01:44my name is justin sullivan my name is eric sullivan and my parents were killed by a drunk driver
01:48on april 15 2012 in las vegas i woke up at 6 30 a.m to a corner knocking at
01:55my door i had first heard
01:56about it my brother had actually given me a call because of how horrific the accident was the car
02:02caught fire when they were hit and they were just unidentifiable it was a shock it was like you just
02:09immediately go numb and just felt dead inside
02:12i don't even know what to say sorry you know i didn't get to see the bodies or anything i
02:19didn't
02:19want to identify them i didn't want to see them like that we immediately went to my parents house
02:23and got all their dental records and that's you know how we identified them they were approximately
02:28two minutes from home less than a half a mile if they would have just stayed at the casino for
02:32another
02:32five minutes if the movie was five minutes longer my dad went to the restroom my mom played another 20
02:38who knows he was the best dad we did a lot as a family a lot of vacations a lot
02:42of spending time
02:43together family dinners holidays my mom was a worrier she'd always check on you she'd wonder what we were
02:49doing even at 26 27 years old just always want to know what's going on i get goosebumps just even
02:56thinking about walking in that courtroom and seeing him there's a lot of a lot of hate there i'd rather
03:01have 15 minutes with him than him go to jail for 15 years my brother and i we've had our
03:06problems
03:06throughout our life hopefully this case brings me and him maybe a little closer i think the biggest
03:11part is just getting through this together trying this case of vehicular homicide our prosecutors
03:19aaron nance and thomas moscow they work in the department's busy dui division and as they
03:24prepare to bring 27 year old matthew dalrymple to trial for the 2012 deaths of john and anita sullivan
03:31seeking 16 to 40 years they go to the crime scene for the first time with the officer who was
03:37first on
03:37the scene that tragic night so officer on the night that this happened what time were you dispatched to
03:43the scene it was approximately 12 30 in the morning 911 emergency i saw the explosion there's a vehicle
03:49on fire the person who was driving is on fire there's nothing nobody can do what direction was the
03:56victim coming from which direction was dalrymple coming from we believe dalrymple was going eastbound
04:00on flamingo the sullivan's would have been coming from which direction uh from there southbound
04:05from the intersection and were these intersections controlled this way on the night of the accident
04:10with the stop signs and the stop lights yes sir they were so the the red lights that were above
04:14the
04:15stop signs were actually working flashing red yes and whereabouts did the actual accident take place
04:22the point of contact we believe is right here at the manhole right here to this manhole right okay
04:26and those might still be the same divots from that accident all these years later and the accident
04:31carried which direction after that it continued eastbound so the accident carried both vehicles
04:36over to the other side of the intersection here yes sir the vehicle uh started spinning in the
04:41intersection continued on over over the sidewalk and actually went backwards into one of the palm trees
04:48so just describe for us because we're gonna have to convey this to a jury what did you observe when
04:52you got here what was going on big giant fireball as i was arriving you can see the glow of
04:58the fire
04:59probably from half a mile down the road i ran up right as fire department started spraying the car
05:04down i asked them if there was somebody inside the vehicle they said that they didn't know at that
05:09time but there was somebody right behind the car that's when they pointed to mr sullivan how long did
05:14it take you to realize there's nothing that can be done for the sullivans right as soon as i saw

05:19sullivan and mrs sullivan he was completely engulfed in flames she was sitting down her arms were up
05:24i believe her fingers were even missing can you give us an opinion about speed involved at least 80
05:31to 100 miles an hour and where did dalrymple's car end up dalrymple was approximately 100 feet from the
05:37intersection when i arrived i noticed his car was right there there was nobody inside i asked him if he
05:45knew what happened with a very slurred speech he just said the other guy ran the stop sign i asked
05:50him if he was okay he's like oh my you know my shoulder kind of hurts gave me one of
05:53those again
05:54in that slurred speech how much does this incident stick with you every day if there's one thing that
05:59that keeps me awake at night it'd be this
06:07roughly eight miles from the corner of flamingo and town center drive
06:11is the canyon gate area of las vegas it's here that chief deputy district attorney jacqueline bluth
06:18and investigator craig fabert from the da's office return to the scene of a brutal and tragic murder
06:25a case for which the da's office is seeking the death penalty for one of the defendants
06:32okay so i wanted to come out here because with the crime scene photos i'm having a hard time
06:36figuring out what witnesses saw and what they heard and almost what they didn't hear
06:42it all began with this note between two roommates
06:48brian haskell who made his living playing online poker and jackie schaefer she was moving out from
06:55his condo claiming he made unwanted advances on her on october 29 2009 she returned to brian's condo with
07:04her boyfriend will sittin and his younger brother robert but she wasn't there just for her belongings
07:11so brian haskell would be here you know the defendants are running back and forth from d to the
07:20parking lot d to the parking lot putting stuff in the car exactly that stuff was brian haskell's
