00:18The fire department personnel realized
00:20that there was a shooting that had occurred.
00:24A medical emergency at Oregon Culinary Institute
00:27becomes something much, much darker.
00:33Things weren't right when we responded.
00:36We expected to see a forced entry,
00:38a burglary, a robbery,
00:40and we weren't seeing any of those indicators.
00:43We were all interviewed,
00:45and the questions were a blur.
00:49Somebody that could plan something like this out
00:52is definitely an anomaly.
00:55It looks like the killer planned
00:57the perfect crime
00:58until a shocking suspect is uncovered.
01:03Nancy was a romance author
01:05and the president of my writing group,
01:08the Rose City Romance Writers.
01:10So she's the queen bee.
01:12She lost herself in her fiction.
01:15It was deliberately sensational.
01:17She seemed like a good grandma.
01:20Even did some babysitting at some point.
01:23We had a hard time wrapping our minds
01:25around her being involved in her husband's death.
01:29Is she a cold-blooded killer
01:31or just somebody's grandmother?
01:33Or just somebody's grandmother?
01:36At the time, I was a student
01:54at the Oregon Culinary Institute.
01:58That morning was a normal day.
02:00The class time for both the culinary
02:04and the baking and pastry program
02:05started at 8 a.m.
02:06I remember I was setting up my station
02:09and I heard a loud shout.
02:12So I walked over to see what was going on
02:14and when I went into the kitchen,
02:17I saw Chef Brophy was on the ground.
02:21He was in front of the ice machine
02:23and he seemed to have fallen backwards.
02:25I thought maybe he'd had a heart attack.
02:29One of my classmates called 911.
02:33911?
02:34Hi, we are at Oregon Culinary Institute
02:36and there was somebody collapsed
02:38in one of our kitchens.
02:40He's one of our chefs and he's an older man.
02:42All right, is he conscious right now?
02:44No, he is not conscious.
02:45Okay, is anyone doing CPR?
02:47Yes.
02:48Okay, someone's doing CPR right now?
02:49Yes.
02:50Is he doing compressions?
02:52Oh, my God.
02:55That morning, about 8.24,
03:00a call came in for an unconscious person
03:02at the Oregon Culinary Institute.
03:04It seemed like a normal, typical EMS run
03:08with a patient who's having some severe issues
03:11that we need to treat and address.
03:12We were led into the kitchen area
03:15where the patient was laying.
03:17The patient wasn't breathing.
03:18He didn't have a pulse.
03:20My firefighter was burying the chest
03:22of Mr. Brophy to put the patches on
03:23and to put the Lucas on.
03:25and he said,
03:25hey, there's a spot of blood on his chest.
03:30During the process of getting ready
03:31to start that IVs,
03:32I was moving his arm,
03:33a shell casing rolled out from underneath.
03:38It was a surprise to me.
03:39It was a surprise to everybody,
03:40but I immediately stopped the scene
03:42and the initial thought
03:44that ran through my head was,
03:45is this a suicide and where's the gun?
03:47During that sweep of just taking that second,
03:50looking around,
03:52I saw two shell casings
03:55and I knew that this was a shooting.
03:57You don't normally shoot yourself twice.
03:59We determined that it was not a survivable event
04:03and we terminated efforts
04:04and pronounced the patient deceased.
04:07At that point,
04:08we called for police code three.
04:10Dispatches in 19,
04:11we need police code three.
04:13Truck four,
04:13I copy,
04:14attending code three police.
04:15Yeah,
04:16this will be a shooting this summer.
04:17As word of Chef Brophy's death begins to spread,
04:23everyone on campus is spooked and rattled.
04:27I was doing yoga at my home.
04:29I got a call from my colleague.
04:32He said,
04:32hey,
04:32something happened at school.
04:35Chef Brophy is down.
04:37He's like,
04:37okay,
04:37I'll go.
04:40I went out in the parking lot
04:42and I was crying
04:43because,
04:44you know,
04:44everyone loves Chef Brophy
04:45and every student of Brophy's
04:48absolutely adored him.
04:53Chef Brophy was backbone of me.
04:56A lot of my stuff,
04:58what I became.
05:00He encouraged me all the time.
05:02Bikram,
05:03you can do it.
05:04I've known Chef Brophy for 22 years.
05:08He's like my father.
05:13And we were all discussing it
05:14and trying to calm down.
05:18And that's when the SWAT team showed up.
05:24That whole situation
05:26dramatically escalated
05:28with the response.
05:30Our police patrol officers
05:31didn't know
05:32if there could have been a shooter
05:33still on the premises.
05:34The police scour the campus,
05:51but they don't find any suspects.
05:54So they make the tough call
05:55to lift the active shooter alert.
05:58That allows investigators in
06:00to start piecing together details.
06:03We quickly wanted to determine
06:04if there were any students
06:06who were missing
06:07from that class that day
06:08that may have been responsible
06:10for this.
06:12Our concern, obviously,
06:13is that somebody's upset with Dan
06:15and decided that they're going to
06:17take him out.
06:19We did follow-up interviews
06:21with each one of those students
06:22and nothing raised any red flags for us.
06:27Everyone just seemed to talk
06:28very highly of him.
06:30The first time I met Chef Brophy,
06:33he was taking everyone out
06:35on a field trip
06:35to harvest chanterelle mushrooms.
06:37He was very interested
06:39in sustainability,
06:41part of his wisdom
06:42that he has to share.
