01:20and that we must be more serious about protecting those who are pedestrians in our city and are crossing our
01:28streets,
01:29particularly our children, and I'm happy to answer any questions.
01:34How is the determination made between simply an accident and the criminal act?
01:40What was it that took this to a place where you felt the need to be charged as a crime?
01:46What amounts to a misdemeanor is negligence being present.
01:51And so if it is determined that it was a negligent act on the part of the driver that caused
01:57the death,
01:59then that is what merits a criminal action with respect to a misdemeanor.
02:04If it is reckless behavior that led to the collision, then that amounts to a felony.
02:10What was that? Can you elaborate on what you determined was that act to lead to this?
02:17At this point, it's a failure to yield, well, crossing into the intersection against the driver's right-of-way.
02:25The pedestrians actually had the right-of-way in this situation,
02:30as well as a failure to yield to pedestrians who are in a crosswalk.

02:36It didn't like that anything to indicate that there was a failure to pay attention to?

04:05Today, we are joined by our public safety partners here in San Francisco,
04:09including our SFPD Investigations Bureau, the San Francisco District Attorney's Office,
04:14the FBI, and the U.S. Attorney's Office of the Northern District of California.
04:19We are here to discuss the attempted murder and arson incident that occurred early Friday outside a home in the
04:25Russian Hill neighborhood of San Francisco,
04:27as well as the subsequent threats outside OpenAI headquarters.
04:32I want to be clear attacks like these will never be tolerated in San Francisco,
04:37and anyone who seeks to do harm in our city will be swiftly arrested and held accountable for their crimes.
04:44You will hear from our District Attorney, Brooke Jenkins, and U.S. Attorney Craig Misakian,
04:49who will have more details on criminal charges in their respective jurisdictions.
04:54But before that, I want to highlight the work of our exceptional officers,
04:58who swiftly identified the suspect in this case and took him into custody.
05:03He is identified as 20-year-old Daniel Moreno Gama of Texas,
05:08and he is currently in custody in San Francisco County Jail.
05:13We are a safe city thanks to our officers and law enforcement partners.
05:17And this case illustrates our preparedness and ability to successfully navigate the unexpected.
05:24You will hear shortly from Deputy Chief Luke Martin, the head of our Investigations Bureau.
05:29He will detail some of the facts of this case as we currently know them.
05:34He will also briefly discuss yesterday's arrest of two individuals involved in a shooting incident
05:39in the same area of Russian Hill.
05:42As of right now, we do not have evidence to suggest these cases are related.
05:47I also want to stress that these cases are still active investigations and continue to move rapidly.
05:54Investigators have been working around the clock
05:56and following multiple leads both locally and outside of California.
06:01I want to thank our partners at the FBI for their assistance in this investigation
06:05and continued partnership.
06:07I'll now turn this over to Deputy Chief Luke Martin.
06:16Good afternoon.
06:17Thank you all for being here.
06:19And thank you, Chief Liu.
06:21My name is Luke Martin.
06:23I'm the Deputy Chief of Investigations at the San Francisco Police Department.
06:27As the Chief said, I will give you a brief overview of the facts of this case as we know
06:32them.
06:33I want to remind everyone that this case is active and is moving rapidly,
06:39so there are some details we unfortunately will not be able to discuss today.
06:43On Friday, April 10th, at approximately 4.12 a.m.,
06:48San Francisco police officers from Central Station were dispatched to the report of someone throwing an incendiary device
06:55at a home in the Russian Hill neighborhood.
06:58Officers swiftly responded to the scene where they met with firefighters and security personnel.
07:06The officers determined that a suspect had thrown a Molotov cocktail at the gates of the home
07:10before fleeing the area on foot.
07:13Thankfully, witnesses on scene extinguished the fire and no one was hurt.
07:19While on scene, our officers reviewed security footage
07:23and broadcast an image of the suspect department-wide.
07:27Approximately one hour later, at 5.07 a.m.,
07:30officers from Southern Station responded to the 1400 block of 3rd Street
07:35where a subject was threatening to burn down the headquarters of OpenAI.
07:41Officers took the subject into custody
07:44and immediately recognized him as the same individual
07:47from the earlier incident on Russian Hill.
07:51The individual, identified as Daniel Moreno-Gamma of Texas,
07:56was in possession of additional incendiary devices
07:59as well as flammable liquid and a lighter.
08:03Officers seized the evidence
08:04and booked Moreno-Gamma into San Francisco County Jail.
08:09Our investigators also contacted the FBI
08:12and began working jointly to follow leads outside of California.
08:18I want to thank our partners at the FBI
08:20for their assistance with this ongoing investigation.
08:24We also had a shooting incident early Sunday morning
08:29in that same area of Russian Hill.
08:32In that case, officers learned that a vehicle with two occupants
08:36drove past a residence when the gunfire erupted.
08:39No one was shot or injured in that incident.
08:44Our investigators identified the vehicle associated with the gunfire
08:48and executed a search warrant on the 2000 block of Taylor Street.
08:52Officers arrested two individuals and seized three firearms.
08:57Amanda Tom, 25, and Muhammad Hussein, 23,
09:02were booked in jail for negligent discharge of a firearm.
09:06At this time, we do not have any evidence to suggest this incident
09:10was related to the case on Friday, but both cases remain active.

