22:14Well, I was just back to sleep, but I woke up and heard this creak at the front door.
22:26I heard it, and I just looked out, and I saw someone walking in.

22:45All of a sudden, a big, dark, shadowy figure appears in the hallway outside your room.

23:15She just recognized it as a person that was looking in on her.
23:17That was the first time we now had somebody else possibly involved.

23:38When Melissa was being interviewed by investigators, she came up with a name for the investigators to look into.

23:48The only thing I can think of is Don's ex-boyfriend.
24:20Melissa Oxley identified Ben's ex-wife as Don Oxley.
24:37He was a violent felon, and she thought maybe he could possibly be involved in this murder because he did
24:48not like Ben.
24:49due to some domestic issues that Ben and Don had had a few years prior.
24:53Maybe Don complained about him or told him some negative things about him.
25:01Jonathan also seemed to be jealous of other men.
25:05So maybe he had some kind of animosity towards him.
25:10Looking at Mr. Reynolds, who has a violent history, it's very concerning, obviously, because that kind of fits a profile
25:16of somebody that would kill somebody.
25:17He was very capable of murder.
25:28After learning of Mr. Reynolds' possibility involvement, we immediately had two questions in our mind.
25:33One was, if he did commit the murder, did he kill Don?
25:36So we needed to immediately go talk to Don and get a welfare check on her to see if she
25:39was still alive or had been hurt.
25:41And secondly, we wanted to know his whereabouts.
25:46We learned that Don only lived about 20 minutes from Ben.
25:49Investigators went over to Don Oxley's house and made contact with her.
25:54The investigators went to check on Don's welfare.
25:56They found at the residence was Don herself, her older daughter, and her son, Devin, and her friend's son, James
26:06Matling.
26:06She was safe and secure.
26:08When investigators advised her of the death of Ben, she appeared distraught.
26:14She made admissions about not liking Ben, but had no way that she wanted the father of her daughter murdered.
26:21Don was in shock.
26:23She had an alibi that James and her, they were watching a movie, and went to bed around 4 o
26:28'clock in the morning.
26:29And that was all that she knew until the investigators woke her up roughly around 6 o'clock.
26:34And we asked her about Mr. Reynolds and his ability to harm.
26:38And when she had last had contact with him, she had said she had spoken to him that day
26:41because he had just gone out of prison a couple days before.
26:47Jonathan had months and months in prison.
26:50Was this festering?
26:51Did he sort of go over plans in his mind to kill Ben?
26:58Maybe he wanted to rekindle the relationship with Don,
27:01sneak it into a dark house when everyone is asleep and they're defenseless.
27:30When we heard that someone was murdered in the middle of the night,
27:42The first thing I thought of was that is right around the corner from where I lived with my family.
27:53It seemed so safe in our neighborhood.
27:56We couldn't believe it.
27:58A lot of us sleep with the windows open.
28:00We don't lock our doors.
28:01You don't really think about what that would mean if someone broke into your house
28:07with the intention of murdering you or your family.
28:12And especially when you're dead asleep.
28:18You just don't think about that.
28:28I had told the detectives the only person that I thought about was Don's ex, Jonathan.
28:43Detectives followed up on that, found him, and he was actually nowhere near the crime scene.
28:49We were able to confirm with Jonathan that he was in Lancaster, California.
28:54And we were able to confirm that with the local sheriff's office there.
28:58And it was within, I believe, six hours of the murder.
29:01So at that time, he had a good alibi of where he was.
29:05He wouldn't have made it from our location to L.A. in six hours.
29:11After learning about Jonathan's whereabouts, now we're looking back at Melissa, thinking,
29:16why is she providing this information on Jonathan?
29:19What is her gain?
29:20Is there a different motive?
29:22Is she trying to throw off the investigation?
29:24Went to focusing back to Melissa.
29:26As we start looking and, you know, kind of seeing what Melissa's patterns are, what is she doing now?
29:31I received a call that there was a life insurance policy that was taken out on Ben a few months
29:36prior to the murder.
29:38It's concerning now that we have an insurance policy that she's going to be the beneficiary of almost $400,000.
29:44That's a lot of red flags.
29:46That's 400,000 reasons to commit a murder.
29:50If that's not a motive, I don't know what is.
29:54I also find out that she's currently dating after approximately three months after the murder.
30:00It's looking very suspicious for someone to be moving on that fast.
30:04How can somebody move on so fast from the person they're supposed to love,
30:07and then they're murdered, and now we're already dating again?
30:09I confronted her on everything from insurance money to the dating.
30:13The idea of being watched or your every move being critiqued or under suspicion,
30:20like, it just, it's never a good feeling, and you lose privacy.
30:25I was young, and I was moving on, and I needed to get out.
30:29That was really the basic.
30:31So you're not sitting at home and just depressed and overwhelmingly just lonely.
30:37I guess I was kind of in my own world, getting through, surviving.
30:43I think she was just lost, which is understandable to me.
30:48And then, again, we discussed the insurance money a little bit time to time,
30:51and she, again, she didn't care about the money.
30:53She just didn't care.
30:54We learned that Melissa hadn't even attempted to cash the money or to even obtain the money.
31:00She wasn't even asking the questions on how to get the money.
31:04I didn't know we had a life insurance.
31:06Had no clue what life insurance was or anything to do with it.
31:15We are back to square one.
31:18We still really don't have a really good suspect list.
31:22You're rethinking the information.
31:24What did I miss?