06:45Chef Brophy is an encyclopedia
06:48of food.
06:50He had so much knowledge
06:52in his brain.
06:53No one has ever seen.
06:56So he has done so much good thing
06:58for all the students
07:00and community
07:01so they can experience it.
07:05Detectives decide
07:05after the interviews
07:07that no students
07:08were responsible.
07:10As investigators
07:12continued to look for evidence,
07:14patrol cops spot someone
07:16trying to enter the building.
07:18We were notified
07:18that Nancy Brophy,
07:20the wife,
07:20was at the location.
07:23And she had come to the scene
07:25because she had heard
07:26that there was some kind
07:28of situation at the school.
07:32Nancy appeared to be older.
07:34She had gray hair.
07:36She was somewhat overweight.
07:37dressed in what looked like
07:39elderly women's clothing,
07:41a dark-colored sort of sweater jacket
07:43over another blouse.
07:46Knowing that was the spouse
07:48of our decedent,
07:50we wanted to take the time
07:52and explain to her
07:53what had happened
07:54to give the death notice.
07:56And it's an important part
07:58of the process.
07:59We recorded that family notification
08:02and we normally don't do that.
08:04The only reason we recorded
08:05that interview with her
08:06is we knew we had something
08:07big on our hands
08:08and we didn't want
08:09to miss one detail.
08:11We're here with Nancy.
08:13And your last name, Nancy?
08:14Brophy.
08:14Okay.
08:16So,
08:17I just want to let you know
08:19that, you know,
08:20we believe Dan,
08:21Dan,
08:22we believe it's Dan
08:23that's been killed.
08:25Yeah, I kind of got that
08:26when everybody gave me
08:27this sad sack look.
08:28Yeah.
08:29I'm sorry.
08:31It's our job
08:32to figure out what happened
08:33and that's why
08:34we're talking to you.
08:35Oh, sure.
08:35Is there anybody
08:38that you know of
08:39that wanted to do something
08:40to Dan?
08:42He doesn't harbor grudges.
08:44I mean,
08:44he truly doesn't harbor judges
08:46when in 25 years of teaching,
08:49I have never heard him
08:50badmouth a student
08:51one time.
08:53She tells them,
08:54we lived a quiet life.
08:55Dan had no enemies.
08:57They both loved to cook
08:58and they would take romantic trips,
09:00just the two of them.
09:02It was a happy life
09:03with her husband.
09:05They did that for 25 years.
09:09Nancy's statement
09:10doesn't give the cops
09:11much to go on
09:12as far as who killed Dan.
09:14But they work late
09:15into the night
09:16looking into Dan's
09:17immediate coworkers
09:18for possibilities.
09:21We actually did
09:22a lot of research, too,
09:23with the administrators
09:24of the school.
09:26We learned his routine
09:27and he was methodical
09:28and consistent with it.
09:31He would park his truck
09:32on the corner
09:33right outside the side door
09:34on 17th Avenue
09:36and then he would take
09:37the garage roll-up door
09:39and open it up
09:40to prepare for his class,
09:41but then he would usually
09:43leave that door open
09:44or he didn't really,
09:45you know,
09:46he was just kind of
09:47absent-minded
09:47when it came to things
09:48like that.
09:49We didn't see any signs
09:51of forced entry
09:52into the location.
09:54It looked like
09:55somebody came in the door
09:56that Daniel Brophy
09:58had opened
09:59and unlocked
10:00and gone through.
10:03We've got so little
10:05to go on at this point.
10:06It was very much
10:08a whodunit.
10:10Realizing that door
10:11could have let just about
10:12anybody into the building,
10:14police pressed the students
10:16to see if anyone
10:17can describe
10:18a possible suspect.
10:20There was one witness
10:21that morning
10:22that described
10:23seeing a vehicle
10:24driving quickly
10:25out of the area.
10:27A dark SUV.
10:28It had been parked
10:29directly across the street
10:30from Oregon Culinary Institute
10:32on the side street.
10:33It looked like
10:34a person trying to
10:35leave quickly
10:36without being seen.
10:38Is it possible
10:39that that person
10:40could have been involved
10:41or assisted
10:41in this incident?
10:42His wife, Nancy,
10:46wasn't just distraught.
10:48She was angry.
10:49She confronted
10:49the president
10:50of the culinary school
10:51and she said,
10:51why aren't there
10:52cameras displaced?
10:53In this situation,
10:54there's two grandmas.
10:55There was some indication
10:57that Daniel's ex-wife
10:59was hostile.
11:01I thought that there
11:02had to be an explanation.
11:04I couldn't wrap my head
11:05around the idea
11:06of a grandmother
11:07doing something like this.
11:12Police investigating
11:15the mysterious shooting death
11:17of culinary instructor
11:19Daniel Brophy
11:20hear about a suspicious vehicle
11:22spotted racing away
11:24from the school.
11:26Initially,
11:26we investigated
11:27that dark SUV
11:29and we learned
11:31that there was
11:31a car repair shop
11:33directly across the street
11:35from Oregon Culinary Institute
11:37on 17th Avenue.
11:40And we learned
11:41that the dark SUV
11:42was likely workers
11:45that were there
11:46early in the morning
11:47shuttling cars
11:48back and forth
11:49to the dealership.
11:51So there was
11:52no information
11:53of relevance there.
11:55The only evidence
11:57we had of the crime
11:58were the two
11:59spent 9mm
12:00semi-automatic
12:01shell casings.
12:03The evidence
12:04was small.
