01:46But with a document emanating from the prosecution team opposite,
01:50and disclosed to us a mere week ago,
01:53not as information material to the preparation of our defence,
01:56but as exonerating evidence,
01:59we can now substantiate what we have suspected for a long time.
02:04The document comprises a transcript of a telephone call,
02:08covertly recorded between four parties who cannot be mentioned in public,
02:13and one of these parties was boasting,
02:16boasting about how he was acting as the silent partner of President BBM,
02:22managing a scheme to funnel witnesses to this court,
02:26while all the time ensuring that he could guarantee
02:29President BBM's plausible deniability.
02:34So it is indeed the defence case
02:37that President Ferdinand Marcos Jr.
02:41set out to neutralise
02:42Rodrigo Duterte
02:44and his legacy.
02:49Cases are decided on the basis of evidence,
02:52not supposition,
02:54not rumour,
02:55not spicy gossip,
02:57and certainly not on the basis of political rhetoric
02:59and bluster,
03:02because at the end of the day,
03:03were it not for those belligerent and controversial speeches,
03:07there would have been no impetus
03:09to bring the People's President to The Hague.
03:11And when the prosecution's evidence
03:13is examined,
03:15I would ask you to keep an open mind
03:17and to question not just whether that evidence
03:20has been selectively presented,
03:22but whether there exists evidence
03:25which the prosecution has failed to produce.
03:27And I say this with justifiable cause,
03:31particularly with respect to the Duterte rhetoric,
03:34as we will prove
03:35during the substantive part of our submissions,
03:38the notorious speeches on which the prosecution relies
03:42have been cherry-picked
03:44to suit its narrative
03:45while ignoring the many other speeches
03:48when the former president tempered his bombastic language
03:52by clear reference to the principle of lawful self-defence.