07:25belongings within minutes the 68 year old brian was being robbed and beaten by the sittens with
07:32jackie schaefer also involved you have to remember i mean brian haskell is a 68 year old diabetic not
07:39very healthy man and so i don't think he even had the muster to even fight back even if he
07:44wasn't
07:44well of course you didn't see it coming and we're positive that he didn't die right away that he it
07:49took him a few days to probably yeah he was in bad shape yeah it's actually very very sad
07:58this note left behind in brian's condo gave authorities jackie schaefer's name and after
08:05the trio cashed a check on brian's account that sealed their fate and they were arrested
08:11in 2015 the case went to trial but ended in a dramatic mistrial just as the jury began their
08:18deliberations now the case is going to trial again with jury selection about to begin jacqueline bluth
08:28strategizes with district attorney steve wolfson and assistant da robert daskus there was a female
08:34named jackie schaefer her and her boyfriend will sit and his brother robertson they beat mr haskell
08:40they um break his nose and leave him with a fractured spine they rob him of everything
08:47basically in the room tv laptop routers um money cards so this is a retrial yes you've got some
08:53challenges because some of your witnesses if not all of your witnesses have already testified now the
08:58defense knows exactly what your witnesses are going to say i know their strategy they know my strategy
09:03right so that's the challenge why is this case so important to you this one to me kind of strikes
09:08a
09:08court because brian he's someone who who does keep to himself very much brian doesn't have people
09:14that are going to walk in those doors and and fight for him and tell the jury about who he
09:19was
09:20you're the one that's fighting well and i want the jury to know that just because he doesn't have
09:24those people it doesn't mean he wasn't like a good person or that there weren't people that love him
09:29you know it it makes a subtle difference because when jurors look in the audience of the courtroom and
09:33they see a victim's family members whether they realize it or not it hasn't it has an impact it
09:39does absolutely and now there's nobody out there for this guy right but it can be almost more of
09:44an impact because it's like there's no one there for him but we're there for him and you can be
09:49there
09:49for him you know feeling just as passionately about the case is jacqueline's co-counsel fellow chief
09:58deputy district attorney lisa lucich opposing them are the same attorneys they faced off against
10:04in the first trial in 2015 with separate teams representing will sittin and jackie schaefer
10:12call your first witness state thank you the state calls lauren keith eyewitnesses paint a vivid picture
10:18for the jury now i'd like to turn your attention now to october 29th of um 2009 um did you
10:25see any of
10:26the people outside that we've been talking about yes i saw two men the two brothers with the car backed
10:32in and the trunk was up and they were putting belongings in there it looked as if they were moving
10:38after that day did you ever see brian haskell again no okay thank you as time went by did you
10:48begin to
10:49notice something that bothered you a smell like something crawled up in a in the dryer chute and
10:56died just it was it was horrible and um the smell just kept growing maybe two weeks later about 14
11:03days
11:03later i get a knock at the door i look and i see his metro so i was like wow
11:08so i opened the door and
11:09they asked me immediately hey um you know have you seen your neighbor i was like no but i think
11:14i could smell
11:15it the medical examiner then details how brian haskell suffered for three excruciating days he had
11:23bleeding in the scalp in the front as well as on the right side towards the back and he had
11:29a fracture
11:29of his fifth thoracic vertebra and a fracture of left rib seven the fracture of the vertebral column
11:38uh may have resulted in him being um unable to to walk or move easily and if he were not
11:45able to get
11:45up or walk or move would he be able to get food water and things like that to sustain him
11:51not likely
11:53and if you can't get water you might last somewhere around three days as the testimony of several
12:00witnesses resonates with the jury both sides know it's the testimony of robert sittin that's the key
12:07that's because robert has taken a plea deal instead of going to trial what he says on the stand about
12:13jackie schaefer may seal her fate and his words regarding his brother could determine if wilson lives or dies
12:35in the state's first degree murder case against will sittin and jackie schaefer will's brother
12:40robert takes the stand he was also implicated in the murder of brian haskell but has taken a plea deal
12:47and is now the state's star witness now turning your attention to october 29th of 2009 on that day
12:55in in the early afternoon did you receive a phone call from will yeah he asked me he said i
13:00need you
13:00to come help and do something and i said what are we doing he said i don't want to talk
13:05about it on the
13:05phone and i said what man what do i got a fight or something he said oh no no no
13:10i want you to help me
13:11move jackie out do you ultimately get to jackie's condo yes ma'am did you consume any alcohol yes i
13:18did okay
13:19how many shots would you say you consumed oh man like seven eight shots in one of your trips back
13:26into the condominium from moving does will motion you to a specific part of the condo
13:32yeah he uh motioned me down the hallway where the other bedroom door was i see brian sitting on a
13:38on
13:38his bed next to the nightstand and jackie standing kind of in front of him will goes in front of
