27:48there is no reason not to see that.

27:56which is that appreciation of the challenges.
27:58Mr. Smith's qualifications were really daytime qualifications,
28:02and he didn't appear to have had any training
28:05that helped him to be safer at night.

38:03and you realise it's just not something
38:05you should be doing.
38:06And I think this just goes

38:11to not just jury,
38:12but also for judge,
38:13of the level of culpability of Smith.
38:16In my experience,
38:27the key thing for a victim's family
38:28is to get a fair and thorough investigation.
38:32Justice may be one result of that,
38:35but that's for the court
38:38to make a decision
38:39as to what will happen.
38:46The evidence in this case
38:58is very strong.
39:00He's driving his rib impaired,
39:03taking no account of the conditions,
39:06not adopting a safe speed,
39:08and the outcome of that,
39:11unfortunately,
39:12was the tragic death of David.
39:16The failings by Morgan Smith
39:26were very significant.
39:29You have to be held to account for it.
39:41It's going to be quite a tricky sentencing
39:43for the judge.
39:44He's a young man.
39:46I hope there's a sufficient sentence
39:49that it's going to discourage others
39:50from behaving in the way
39:53that Morgan Smith did.
40:03When you're working on a case
40:05that's had a fatality,
40:06you're always conscious
40:08that there's a great many people
40:09being affected by it,
40:12family and friends.
40:13It's a tragedy for everybody.
40:17This sort of behaviour
40:18won't be tolerated
40:19and will be prosecuted.
40:26I hope the sentence
40:27Morgan Smith gets
40:28recognises the harm he's done
40:29and ensures David Haw's death
40:32isn't in vain.
40:33A boat skipper has been jailed

40:45after a collision in Poole Harbour.

40:51for the gross negligence
40:52manslaughter of David Haw.
40:54One of the hardest things

41:01when you're dealing with fatality
41:02is often that
41:03a lot of them
41:04are just unnecessary.
41:06If people had done their job,
41:08had been careful
41:09in many instances,
41:10it wouldn't happen.
41:11I'm conscious that
41:13when we move on
41:14to another case
41:15that the Haw family
41:17will still be living with this
41:19and I hope they have managed
41:23to find some form of closure
41:24at some stage.
41:25The Haw family
41:55David was a happy young chap.
42:25He got to a national level
42:28in sailing in the UK
42:28and it was always his ambition
42:30once he'd finished
42:31his professional qualifications
42:33in accountancy
42:34that he was going to go
42:35and travel and see the world.
42:40David's death
42:40has had a massive impact on us.
42:43It's an experience
42:44that you can't put into words.
42:48One moment he's with us,
42:50the next moment he's gone.
42:51It's just such a wrench.
42:57I've never worked
42:58the full time since.
43:04Even now,
43:05it's difficult to talk about it.
43:06what my wife and I are hoping
43:13after what's happened to us
43:14was that nobody goes
43:16through the same scenario again.
43:19And this is all because
43:20people didn't follow
43:21basic safety requirements.
43:25And all we hope
43:26is from David's death,
43:27people learn
43:28that cutting these
43:29sort of corners,
43:31the risk's far too high.
43:34Morgan should not have
43:35been driving that boat.
43:37If he'd have only made sure
43:38everybody had life jackets on,
43:40it's a good chance
43:41David may still be with us.
