine matter.
20:12I mean, we're talking about surveillance video.
20:14It's the foundation of modern police work.
20:16And as a result, it's the foundation of most criminal trials.
20:19So for Sullivan to flat-out suppress it, based on the simplistic argument that Attorney Banks put forth,
20:27it's hard to fathom.
20:28Huh.
20:29Judges have a lot of discretion.
20:31And like you said, the surveillance system's outdated.
20:34So let it go and move on to jury selection.
20:36Build a case with what you have, not with what you wish you had.
20:39Just make sure you put together a solid jury.
20:42And they're not paying too much attention to all that fake news out there.
20:47Yeah.
20:48Came across this little gem a few hours ago.
20:51Thought you might appreciate it.
20:52Oh, God.
20:55It doesn't stop, does it?
21:00In our system of justice, a defendant is presumed innocent.
21:05And that doesn't change unless and until the people, that is myself and Ms. Maroon,
21:10prove our case beyond a reasonable doubt.
21:13If we don't do that, the law requires you to return a verdict of not guilty.
21:18So, is there anybody here who feels that if a person has been charged with a crime, they probably did
21:28something wrong?
21:32Very good.
21:33A plus so far in civics.
21:35Another issue that we run into is media coverage.
21:39Information is everywhere in the newspapers, our phones, social media.
21:43This case has garnered some publicity.
21:46Has anyone here read or heard anything about this case?
21:51It's perfectly understandable.
21:53Yes.
21:54Uh, juror 211, could you describe what you've read or heard?
21:57Uh, this thing's been all over the talk shows and stuff.
22:00My understanding is that the cops might have arrested the wrong guy.
22:05Goodness.
22:07Anyone else heard anything like that?
22:09Yeah, juror 214.
22:10Yeah, I heard the same stuff.
22:12Like this whole thing is political.
22:13A witch hunt.
22:14Right.
22:15That's the word they used.
22:17Your Honor, the people moved to excuse jurors 211, 214 and 216 and thank them for their service.
22:24Approach.
22:34Mr. Price, Admiral Garvey is a southern white male.
22:38Uh, yes, correct.
22:39Well, you moved to excuse three white men from this jury.
22:42I'm sorry, Your Honor, I'm not following.
22:44As a matter of integrity, it's my job to guard against any impression that we might be stacking the jury.
22:50Batson tells us that these strikes could be viewed as eliminating white men in favor of minorities
22:57less inclined to sympathize with the defendant.
23:01Your Honor, I am not moving to strike because they are white men.
23:05I'm moving to strike because they acknowledge digesting literal fake news about this case.
23:12Help us out here, fellas.
23:14Could you still be objective about this case despite what you might have heard on the news?
23:21Yeah, sure.
23:22You didn't walk in here today with your mind made up regarding this man's guilt or innocence?
23:28I don't guess so.
23:31There you have it.
23:32Your Honor, we're not impugning the character of these jurors, but there's no question that
23:37they've been exposed to material that would never be admissible in this courtroom.
23:42This creates an unacceptable risk of prejudice.
23:44Trial by jury does not require us to see jurors who have lived in isolation in this world.
23:51Motion to strike these men is denied.
24:02These are two of the most aggressive pro-defense rulings I've ever seen.
24:07Video compression?
24:09Nonsense.
24:10And this Batson ruling, it's absurd.
24:12Batson was designed to protect black defendants who used to get railroaded by all-white juries.
24:18Not powerful white men.
24:19It makes no sense.
24:22Unless, of course, that is the whole point.
24:26Meaning what?
24:27Meaning, unless Sullivan knows what he's doing, it makes no sense.
24:31Wait, are you suggesting-
24:32I can't prove that he is in Garvey's pocket, but it definitely feels that way.
24:39Are you seriously accusing Sullivan of being corrupt?
24:42He's been on the bench for 20 years.
24:44He was a prosecutor for 15.
24:46He started out right here in this office.
24:48He held your job for like five.
24:50Exactly.
24:50That is why this is so concerning, because he knows better.
24:53I think he should recuse himself.
