37:47how you keep doing this.
37:49You make some
37:50of my favorite documentaries
37:51I've ever seen,
37:52but how do you...
37:54Well, I mean,
37:55Capturing the Freedmans,
37:57The Jinx.
37:58How do you know
37:59when you have a good story?
38:01I think we always
38:02try to go in
38:03without a preconceived notion
38:04of what the story
38:05is going to be.
38:05We just try to see
38:07what we can see.
38:07And in this case,
38:09it was so surprising
38:10because we never expected
38:12to have access
38:13to the Alabama
38:14state prison system.
38:15That's a very secretive system.
38:17Not that different
38:17than when I was making
38:18Capturing the Freedmans
38:19and I thought I was making
38:20a film about professional
38:22children's birthday party
38:23entertainers,
38:23and later it turned out
38:25to be about child molestation
38:27or, you know,
38:28the usual.
38:30Or we, you know,
38:31started out making a film
38:32about Robert Durst.
38:33We didn't know
38:33that he was then going to
38:34sit down for 21 hours
38:36of interviews
38:37that we were going to
38:37do this investigation
38:38and he was going to
38:39get arrested
38:40based on the material
38:41in the film.
38:42Yeah, you don't know
38:42what's going to happen next.
38:43But when I'm watching
38:44the Alabama Solution,
38:46I kind of got that
38:47same kind of vibe
38:48because it starts,
38:49I mean, how did you
38:50choose Alabama
38:52and seeing the corruption
38:54behind the prison system?
38:56You know, I was always
38:56interested in the problems
38:58with incarceration
38:58in America
38:59and I was fascinated
39:02by Alabama,
39:03but it's such a secret
39:04of system.
39:05They don't let the press in.
39:06They don't even really
39:07let the government people
39:08in to see what's going on there.
39:09So, of course,
39:10what's going on there
39:11is not good.
39:12And I was talking to my daughter
39:14who was 14 at the time
39:16and was a big reader
39:16and she was reading a book
39:18by a man
39:18who had been wrongfully convicted
39:20in Alabama.
39:20And she said,
39:21I know you're interested in this.
39:22Maybe we should read it together.
39:24So we read it together
39:25and then we just spontaneously
39:26decided to take a road trip,
39:27kind of father-daughter trip.
39:29We went down there
39:30and we met a man
39:31who was the first
39:31black prison chaplain
39:33in the state of Alabama
39:34and he said,
39:35if you're interested,
39:36why don't you come in?
39:38And I said,
39:38well, I'm a filmmaker.
39:39They're never going to let me
39:40bring cameras in.
39:41And he said,
39:41well, you know,
39:42the Lord works
39:42in mysterious ways
39:43and let's see what happens.
39:45And we ended up
39:45being able to film
39:46for one day
39:48in that prison.
39:50But you go
39:51and it's kind of like a party.
39:53It's like a barbecue almost.
39:55This is the truth.
39:56And then you're there
39:57filming this barbecue
39:59and then a couple
40:01of the incarcerated individuals
40:03go,
40:03of course you're here on this day.
40:05This is not life at all.
40:07Yeah.
40:07This is,
40:08they set you up.
40:09This is not what our life is.
40:10And you go, right?
40:11Yeah.
40:11I mean,
40:12you know,
40:12I said to the men
40:15when we first met them,
40:16my partner Charlotte,
40:17and I,
40:18who were making the film,
40:19we said to them,
40:20you know,
40:21how are you doing?
40:22And they said,
40:22what you're seeing right now
40:24has nothing to do
40:25with our daily life.
40:26You're seeing this
40:27beautiful revival meeting
40:28and they're feeding us food
40:29that we would never see
40:30in a million years.
40:31Our food says not fit
40:32for human consumption
40:33on the packages.
40:34And therefore,
40:36you know,
40:36you need to get into this.
40:37We need you to help.
40:38We need you to look
40:39in that building over there
40:40that you're not allowed to see.
40:41That's a,
40:42that,
40:42that tin building
40:43is where they've had men
40:44in there for,
40:44in solitary confinement
40:46for five years,
40:47individuals.
40:48And so there were
40:49so many disturbing things
40:50that we were seeing.
40:51And then,
40:52of course,
40:52we get a little too nosy
40:53and then they kick us out,
40:55you know,
40:56which I wasn't that surprised by.
40:58You know,
40:58we started,
40:59the warden said to us,
41:00don't talk to the men
41:01when you go inside,
41:02just talk to these two men.
41:04These guys are okay to talk to.
41:05Everyone else is going
41:06to be dangerous and scary.
41:08And of course,
41:08we went in there
41:09and very quickly,
41:10we realized we felt
41:11much more comfortable
41:12with the incarcerated men
41:13than we did with the guards
41:14who were bringing us in.
41:15And then we were worried
41:16that we weren't going
41:17to be able to tell the story.