12:05We did not locate
12:06a weapon
12:07and there were
12:08no eyewitnesses
12:10to the actual
12:11shooting incident.
12:13There was
12:14an alarm system.
12:16Chef Brophy
12:16disabled that alarm
12:17at 7.21 a.m.
12:19and a lot of the students
12:20were arriving
12:21at 7.30.
12:22That's a short
12:23window of time.
12:25Nobody heard
12:27a gunfire.
12:28Nobody saw
12:29anybody running
12:30around with a gun.
12:32There weren't
12:32any cameras
12:33inside the building
12:34or outside the building.
12:35So at this point
12:40our law enforcement
12:41experience was telling
12:42us that this
12:43could be forced
12:44entry, a burglary,
12:45a robbery,
12:47something of that
12:48nature.
12:50Darren, myself,
12:51other investigators,
12:52we all took
12:52different quadrants
12:53of the building
12:54and started searching
12:54for anything out
12:55of place.
12:57During the search
12:58one of the
12:59interesting things
13:00was that Mr. Brophy
13:01had his wallet.
13:03The cash and credit
13:04cards were all
13:04in his wallet.
13:06It didn't look like
13:07there was a fight
13:07and there didn't
13:09appear to be
13:10anything taken
13:11from the Culinary
13:12Institute.
13:14This seemed
13:14very focused
13:15on Mr. Brophy.
13:18The evidence
13:19is telling police
13:20that someone
13:21planned this out
13:23and intended
13:24to shoot
13:25Chef Brophy,
13:27hoping they can
13:27unmask his killer
13:29that cops
13:30delve into
13:31his past.
13:33Dan Brophy
13:34was a preacher's
13:35son from North
13:35Dakota.
13:36From a very
13:37young age,
13:37he became enchanted
13:38by both the
13:39cultures of the
13:40West and its
13:40food.
13:41He wasn't
13:41necessarily farm
13:42to table,
13:42but he was
13:43backyard to table,
13:45that's for sure.
13:46So Dan had a
13:46first marriage
13:47that was tumultuous
13:48at best.
13:49They had a son
13:49together,
13:50but Dan left
13:51and was not
13:52involved with his
13:53son's life until
13:53around high school.
13:55Nancy Brophy
13:56was from the right
13:56side of the tracks
13:57on Wichita Falls,
13:58Texas.
13:59She decided that
13:59she was going to
14:00become a successful
14:01caterer.
14:02So she went to
14:03culinary school
14:04and that's where
14:05she met Dan.
14:07She worked in catering,
14:08had a very successful
14:09business that she
14:10kind of walked away
14:11from inexplicably
14:12to write romance
14:13novels.
14:15Nancy was a
14:16romance author
14:17and the president
14:19of my writing
14:20group,
14:21the Rose City
14:21Romance Writers.
14:22So she's the
14:23queen bee.
14:24She would celebrate
14:25people who had
14:26either finished books
14:27or published books.
14:28She would give
14:28them a rose
14:29and that was
14:31a very big honor.
14:34Very few people
14:35in the Rose City
14:35Romance Writers
14:36were full-time
14:38writers.
14:39Most of them,
14:40like Nancy,
14:41were aspiring.
14:45Nancy and Dan
14:46did not have
14:46children,
14:47but Dan had
14:48his son, Nathaniel,
14:50when he was married
14:51to his first wife.
14:53During the initial
14:54notification we had
14:56with Nancy,
14:57it sounded like
14:57she really loved
14:59Nathaniel as a son,
15:01loved his children.
15:03She considered
15:03them her grandchildren
15:04and they would have
15:05a lot of family
15:06functions and
15:07dinners together.
15:09Nancy wanted to be
15:10the uber-grandma.
15:12She would say,
15:13let's go on a family
15:14trip to the zoo
15:14or the garden.
15:15She really wanted
15:16to be there to
15:17have some fun time
15:18with the little ones.
15:20It turned out
15:21that Dan and Nancy
15:22had actually acted
15:24as a caregiving couple
15:26to a relative
15:27of Nancy's,
15:27right?
15:28Nancy stepped up
15:29and she said,
15:29hey, I could take
15:30care of a young
15:31relative.
15:32I'd love it.
15:35The details
15:37seemed to paint
15:37the picture
15:38of Dan and Nancy
15:39as happily married
15:41grandparents.
15:42So why would
15:43someone want
15:44Dan dead?
15:45You know,
15:47we had some
15:48more information
15:48to try to obtain
15:50from her
15:51because we were
15:51still trying
15:52to understand
15:52Daniel and some
15:54of the features.
15:55I think we also
15:56asked if Dan
15:57would have had
15:58a gun with him
15:59for safety purposes
16:01because he's
16:02opening up
16:02the building.
16:04She said that
16:05they had bought
16:06a gun because
16:07of school shootings
16:08and she said
16:10she believed
16:10it was at the house
16:11and that they
16:12had never used
16:13it ever
16:13because they realized
16:14that after they
16:15bought it
16:15they weren't gun
16:16people and so
16:16they never did
16:18anything with it.
16:19And then what we
16:20did is we had
16:21two detectives
16:22go with her
16:23to check on
16:24the status
16:25of the gun.
16:29When the detectives
16:31brought that gun
16:31back, it still
16:33had the zip ties
16:34that are put
16:34through the barrel
16:35and slide
16:36to make it safe.
16:37Never operated,
16:38never loaded.