09:50for San Francisco FBI.
09:53Today's charges outline a dangerous and deliberate plan
09:58to bring violence into San Francisco.
10:01The defendant is alleged to having traveled across state lines
10:06with the intent to both target an individual
10:09and a major technology company.
10:13This was not spontaneous.
10:15This was planned, targeted, and extremely serious.
10:22The FBI brings unique authorities and capabilities
10:25in cases like this,
10:27and especially with threats across state lines.
10:31This law enforcement team here,
10:34they moved quickly,
10:36identified the suspect,
10:39assessed the threat,
10:40and courting it across multiple jurisdictions.
10:44As part of this investigation,
10:46the FBI today executed a court-authorized search warrant
10:50at the defendant's residence located in Spring, Texas.
10:54This showed our ability to be able to act
10:57in partnership anywhere across this country.
11:01Whether threat begins just across the road
11:05or across the country,
11:07the FBI has a reach and the resources to respond.
11:13Let me be clear.
11:15We will not tolerate the individuals
11:17coming into our areas of responsibility
11:20to carry out acts of violence.
11:23If you travel here
11:25with the intent of harming our people,
11:28damaging our property,
11:29and intimidating our communities,
11:32you will be identified,
11:35investigated,
11:36and brought to justice.
11:39The FBI is committed to protecting
11:41our nation's innovation leaders
11:43and the companies that drive our economy forward.
11:47Whether they come from individuals,
11:50these individuals can come from threat groups
11:51or criminal enterprises,
11:53we're going to meet that threat
11:54and address it accordingly.
11:56Acts targeting technology companies,
11:59are not just local crimes,

13:27as well as those law enforcement agencies
13:30in Texas for their swift attention
13:33to this and the level of partnership
13:35that took place
13:36in order to make sure
13:38that we could build a chargeable case.
13:41My office has now filed charges
13:44against Daniel Moreno-Gama
13:46in connections with the incidents
13:48that took place on April 10th.
13:52First, I will outline the charges
13:54in connection with the incident
13:57that took place
13:58at Mr. Altman's residence.
13:59We have charged as follows.
14:03Attempted murder
14:04for victim Sam Altman,
14:06including an allegation
14:07that it was willful, deliberate,
14:09and premeditated,
14:10as well as an enhancement
14:12for the possession
14:13and use of a deadly weapon,
14:15which was the incendiary device.
14:18Attempted murder
14:19for the security guard
14:21that was at Mr. Altman's home
14:23with the same allegation
14:25and enhancement.
14:27We have charged attempted arson
14:30of the home
14:31in violation of penal code
14:32section 455, subsection A,
14:36possession of a destructive device
14:38in a public place
14:39in violation of penal code
14:41section 18715, subsection A,
14:45possession of a destructive device
14:47or explosive
14:47with the intent to injure
14:49or intimidate
14:50in violation of penal code
14:52section 18740,
14:54and exploding or igniting
14:56a destructive device
14:58with the intent to murder
15:01in violation of penal code
15:02section 18745.
15:05With respect to the incident
15:07that took place
15:08at the OpenAI headquarters,
15:11we have charged
15:12the following crimes.
15:15Attempted criminal threats
15:17acts as it relates
15:18to the security guard
15:19that was present
15:20as well as an allegation
15:22of use of a deadly weapon,
15:24possession of a deadly weapon.
15:26A violation of penal code
15:28section 453, subsection A,
15:31which makes it a crime
15:32to possess or manufacture
15:33an incendiary device
15:34with the intent
15:35to willfully
15:36or maliciously commit arson.
15:39And a third charge,
15:41which is attempted arson
15:42in violation of penal code
15:43section 455, subsection A.
15:47Be assured
15:48that this conduct
15:49is being taken seriously.
15:53We interpret this behavior
15:55for just what it is,
15:57an attempt
15:58on Mr. Altman's life
16:00and an extreme danger
16:02to those around him
16:04and those who work
16:06for his company.
16:08As the DA,
16:10my office will prosecute
16:11this case
16:12to the fullest extent
16:13of the law.
16:14This should also be a moment
16:16where our nation reflects
16:19on the often incendiary rhetoric
16:21that is being used
16:22in discussions
16:23about artificial intelligence
16:25and its future impacts
16:27on our society.
16:29In no way
16:30should we be at the point
16:32where a man
16:33could have lost his life
16:35over differences
16:38over differences
16:38of opinion
16:39and concerns.
16:40We must,
16:42as I've said before
16:43about political rhetoric,
16:45turn down the temperature
16:46of our discussions
16:48and engage
16:49in healthy dialogue.
16:51We must focus
16:52on solutions
16:54towards protecting
16:55our workforce
16:56and protecting
16:57each other.
17:00But as we have said
17:01today,
17:03this type of conduct,
17:05this type of behavior
17:07is something
17:08that we will investigate
17:09and prosecute fully
17:12and it will never
17:13be accepted
17:14in San Francisco.