24:56On what grounds?
24:57Does he know the defendant?
24:58His family members?
24:59Not to my knowledge.
25:00Does he have any special relationship with Attorney Banks?
25:02With the Navy?
25:03Not to my knowledge.
25:05So what, you're going to ask him to step aside because you think he's a prick?
25:08For starters, he's going to tell you to go to hell.
25:11And then he's really going to jam you.
25:14Going to war with a judge is bad business, Nolan.
25:17So you want me to pretend this isn't happening?
25:19I want you to pretend that he doesn't matter as much as you think he does.
25:23The jury makes the decision, not him.
25:34Kenneth.
25:36Nick.
25:37Hey.
25:39You know, as you might expect, I've been following this Garvey case pretty closely.
25:42Is that right?
25:43Yeah, a lot of eyes on this one.
25:46Guessing you're pleased with that?
25:50Is that what this is all about?
25:52Me getting the nod for the DA position instead of you.
25:55I know you wanted it.
25:57Your people weren't very subtle about it.
26:00I have no idea what you're talking about.
26:03Well, let me be a little more direct.
26:06You've made two questionable legal rulings, and I'm trying to understand why.
26:11Every decision I make is based on the law.
26:13I sure hope so.
26:15That's the whole point of this, isn't it?
26:17Follow the law?
26:19To get justice?
26:22I'm going to give you the benefit of the doubt on this one, Kevin, for the time being.
26:26Is that a threat?
26:28No, it's a compliment.
26:30I have too much respect for you and your career to ask for an accuser.
26:36Ask me, you're the one acting unethically.
26:40Excuse me?
26:40I'm reaching out to me on an ex parte basis, trying to influence a case.
26:47Oh.
26:49We're just two people trying to do the right thing.
26:52Who happen to bump into each other outside the courthouse.
26:56Have a nice evening.
27:01Vice Admiral Wallace Kane was a hero.
27:05But, like all of us, he was far from perfect.
27:11Two years ago, the FBI discovered that a man named Frank Mazzeo was bribing naval officers to dock their vessels
27:19at his slips.
27:20The FBI asked Mr. Mazzeo to cooperate to implicate the men that he was paying off.
27:26Vice Admiral Kane was one of those men.
27:30On the night of the murder, Mr. Mazzeo met with Kane wearing a wire, hoping to incriminate him.
27:37But Wally Kane was nobody's fool.
27:40He clammed up, he rushed out, and the first thing he did was to call his partner in crime, the
27:48defendant.
27:51It was clear to Admiral Garvey that their secrets might be exposed, that this whole mess had to be put
27:56to bed.
27:57Loose ends, tied up, so he pushed Wally Kane off the side of a walkway and watched him fall to
28:04his death.
28:06This is the story of two good men, two brave men, doing bad things.
28:13One of those men is now dead, and the other is the killer.
28:22As Mr. Price just stated, Admiral Garvey is a brave man, a hero of several wars.
28:33Admiral Garvey did not kill Wally Kane.
28:37He loved Wally Kane.
28:39They were roommates in Annapolis.
28:40They worked together for 20 years.
28:44The sad truth here is
28:49the NYPD and the district attorney's office knew they were under a political scrutiny,
28:56that the world was watching and judging them for allowing something like this to happen in the first place.
29:05Objection.
29:06Overruled.
29:07And the cherry on top, of course, was the chance to embarrass the federal government, the Navy.
29:13As this trial moves forward, please pay attention to the lack of specific evidence
29:24and the far-fetched narrative the prosecution is attempting to craft.
29:29If you do that, you will come to two conclusions.
29:32One, that Admiral Garvey did not kill Wally Kane.
29:36And two, that the DA's office cares more about politics than the law.
29:44Thank you for your time, for your service, and your fairness.
29:50We will break for lunch.
29:52All parties back here in 90 minutes.
29:59Call Mazzy over.
30:01Now?
30:01Now we're gonna kick this thing off in style, make it clear right from the start that despite the
30:06fancy title and uniform, Garvey is not a knight in shining armor.