16:40That gun was
16:40cleared by the
16:41crime lab
16:42here in Oregon
16:43as not being
16:44the gun that
16:44fired the two
16:45spent casings
16:46at our crime
16:46scene.
16:47So we knew
16:48we didn't have
16:48the actual gun
16:50responsible for that.
16:52With just no
16:53solid leads
16:54to work with,
16:56the police
16:56take another
16:57look at the
16:57crime scene.
16:59Right across
17:00the street
17:00on Southwest
17:01Jefferson,
17:02about a half
17:03a block up,
17:04we noticed
17:05that there were
17:05pretty good
17:06video cameras
17:06on Bellagio's
17:07pizza store.
17:09We went in,
17:12manager took us
17:13to the back
17:14video room
17:15and turned
17:16the video on.
17:18Cameras were
17:19inside the
17:20restaurant,
17:20but they filmed
17:21a perspective
17:22that went right
17:22through their
17:23big front
17:23picture windows.
17:26Trying to see
17:27if we see
17:27somebody running
17:28from the place
17:29or whatever.
17:30And so,
17:30as I'm looking
17:31at that,
17:32this van
17:33drives by.
17:34It was a
17:35tan gray
17:36Toyota minivan.
17:37It looked like
17:40somebody trying
17:41to leave the
17:41scene.
17:43It was right
17:44in the beginning
17:44of the morning.
17:45It was 7.28 a.m.
17:48There's literally
17:48a student arriving
17:50just a couple
17:51minutes after that.
17:52That's the right
17:53time for when
17:54we think this
17:55incident has
17:56occurred.
17:57We all were
17:58like,
17:58who's the person
18:00in the van?
18:00Portland police
18:06set their sights
18:07on a suspicious
18:08van that left
18:09the area right
18:10around the time
18:11Dan Brophy
18:12was shot.
18:13The question
18:14is,
18:15who was driving?
18:17As I'm looking
18:18through the video
18:19and I'm like
18:20going,
18:20that van looks
18:22a lot like
18:23Nancy's van
18:24that Nancy
18:25drove to the
18:27school that
18:28morning.
18:29It looks
18:30exactly like
18:30it and that's
18:31what he said
18:31and we all
18:32were like,
18:33whoa,
18:34it looks
18:35exactly like
18:35it.
18:36We looked
18:36at it and
18:37we were like,
18:37oh,
18:37maybe this is
18:38off,
18:39that timestamp
18:40might be off
18:40because she
18:41just drove
18:41down here.
18:42Maybe this
18:43is when she
18:43first drove
18:44down.
18:45But we
18:45don't see
18:45any crime
18:46scene taped.
18:46There's no
18:46police anywhere.
18:50I mean,
18:51the person
18:51who you see
18:52in the image,
18:53it's hard to
18:53see.
18:54There's a lot
18:54of reflective
18:55issues and
18:56whatnot,
18:57but the
18:58person fits
19:00Nancy's
19:01description
19:01generally.
19:05This is
19:06something that
19:06we need to
19:07examine further.
19:10Immediately,
19:11I had
19:11Anthony call
19:12our other
19:13detectives and
19:14asked him to
19:15quickly take
19:16some pictures
19:17of the van
19:19as much as
19:20he could.
19:21While they
19:22were taking
19:22the pictures,
19:23Nancy says,
19:25why are you
19:25taking pictures
19:26of my van?
19:27I wasn't
19:27down there.
19:29And so,
19:30to us,
19:31that became
19:31a big red
19:32flag.
19:33With that
19:34video possibly
19:35showing Nancy
19:36right there
19:37at the time
19:38of the murder,
19:39detectives decide
19:40to show the
19:40DA what
19:41they've got.
19:44When I
19:45watched the
19:45surveillance video
19:46from Bellagio's,
19:47my reaction
19:48was the same
19:48as the
19:49detectives.
19:50It kind
19:51of had a
19:52profile that
19:52you could make
19:53out a side
19:54view profile
19:54that was
19:55consistent with
19:56Nancy, but
19:57nothing that we
19:58could be
19:58definitive with.
20:01The video
20:02wasn't clear
20:02enough to
20:03really see the
20:03driver, and
20:04there was no
20:05license plate
20:05that you could
20:06see.
20:07We're not
20:07going to go
20:07arrest somebody
20:08just based on
20:09that.
20:10And although I
20:11had it in the
20:12back of my
20:12mind that, you
20:13know, Nancy
20:13was there, I
20:14thought that
20:15there had to
20:15be an
20:15explanation.
20:16I couldn't
20:17wrap my head
20:17around the
20:18idea of
20:19a grandmother
20:20doing something
20:21like this.
20:23it's not
20:23who fits
20:24the mold
20:25of a
20:26killer.
20:28Since the
20:29video's too
20:30grainy to
20:31prove Nancy
20:31was driving,
20:33detectives decide
20:34to look for
20:35more evidence.
20:37Anthony and I
20:38were both at
20:38the autopsy
20:39with the
20:40medical
20:40examiner.
20:41Through that,
20:42we were able
20:42to get a
20:43feature of
20:44the trajectory
20:45of the
20:46shots
20:46through the
20:47body.
20:48The gunshot
20:49to the back
20:49was actually
20:50probably the
20:51first gunshot
20:52because that
20:53hit his
20:54spine.
20:55That would
20:56have caused
20:56him to fall
20:58backwards.