41:18And then we had
41:19this responsibility
41:19because now people
41:20have told you the story.
41:21Nobody else is going
41:22to get in there.
41:22You've got to dig deeper.
41:23And so we realized
41:25when we got out
41:25that we should start talking
41:27to some people
41:27who were out.
41:28And they said,
41:29you know,
41:29there's a network of leaders,
41:31these brilliant guys inside
41:32who've been managing,
41:34kind of leading
41:34a non-violent protest effort,
41:36doing work strikes
41:37and doing hunger strikes.
41:40And they have access
41:41to contraband cell phones.
41:43And they get these cell phones?
41:45Well, it's funny.
41:46I didn't know
41:46when I first heard about it.
41:48I said, wait,
41:48people in prison have cell phones?
41:49And everybody said,
41:50no, of course
41:51they don't have cell phones.
41:53But then they did.
41:54And I said,
41:55you know,
41:55how do these phones come in?
41:56I was talking to one
41:57of the incarcerated men
41:58on a cell phone.
41:59And I said,
42:00where are these phones
42:00coming from?
42:01And he looked at me
42:02like I was an idiot.
42:03And he said,
42:04you know,
42:04we don't leave here, right?
42:07And I said, yeah.
42:08And he said,
42:10so who leaves
42:11and comes back in every day?
42:13And I said,
42:13the prison guards.
42:14And he said, bingo.
42:15Those are the people
42:16that are bringing in
42:16the cell phones.
42:17The two main guys
42:18in the film
42:18both have life without parole.
42:20So it's not like
42:21they're about to get out.
42:23They're trying to do this
42:24for the other people.
42:24He's in solitary confinement.
42:26Yeah.
42:26And you're talking to him.
42:27Yeah.
42:28Yeah.
42:28When we film,
42:28with the opening of the film,
42:29we start talking
42:30to Robert Earl Council,
42:31who goes by Kinetic Justice.
42:33And it's like,
42:34honestly,
42:34it's like talking to Mandela.
42:36This is a guy
42:36who never should have
42:37been incarcerated.
42:39His crime had to do
42:40with somebody getting shot
42:42when he was in the process
42:44of getting run over
42:45by a car.
42:46So clearly,
42:46that would have been
42:47a self-defense case.
42:48But he's a very,
42:50very powerful speaker
42:51and motivator.
42:52And, you know,
42:53you can read his words
42:54and really feel inspired.
42:56I felt so lucky.
42:57And people say,
42:58well,
42:58these are unlikely heroes.
42:59It's kind of true
43:00that they're unlikely heroes,
43:01but heroes nevertheless,
43:03they're worrying about people
43:05other than themselves.
43:06And they're doing these
43:08extremely risky things
43:10to get the word out.
43:11It's fascinating.
43:11And it's shocking.
43:13But I,
43:15also,
43:15the governor of Alabama
43:16is a pretty big character
43:18in this.
43:19Have you heard from...
43:20Yeah, yeah.
43:21Her name is Kay Ivey.
43:22And she and Steve Marshall,
43:24who's the attorney general,
43:25are kind of presiding
43:26over this very deadly system.
43:28I'd like to believe
43:29they don't know everything
43:30that's happening
43:31in this system,
43:32but one would,
43:33that's a little hard
43:34to imagine.
43:35She didn't react at all
43:37to the film
43:37since it came out
43:38at Sundance.
43:39Really?
43:39They had no comment.
43:41But then,
43:41when the film got nominated
43:43for the Oscar,
43:45she came out with a statement
43:46that was,
43:47we always knew
43:48the Oscars had a low bar.
43:51So, you know,
43:52here she is
43:53getting into fisticuffs
43:54with the Oscars.
43:55So we thought,
43:56well, you know,
43:57in a way,
43:58let's try to
43:58meet this with kindness.
44:00You know,
44:01maybe she doesn't know
44:02what she's doing.
44:03She's called Meemaw.
44:05Maybe there's a grandma
44:06in there somewhere
44:06that would be worried
44:07about this.
44:08And so we reached out
44:10to her
44:11and to Steve Marshall,
44:12the attorney general,
44:13and we said to them,
44:14we'd like you to come
44:15to Los Angeles,
44:16you know,
44:17March 14th,
44:18the day before the Oscars.
44:20We'd like you to watch
44:21the film with us
44:22and with the family members
44:24of some of the people
44:24who have lost
44:25their children in this system.
44:271,500 people have died
44:28in that system
44:29since we started
44:30making the film.
44:31And then we'd like you
44:33to acknowledge the problem
44:35and then come with us
44:36and those families
44:37to the Oscars.
44:38We have not heard back yet,
44:39but we're hopeful.
44:41Wow.
44:43It's amazing
44:44that you did this
44:45and keep doing
44:46what you do.