31:26We started looking at who we contacted, and we started looking at his ex-wife, Dawn.
31:37So we started looking into Dawn and what motives she might have towards Ben.
31:41After the divorce, there was split custody of Alyssa between Ben and Dawn.
31:45But as time progressed, Ben petitioned the court for full custody of Alyssa, and he was granted it.
31:51Dawn was a single mom, worked in the casino, was a cocktail waitress.
31:56She had two other children, and then there was Alyssa, and Ben took care of all of them.
32:02It seemed to be pretty cordial, but Dawn wasn't really in the children's life.
32:09The child custody dispute between Ben and Dawn, that weighed heavily on Dawn.
32:15She took that very personally.
32:19Let's do this.
32:20What time did you think you went to sleep?
32:22Oh, God.
32:24I had.
32:25I watched some movies, The Departed, and Descent, and I had it in, like, I don't know, about 4, 4
32:35.30.
32:36She stated that she was at the house the whole time, and that was all that she knew.
32:43Who was at the house?
32:46My son, Devin, my daughter, Brandy, Eric, which is my son's friend, and James.
32:55And James is my, like, best friend's son.
32:58He hangs out there a lot.
33:01At 4.30, who else is still up?
33:10talking to the family and everybody there, the people that were there, they all confirmed
33:15that they were all home that night.
33:24We're starting to put James Matling and Dawn Oxley into the forefront of our investigation
33:29because we felt they had something to do with it.
33:31We just didn't know what it was.
33:34We did open surveillance where we followed them and made sure they knew we were following
33:38them around.
33:40We wanted them to see us following them.
33:42We wanted them to see us out and about in the community where they were at to add pressure.
33:52Let's see if one of them would come forward with some information.
34:00As we started looking at Dawn and James Matling, we started realizing that there is some untruths
34:05there.
34:05We started hearing a little bit about them being in a relationship, which was denied at
34:09first.
34:09and the question is, is why was that held from us?
34:14Initial interviews at the house, they said they never left.
34:17We went back, did some second interviews.
34:19That's when Dawn said that James did leave.
34:23They obtained the surveillance video.
34:27We found out James was at the convenience store the morning of the homicide.
34:35So we know that now his story has changed.
34:37At first, he never left the house and now we know he's out and about in the early morning
34:42hours of the night of the homicide.
34:52What do you think I'd like to hear about?
34:55In that first interview, when I originally asked you if you had gone out of the house
34:59that night, you told me no.
35:01You made up a big story about how you guys watched movies all night long, how you passed
35:06out of the couch, et cetera, et cetera.
35:08You went on about that.
35:09Later, I found out through surveillance video that you were at 7-11.
35:13We're finding holes in his story.
35:16Now we start looking into them deeply like, okay, so if you're lying, what else is not true?
35:19Did I kill Ben?
35:21No.
35:21Do I know who killed Ben?
35:22No.
35:23Did Dawn kill Ben?
35:24No.
35:25Do I know anything about the murder?
35:26No.
35:27It kind of makes you think, hmm, somebody's not telling me the truth.
35:30Were you and Dawn in any way involved in the planning of the death of Ben?
35:33No.
35:47Interviewing James Matling.
35:48He admittedly denied any involvement in the murder of Ben.
35:51He said Dawn Oxley had nothing to do with the murder of Ben.
35:54I'm looking you into your eyes.
35:56I did not kill him.
35:58I had nothing to do with him.
36:00I just didn't believe James, but you cannot arrest somebody on a hunch.
36:03You have to arrest them for what they do with evidence.
36:10So at that period, Investigator Stork and the other investigators started focusing on Dawn,
36:14and then Dawn is continuing to feel the pressure of the investigative team looking at her as a possible involvement
36:20in this homicide.
36:23We could tell Dawn was very uneasy about the surveillance, and we could tell it started to weigh on her.
36:32There was a lot of stress going on, and we just needed that stress to come out in some type
36:37of statement to us.
36:43Dawn called and wanted to talk about the case and that she had had information on who killed Ben.