21:03The trajectory
21:04of the second
21:05bullet to the
21:06chest was
21:07angular, almost
21:09as if somebody
21:09had come and
21:10stepped up over
21:11his body and
21:13shot into his
21:14chest.
21:15It looked like
21:17somebody executed
21:18Daniel.
21:22We didn't know
21:23who was
21:24responsible for
21:25this.
21:25All we knew
21:25was it seemed
21:26very personal.
21:27It seemed like
21:28somebody went
21:28there with
21:29vengeance, like
21:30they wanted to
21:31kill Chef
21:32Brophy and that
21:33was all they
21:33wanted to do and
21:34they did it in
21:35a very tight
21:36window of time
21:37and were
21:38undetected.
21:39Judging by
21:41how much
21:41this shooting
21:42looks like
21:43the work
21:43of a hit
21:44man, the
21:45cops just
21:46have a hard
21:46time believing
21:47that Nancy
21:48pulled the
21:48trigger.
21:50We had a
21:51hard time
21:51wrapping our
21:51minds around
21:52the elderly
21:53grandmother
21:53figure coming
21:54in there and
21:55executing her
21:55husband, center
21:56punched in the
21:57back and in
21:58the chest like
21:59an assassin.
22:01Whoever did
22:02the shot, shot
22:03well.
22:03They knew what
22:04they were doing
22:04when they shot
22:05the handgun and
22:06we just couldn't
22:06picture that.
22:07As the search
22:09for the killer
22:09goes on, Daniel's
22:11family and
22:12friends gather
22:14to say goodbye.
22:17The feeling at
22:19the vigil was
22:20very positive.
22:22Everyone knew
22:23that Chef Brophy
22:24wouldn't want us
22:25to all just be
22:26sad that day and
22:27instead we talked
22:28about all of our
22:29favorite things and
22:30our favorite moments
22:30with Chef Brophy.
22:31I think we all
22:32needed that to heal.
22:33We did a
22:37spiritual puza and
22:38that's my country.
22:40How we do, the
22:42only thing I can
22:43share was my
22:46love.
22:47We lost someone
22:48who was one of a
22:50kind.
22:51It was an
22:52overwhelming show
22:53of support with
22:54candles and roses.
22:57His colleagues
22:57were there and
22:58Nancy Brophy was
22:59there too.
23:01I stood across
23:01from her.
23:02I could see how
23:03sad she looked.
23:04I thought, this
23:05is a heartbroken
23:06widow.
23:08Everyone quickly
23:09kind of rallied
23:10around to support
23:11her.
23:12Nancy's the sweet
23:14little grandmother
23:15who's lost their
23:16spouse to a violent
23:17crime.
23:18It's just completely
23:19out of the realm
23:21of what you might
23:21expect.
23:25What I came to
23:26find out later is
23:27that Nancy wasn't
23:28just distraught,
23:29she was angry.
23:30She confronted the
23:31president of the
23:31culinary school and
23:32she said, why aren't
23:33there cameras this
23:33place?
23:34Why didn't you have
23:34better protection here?
23:35If there were some
23:36cameras, we would
23:36know who had killed
23:37my husband.
23:40Nancy was telling
23:41people at the vigil
23:42who she thought might
23:43be suspects.
23:44She talked about
23:45Dan's ex-wife who
23:47was apparently
23:47motivated somehow to
23:49get revenge.
23:50That was a piece of
23:51background information
23:52on the victim that
23:54didn't come up when
23:55Nancy was interviewed.
23:56In this situation,
23:58there's two grandmas.
23:59There's the real
24:00grandma by blood
24:02before he and Nancy
24:04got together.
24:06There was some
24:06indication that
24:08Daniel's ex-wife
24:09was hostile.
24:11when we learned
24:15about this
24:15information,
24:16we were like,
24:17oh, this is
24:18new.
24:20That definitely
24:20fueled and
24:22motivated us
24:23to try to
24:25dig that information
24:26out where we
24:27could.
24:28When you're
24:29looking at other
24:30options,
24:31I think you're
24:32always going to
24:32look at the ex.
24:33What if there was
24:34a motive,
24:35even though it's
24:36been 25 years,
24:37to come and
24:38murder somebody?
24:38I think that's
24:39something in any
24:40case you're
24:41going to always
24:41want to run
24:41down and
24:42investigate.
24:48When the
24:49cops get a
24:50tip that Dan
24:51Brophy's
24:52estranged ex-wife
24:53could be
24:54connected to his
24:55murder, they
24:56find and contact
24:57her right away.
24:58We eventually
24:59got the contact
25:00information for
25:01Daniel Brophy's
25:02ex-wife,
25:03Perla Stillwater,
25:04to make sure
25:05there wasn't
25:05something there.
25:07Perla Stillwater
25:07was very
25:08cooperative with
25:09us and sat
25:10and gave us
25:10a long
25:10interview.
25:13We found
25:14out that even
25:15though things
25:15had been
25:15difficult initially
25:17during the
25:17divorce and
25:18after the
25:18divorce with
25:19Daniel and
25:20his ex-wife,
25:21things had
25:22been resolved
25:23and it wasn't
25:24necessarily an
25:25issue.
25:26There was
25:26some healing
25:27trying to
25:28happen in
25:29regards to
25:29what had
25:30happened in
25:30the past.
25:32We didn't
25:33uncover really
25:33any abuse
25:35or mistreatment
25:37between Dan
25:38and his
25:38ex-wife.
25:39They had a
25:40decent
25:40relationship.