13:44him
13:44squats down and uh he said you got something coming and he socked him in his in the side of
13:52his face
13:52at that time jackie was standing there and she said how can you do this to me she started welding
14:00on him
14:02jackie was asking brian where where where money was and he was trying to get up and will was the
14:08damn it brian stay down he stomped down on uh on brian's back between his shoulders and then will
14:15knocked him out okay did you ever see brian awake after that no you know above all else you didn't
14:27just
14:28take an agreement to testify against anyone you took it to testify against your brother did that
14:33decision weigh heavily on you yeah it weighed on me because because he's my brother thank you i'll
14:41pass the witness you ultimately pled to conspiracy to commit robbery and or murder in this case right
14:49and that's kind of a mutually beneficial thing for both the government and for yourself right yeah
14:54okay you get something out of this yeah and it's your testimony that jackie and you share a shot of
15:00tequila you had more than a couple shots oh yeah i had a lot of shots do you get mad
15:04when you get drunk
15:08no you get in fights when you get drunk no i'm a happy drunk together what i did that night
15:15i'll be honest with you they did to brian haskell you sure you're not replacing things
15:22yeah i'm positive tell the ladies and gentlemen of the jury what punch will use to knock out brian
15:28haskell he threw a right hook are you right-handed or left-handed i'm left-handed what's will he's
15:35right-handed i'm sitting here looking at will right now he's writing with his left hand
15:40i mean i don't pay attention like that well you sure paid attention to which punch you threw
15:47when mr tom check asked you whether you get violent and angry when you're drinking you kind
15:55of hesitate i know well do you no sir will sit in's attorney then delves into robert's troubled
16:03and violent past how about that mentally challenged boy you beat up you remember him
16:08how badly did you beat him did brain damage a little bit you gave a mentally challenged boy brain
16:16damage yes but i wasn't the sole person that did that you weren't completely involved that wasn't
16:21all you you had there were two others and they were worse than you right they were isn't that exactly

16:27you're doing right now today this person right here mr sitting that person back there miss schaefer
16:32they're they're bad they're the ones they're isn't this is exactly what you did when you got in
16:38trouble before sir no it's not i never said that i was innocent of this crime i'm just as guilty

16:46and her i did punch on that man yes he did die yes i am guilty of it because i
16:53have participated
16:54i'm not the sole person guilty of this whole crime nothing
17:03my biggest my biggest concern is they don't believe robert because robert really is the entire
17:10case if you think about it yeah but but it's true i mean that's that's our biggest hurdle to make
17:15robert believable and juries don't love snitches no because snitches always have a motive yeah
17:24in the state's other case there's just a week to go before trial prosecutors aaron nance and thomas
17:30moskell meet with their boss district attorney steve wolfson to get his perspective on the case
17:35the defendant matthew dowrimple is being charged with two separate counts of vehicular homicide
17:41one for each victim you know i was a defense lawyer for 25 years i did a lot of dui
17:46cases
17:46who's his lawyer craig mueller all right craig's effective he does a lot of dui craig's yeah one
17:52of the most experienced dui lawyers in town he's not afraid to get in there and fight
17:56does mueller come to you and say you know plead to one dismiss one anything like that he did come
18:01recently to plead to one to dismiss one it's just not something that the family would be on board with
18:05it's not something that we would be on board with you know we have a per se theory the two
18:09hour rule hey if you're over a certain limit in two hours and we can prove that yeah the case
18:13is
18:13pretty much done the blood draw was within two hours it was it was well within two hours good police
18:18work well because there were a death involved in this case the police did two blood draws and the
18:23first one they did in time uh worked out to a point one four and then approximately an hour later
18:28they
18:28did a second blood draw and it was a point one two so this guy was well over the limit
18:32now when you
18:34argue to a jury can you try and say what you believe his blood alcohol would have been at the
18:39time of the accident we would bring in a retrograde expert to explain how the body metabolizes alcohol
18:44and work it back to what it was at the exact time of the crash as opposed to the time
18:48of the blood draw
18:49but in this case because of the way the two hour theory works it's well above 0.08 it's well
18:54within
18:54two hours as a defense lawyer i might say what is the highest blood alcohol test you've ever had
19:00and i imagine your expert's going to say 0.3 something and in this case all you had was a
19:070.12 to try and show that it wasn't that much above the legal limit you've got to combat that
19:13though
19:14and remind them of what the law is and perhaps bring out from that expert that it takes a lot
19:20of alcohol
19:21to get to 0.14 and 0.12 another thing is if the defense lawyer says that this is just
19:27an accident
19:28you need to bring home a tragic behind a wheel while under the influence of alcohol is because
19:35look at the damage it caused that could have been any citizen of clark
20:27that it could have been little repairs and they are in both ways and those judges that are going to
20:28Ochre
20:28escorting by this was the consequence for 0.6 my coworkers but i think your so set up