37:07Ben and I were going through all our tough spots.
37:11James said he could put a bullet in his head then.
37:16It wasn't something I thought would be serious, you know what I mean?
37:19I didn't think about it like that.
37:21He said, no, I could really go take care of it.
37:24And I'm like, no.
37:27No.
37:29You know, you can't be serious about it because this is ridiculous.
37:32That was the way I looked at it.
37:37Dawn said that James did it at his own accord and that she didn't want him to murder.
37:43She was just angry and talked, and James took that out of context.
38:07As much as we want to all believe that's the truth, that's the end of it, something told us this
38:11isn't the truth.
38:13The hard part is, I think, and my heart, and I think the rest of the team believe this, that
38:17she was involved.
38:19We ended up giving her an immunity agreement for her to testify against James.
38:26And I think that's the choice we made, that we needed to punish the actor first.
38:31And then if she was not truthful with us, then we need to go after and try to prove that
38:35she was untruthful.
38:53James sits down, and you could tell just he had so much stress and weight laying on his shoulders.
38:59And he makes mention that he needed to get this off his chest.
39:05He needed to confess.
39:08She was always ranting and raving about Ben.
39:12I said, I'll take care of Ben.
39:14She said, I don't want you to take care of Ben. I want you to kill Ben.
39:18I said, you want me to kill Ben?
39:20She said, yes.
39:23Through the interview, James tells us that this was Dawn's idea.
39:28Don had wanted Ben dead, and James told her that he would kill Ben for her.
39:35During their time at the house, they conspired how to commit the homicide.
39:40I told Dawn that I would need some things.
39:47She gave me a big card, went to 7-Eleven, and pulled out $40.
39:53I had a blue trunk with a double-barrel 12-gauge shotgun in it.
39:58He took my truck to Walmart.
40:03At Walmart, I bought the shotgun shells.
40:05I bought shoes.
40:07I bought rubber gloves.
40:08I bought paper towels.
40:14James goes on to say that they drove to Benjamin Oxley's house.
40:19So he didn't know the layout of the house.
40:21So he told Dawn that she needs to go inside the house with him.
40:30We then went to the right-hand side of the house and threw a sliding glass door.
40:45And then we go down the hallway.
40:48And as I'm walking down the hallway, Dawn stops in front of an open doorway,
40:52which was Alyssa's bedroom.
40:58And almost to the master bedroom.
41:00And I turn around and see that Dawn's not following me.
41:06The scary dark figure standing in Alyssa's room was her own mother, Dawn.
41:15James says he makes Dawn leave the house to go outside and get in the car
41:21so they can make a fast getaway.
41:24He approaches the bedroom where Ben and Melissa were sleeping.
41:31Lifts up the shotgun to the back of Ben's head.
41:38And I'm standing there.
41:41I don't know how long I was standing there.
41:43Something happened.
41:44I jolted and I pulled the trigger.
41:49I shot Ben.
41:50I killed Ben.
41:53I'm in shock listening to this because I'm thinking,
41:57if this is true, Dawn is 100% involved in this case.
42:03And Melissa is the luckiest person alive right now.
42:07Dawn had asked if I could kill Melissa too.
42:09And I agreed to it.
42:23I could do it again.
42:27I never thought, like, why was I spared?
42:32Obviously grateful in a sense that I was.
42:35That brought a whole nother level of fear.
42:38It was, like, unreal at that point that you were actually supposed to be dead too.
43:00In my opinion, Dawn definitely got away with murder.
43:03Definitely not fair to Ben, Alyssa.
43:07It's just hard for me thinking about Alyssa knowing that her mom had her dad killed.
43:20Investigation being finalized, I was able to have Alyssa back full time.
43:27It was like another piece given back, like we could go on.
43:33The only way I would have been able to get through life to this point is the bracelets that say,
43:39what would Jesus do?
43:40I always think about, what would Ben do?
43:44I try not to think about Ben and the memories.
43:49It's just, like, that sense of security and love and smile that I come home to every day.
43:56There's still a sense of him here and with us.
44:01Like, he has so much to live on and the legacy here that he's left and how he loved.