25:42I just
25:42didn't
25:42understand why
25:43Nancy lied
25:43about it.
25:44Right away,
25:45I thought,
25:47what is going
25:49on with this
25:49woman?
25:49Once they
25:52clear Perla
25:53Stillwater,
25:54investigators keep
25:55looking for new
25:56suspects.
25:58While we're
25:59working on all
25:59this information,
26:00Nancy called
26:01Darren on the
26:02phone.
26:03I remember
26:04distinctly I was
26:04sitting right next
26:05to him and he
26:06just seems like
26:07shocked by whatever
26:08she just said.
26:09She's asking me
26:11about getting a
26:12letter of
26:13clearance that
26:14she's not a
26:14suspect in the
26:15case.
26:17And I was like,
26:18why would you
26:19ask for that?
26:19And what she
26:20said was that it
26:21was for a small
26:22insurance policy and
26:24that they needed
26:25that so that they
26:26could release funds
26:27to her.
26:30That's not
26:30something the
26:31police do.
26:31They don't give
26:32letters of
26:33exoneration.
26:34And she was
26:35very jovial in
26:36that call.
26:37She thought it
26:37was funny that
26:38she needed this
26:39letter to send
26:40to her insurance
26:41company.
26:43During our
26:43interaction with
26:44Nancy that first
26:45day, she was a
26:46grieving elderly
26:47widow, which was
26:48the way we viewed
26:49her.
26:50But now she
26:51didn't seem really
26:53upset.
26:54I would probably
26:55say that's when
26:55we're going,
26:57she's involved
26:58somehow.
27:00After this call,
27:02the cops decide
27:03they better look
27:04into the Brophy
27:05family financials.
27:07We found out
27:08that there were
27:09some financial
27:09issues with Dan
27:11and Nancy.
27:12They weren't
27:13making ends meet
27:14all that great.
27:16We learned that
27:17they had not paid
27:18their mortgage
27:19several different
27:20times over the
27:21period of about a
27:22year and a half.
27:23But we did note
27:24that they were
27:24successfully paying
27:25all these premiums
27:27for the life
27:27insurance policies.
27:29And when they were
27:30added up, they
27:30were extensive.
27:33She actually had
27:34about $800,000
27:35in life insurance
27:36on Dan.
27:38And then because
27:39Dan was killed
27:39at work, she was
27:41going to be entitled
27:41to workers' comp.
27:43That was going to
27:43be about another
27:44$400,000.
27:45Without that, they
27:47were about to be
27:47very, very broke
27:49in just a couple
27:49of months.
27:50Things would have
27:51been really bad.
27:54When the detectives
27:55saw all of these
27:56overlapping life
27:57insurance policies
27:58exclusively taken
27:59out on Dan Brophy,
28:00they had a motive.
28:03She stood to gain
28:04quite a bit.
28:05But there's only
28:06so much you can do
28:07without serving
28:07warrants, seizing
28:08cell phones and
28:09computers, searching
28:10the property to find
28:11every piece of
28:11evidence.
28:13We were confident
28:14at this point that
28:15we had ruled out
28:16any other suspects
28:17in this case based
28:18on the investigation.
28:20We felt 100%
28:21confident that that
28:22was Nancy's van that
28:24drove into the area
28:25before his death
28:26and left the area
28:27right after his death.
28:28Police changed
28:31their tune
28:31about Nancy Brophy.
28:33This woman they
28:34thought was a grieving
28:35granny has quickly
28:37become their main
28:38suspect in her
28:39husband's murder.
28:42We had a lot
28:43to learn still.
28:45I couldn't wrap
28:46my head around
28:46the idea that
28:47this person who
28:48looks like my
28:49grandmother could kill.
28:54Nancy did not
28:55have any criminal
28:56history that we
28:57found.
28:58We learned by
28:59speaking to her
29:00brother-in-law that
29:02she had an
29:03interesting interaction
29:04with one of her
29:05family members.
29:06One of her
29:07relatives was in
29:09trouble criminally.
29:12So Nancy and Dan
29:13had started to
29:14provide care for
29:14the relative's child
29:16for some time frame
29:17here in Portland.
29:18And at some point
29:19Nancy didn't think
29:20that the child
29:21should return to
29:21that house.
29:22and she apparently
29:25according to records
29:26we found attempted
29:27to keep the child
29:28against the parents'
29:31decision making on
29:32this.
29:33Nancy had almost
29:35somewhat kidnapped
29:36this person for a
29:37period of time that
29:39was so odd.
29:41Ultimately the child
29:43went back with his
29:44parents.
29:44I don't think we
29:47really ever understood
29:48what was really going
29:49on with Nancy at
29:50that time other
29:51than she was
29:52expressing a desire
29:53to become this
29:54child's grandparent
29:56essentially.
29:56Stories from Nancy's
30:04past start to reveal
30:05she's got more than
30:06a few dark corners
30:08in her personality.
30:10I think she always
30:11leaned into the
30:13harmless grandmother
30:14stereotype or
30:15expectation based on
30:17her looks.
30:18Unassuming and
30:20quiet and
30:21humble.
30:23But by contrast
30:24the Nancy as
30:26president she is
30:29up front at the
30:30podium like a
30:31blowhard like
30:32larger than life
30:33and that was a
30:34very specific
30:35personality pattern.
30:39Nancy Brophy
30:39wanted to be a
30:40successful romance
30:41novelist.
30:43She'd gone and
30:44taken classes.