30:12Navy ships are big.
30:14They need a lot of dock space, especially during fleet week,
30:17when a bunch need to park at the same time.
30:20So, you know, I would incentivize certain people to use my ports here in New York, New Orleans, San Diego.
30:30By incentivize, you mean paying them cash?
30:33Yeah.
30:33And Wally Kane was one of those people?
30:36Yes.
30:37When was the last time you saw him?
30:39The night he was killed. We met for a drink at a bar on 18th Street.
30:42What was your agenda that evening?
30:44To get Wally to say something stupid.
30:47Can you elaborate?
30:49I was wearing a wire, a listening device.
30:52I was trying to get him to acknowledge that we were doing business together and he was being paid.
30:59He didn't, he didn't bite.
31:01You ever do business with the defendant?
31:03No, not directly, but Wally said he shared the bribes with his boss.
31:08Objection hearsay.
31:10Sustained.
31:11Nothing further.
31:14This, uh, this bribery scheme was your idea?
31:18Correct.
31:19And you obviously knew what you were doing was illegal.
31:22Correct.
31:23So, breaking the law doesn't bother you?
31:27No, it bothered me.
31:28It bothered me.
31:30Just not enough, I suppose.
31:34Was that meant to be funny?
31:36No, just honest.
31:38So you're honest about being a criminal, about your willingness to deceive people, skirt the law.
31:45That's one way to put it.
31:47Is it also true that you were arrested nine years ago for domestic assault?
31:54Objection.
31:55It goes to the witness's credibility.
31:57This is outrageous.
31:58Relax.
31:59No need for hyperbole.
32:01Let's discuss this in chambers.
32:04Court is adjourned.
32:09Yeah, Mazio was arrested, but never convicted.
32:12Hell, he wasn't even charged.
32:13But even if he had been and was then convicted, it still isn't admissible.
32:17It has absolutely nothing to do with his propensity for truthfulness.
32:21I don't know about that.
32:23Excuse me?
32:23People who commit crimes are inherently less believable than people who don't.
32:28That's not...
32:33Okay.
32:35All right, let's say that you're right, but the defense has already made that point.
32:39And they already established that the FBI was investigating Mazio for bribery,
32:43and that they gave him immunity in exchange for his cooperation.
32:45And that all makes sense.
32:47That is directly related to this case and to the defendant's motive.
32:50But this alleged domestic assault from nine years ago has absolutely nothing to do with whether or
32:57not Admiral Garvey killed Wally Kane.
32:59Sure it does.
32:59It speaks to who this man is.
33:02In full.
33:04I agree.
33:05The jury has a right to know that the man accusing a war hero of fraud and by implication murder
33:12is not
33:12only a career hustler, but a wife beater.
33:16You may proceed.
33:25I don't know what to say other than this is a highly unusual decision.
33:30No, it's more than that, Nick.
33:32He is jamming us at every turn.
33:35It can be a coincidence.
33:36It is not a coincidence.
33:39I know you don't want to hear this right now or accept it, but he's in Garvey's pocket.
33:45There is no other explanation.
33:49The question is, can we prove it?
34:01I'm not sure I understand where you're coming from.
34:04I'm just trying to.
34:07This case has been unusual in many ways.
34:12How so?
34:14There have been a series of questionable rulings that I'd prefer not to bring you into the weeds on this.
34:22I appreciate that.
34:24I think.
34:25To put my paranoia to bed, I need to know how Sullivan caught this case.
34:30You're the chief administrative judge.
34:32The docket flows through your office.
34:34Was this case assigned to Sullivan or did he ask for it?
34:40You're really saying what I think you're saying?
34:42I don't know what to tell you, Charles.
34:45Other than I wouldn't be here if this weren't a serious matter.
34:55Off the record?
34:57Of course.
34:59Sullivan asked for it.
35:00Claimed he had some expertise handling cases involving the military.
35:08I kept hoping I was wrong.
35:10And I was overthinking it, but you bastards are really doing this.
35:15You're really trying to fix this damn thing.
35:21That's, that's a hell of an accusation.
