01:40predicted they were mightily pissed off at having to hand it over and they even said that they had no
01:45desire in the current financial climate to spend disproportionate sums defending a claim that was
01:50many years out of date and legally had no prospect of success well they can fuck right off I couldn't
01:58have said it any better myself okay so as predicted the IPCC investigations into both of your cases find
02:06the complaints are not substantiated and the most serious disciplinary action that they recommended
02:10was there a few written warnings what about telling me that the CPS had reviewed my case when
02:18it hadn't a genuine mistake okay and what about not telling me that they found the drugs that he
02:26used to sedate me in my bloodstream they actually do find that largely substantiated but they they do
02:31want to note that the investigating officer at the time had um a heavy workload what we now know that
02:38they didn't search war boys house when he was first arrested I was told that they did and that they
02:43didn't find anything incriminating but actually the most incredible revelation is of the CCTV footage of
02:49you leaving the club that night they said that there was no sign of me on the footage that's because
02:56they were looking at the wrong night the 27th not the 26th if they had the correct date they would
03:03have seen that you left the club at 2am and they would have known that war boys was lying when
03:07he said
03:07he picked you up at 350 the initial investigation didn't even analyze your mobile phone data which
03:13would have confirmed when you got into his cab and where he took you it's like a joke
03:20i'm guessing it doesn't get any funnier for me no because almost all the allegations in your case
03:25they say are not proven you saying that you weren't believed not proven being told not to show emotion in
03:30your interview well DC Stevens even denies ever saying that to you so it's your word against his
03:35the only concession is that they agree that the guy living in your old flat billy houghton
03:41should have been interviewed and to cap it all off they've released a statement saying that they
03:45have improved training and changed procedures so that none of this will ever happen again

09:49the fact that you are fighting this makes me feel like you still don't believe me
09:57the police's position is that whilst we are of course sympathetic to the undoubted trauma you've both suffered

12:12NBV told us that even after she'd been sick in the toilet,
12:16she still carried on drinking.
12:18Did this have an impact on your assessment of NBV?
12:22The CCTV footage of her falling over at the campus
12:26was entirely consistent with the actions of someone
12:28who had had too much to drink that night.
12:30I thought the whole thing was odd.
12:33I thought it was odd that an educated girl
12:36would accept a drink from a stranger in those circumstances.
12:40DSD told us she had taken some cocaine with her friends,
12:43and this showed up subsequently in her blood tests.
12:45Had she also drunk alcohol that evening
12:49before getting into Allboys' cab?
12:50Well, her friends told us they put her into the cab
12:52after their night out because she was so out of it.
12:57My conclusion was that DSD had not sustained
13:00any specific psychiatric injury as a consequence of the rape.
13:04She had, however, suffered a depressive episode
13:06as a consequence of how she'd been dealt with by the police.
13:10Well, following the assault,
13:12NBV developed symptoms of post-traumatic stress disorder,
13:16including nightmares, intrusive imagery, flashbacks,
13:20avoidance, anxiety and depression,
13:23poor concentration and social withdrawal.
13:25She still suffers from moderate to severe symptoms.
13:29She can be tearful and experiences mood swings.
13:32And she suffers from continuing sexual aversion
13:36and a lack of sexual enjoyment.
13:45Are you aware, Inspector Underwood, of a guide
13:49which outlines the Met's standard operating procedures
13:51for investigative techniques in rape and sexual assault cases?
13:57I'm aware of it, yes.
13:58It lays out detailed steps and considerations to be followed
14:01from a starting point of treating the victim's account as truthful,
14:07does it not?
14:09I don't know.
14:12Why not, may I ask?
14:13I just can't recall it in any detail.
14:15As a member of one of the Met's Sapphire teams,
14:19which are specialist rape and sexual assault investigation units,
14:23I find that quite an extraordinary thing for you to say.
14:26In my opinion, it's not something I consider practical
14:29to apply to each and every case.
14:32To this case?
14:34I think these policies are fine in theory,
14:38but they're not always applicable to day-to-day policing.
14:41Then why have they been set out by the Met as their guidelines?
14:46I think they have been created purely
14:49to protect the police from legal challenges.
14:53If a case is not classified as a serious sexual assault,
14:56then details of the investigation
14:57are not entered into the Criminal Intelligence Computer Database, are they?
15:02No.
15:04Meaning, no closing report would need to be done, would it?
15:07No.
15:08Is that a good thing?
15:09Honestly, an opportunity to not have to do one would be taken gladly.
15:14Was there a drive from your superiors at Borough Management
15:18to disprove allegations of rape and sexual assault?
15:23Yes.
15:24Why was that?
15:26Because if an allegation can be legally disproved,
15:29then it would improve detection rates.
15:31So junior officers were effectively encouraged
15:33not to pursue allegations of rape and sexual assault
15:35and instead to focus on other crimes,
15:37such as burglary, which were easier to clear up.
15:40Is that right?
15:42Broadly speaking, yes.
15:44Coming now, D.C. Coldham,
15:47specifically to the case NBV.
15:49Even though her case bore all the hallmarks
15:51of a drug-facilitated sexual assault, she was not treated as such, was she?
15:54Personally, I believed her account.
15:56But I knew there was no prospect of the case being reopened
15:59once the forensic and toxicology results had come back as inconclusive.
16:02Even though there were still many important leads still to be followed up?
16:06Yes.
16:07So under pressure from on high, her case was not recorded as a serious sexual assault,
16:12supervision from more senior officers did not occur,
16:15and her case was not entered into the databases?
16:18No.
16:19And the case was cleared up in three months.
16:21No case closure report, no detailed report entered into the system,
16:25and the borough's clear-up rate was thereby improved
16:28since the case was not left as unsolved.
16:32Like I say, that was the situation at the time.