30:45She'd learned that
30:45the way to be a
30:46successful romance
30:47novelist is to write
30:48a series of novels
30:49and give the first
30:50one for free and
30:50make them buy the
30:51rest.
30:51So she published
30:52under her own name
30:53and she self
30:54published those
30:54books.
30:55It was a big
30:56dream but she
30:56was never
30:57successful.
30:58She was making
30:5810 or 20 bucks
31:00off these books.
31:02I think it was
31:02horribly embarrassing
31:03for Nancy.
31:06She is the
31:07president of this
31:08group that's
31:09supposed to make
31:09authors successful
31:10but she never
31:12really built
31:13either that
31:14audience or got
31:15that traditional
31:15publishing
31:16recognition.
31:18The reality,
31:19the financial
31:20reality was that
31:21they were really
31:22living on the edge.
31:23several of her
31:24friends said that
31:25Nancy needed to
31:26borrow money from
31:26them in order to
31:28be able to fund
31:29going to some of
31:30these writing
31:30events and
31:32conventions.
31:33We started to
31:34find out Nancy
31:35was a romance
31:36novelist.
31:37People started
31:38contacting us
31:39because Nancy had
31:41written a
31:42writer's blog and
31:44it was how to
31:45murder your
31:46husband.
31:47It talked about
31:51how you go to
31:52the person's
31:52work site, make
31:53sure there's no
31:54video cameras, you
31:55do these things
31:55and it was just
31:57kind of this theme
31:58of a woman
31:58character solving
32:00her problem by
32:01getting rid of a
32:02male in her life
32:03that was causing
32:03all her problems.
32:05It was clickbait.
32:06It was deliberately
32:07sensational but if
32:10you read the
32:10comments it's really
32:11quite disturbing.
32:13One person said
32:13I'm going to check
32:15on Dan and see
32:16if he's okay.
32:20I don't know to
32:22what degree she
32:23lost herself in
32:26her fiction.
32:27I think that a
32:29question that we
32:29always wanted to
32:31understand was
32:33Nancy using her
32:34books as a trial
32:35ground for
32:36ultimately acting
32:38out that process
32:40of shooting your
32:42husband, getting
32:42away with it,
32:44riding off into
32:44the sunset,
32:45to do the
32:45things you
32:46wanted to do
32:46in life.
32:48She had written
32:48that article back
32:49in 2011 but
32:51nonetheless it made
32:52us curious about
32:53her writing.
32:54It was apparent
32:55that she had
32:55knowledge of
32:56firearms, police
32:58procedures and
33:01how somebody
33:02might carry out
33:03a murder.
33:07With money as a
33:09motive and
33:10Nancy's writing
33:11more than a little
33:12suspicious, the
33:13DA gives police
33:15and it's the
33:15okay to have a
33:16teen watch Nancy's
33:17movements.
33:19The idea was that
33:20detectives were
33:21going to be out
33:22on scene so they
33:23could monitor where
33:24she was because we
33:26kind of thought that
33:28maybe she had wind
33:29that we were onto
33:30her.
33:31So I walked over to
33:32the Portland Police
33:33Bureau, we get
33:34upstairs and we're
33:36informed that there
33:38was some
33:38miscommunication on
33:39scene and she had
33:42been arrested.
33:43Whoops!
33:45They jumped the
33:46gun with the
33:46arrest.
33:48Without the right
33:49evidence, the
33:50entire case could
33:52fall apart.
33:54It was a chaotic
33:55moment because Nancy
33:56was arrested too
33:57soon.
33:58It starts this
33:59countdown clock
34:00because suddenly they
34:01need to go and show
34:01a grand jury that
34:03they have proof,
34:04which they weren't
34:05quite ready to do.
34:06Nancy was
34:17transported back to
34:18the detective
34:19division.
34:20Darren and I
34:21attempted to
34:22interview her.
34:23We know that
34:24you're involved with
34:26your husband's
34:26death.
34:28The information's
34:28clear.
34:29It shows your
34:29vehicle.
34:30It even captures
34:31your license plate.
34:33Before you are
34:34asked any questions,
34:35you must understand
34:36your rights.
34:36I understand
34:37those rights.
34:38And I have a
34:39lawyer.
34:39Okay.
34:40She invoked and
34:42asked for an
34:42attorney very
34:43quickly.
34:45Nancy didn't ask
34:46for an explanation
34:47about why she was
34:48being arrested.
34:49Her response was,
34:50oh, you must think
34:51I killed my
34:51husband.
34:52And it surprised
34:53me just because of
34:54the lack of emotion
34:54that this person
34:55was showing.
34:58The clock is
34:59ticking and the
35:00cops have to
35:00scramble to gather
35:01enough evidence to
35:03make their case.
35:04We went to the
35:05house to execute
35:06the search warrant.
35:07We found various
35:08life insurance policy
35:09documentation that
35:10we collected.
35:12We also found
35:12documentation of a
35:14storage unit that
35:15she had purchased.
35:17We conducted a
35:19search warrant on
35:20that storage unit.
35:21And during that
35:23search, a box was
35:24located that was
35:25marked scarves,
35:27purses, and GK.
35:29And when they
35:31opened that, it
35:33was an unbuilt
35:34ghost gun.
35:37A ghost gun is
35:38an 80% built
35:39firearm.
35:40You could buy
35:41online.
35:42It's unserialized.
35:43It's unregistered.
35:44And once you buy
35:46it and it arrives,
35:47you have to do a
35:49couple of things to
35:50it in order for it
35:51to be an operable
35:51firearm.