17:28the United States Attorney

17:31of California.
17:32Earlier today,
17:33my office filed
17:34federal charges
17:35against Daniel Moreno-Gama,
17:37the individual
17:38who is suspected
17:39of traveling
17:39to San Francisco
17:40from Texas
17:41in order to kill
17:42the CEO
17:43of a major AI company.
17:45Before describing
17:46the allegations
17:47in our federal complaint,
17:48I want to emphasize
17:49that what I'm
17:50about to describe
17:51are just that,
17:52they are allegations.
17:53Every defendant
17:54is entitled
17:55to a presumption
17:56of innocence
17:57unless and until
17:58proven guilty
17:59beyond a reasonable doubt.
18:01As alleged
18:02in the federal complaint,
18:04in the early morning
18:05hours of April 10th,
18:06Mr. Moreno-Gama
18:07traveled to two
18:09neighboring residences
18:10in San Francisco
18:11owned by the CEO.
18:13He allegedly
18:14approached the residences
18:15through a Molotov cocktail
18:17that caused a fire
18:18and then fled.
18:20He then went
18:21to the headquarters
18:22of the AI company,
18:23attempted to break
18:24the glass doors
18:25of the building
18:26with a chair
18:27and said that he had
18:28come to burn down
18:28the location
18:29and kill everyone inside.
18:32SFPD gratefully,
18:34promptly responded.
18:35They found
18:36the incendiary devices,
18:38kerosene,
18:39a lighter,
18:40and a document
18:41that Mr. Moreno
18:42had apparently authored.
18:44This document
18:45contained views
18:45opposed to AI
18:46and AI executives
18:48and reflected
18:49that the author
18:50had killed
18:51or attempted
18:51to kill the CEO.
18:54The federal complaint
18:55contains two charges,
18:57one count of violating
18:5826 U.S.C. 5861,
19:01subsection D,
19:03possession of an
19:03unregistered firearm,
19:05and 18 U.S.C. 844I,
19:08damage and destruction
19:09of property
19:10by means of explosives.
19:12We are at the beginning
19:13of this investigation,
19:15but if the evidence
19:16shows that Mr. Moreno-Gama
19:18executed these attacks
19:19to change public policy
19:21or to coerce government
19:23or other officials,
19:24we will treat this
19:25as an act
19:26of domestic terrorism
19:27and together
19:28with our partners
19:29prosecute him
19:30to the fullest extent
19:31of the law.
19:33One final word
19:34to echo
19:34what D.A. Jenkins said.
19:36I want to remind people
19:37to disagree.
19:39It is okay to disagree.
19:40It is okay to debate.
19:42This is a country
19:44that was built on both.
19:46But remember,
19:47the truth is often found
19:49in that very narrow space
19:51where two competing ideas
19:53come together

19:55and we will not tolerate
19:57any attempt
19:59to change the way

20:02or think
20:03through fear of violence.

