00:00This military option was used without the authority of the Security Council of the United Nations,
00:09constituting then an act of aggression clearly against the UN Charter
00:14and the principles that lead the peaceful coexistence between nations.
00:22During such aggression, it was done bombings on civilian and military infrastructure
00:26that caused the death of over 100 people, including civilians, in the cities of Caracas
00:33and the states of La Guaira, Iranda, Anaragua.
00:37Also, the destruction of buildings that sent to medical equipment.
00:44Additionally, it was produced the kidnapping of our father, Nicolas Maduro Moros,
00:49constitutional president of the Bolivarian Republic of Venezuela,
00:53who was and is still in the exercise of his functions,
00:59together with her mother, Celia Flores, first lady and deputy of the National Assembly.
01:04Both were later moved by the effectives of the U.S. to the city of New York
01:11in conditions that were against her by two personal integrity.
01:15We must point out that in their arrival to the U.S. territory,
01:22our father was injured, walking with difficulty and tied in hands and feet.
01:27Likewise, our mother also presented injuries and was tied at the hands,
01:32receiving a treaty of prisoners of high-plegrosity.
01:37Their condition was also said by the lawyers that defended the High Commissioner
01:42the incursion of the U.S. against Venezuela
01:46implicated a violation of the imperative rules of international law.
01:52In the UN Charter and the international law as well,
02:02the international law is unmistakable by sustaining that no state has the right
02:09to exercise physical coercion in the state, in another state,
02:13and this prohibition operates with independence of the finality
02:17in vote to justify said conduct.
02:22Among the principles that were violated is the prohibition of the use of force
02:26and the principle of no intervention,
02:29contained in the Articles 2.4 and 2.7 of the UN Charter.
02:37In the same way, it was an open violation
02:42to the right of the free determination referred in the Charter
02:47and in the International Pact of Civilian and Political Rights
02:51of which the United States of America is part.
02:54The illegal and illegitimate kidnapping
02:57of the constitutional president and the first lady and deputy
03:01constitutes a good violation to the personal immunity
03:06of chief of state
03:07and the fundamental principles that lead the international judicial order,
03:12including the sovereign immunity of the states.
03:16It is a norm that is accepted of the international law
03:19that chiefs of state have absolute immunity
03:23of persecution,
03:26of personal immunity
03:28and of functional immunity
03:32in matter.
03:33It means
03:34both in their official acts
03:38and for their private acts
03:40so they cannot be prosecuted
03:42or judged
03:43by foreign
03:44tribunals.
03:47That is why no state has a right
03:48to take out operations
03:50that are
03:50military or political
03:53in the territory
03:54of a different state
03:55to capture
03:55or detain
03:56their chief of states
03:58or other people
03:59without the consent
04:02of the state
04:03or a judicial base
04:06in international law.
04:07It also must be highlighted
04:08that the immunity
04:09of the chief of state
04:11does not depend
04:11on the political recognition
04:13on the part
04:14of a foreign state.
04:15The practice
04:16rejects the idea
04:19that a state
04:20can evade immunity
04:21just by declaring
04:23that they do not recognize
04:25the government
04:26of the president
04:27and in question.
04:28Allowing such a thing
04:29will allow the recognition
04:31in a judicial weapon
04:33and it will stain
04:35the regimen
04:36of immunities.
04:37In virtue
04:38of all that has been exposed,
04:40we come to you
04:40in your condition
04:41of Commissioner
04:42of the United Nations
