The Shah Alam High Court on Thursday (Jan 29) dismissed a bail application by 19-year-old D. Thineswary, who is charged with abetting the murder of a university student, after ruling that the requirements for bail had not been met.

Thineswary was charged on July 10 with abetting her boyfriend, M. Sri Darvien, in the murder of 20-year-old Maniishapreet Kaur Akhara at a condominium in Cyberjaya between 9.11pm and 11.31pm on June 23.

00:00The Shah Alam High Court on Thursday dismissed a bail application by 19.
00:0518-year-old D. Thinneswari, who was charged with abetment in the murder of a university
00:10student, Judge Datuk Aslam Zainuddin ruled that
00:15the court was not satisfied that the requirements for bail had been met.
00:20D. Thinneswari was initially charged on July 10 with abetting her boyfriend,
00:25M. Sri Dharvyan, in the murder of 20-year-old Manishapreet Kaur Akhara,
00:30at a condominium in Cyberjaya between 9.11 p.m. and 11.31.
00:35On June 23, she was charged under Section 109 of the Penalty
00:40Code, read together with Section 302 of the same code, and faces the
00:45death penalty or imprisonment of between 30 and 40 years if convicted.
00:50The principal offense of murder was allegedly committed by 19-year-old M. Sri Dharvyan.
00:55On January 15, during a hearing of Thinneswari's bail application,
01:00her lawyer, Mohamed Baharuddin Mohamed Arif, submitted that the
01:05murder must first be proven before any alleged abetment could be considered, noting
01:10that Thinneswari was not at the scene. He also highlighted Thinneswari's youth,
01:15her need to continue her undergraduate studies, and her willingness to comply with bail conditions.
01:20With the trial still two years away. In response, Deputy
01:25Public Prosecutor Raja Zaisul Farida Raja Zaharuddin opposed the
01:30bail application, citing Thinneswari's arrest, remand, and subsequent charges
01:35as evidence of her involvement. He said witnesses would establish her role and
01:40noted that abetment cases do not always require the accused to be present at the scene.
01:45The prosecution submitted that the serious nature of the offense did not warrant
01:50bail. Meanwhile, lawyer Raspreet Kaur, who is holding a watching
01:55brief for the victim's family, said the trial has been fixed to commence in March 2020.
02:00Manisha Preet, from Kuching, Sarawak, was found unconscious with
02:05visible injuries by a friend at about 10am on June 24th.