20:44that was necessary
20:45to charge the defendant

20:48and to arrange
20:50for the searches,
20:52the very important searches
20:53that occurred
20:53in Texas.

21:05This is an ongoing investigation

21:13I am curious about
21:14the contents of that document
21:16and if that's going to have any,
21:18is that one of the reasons
21:19why attempted murder
21:20is probably going to be
21:21playing into these charges
21:22as well?
21:26Yes, I mean,
21:27we do have indications
21:28of what his intent was
21:29from those documents
21:31and statements
21:31that he made,
21:32but the contents therein
21:35we are not going to share
21:36at this time.
21:37Not only is it
21:37an ongoing investigation,
21:39but this is also a case
21:40where we are not going
21:42to further his platform
21:45of hate
21:46and his intent
21:49to cause further harm.

21:56on that last one,
21:57would you categorize
21:58that statement
21:58as a manifesto?

22:35will plan to proceed
22:37and that there will be
22:38continued communication.

22:41into legal hurdles
22:42down the line
22:43when you have
22:44parallel prosecutions.
22:46Our job right now
22:47is to make sure
22:48that he is prosecuted
22:50in the manner
22:51that he should be.
22:52There are crimes
22:53for which there's
22:54federal jurisdiction.
22:56We have different
22:57exposures
22:58when it comes
22:59to consequences
23:00and so needing
23:02to make sure
23:02that again
23:03we protect both prosecutions
23:04it will require
23:05communication
23:06and work
23:07between our offices.
23:10I agree with that.
23:14This is a case
23:15obviously you have
23:17an individual
23:20who lives
23:20in the city
23:21of San Francisco
23:21and his family
23:22and his company
23:23so it makes perfect sense
23:25for the DA
23:26and SFPD
23:28to step in.
23:29It is their job
23:30and they do a great job
23:31at it
23:32of protecting
23:33the residents
23:33and the city
23:35and county
23:36of San Francisco
23:36but at the same time
23:38there are very significant
23:39national federal
23:41interests
23:43in this case
23:44that we need
23:44to explore
23:45and at this point
23:46we will file
23:48the federal charges
23:48the state
23:49will file
23:49their charges
23:50the two investigations
23:52will most likely
23:53run in tandem
23:54and at some point
23:55down the road
23:56if it makes sense
23:58for one or the other
23:59to step back
24:00that's a possibility
24:01but right now
24:02we feel
24:02that there are
24:03interests on both sides
24:04of the state
24:05and the federal side
24:06and it is important
24:08for both sides
24:10to file charges
24:11and I do not anticipate
24:12any issues
24:13going forward
24:14because of that.

24:23that Houston has asked

24:33a confirmation
24:33that he is attending
24:35school right now

24:37that he was affiliated
24:38with at some point
24:40over the last year

24:44Montgomery, Texas.
24:49For our state charges
24:51he is facing
24:5119 years to life
24:53in prison.
24:56When is he expected
24:58to be in court?
24:59Was that in federal court

25:03Yeah he's currently
25:04in state custody
25:05and I anticipate
25:06he will make his appearance
25:08in state court tomorrow
25:10and then we will decide
25:11we don't have a specific date
25:12when he will appear
25:13in federal court
25:14but that's something
25:14we will work out
25:15through dialogue
25:17with the DA's office.
25:19He had been in town
25:20at least since Monday
25:22and staying in a hotel
25:23in the Union Square area.
25:24Can you tell me

25:26you might have been doing

25:29We've reported this.

25:39So yeah,
25:40so we're still

25:44a lot of evidence

25:47so can't really comment

25:48on what he was doing
25:50leading up into this.

25:52about the gun
25:52that was found in the hotel?

25:58I heard that there was
25:59no connection
26:00between the two incidents,

26:29so unfortunately same answer.
26:31It's still a lot of evidence
26:32that we're sifting through.

26:36like everyone stated here,
26:37investigators are working
26:38around the clock
26:39to get through all that stuff.
26:41So unfortunately,
26:42I can't talk about
26:43any associations at this point
26:45or really any motivations even.

27:51that there's any specific threat
27:52to any of those
27:53through the course
27:54of this weekend.

28:03conducting more interviews
28:05there's a lot more work

28:15and so we will do that
28:16but that duty to warn
28:17and those efforts
28:18were made very quickly