35:53We realized the
35:54gun's never been put
35:55together.
35:56but she never
35:57told us about
35:58this gun.
35:58Why would you
35:59have a ghost gun?
36:00Especially that
36:01kind of gun that's
36:01unserialized with
36:03law enforcement.
36:04So we started
36:05developing a running
36:07theory once we
36:07found that gun that
36:09that must have
36:10been her plan was
36:11to buy a ghost
36:12gun.
36:12She could commit
36:13the murder with
36:14it.
36:14She could drop it
36:15in one of our
36:16many bodies of
36:16water and nobody
36:18would be the wiser
36:19and we'll never
36:21find it.
36:21But once she
36:22realized that she
36:23couldn't build it,
36:24she had to come up
36:24with another plan.
36:26And that's when we
36:28found the other
36:28guns.
36:34Once the cops find
36:36Nancy Brophy's
36:37ghost gun, they
36:38scour every bit of
36:39her activity on the
36:40internet to see
36:42what else she's
36:43hiding.
36:44Come to find out,
36:46Nancy buys a
36:47full-size Glock
36:48handgun at a gun
36:50show.
36:51And then she was
36:53on eBay and she
36:54had purchased
36:55the slide and
36:57the barrel
36:58assemblies that
37:00fit onto a
37:01Glock handgun.
37:03That gun that she
37:05bought at the gun
37:05show turned out to
37:06be the gun that she
37:07had handed over to
37:08police on the day
37:09of the murder.
37:11So knowing that
37:12that gun was not
37:13the murder weapon,
37:14we started thinking,
37:15well, maybe she
37:16swapped the slide
37:17and barrel.
37:17Once police had that,
37:21if they tested it,
37:21it would not be a
37:22match and would take
37:24us off the trail that
37:25she possibly did this.
37:28Despite continuous
37:29searching, searching of
37:30sewers, searching of
37:32garbage cans, we were
37:34never able to find the
37:35slide and barrel that she
37:36bought on eBay.
37:37Unfortunately, ballistics
37:43can't match Nancy's gun
37:45to the crime.
37:46So the cops go back to
37:48that video of the
37:49suspicious van to see
37:51what else lines up.
37:53We knew this van fit with
37:55the description of Nancy's
37:57van.
37:58So we started working
37:59really hard on the video.
38:01We played with it over and
38:02over trying to grab that
38:04one image, we were able
38:06to actually read numbers
38:08and letters off the
38:09license plate.
38:12And we were able to run
38:14reports with DMV.
38:17The only one with that
38:19partial plate, make,
38:20model, and color, came
38:21back to their van, the
38:23Brophy van.
38:26And that video also
38:27provided for us a really
38:28good window of time when
38:30she first arrived in the
38:31van.
38:32It was 7.08 a.m.
38:34That morning, Dan had put
38:37in his pin to disarm the
38:39alarm, and he did that at
38:417.21 a.m.
38:43We have the video that
38:44shows the van leaving at
38:467.28.
38:48And we know the next
38:49instructor arrived shortly
38:51after 7.30.
38:52So we did have a nice,
38:54tight window that we could
38:55focus on.
38:57We believed that she had
38:58parked somewhere in that
38:59back block, where there's no
39:00video, and saw him park,
39:03and saw him leave the
39:04door open, and went in
39:07and did what she did.
39:14That made us feel pretty
39:15strong about our case.
39:18With all the evidence he
39:21needs, the DA proves to the
39:23grand jury that this case is
39:25ready to move to trial.
39:27Nancy's trial is delayed for many
39:32years.
39:33COVID hits, and the courthouses
39:34shut down.
39:36So she sits in jail for four
39:39long years, from 2018 to 2022.
39:41I was very confident that we
39:51were going to convict Nancy as
39:53long as our evidence came in
39:55the way that we anticipated it.
39:58We wanted an older jury.
40:01We thought a young juror would
40:04walk in the courtroom, look at
40:06her.
40:07She's going to be dressed in nice
40:08clothing, she always had a nice
40:10scarf on every day, and they're
40:12going to see their own
40:13grandmother, and not ever be
40:16able to convict their own
40:17grandmother.
40:21The defense pushed really hard
40:24on our theory of the case.
40:26She tried to explain what she
40:29was doing that morning, why she
40:31would have lied about it, because
40:33it just came across so
40:34insincere.
40:35This was a very tough trial for
40:38Dan's family.
40:41Dan's son, Dan's mother and
40:43father were all there.
40:44They were trying to see justice
40:46done for the person who had
40:48killed their son, and they're
40:49seeing this person deny it all.
40:52It didn't make any sense.
40:54So I said, isn't it possible?
40:56What really drove Nancy to kill was
40:58she wanted to change a lifestyle,
41:00and Dan couldn't give that to
41:02her.
41:05Ultimately, we were left with a
41:12good panel.
41:14We went about eight weeks.
41:16This is broke, if you can rise.
41:18The jury came back with the
41:19correct verdict of guilty for
41:21murder in the second degree,
41:23which carries a life sentence.
41:28With Nancy locked up, Dan's
41:31memory lives on in the hearts of
41:33those who learned from and loved
41:35him.
41:36There's a lot of lasting wisdoms
41:39that Jeff Brophy has given to a
41:41lot of people.
41:42I wish that he could have
41:44continued to teach.
41:46He left a great impact on many
41:49people that love him still.