35:24Sullivan requested this case.
35:26He's now on the short list for the federal court of appeals.
35:29He's made pro-defense ruling after ruling that make no sense.
35:34Unless, of course, you look at them through a different lens and then they make a whole lot of sense.
35:37Why are we really here, Nick?
35:40I guess I just wanted a chance to look you in the face and say, I know.
35:45And that I'm coming for you.
35:46And Sullivan and everyone else involved in this damn thing.
35:50That would be unwise.
35:51But I don't care.
35:53I am done with this nonsense.
35:59Does everything have to be so damn political?
36:02Us versus you.
36:05Can't it just be about the law?
36:08Garvey was taking bribes.
36:10He was afraid he was going to get caught and he killed a guy.
36:14That's what happened.
36:16Does it really matter?
36:18What the hell does that mean?
36:20Means we want what we want.
36:22And if I were you, I would find a brilliant legal reason to give it to us.
36:27To dismiss the case.
36:29Win-win.
36:30We get the secretary of defense we want and you get to wrap yourself in the constitution.
36:36And reassure the voters that you are a noble prosecutor who would never convict someone without sufficient evidence.
36:44It's not going to happen.
36:45Our case is still strong.
36:48Despite your attempts to undermine it.
36:55No.
37:01You were right, Nolan.
37:04You were right all along.
37:05I wish that weren't true.
37:07I'm going to demand a mistrial.
37:09Really?
37:10And then I'm going to file criminal charges against Sullivan and everyone else involved in this damn conspiracy.
37:15I'm not so sure that's...
37:17What's the alternative?
37:19To stand by and let them make a mockery of the judicial system?
37:22No, but you're the one who told me not to get emotional that attacking judges is bad business.
37:28Stop.
37:29Just stop.
37:30I'm not here for a conversation or a lecture.
37:33Just send me the file.
37:35I'll handle it from here.
37:55Is this what I think it is?
38:01Well, I'm happy to talk.
38:04But we're feeling pretty good about where we stand.
38:08Good enough to toss a coin.
38:10Heads, Garvey walks.
38:12Tails, spends the rest of his life in prison.
38:27Criminally negligent homicide?
38:29You really cut a deal with Admiral Garvey without my consent?
38:39Uh, yes, I did, given the facts.
38:41He'll be out in a year.
38:43Hell, I might even suspend his sentence.
38:45Yeah, maybe.
38:45But at least we got something.
38:47Because we didn't have the cards, Nick.
38:48We just didn't.
38:49That is my decision.
38:51Not yours.
38:55I just couldn't stand there and watch you destroy your career.
39:02You should worry about you.
39:05About your career.
39:07Well, that's what I'm doing, Nick.
39:09And how's that?
39:10You go after Sullivan, you will get blown up.
39:12You'll lose the election and I will lose my job.
39:15And I like what I do and I'm good at it.
39:17So if it makes you feel any better, I did this for me.
39:21Not you.
39:24It doesn't.
39:30Someone needs to hold the line.
39:34Why not us?
39:38Why not now?
39:44This morning, Admiral Rustin Garvey pleaded guilty to one count of criminally negligent homicide.
39:53Based on the evidence and the specific facts and circumstances of this case, we believe this is a just result
40:00for all parties.
40:03In this country, we do not prosecute to please a crowd.
40:09And we do not neglect to prosecute to appease one.
40:12The courtroom is a place where facts still matter, where evidence still matters, where the law quietly and deliberately does
40:23its work.
40:26And we must fight as hard as we can to protect the sanctity of this hallowed institution.
40:31Because if we don't, this whole thing, this grand experiment will crumble.
40:42When we feel ill,
40:45when we feel that lies and injustice are beginning to invade our collective well-being,
40:53law is the medicine that can help us heal.
41:15Buying a university.
41:16Have faith in the universe.
41:20We are juniors.
41:23Let us know for you here in thehan,
41:27us't zu m всегда.
41:37I don't think of you as a person that is going on.
41:39A time!
41:39Whoa!
41:41Let us know in the 44 million.
