00:05issue,
00:06kausapin po natin si House Justice Committee Chairperson at Matangas 2nd District Representative Jerviel Luistro.
00:13Magandang umaga at welcome po sa Balitang Hali, Ma'am.
00:16Magandang umaga, Connie, and thank you for having me here.
00:35Well, we cannot comment on that, no?
00:37And as far as the Justice Committee is concerned,
00:41ang trabaho namin is to wait kung kailan ma-transmit ito sa Justice Committee
00:47and to conduct the same deliberation and evaluation that we had.
00:54Similar dun sa nangyari ka sa impeachment complaint against the President, no?
01:00As to whatever is the motive about the filing of the fourth impeachment complaint,
01:05we are totally unaware of that.
01:35for as long as it is being filed within the regulatory period.
01:40We have to remember, hindi naman nagbago yung Francisco ruling,
01:46what operates initiation in as far as impeachment complaint is concerned
01:54To this date, wala pang referral, no?
01:57I think the first three impeachment complaints were transmitted already to the Office of the Speaker.
02:07but since wala pang nare-refer sa Justice Committee
02:11at hindi pa rin naglalaps yung 10 session days
02:15when the Office of the Speaker is supposed to include
02:18all this impeachment complaints in the order of business of the plenary,
02:22so I think pwede pa, pwede pa mag-file ng impeachment complaint, Connie.
02:40I hope it will not affect, no?
02:47that this is a constitutional duty that we really have to face, no?
02:51This is not a question of gusto ba namin o ayaw namin.
02:55This is not a question of pro-administration ba kami o pro-Duterte ba kami, no?
03:01This is a constitutional duty na kairangang harapin ng members ng Justice Committee
03:07and ultimately by the members of all the members of the House
03:11when we already approve or disapprove the committee report of the Justice Committee.
03:33Connie, I am very conservative.
03:35My perspective is as chairperson of the Justice Committee, no?
03:40So regardless of the consequence of the pronouncement of the Vice President kahapon
03:46and regardless of the motive of the complainants behind this four impeachment complaints already, di ba?
03:56Ang iniisip lang namin sa Justice Committee is for us to be able to do our duty
04:03in as far as the determination of probable cause supporting the impeachment complaint is concerned, Connie.
04:26Yeah, so from the date of referral to the Office of the Speaker, no?
04:32I'm just checking, no?
04:33The first and the second complaint were referred to the Office of the Speaker on February 5.
04:40Tapos, itong third complaint naman, referred to Office of the Speaker on February 9, no?
04:48So counting from February 5, Rafi, no?
04:51The Office of the Speaker has a period of 10 session days within which to include the impeachment complaints in
04:58the order of business.
05:00At kailangan nito ma-observe strictly, ha?
05:03Because if we don't mag-ooperate yung pronouncement ng Supreme Court in the recent resolution,
05:09that because of inaction of the House of Representatives upon the lapse of the regulatory period,
05:17considered or deemed initiated already ang impeachment complaint, no?
05:22So given these dates, no, Rafi, yung first and second complaint, unang na-refer,
05:29unang na-transmit sa Office of the Speaker, February 5.
05:32So from February 5, we should count 10 session days.
05:36And within that period, dapat mai-include na sa order of business
05:40either some or all of the impeachment complaints, if that is the desire of the Office of the Speaker.
05:58Well, we're supposed to tackle everything na marirefer sa amin, no?
06:02Just like what we did in the past impeachment deliberation against the President, no?
06:14And then, we also deliberated upon per ground, di ba?
06:19So we will be following the same parameter, the same mode, the same deliberation
06:24pagdating dito sa impeachment process against the Vice President, no?
06:29But what is important, we should be mindful about that February 5, no?
06:33Kasi February 5, na-transmit sa office ni Speaker yung first two impeachment complaints.
06:38So, very significant yung date na yun.
06:41Kasi from February 5, diyan tayo bibilang ng 10 session days
06:45within which dapat ma-include sa order of business ng plenary ang impeachment complaint.
06:51Not only those two, it may include also the third and the fourth.
06:55Basta yung 10 session days, it should be counted from February 5.
06:59Okay.
07:12Well, since, Rafi, itong apat na impeachment complaints ay filed under the first mode, no?
07:18Sa pagka-endorsed ito by few members of the House, no?
07:30So, the proper time when to file an answer will be after the determination of form and substance.
07:38Tune tayo sa step three, no?
07:40Remember, we summarized the process of the Justice Committee into five.
07:45One is the determination of sufficiency in form.
07:49Second is determination of sufficiency in substance.
07:53Third, kapag pareha sufficient in form and substance,
07:57bibigyan na natin ang notice si respondent for her to file an answer within the period of 10 session days,
08:04no?
08:0410 calendar days, no?
08:07And then from there, ay mag-pwede pang sumagot ang complainant by way of reply.
08:14And then the respondent may answer also by way of rejoinder.
08:19And then they may also consider the submission of all evidence,
08:23including the swearing-in of the affidavit and counter-affidavit.
08:28At kapag nakompleto niya, yan, that's the time that they will proceed to the detail
08:33whether there is sufficient basis to support the impeachment complaint.
08:37That is our step three, Rafi.
08:39After that, proceed tayo sa step four.
08:41Dito natin iimbitahin yung parties.
08:44Complainant, witness, and even the respondent.
08:47And again, palaging tinatanong ng mga tao,
08:50paano kung hindi pumunta yung respondent?
08:53It's actually her prerogative, no?
08:55Ito rin yung naging sagot ko during the impeachment process against the president.
08:59Whether she comes or not, that's her prerogative
09:03because yung presence niya is part of due process.
09:07So kung hindi siya dadating,
09:08it will only be interpreted as her waiver of her right to be present during the hearing.
09:14And after that hearing, which is our step four,
09:17we proceed to step five,
09:18that is the determination of the existence of probable cause.
09:22Whatever will be the decision of the Justice Committee,
09:26isusulad namin yan sa committee report,
09:29if forward sa plenary,
09:30which will be subject to the vote of at least one-third of all the members of the House.
